8 1642 Canada Gazette Part I June 23, 2012 GOVERNMENT NOTICES EPARTMENT OF THE ENVIRONMENT CANAIAN ENVIRONMENTAL PROTECTION ACT, 1999 Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, isposal at Sea Permit No authorizing the loading for disposal and the disposal of waste or other matter at sea is approved. 1. Permittee: P. Janes & Sons Limited, Jackson s Arm, Newfoundland and Labrador. 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish processing operations Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste. 3. uration of permit: Permit is valid from August 2, 2012, to August 1, Loading site(s): Jackson s Arm, Newfoundland and Labrador, at approximately N, W (NA83). 5. isposal site(s): Jackson s Arm, within a 250 m radius of N, W (NA83), at an approximate depth of 95 m. 6. Method of loading: 6.1. The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered. 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site. 8. Method of disposal: 8.1. The Permittee shall ensure that the waste to be disposed of is discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion. 9. Total quantity to be disposed of: Not to exceed tonnes. 10. Le titulaire du permis doit s assurer que les matières sont chargées sur un équipement flottant respectant toutes les normes de sécurité et de navigation applicables et pouvant contenir la totalité des matières à immerger durant le chargement et le transport jusqu au lieu d immersion approuvé Le titulaire du permis doit s assurer que les matières à immerger sont recouvertes d un filet ou autrement afin d empêcher les goélands et autres oiseaux marins d y accéder, sauf durant le chargement ou l immersion Les matières chargées pour l immersion en mer ne seront pas gardées plus de 96 heures à bord du navire, à compter du début du chargement, sans l autorisation écrite d un agent de l autorité désigné en vertu du paragraphe 217(1) de la Loi canadienne sur la protection de l environnement (1999) Le chargement et le transport doivent s effectuer de façon qu aucune matière ne contamine l environnement marin, notamment le havre et les plages adjacentes. Le titulaire doit également s assurer du nettoyage des lieux de chargement et, s il y a lieu, de la récupération des déchets déversés. 7. Parcours à suivre et mode de transport : Voie navigable la plus directe entre le lieu de chargement et le lieu d immersion. 8. Méthode d immersion : 8.1. Le titulaire doit s assurer que les matières à immerger seront déchargées du navire ou de la pièce d équipement en mouvement à l intérieur de la zone du lieu d immersion et d une manière qui permettra la plus grande dispersion possible des matières. 9. Quantité totale à immerger : Ne pas excéder tonnes métriques. 10. Inspection : En acceptant ce permis, le titulaire et ses entrepreneurs acceptent d être assujettis à des inspections conformément à la partie 10 de la Loi canadienne sur la protection de l environnement (1999).

Reporting and notification: The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The Permittee shall ensure that the waste to be disposed of is discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion. 9. 14 1648 Canada Gazette Part I June 23, 2012 Substances that are not listed on the omestic Substances List can be manufactured or imported only by the person who has met the requirements set out in section 81 of the Canadian Environmental Protection Act, Under section 86 of the Canadian Environmental Protection Act, 1999, in circumstances where a Significant New Activity Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the Significant New Activity Notice and of the obligation to notify the Minister of the Environment of any new activity and all other information as described in the Notice. It is the responsibility of the users of the substance to be aware of and comply with the Significant New Activity Notice and to submit a Significant New Activity notification to the Minister prior to the commencement of a significant new activity associated with the substance. However, as mentioned in subsection 81(6) of the Canadian Environmental Protection Act, 1999, a Significant New Activity notification is not required when the proposed new activity is regulated under an act or regulations listed on Schedule 2 to the Canadian Environmental Protection Act, A Significant New Activity Notice does not constitute an endorsement from Environment Canada or the Government of Canada of the substance to which it relates, or an exemption from any other laws or regulations that are in force in Canada and that may apply to this substance or activities involving the substance. The following information must be provided to the Minister at least 90 days before the commencement of each proposed significant new activity: (a) a description of the proposed significant new activity in relation to the substance; (b) for a significant new activity described in paragraph 1(a): (i) the information specified in item 7 of Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers), (ii) the information specified in item 8 of Schedule 5 to those Regulations, (iii) the information specified in item 11 of Schedule 6 to those Regulations, (iv) the test data and a test report on the subchronic inhalation toxicity of the substance, including a satellite (reversibility) study, conducted according to the methodology described in the Organisation for Economic Co-operation and evelopment (OEC) Test Guideline Test No. 413 (Test Guideline) titled Subchronic Inhalation Toxicity: 90-day study, and where the Test Guideline is current at the time the test data are developed, and (v) the test data and a test report on bronchoalveolar lavage conducted immediately following the last exposure and recovery in the subchronic inhalation toxicity test required in subparagraph (iv), conducted according to the methodology described in the OEC Series on Testing and Assessment, Number 125 (Guidance ocument), titled Guidance ocument on Histopathology for Inhalation Toxicity Studies, Supporting TG 412 (Subacute Inhalation Toxicity: 28-ay Study) and TG 413 (Subchronic Inhalation Toxicity: 90-ay Study), and where the Guidance ocument is current at the time the test data are developed; (c) for a significant new activity described in paragraph 1(b): (i) the information specified in Schedule 6 to the New Substances Notification Regulations (Chemicals and Polymers), (ii) the analytical information to determine the primary and secondary particle size of the substance, (iii) the information describing the agglomeration and aggregation state, shape, surface area and surface charge of the substance, (iv) the analytical information to determine the leachability potential of the substance and its precursors from any final product resulting from the new activity; (v) the test data and a test report on the water solubility of the substance conducted in accordance with the OEC Series on Testing and Assessment, Number 29, Guidance ANNEXE Exigences en matière de renseignements (Article 85 de la Loi canadienne sur la protection de l environnement (1999)) 1. À l égard de la substance hydroxyde et sulfate de magnésium (Mg 6 (OH) 10 (SO 4 )), une nouvelle activité est : a) son utilisation dans des revêtements architecturaux, des matériaux de friction, de l isolant ou des matériaux de construction destinés à être utilisés par les consommateurs, en une quantité supérieure à 100 kg par année civile; b) toute utilisation mettant en cause une quantité supérieure à 10 kg par année civile lorsqu elle est modifiée pour contenir des particules dont la taille se situe entre 1 et 100 nanomètres dans au moins une dimension. 2. Les renseignements suivants doivent être fournis au ministre au moins 90 jours avant le début de chaque nouvelle activité : a) la description de la nouvelle activité proposée à l égard de la substance; b) pour une nouvelle activité décrite à l alinéa 1a) : (i) les renseignements prévus à l article 7 de l annexe 4 du Règlement sur les renseignements concernant les substances nouvelles (substances chimiques et polymères), (ii) les renseignements prévus à l article 8 de l annexe 5 de ce règlement, (iii) les renseignements prévus à l article 11 de l annexe 6 de ce règlement, (iv) les résultats et le rapport d un essai de toxicité subchronique par inhalation de la substance, y compris une étude satellite (étude de réversibilité), effectué selon la méthode exposée dans la ligne directrice numéro 413 de l Organisation de coopération et de développement économiques (OCE), intitulée Toxicité subchronique par inhalation : étude sur 90 jours (la «ligne directrice»), qui est à jour au moment de l obtention des données d essai, (v) les résultats et le rapport de lavage bronchoalvéolaire effectué immédiatement après la dernière exposition et la récupération dans les essais de toxicité subchronique par inhalation requis aux termes du sous-alinéa (iv) selon la méthode exposée dans le document d orientation numéro 125 de la Série de l OCE sur les essais et les évaluations, intitulé Guidance ocument on Histopathology for Inhalation Toxicity Studies, Supporting TG 412 (Subacute Inhalation Toxicity: 28-ay Study) and TG 413 (Subchronic Inhalation Toxicity: 90-ay Study) [le «document d orientation»], qui est à jour au moment de l obtention des données d essai; c) pour une nouvelle activité décrite à l alinéa 1b) : (i) les renseignements prévus à l annexe 6 du Règlement sur les renseignements concernant les substances nouvelles (substances chimiques et polymères), (ii) les renseignements analytiques qui permettent de déterminer la taille primaire et secondaire des particules de la substance, (iii) les renseignements qui permettent de déterminer l état d agglomération et d agrégation, la forme, la surface active et la charge superficielle de la substance, (iv) les renseignements analytiques qui permettent de déterminer le potentiel de lixiviabilité de la substance et de ses précurseurs à partir de tout produit fini produit dans le cadre de la nouvelle activité,

16 1650 Canada Gazette Part I June 23, 2012 ocument on Transformation/issolution of Metals and Metal Compounds in Aqueous Media, and that is current at the time the test is developed, (vi) the analytical information to determine the primary and secondary particle size of the test substance as administered in the health and ecological toxicity tests required under subparagraph (i), and (vii) the information describing the agglomeration and aggregation state, shape, surface area and surface charge of the test substance as administered in the health and ecological toxicity tests required under subparagraph (i); and (d) all other information or test data in respect of the substance that are in the possession of the person who intends to use the substance for the proposed significant new activity, or to which they have access, and that are relevant to determining whether the substance is toxic or capable of becoming toxic. 3. The test data and the test reports described in subparagraphs 2(b)(iv) and (v) must be in conformity with the practices described in the OEC Principles of Good Laboratory Practice (Principles of GLP) set out in Annex 2 of the ecision of the Council Concerning the Mutual Acceptance of ata in the Assessment of Chemicals, adopted on May 12, 1981, and where the Test Guideline, Guidance ocument and Principles of GLP are current at the time the test data are developed. 4. The above information will be assessed within 90 days after the day on which it is received by the Minister. Les résultats et les rapports requis aux termes des sousalinéas 2b)(iv) et (v) doivent être réalisés suivant des pratiques de laboratoire conformes à celles énoncées dans les Principes de l OCE de bonnes pratiques de laboratoire (les «principes de BPL»), figurant à l annexe 2 de la écision du Conseil relative à l acceptation mutuelle des données pour l évaluation des produits chimiques adoptée le 12 mai 1981, dans la version à jour à la fois de la ligne directrice, du document d orientation et des principes de BPL au moment de l obtention des données d essai. 4. Les renseignements qui précèdent seront évalués dans les 90 jours suivant leur réception par le ministre. EXPLANATORY NOTE (This explanatory note is not part of the Significant New Activity Notice.) A Significant New Activity Notice is a legal instrument issued by the Minister of the Environment pursuant to section 85 of the Canadian Environmental Protection Act, The Significant New Activity Notice sets out the appropriate information that must be provided to the Minister for assessment prior to the commencement of a new activity as described in the Notice. Substances that are not listed on the omestic Substances List can be manufactured or imported only by the person who has met the requirements set out in section 81 of the Canadian Environmental Protection Act, Under section 86 of the Canadian Environmental Protection Act, 1999, in circumstances where a Significant New Activity Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the Significant New Activity Notice and of the obligation to notify the Minister of the Environment of any new activity and all other information as described in the Notice. It is the responsibility of the users of the substance to be aware of and comply with the Significant New Activity Notice and to submit a Significant New Activity notification to the Minister prior to the commencement of a significant new activity associated with the substance. However, as mentioned in subsection 81(6) of the Canadian Environmental Protection Act, 1999, a Significant New NOTE EXPLICATIVE (La présente note explicative ne fait pas partie de l avis de nouvelle activité.) Un avis de nouvelle activité est un document juridique publié par le ministre de l Environnement en vertu de l article 85 de la Loi canadienne sur la protection de l environnement (1999). Il incombe également aux utilisateurs de la substance de prendre connaissance de l avis de nouvelle activité et de s y conformer, ainsi que d envoyer une déclaration de nouvelle activité au ministre avant le début d une nouvelle activité associée à la substance. Il est à noter que le paragraphe 81(6) de la Loi canadienne sur la protection de l environnement (1999) précise qu une déclaration de nouvelle activité n est pas requise
