4 REPORT OF ACTIVITY FOR THE YEAR 2014 INTRODUCTION In the year 2014, the International Institute of Humanitarian Law (from now on referred to as Institute ), offered a wide-ranging programme of activities and registered an increase in the number of participants particularly at courses run in Sanremo. The total number of participants was affected by the slight decrease in the number of participants attending courses outside Sanremo, however, there were still nearly 1,500 participants registered. It is worth mentioning that there was an increase in the number of paying participants although there was a decrease in the number of scholarships granted by governments and international organisations. The Institute is convinced that its determination in promoting its products in the past two years together with the quality it offers have been decisive factors in the success of its activities despite the global economic crisis and the reduction in the resources it normally receives from governments for training. The Council has always had the search for new fund-raising channels at heart and, in 2014, it again analysed the problem producing a new document to support its arguments and mainly aimed at possible donors. Closely in-keeping with the issue of fund-raising, the General Assembly of the Institute convened in extraordinary session on 6 th September and, at the request of the Council, decided to create the Foundation auxiliary to the Institute. The Foundation was established with a public decree on 3 rd December with the aim of promoting, sustaining and enhancing the initiatives of the Institute, both in Sanremo and abroad, as well as protecting and conserving its headquarters in Villa Ormond respecting its historical and architectural value. To resist the constant decrease in public funding in recent years, the Institute felt that creating such a foundation would be the best way, within a wider fund-raising policy, to diversify the possible requests for contributions also with private sources in mind. Moreover, the Foundation would allow the Institute to manage the use of Villa Ormond for events that were not strictly institutional as was also encouraged by the Municipality of Sanremo, owner of the Villa. The workforce of the Military Department of the Institute was strengthened in 2014 by the secondment as training officer of Maj. James Hill by the US Army Judge Advocate. The presence of an American officer at the Institute would not only give new input to the work of the Department but it would also reinforce relations with the United States and encourage their participation at the courses of the Institute. Following the guidelines laid down by the Council, the Institute continued to collaborate with bodies and institutions based and operating in the various areas of the world to encourage awareness and appreciation of its programmes also adapting to the specific demands of its partners. Once more, collaboration with US AFRICOM and EQUION is well worth mentioning as, between them, they offered a substantial number of scholarships for various courses. The Institute s Liaison Office in Geneva, situated at the headquarters of the World Meteorological Centre, once again offered its precious collaboration by holding several meetings on the premises to maintain constructive relations with international organisations present in Geneva and to promote the Institute in this important international location. Given the decreased financial resources in 2014, the Institute s management had to be rather careful with regard to all costs, including improvements and maintenance works on Villa Ormond, some of which had to be postponed. One of these necessary interventions concerned the air conditioning system requiring a large investment of money to respect the new anti-pollution laws. At the same time, some measures to make savings and have more environment friendly facilities were taken, while others were still in stand-by. 3

5 TEACHING AND TRAINING ACTIVITIES COURSES ON INTERNATIONAL HUMANITARIAN LAW To foster the knowledge of International Humanitarian Law (IHL), also known as the Law of Armed Conflict (LOAC), the Institute has structured its courses in three levels which develop progressively and emphasize the practical application of IHL. The three levels are organised in the following way: 1 st level: Basic courses on IHL: participants are offered a practical introduction to IHL delivered from the perspective of military operations; 2 nd level: Specialised courses on IHL: aimed at personnel who require an enhanced practical understanding of specific areas of IHL; 3 rd level: Workshops: directed to participants with a good working knowledge of the given subject. These workshops are usually shorter with less formal training involved. Emphasis is placed on the exchange of views and experience of both participants and instructors so that a deeper understanding of the subject can be reached thus consolidating the professional preparation of those attending. Instructors and participants hail from all over the world thus assuring the best opportunities for learning with a broad and engaging international perspective. These courses are addressed to civil and military personnel with or without specific legal background. LOAC Foundation and Advanced Courses 153 rd Course (English with an Arabic class) 154 th Course (French) 155 th Course (Spanish with a Portuguese class) 156 th Course (English with a Chinese and Russian class) 25 th Advanced Course (English) 27 th Advanced Course (Spanish) Course hosted by the Regional Center for Training on Conflict Resolution and Peacekeeping in Africa (CCCPA), Cairo In keeping with the agreement of understanding signed with the Regional Center for Training on Conflict Resolution and Peacekeeping in Africa (CCCPA) and in consideration of the success of such initiative in the past, the Institute co-organised a course on IHL and human rights for military and civilian personnel from African countries engaged in peace missions. The course was held in Cairo from 9 th to 13 th March. 13 th Edition of the Competition on IHL for Military Academies The 13 th edition of the Competition on IHL for Military Academies took place from 24 th to 28 th March at Villa Ormond. Over one hundred cadets from different countries (Belgium, Brazil, Denmark, France, the Former Yugoslav Republic of Macedonia, Germany, India, Italy, Nigeria, Norway, The Netherlands, the United Kingdom, USA, Sweden, Switzerland, Turkey) gathered together in Sanremo to benefit from the practical and specific approach of teaching aimed at assuring rapid awareness on the part of participants of the fundamental importance of IHL in multinational military operations. The Competition, which is one of the most prestigious training events of the Institute organised on a yearly basis in Sanremo since 2002, is divided into two parts: the first one consists of a 4

6 series of interactive presentations held by different experts in the field of IHL and human rights; the second part is characterized by a series of simulated multinational military operations where the cadets, who are divided into mixed teams, have to show how they would interact effectively in complicated geopolitical situations during military operations in full respect of the application of humanitarian law. The teams are judged by a commission, which, at the end, awards prizes to the best mixed team and the best cadet. to 9 th May, gathered together highly-qualified civil and military experts and lawyers, who offered participants an intense programme with interactive sessions to encourage an exchange of the different experience accumulated in more recent military operations. Africa Accountability Colloquium Workshop on Detainee Handling in International Military Operations This workshop took place in Sanremo from 1 st to 3 rd April. The programme concentrated on three key issues in the field of detention and human rights, such as, the treatment and questioning of detainees and the sharing of the intelligence gained. Considering the difficulty of implementing these principles, special attention was given to putting into practice the experience of best practice on the ground. For this purpose, discussion was encouraged among participants hailing from fourteen different countries who were either members of the Armed Forces or civilian experts in the field. Course on International Law in Indonesia Thanks to the financial contribution of the Norwegian Centre for Human Rights, the Institute organised a two-week course on IHL at the Military Base in Sentul (Jakarta) from 29 th April to 9 th May. Forty officers attended including members of the Indonesian Armed Forces, civil servants and officers from other Asiatic countries such as Bangladesh, China, Laos, Myanmar, Singapore and Thailand. This course successfully contributed to the developing and strengthening of the specific expertise of participants in the field of IHL, granting them the ability to apply the fundamental principles to a plethora of operational scenarios. Workshop on Targeting: Terrestrial, Cyber and Space This four-day workshop, held in Sanremo from 6 th The Institute, in collaboration with the United States Africa Command (US AFRICOM) and as a consequence of the success the same initiative had the previous year, held the second edition of the colloquium on accountability with African countries in mind. The aim of the colloquium was to train military officers working for human rights and the application of the rule of law. The programme mainly addressed military and transnational justice as well as international criminal justice. Participants, from twenty-five African countries, discussed the problems arising from United Nations peacekeeping operations and anti-piracy operations with reference to individual responsibility based on the violation of humanitarian law. The colloquium was held from 27 th to 29 th May. Workshop on Non-International Armed Conflict This workshop, which took place in Sanremo from 3 rd to 5 th June, addressed the complex and often uncertain legal regime applicable to noninternational armed conflict. Certain issues were examined in depth such as the different definitions 5

7 of non-international armed conflict as well as the delicate question of legitimate objectives, the application of human rights and the access to humanitarian assistance and protection. Working groups considered the concrete cases of Mali, the Republic of Central Africa and Syria. The workshop was directed by both military and academic experts. placed particular emphasis on the application and implementation of both international humanitarian law and human rights in peace support operations, on their dissemination and protection thanks to the UN Forces and other international agencies. The teaching staff consisted of an extensive list of experts in both military and civil domains. Courses on IHL and Human Rights in Erbil On the request and with the financial contribution of the Italian Ministry of Foreign Affairs, the Institute organised a course on international humanitarian law and human rights in Erbil, the capital of Iraqi Kurdistan. This course, which was the sixth the Institute had organised in Iraq, took place from 8 th to 12 th June under the co-ordination of Gen. Giorgio Blais and with the collaboration of the Italian Consulate in Erbil. Most of the participants came from the police force of the Kurd region. The Vice-Minister of the Interior of the Kurd region, who participated at the closing ceremony, expressed his hopes in the possibility of organising further training initiatives and expressed his appreciation of the fruitful collaboration existing between the Ministry and the Institute. 10 th Course on the Conduct of Peace Support Operations Considering the ever-increasing complexity of legal application in peace support operations, the Institute organised the 10 th edition of its course on the conduct of peace support operations at Villa Ormond from 16 th to 20 th June. The course Summer Course on IHL, Sanremo-Geneva The 14 th edition of the summer course on international humanitarian law, co-ordinated by the Vice-President, Prof. Michel Veuthey, took place from 23 rd June to 4 th July partly in Sanremo and partly in Geneva. The course gathered together 47 university students and junior governmental officials coming from thirty-eight countries. The event offered the possibility to discuss with eminent personalities from legal and diplomatic circles committed to the field of promoting international humanitarian law and human rights. In Geneva, participants visited the main international organisations with a humanitarian vocation. Workshop on the Rules of Engagement This workshop took place in Sanremo from 8th to 12 th September under the direction of Captain Dennis Mandsager (USA), member of the Council of the Institute. The workshop discussed a wide range of topics spreading from a general introduction to more specific issues such as the use of force on the part of private security companies. Concrete cases for discussion among the participants were used. The Sanremo Handbook on the Rules of Engagement, realized by the Institute, provided the main didactic tool used by the participants who came from different parts of the world. Course on Naval Operations and International Law The second edition of this course, organised from 27 th to 31 st October on the basis of the success the same course in 2013, benefitted from the tenyear experience of running past courses on naval operations and offered a valid opportunity to revise the topic. The course, which was inspired by the 6

8 famous Sanremo Handbook on International Law applicable to Armed Conflict at Sea, provided a very specific programme which included the analysis of the legal regime applicable to the planning and conduct of naval operations throughout the course of a conflict; the specific rules of engagement and the practical application of law in such contexts as the fight against terrorism, against piracy and against drug trafficking. Course on IHL and Human Rights for Members of the Armed Forces and Governmental Officials of the Former Yugoslav Republic of Macedonia 30 th (English) and 31 st (French) Courses for Directors and Trainers of IHL Teaching Programmes The 30 th course for Directors and Trainers of IHL teaching programmes and the 31 st course for Directors and Trainers of IHL teaching programmes were both held in Sanremo from 1 st to 5 th December. The two courses gathered together military officers and lawyers responsible for planning IHL training in their respective countries. Participants were involved in the compiling of course programmes, the creation of modules and didactic material relative to the teaching of IHL within their respective Armed Forces both at the level of director and the level of trainer. The objectives of the course were to examine specific needs, define purpose, develop programmes and integrate them into the main training of the different categories of personnel within the Armed Forces. The Institute, thanks to the support of the Italian Ministry of Foreign Affairs and International Cooperation, organised a course on IHL and human rights at Skopje from 17 th to 21 st November. The course, which was made possible also thanks to the cooperation of the Embassy of Italy in Skopje, examined the main IHL issues of current interest as part of the traditional series of didactic events organised by the Institute in the Balkan area. The session was opened by the FYROM Minister for Foreign Affairs and the President of the Institute, Professor Pocar. Workshop on Human Rights, Gender and International Humanitarian Law for Afghan Governmental Officials and Members of the Armed Forces Building on the success of the three previous editions and thanks to the support of the Italian Ministry of Foreign Affairs and the International Cooperation and of NATO, the Institute organised a fourth workshop on training for government officials and members of the Afghani Armed Forces and Police. The workshop, directed by Gen. Salvatore Lato (Italy), took place in Sanremo from 29 th November to 8 th December. The tailor-made programme included the topics of IHL, human rights and refugee law. Participants had the opportunity to learn how to apply the principles and norms of human rights and IHL and understand the evolution of the concept of gender equality within the human rights system. Particular emphasis was placed on the importance of the application and implementation of these norms and integrating them within the framework of domestic law. Such initiative contributed to the actions on the part of the international community to encourage the peace process and to assist in the development of democratic institutions in Afghanistan. 7

9 COURSES ON INTERNATIONAL REFUGEE LAW The Institute convened its working group on refugee law, IDPs and migration law at its liaison office in Geneva on 28 th February. As was the case with previous annual meetings, the meeting provided a useful occasion for the IIHL to present its 2013 report of activities in the field of refugees and migration as well as its 2014 programme of activities in the same field. Officials from governments financing the projects of the Institute together with representatives of the main international organisations such as UNHCR and IOM attended. During the meeting it was also announced that Dr. Jean-François Durieux would take on the role of Director of the international programme of IIHL courses on refugee law and migration. Dr. Durieux s wide experience resulting from his long professional career with UNHCR, enriched by the prestigious experience of collaborating with Oxford Refugee Centre, would contribute not only to the relaunching of courses already planned but also to the organisation of new and more specific training events directed in particular to professionals. On the same occasion, the Institute also acknowledged the availability of Dr. Olga Nikolova, formerly part of the UNHCR Office in Sofia, as the co-ordinator of IIHL courses. As in previous years, the courses were organised in close collaboration with UNHCR and with the support of the Swiss Federal Office for Migration and the US State Department. More than one hundred and sixty-five participants from seventy countries attended the following courses: 75 th Course (English) 76 th Course (French) 78 th Course (English) 79 th Course (Arabic) Special Training Day on Refugee Protection Following the success of its first edition in 2013, the Institute organised a special training day in Geneva on the protection of refugees aimed for the personnel of governmental missions at the United Nations Office in Geneva on 3 rd December. Such event, organised with the co-operation of UNHCR and supported by the Swiss Federal Office for Migration, had been requested to counteract the lack of preparation of personnel periodically assigned to Geneva in the field of refugee law. The event not only provided exhaustive information concerning the more current issues of refugee law and the protection of refugees, but it also offered a venue for constructive discussion among colleagues of such issues as mixed migration, international protection and national security. The session was directed by Dr. Jean-François Durieux, Director of the programme of IIHL refugee courses, and by Dr. Steven Wolfson, Head Training Officer of the UNHCR Centre in Budapest. Prof. Michel Veuthey, Vice- President of the Institute, gave a presentation on IHL and refugee law. Courses on the Law of Internally Displaced Persons (IDPs) The Institute organised its 10 th course on issues concerning IDPs in close collaboration with Dr. Chaloka Beyani, Special Rapporteur of the Secretary- General of the United Nations on the Human Rights of Internally Displaced Persons, who also participated as lecturer. The course, which was held in English from 24 th to 29 th November, was attended by officials from different countries interested in the problem of the protection of those within their respective countries who had to leave their homes to escape from the effects of conflict, internal unrest or natural disasters. The course was made possible thanks to the support of Brookings Institution, Washington and the United Nations High Commissioner for Refugees. COURSES ON INTERNATIONAL MIGRATION LAW The Institute, in close collaboration with the International Organization for Migration and with the support of the Swiss Federal Office for Migration, 8

10 organised its 10 th course on international migration law. The course was run in English and was held in Sanremo from 29 th September to 3 rd October. Officials, experts and operators involved in the treatment of migration and asylum issues in various parts of the world took part. INTERNATIONAL COURSES ON THE LAW AND LEGAL PROTECTION IN NATURAL DISASTERS A pilot course on international law applicable to manmade and natural disasters was held from 28 th April to 2 nd May. This new course was jointly organised with the International Federation of Red Cross and Red Crescent Societies (IFRC) and the University group involved in the International Disaster Law Project consisting of: Roma Tre University, Bologna University, Scuola Superiore Sant Anna and Uninettuno University. The opening speeches were delivered by Dr. Edoardo Valencia-Ospina, Special Rapporteur of the International Law Commission on the Protection of Persons in the Event of Disasters and Prof. Walter Kälin, former Representative of the UN Secretary-General on the Human Rights of Internally Displaced Persons. The course, which was run in English, registered thirty-four participants many of whom from National Red Cross and Red Crescent Societies and was a great success. As a result of the positive outcome of the pilot course another course on the same topic was again organised by the Institute in collaboration with the IFRC and the United Nations Programme for Development (UNDP). Both the IFRC and the German Government gave their financial support. The course was held in Sanremo from 8 th to 12 th December and aimed at giving an answer to a wide range of questions concerning the legal aspects of the unfortunately ever-frequent phenomenon of the protection of those hit by natural disasters also caused by climatic change, or man-made disasters. Countries particularly exposed to such disasters, namely Bangladesh, Cambodia, Kenya and Malawi, were well represented. JOINT PROGRAMME WITH THE UNIVERSITY OF NICE During the academic year , in collaboration with the Institut de droit de la paix et du dévéloppement, Nice University, the Institute offered a University diploma in International Humanitarian Law. The diploma provides for a series of training modules in English and French to be completed by attending courses at both Institutes or through distant learning online. Fifty-four young graduates and officials from organisations working in the humanitarian field participated from France, Italy and different French-speaking countries such as Canada, Ivory Coast, Mali and Senegal. Fortytwo students were distance learners and twelve were residential. The programme, organised for the second year running on the basis of the original HUMANMED project in 2011, proved to be a great success. 9

11 ROUND TABLES, EXPERT WORKSHOPS AND SEMINARS Round Table on Planned Relocations, Natural Disasters and Climate Change: Consolidating Good Practices and Preparing for the Future, Sanremo, 12 th to 14 th March The Institute hosted this important meeting, organised by the United Nations High Commissioner for Refugees and the Brookings-LSE Project on internally displaced persons, which addressed the delicate issue of planned relocations in the event of natural disasters and climate change. The event took place at Villa Ormond and was attended by experts in the field together with governmental officials from countries at risk. Guidelines were discussed and different experiences were shared with the aim of improving cooperation between the various actors affected by such problem. Training Advisory Group Seminar for Experts in the Field of Training, Sanremo, 21 st -22 nd March The Institute s group of training experts (TAG) held its annual meeting in Sanremo on 21 st and 22 nd March gathering together representatives of different academic and military institutions from all parts of the world. The event offered the opportunity to discuss new developments in the field of didactic methodology and to compare the new problems arising in the training in international humanitarian law with the aim of guaranteeing a suitable standard able to meet the demands of civilian and military experts participating at the courses and the seminars organised by the Institute. XXXVII Round Table on Current Problems of International Humanitarian Law: The Conduct of Hostilities: the Practice, the Law and the Future, Sanremo, 4 th - 6 th September The XXXVII Round Table, jointly organised with the International Committee of the Red Cross, addressed the issue of The Conduct of Hostilities: the Practice, the Law and the Future. The Round Table, which took place in Sanremo from 4 th to 6 th September, highlighted the conduct of hostilities in new scenarios of conflict, both international and non-international. The norms of IHL regulating the conduct of hostilities aim at creating a suitable balance between two fundamental and at times conflicting principles: military necessity and humanity. The application of such norms is essential to limit the often disastrous human cost of conflict and particularly to avoid civilian victims, the destruction of civilian infrastructures and long-term displacement. The XXXVII Round Table strengthened and clarified the understanding of norms and appropriate procedures to respect in the conduct of hostilities, a vital commitment to ensure that such norms are always respected even in the heart of a battle. The interventions of the speakers, experts from all over the world, analysed, above all, the current notion of military objectives and the prohibition of indiscriminate attacks. Moreover, the Round Table also allowed space for discussion on how the norms concerning the conduct of hostilities were reflected in the different spheres of application. Air warfare, for example, is an important aspect of most current conflicts and the increased use of drones led to particularly spirited debates. Finally, the Round Table also considered the future evolution of armed conflicts that are increasingly affected by cyber warfare and the use of arms that are becoming more and more autonomous. The questions discussed in the closing session of the event included: how technological development would affect combat situations; the extent machines could replace human judgement; the challenges such an evolution would create for international humanitarian law. The Round Table was attended by 250 persons from all over the world. Course on the Protection of Migrants and Refugees, Belgrade, 8 th -11 th December Building on the positive outcome of the seminar held in 2013 on the same topic, the Institute organised a course in Belgrade from 8 th to 11 th 10

12 December addressed to governmental officials of the Republic of Serbia, Bosnia and Herzegovina and Montenegro. Commissioned and financed by the Swiss Federal Office for Migration, this event was run in collaboration with the Republic of Serbia s Office of the High Commissioner for Refugees and with the participation of representatives of the UNHCR and the IOM Delegation in Belgrade. The seminar gathered together 50 persons who were mainly officials from the UNHCR and the Ministries of the Interior and Justice of the countries invited to attend. The topics on the agenda provoked discussions and offered many solutions to the officials present who were increasingly exposed to new problems arising from the entrance into their countries of asylum seekers and migrants. The course was coordinated by Dr. Liesbeth Schockaert. Specialised Course forlegal Officers: Legal Issues arising from EU Operations, Rome (CASD), 22 nd- 26 th September In the framework of the Italian Presidency of the Council of the European Union, the Institute was approached to organise a specialised course for legal counsellors of European countries which took place at the Centro Alti Studi Difesa (CASD) in Rome. The course programme, which was agreed upon with the European Security and Defence College (ESDC), examined in depth the various problems of international humanitarian law in joint operations. The course was directed by Col. James Stythe from the Legal Office of the British Army, former Director of the Military Department of the Institute. ADDITIONAL EVENTS The Institute participated in two meetings (on 6 th May and 19 th November respectively), organised by the Italian Ministry of Foreign Affairs along with Italian-based international legal organisations. Apart from the Institute, other international organisations invited included IDLO (International Development Law Organisation), UNIDROIT (International Institute for the Unification of Private Law), UNICRI (United Nations Interregional Crime and Justice Research Institute), the Council of Europe s Venice Commission and ISISC (International Institute of Higher Studies in Criminal Sciences). The aim of the meetings was to create a network to exchange experiences and improve resources for possible joint projects to be held under the patronage of the Ministry. During the second meeting, mention was made of the universal EXPO in Milan and of a possible contribution of those organisations present to the content of the Carta di Milano where global food challenges were concerned. It was also noted that 2015 would mark the 70 th Anniversary of the United Nations and the 60 th Anniversary of Italy s membership to the United Nations. President Pocar was invited to take part in the first Red Cross and Red Crescent Doha Dialogue on Migration which was held in Doha on 16 th and 17 th June. This high profile event provided an important opportunity to discuss the delicate problem of migrant workers mainly from the Middle East but also from certain areas of Asia and North Africa. The Institute participated at the IX Meeting on Human Rights and International Humanitarian Law: Colombia, a Scenario of Peace and Reconciliation, organised in Bogota from 28 th to 31 s t October with the support of EQUION Ltd. Colombia. President Pocar delivered two lectures on the issues of the application of human rights at the end of an armed conflict and of the protection of victims in the context of transitional justice. On the occasion of the XXXVII Round Table, during the concert offered in honour of participants, a ceremony was held to commemorate Gen. Erwin Dahinden. Prof. Pocar, Col. Marchand and Dr. Melzer paid tribute to his memory emphasising his great commitment and contribution to the Institute. On the occasion, the volume The Role of Law in International Security: Compendium in Memoriam of BG Erwin Dahinden ( ) was presented. On several occasions, the Institute hosted groups of students from upper secondary schools from Sanremo but also from other places. The aim of these initiatives was to provide youngsters, particularly those who are nearing school leaving age, with the basic knowledge needed to understand and critically analyse emergency situations and international security operations. The Institute regularly participated as observer at various meetings organised by international organisations based in Geneva. PUBLICATIONS In 2014, the Institute published the proceedings of its XXXVI Round Table on The Respect of International Humanitarian Law: Challenges and Responses through the publishers FrancoAngeli. PARTNERSHIPS The year 2014 witnessed the signing of the following Memoranda of Understanding with: NATO Rapid Deployable Corps, Italy (NRDC-IT) Venice International University Cooperative University of Colombia. 11

MEETINGS OF STATUTORY BODIES The General Assembly of the Institute met in Sanremo in ordinary session on 16 th May to adopt the Report of Activity for the year 2013 and the relative Financial Report, both certified by external auditors. The Assembly also met in extraordinary session on 6 th September to approve the creation of the Foundation auxiliary to the International Institute of Humanitarian Law. Carl Marchand, Head of the IHL and Human Rights Department of the Swiss Armed Forces, was co-opted in the Council. On 6 th September, Ambassador Benoît D aboville, Council member, was elected as Vice-President of the Institute. 12

14 RAPPORT D ACTIVITÉS POUR L ANNÉE 2014 INTRODUCTION L Institut International de Droit Humanitaire (IIDH) a realisé durant l année 2014 un important programme d activités qui a enregistré une augmentation des participants aux cours ayant pris place à Sanremo. La légère baisse d événements organisés à l extérieur de Sanremo en 2014 a, au contraire, produit une petite réduction du nombre des participants, en conditionnant les chiffres totaux, qui restent très peu inférieurs à Un signe bien encourageant qui mérite d être souligné est l augmentation des participants payant les frais d inscription. De même, il faut noter une sensible réduction du nombre des bourses offertes par les gouvernements et les organisations internationales. L Institut est convaincu que la détermination avec laquelle il a promu ses activités ces dernières années, ainsi que la qualité des cours, ont eu un impact positif, malgré la persistance de la crise financière globale et la baisse des resources destinées à la formation accordées par les gouvernements. La recherche de nouvelles contributions, toujours essentielle pour l Institut, en 2014 a été encore traitée par le Conseil au moyen de la publication d un document destiné a d éventuels donateurs. La réunion de l Assemblée Générale tenue en session extraordinaire le 6 septembre a eu spécialement trait à la recherche de fonds. La décision fut de créer, sur proposition du Conseil, une Fondation Auxiliaire de l Institut. La Fondation fut crée par acte notarié le 3 décembre ayant comme finalité la promotion, le soutien et la valorisation de l Institut, en Italie comme à l étranger, et aussi la protection et la mise en valeur de son siège, la Villa Ormond, un édifice de valeur historique et architectural reconnue. Face à une réduction constante des financements publics, ces dernières années l Institut a décidé, dans le cadre d une ample politique de recherche de fonds, que l instrument de la Fondation était le plus adéquat pour diversifier les différentes requêtes de contributions financières, aussi envers de sujets privés. La Fondation, en outre, permettra la gestion indépendante de l emploi et de la location de la Villa Ormond pour des fins autres qu institutionnelles, ce qui fut encouragé aussi par la Ville de Sanremo, propriétaire de la Villa. Le Département Militaire de l Institut a été renforcé par l arrivée, au mois de juin, du Maj. James Hill, conseiller juridique et instructeur de l armée de terre des Etats-Unis. La présence d un officier américain à l Institut non seuelemt donnera une impulsion au travail du Départment, mais renforcera également les relations existantes avec les Etats-Unis pour augmenter leur participation aux activités de l Institut. En respectant les directives du Conseil, l Institut a maintenu sa collaboration avec les institutions et les organisations basées dans les différentes régions du monde, dans le but de faire connaître et apprécier ses programmes, en les adaptant aussi aux exigencies particulières des partenaires. Il faut mentionner, pendant l année 2014, la collaboration avec US AFRICOM et EQUION Ltd. Colombia, qui ont offert un nombre important de bourses aux différents cours. Le bureau de liaison de l Institut à Genève, localisé auprès du siège de l Organisation Mondiale de la Météorologie, a donné aussi en 2014 sa précieuse collaboration pour quelques réunions dans ses locaux, pour maintenir les relations constructives avec les Organisations Internationales présentes à Genève, et pour la promotion de l Institut dans cette importante ville internationale. Dû à la diminution des ressources financières disponibles, l Institut a maintenu une gestion très prudente des dépenses, y compris celles liées aux améliorations et au maintien de la Villa Ormond, en laissant à plus tard quelques interventions, c est-à-dire le replacement du système de conditionnement de l'air qui demande une dépense importante pour garantir le respect des lois contre la pollution. En plus, des mesures budgétaires et environnementales, d autres initiatives sont prises en considération. 13

15 ACTIVITÉS DE FORMATION ET D ENSEIGNEMENT COURS DE DROIT INTERNATIONAL HUMANITAIRE Pour favoriser la connaissance du droit international humanitaire (DIH), aussi connu comme le droit des conflits armés (DCA), l Institut a structuré ses cours en trois niveaux, qui se développent progressivement, en maintenant l accent sur l application pratique du DIH. Ces trois niveau sont articulés comme suit: 1 er niveau: Cours de base sur le DIH - ils offrent une introduction concrète au DIH, dispensée du point de vue des opérations militaires; 2 ème niveau: Cours avancés sur le DIH - ils sont adressés au personnel qui requiert un apprentissage avancé et spécifique de différentes sujets du DIH; 3 ème niveau: Atelier - ils s adressent aux participants ayant déjà une connaissance pratique du sujet traité. Ces séminaires sont souvent plus brefs, avec un apprentissage moins académique. Ils favorisent un échange de vue et d expériences des participants et des instructeurs, afin d arriver à une comprehension plus profonde du sujet traité, ce qui renforce la préparation professionnelle dèjà acquise. Les participants et les instructeurs aux cours viennent du monde entier. Ces derniers assurant les meilleures garanties d apprendissage, avec une perspective vaste et captivante. Les cours s adressent aux fonctionnaires civils et militaires, ayant une formation juridique, ou non. Cours de Base et Cours Avancés sur le DIH 153 ème Cours (anglais avec uneclasse en arabe) 154 ème Cours (français) 155 ème Cours (espagnol avec une classe en portugais) 156 ème Cours (anglais avec une classe en chinois et en russe) 25 ème Cours Avancé (espagnol) 26 ème Cours Avancé (anglais) 27 ème Cours Avancé (espagnol) Cours auprès du Centre Régionale pour la Formation sur la Résolution des Conflits et le Maintien de la Paix en Afrique au Caire Dans le cadre de l accord signé avec le Centre Régional pour la Formation sur la Résolution des Conflits et le Maintien de la Paix en Afrique, et fort des résultats positifs obtenus dans les initiatives précédentes, l Institut a coorganisé un cours de formation pour le personnel militaire et civil de pays africains engagés dans les missions de paix sur le droit international humanitaire et sur les droits de l homme, qui s est tenu du 9 au 13 mars au Caire. 13 ème Concours sur le DIH pour les Académies Militaires La 13ème édition du Concours sur le DIH pour les académies militaires s est déroulée du 24 au 28 mars à la Villa Ormond, siège de l Institut. Plus de quatre-vingt cadets en provenance de différents pays (Allemagne, Belgique, Brésil, Danemark, France, FYROM, Inde, Italie, Nigéria, Norvège, Pays-Bas, Royaume Uni, Etats-Unis, Suède, Suisse, Turquie) se sont réunis à Sanremo pour bénéficier d une approche pragmatique et spécifique à l enseignement. Cela permit aux participants de développer de façon précoce la conscience de l importance du DIH dans les opérations militaires multinationales. Le concours, l un des plus prestigieux événements organisés annuellement à Sanremo depuis 2002, est dispensé en deux parties: la première consistant 14

16 dans une série de présentations intéractives tenues par des experts dans le domaine du DIH et des droits de l homme. La seconde partie est dans une série d opérations militaires multinationales simulées dans lesquelles les cadets, subdivisés dans des équipes mixtes, doivent interagir en tenant compte de complexes réalités geopolitiques et en respectant l application du droit humanitaire. Les équipes sont jugées par une commission qui, à la clotûre du concours, décerne les prix à la meilleure équipe mixte et au meilleur cadet. Workshop sur la privation de la liberté (détention) et le DIH Cet atelier a eu lieu à Sanremo du 1 er au 3 avril. Le programme a mis spécialement l accent sur trois thèmes fondamentaux dans la détention et dans les droits humains, tel que le traitement des détenus, les méthodes d interrogatoires et le partage des informations acquises. En raison de la grande difficulté dans l application concrète de cette matière, une attention spéciale fut réservée à l application des bonnes pratiques (best practices) sur le terrain. Les débats parmi les participants soit membres des forces armées, soit experts civils - venant de quatorze pays, ont été, a cette fin, bien encouragés. Atelier sur le ciblage kinétique et dans l espace Cet atelier s est tenu à Sanremo du 6 au 9 mai, et a réuni des experts et des juristes, civils et militaires, dotés d une préparation avancée, en leur offrant un programme intense avec des sessions interactives appropriées à la confrontation de différentes expériences mûries à propos des récentes opérations militaires. Colloque sur la responsabilité en Afrique En collaboration avec l AFRICA Command des Etas- Unis (US AFRICOM) et suite au succès de l année précédente, l Institut a organisé la deuxième édition d un colloque sur la responsabilité dans une optique spéciale pour les pays africains. Le but de ce colloque était la formation d officiers responsables du le respect des droits de l homme et de la mise en application de la loi. Le programme du colloque était centré sur le droit pénal militaire et la justice transnationale. Les participants, venant de 25 pays africans, ont discuté des problèmes qui surviennent lors des missions de maintien de la paix des Nations Unies et des opérations contre la piraterie, avec une attention spéciale sur la responsabilité de l individu découlant de la violation du DIH. Le colloque s est tenu du 27 au 29 mai. Cours de formation en Droit International Militaire en Indonésie L Institut, grâce à la contribution financière du Centre Norvégien pour les Droits de l Homme, a organisé un cours de deux semaines sur le DIH dans la Base Militaire de Sentul (Jakarta), du 29 avril au 9 mai. Ce cours a vu la participation de quarante officiers des Forces Armées indonésiennes, et également de fonctionnaires civils et d officiers d autres pays de l Asie (Bangladesh, Chine, Laos, Myanmar, Singapour et Thailande). Le cours, qui connut un bon succès, a contribué au développement et au renforcement des compétences spécifiques des participants en matière de DIH et leur a permis l application des principes fondamentaux dans un éventail de scenarii opérationnels. Atelier sur les conflits armés non-internationaux Cet atelier, tenu à Sanremo du 3 au 5 juin, a eu pour objet le très complexe et incertain régime juridique qui s attache aux conflits armé non-internationaux. L atelier a pu approfondir des thèmes tels que les différentes définitions des objectifs légitimes des conflits armés non-internationaux, l application des droits de l homme et l accès à l assistance et à la protection humanitaire. Les groupes de travail ont analysé les cas concrets du Mali, de la République Centrafricaine et de la Syrie. L atelier s adressait aux experts militaires et aux specialists académiques. Cours sur le DIH et les droits de l homme à Erbil L Institut a organisé, à la requête du Ministère italien des Affaires Etrangères et avec son soutien financier, un cours sur le droit international humanitaire et sur les droits de l homme à Erbil, dans la region 15

17 du Kurdistan irakien, du 8 au 12 juin. Le cours, le sixième organisé par l Institut en Irak, a eu lieu sous la supervision du Général Giorgio Blais, membre de l Institut, avec la collaboration du Consulat Italien à Erbil. La majorité des participants était des officiers des forces de Police de la region kurde. Le Vice Ministre de l Intérieur du gouvernement local, qui était présent à la séance de clotûre, a souhaité que d autres initiatives de formation similaires puissent se répéter et a exprimé sa satisfaction quant à la collaboration de l Institut. étudiants universitaires et jeunes fonctionnaires d agences internationales en provenance de 38 pays y ont participé. Le cours fut dispensé par d éminentes personalités du monde juridique et diplomatique qui travaillent dans la promotion du droit international et des droits humains. A Genève, les participants ont eu l occasion de visiter les plus importantes organisations internationales à vocation humanitaire. Atelier sur les règles d engagement (ROE) L atelier a eu lieu à Sanremo du 8 au 12 septembre sous la direction du Capitaine (US) Dennis Mandsager, membre du Conseil de l Institut. L atelier a discuté une vaste gamme de thèmes, en partant d une introduction générale jusqu à des questions spécifiques telles que l emploi de la force de la part des compagnies de sécurité privées, et en passant par l utilisation de cas concrets pour le débat parmi les participants. Le Manuel de Sanremo sur les Règles d Engagement, publié par l Institut en 2009, fut le principal document didactique employé par les participants, qui provenaient de différentes régions du monde. 10 ème Cours sur la conduite des opérations de paix A la lumière de la toujours croissante complexité du régime juridique applicable aux opérations de soutien de la paix, l Institut a organisé la 10 ème édition du Cours sur la Conduite des Opérations de Paix du 16 au 20 juin, à la Villa Ormond. Le Cours a surtout traité de l application et de la mise en oeuvre du DIH, ainsi que des droits de l homme, dans les opérations de soutien de la paix, et pour leur développement et protection, grâce aux Nations Unies et à d autres agences internationales. Les instructeurs étaient des experts militaires ou civils de très grande renommée. Cours d Été sur le DIH, Sanremo-Genève La 14 ème édition du Cours d été sur le Droit International Humanitaire, coordonnée par le Vice-Président de l Institut Prof. Michel Veuthey, s est déroulée du 23 juin au 4 juillet, la première semaine à Sanremo, et la seconde à Genève. 47 Cours sur les Opérations Navales et le Droit International Cette deuxième édition du cours, organisé par l Institut du 27 au 31 octobre après le succès obtenu en 2013, jouit de l expérience décennale des cours sur le droits des opérations navales. Ce cours est l occasion de revister ce sujet. Le cours, inspiré du reconnu Manuel de Sanremo sur le droit des opérations navales, a offert un programme très spécialisé qui a inclus l analyse du régime juridique de la planification et de la conduite d opérations navales durant les conflits, ainsi que les règles d engagement spécifiques et leur mise en oeuvre pratique dans des contextes tels que la lutte contre le terrorisme, la piraterie et le trafic de drogue. Cours sur le droit humanitaire et les droits de l homme pour les forces armées et les fonctionnaires gouvernementaux de la Ex-République Yougoslave de Macédoine 16

18 L Institut, grâce au soutien du Ministère Italien des Affaires Etrangères et de la Coopération Internationale, a organisé un cours sur le DIH et les droits de l homme à Skopje, du 17 au 21 novembre. Le cours, dont la realisation fut rendue possible grâce à la coopération de l Ambassade d Italie à Skopje, a analysé les thèmes actuels du DIH. Il entre dans la lignée d autres évenements organisés par l Institut dans les Balkans. La session d ouverture a vu l intervention du Ministre local des Affaires Etrangères et du Président de l Institut, Professeur Pocar. 30 ème (anglais) et 31 ème (français) Cours pour les directeurs et les instructeurs des programmes d enseignement du DIH Ces deux Cours ont eu lieu déroulés ensemble à Sanremo, du 1 er au 5 décembre. Ils ont réuni officiers et juristes chargés de la planification de la formation en DIH dans leur pays. Les participants furent impliqués dans la préparation de programmes de cours et de modules et matériel didactique concernant l enseignement du DIH dans leurs propres forces armées, soit au niveau de directeurs soit au niveau d instructeurs. L objectif de ces cours est l analyse d exigences spécifiques, la définition des buts, le développement de programmes qui doivent s intégrer dans la formation continue des différentes categories de personnel des forces armées. Séminaire de formation sur le droit international et sur les droits de l homme pour officiers et fonctionnaires afghans Suite au succès des trois éditions précédentes et grâce au soutien du Ministère Italien des Affaires Etrangères et de la Coopération Internationale et de l OTAN, l Institut a organisé un quatrième cours de formation pour les fonctionnaires gouvernementaux et les membres des forces armées et de Police afghanes. Le séminaire, sous la direction du Général Salvatore Lato, s est tenu à Sanremo du 29 novembre au 8 décembre. Le programme réalisé sur mesure, incluait des thèmes de DIH, des droits de l homme et de droit des réfugiés. Les participants ont pu étudier la mise en oeuvre des principes et des normes des droits de l homme et du DIH, et comprendre l évolution du concept d égalité de genre et des droits de la femme dans le système des droits de l homme. Le programme a analysé en profondeur l importance de l application et de la mise en oeuvre des ces thèmes, et leur intégration dans le droit national. Cette initiative fait partie des actions que la communité internationale organise pour encourager le processus de paix et pour coopérer au dévéloppement des institutions démocratiques en Afghanistan. COURS SUR LE DROIT INTERNATIONAL DES RÉFUGIÉS Le 28 février, l Institut a réuni son Groupe de Travail sur le Droit International des Réfugiés et des Migrations près du bureau de liaison de Genève. Comme toujours dans les rencontres annuelles, on a eu l occasion de présenter le rapport d activités de l année précédente dans le domaine du droit des réfugiés et des migrations, ainsi que le programme prévue pour A la réunion ont participé des fonctionnaires des gouvernements qui financent les projets de l Institut dans ce secteur, et des représentants des plus importantes Organisations Internationales, telles que HCR et OIM. Pendant les travaux, on a annoncé la prise des fonctions de Directeur Académique par le Dr. Jean-François Durieux, présent à la réunion, pour le programme des cours sur le droit des réfugiés et des migrations organisés par l Institut. La grande expérience de M. Durieux pendant sa longue carrière au HCR, dernièrement enrichie par une préstigieuse collaboration avec l Oxford Refugee Centre, contribuira non seulement à la relance des cours déjà programmés, mais aussi à l organisation de nouvelles activités de formation plus spécialisées et visant directement des categories particulières de professionnels. A partir de la même date, l Institut pourra compter aussi sur une nouvelle coordinatrice de ses cours, Mme Dr. Olga Nikolova, qui travaille au Bureau HCR à Sofia. À l'image de ces dernières années, les cours ont été organisés en collaboration étroite avec le Haut 17

19 Commissariat des Nations Unies pour les Réfugiés et avec le soutien de l Office Fédéral Suisse pour les Migrations et du Département d Etat des Etats-Unis. Plus de 165 participants en provenance de 70 pays ont pris part aux cours suivants: 75 ème Cours (anglais) 76 ème Cours (français) 78 ème Cours (anglais) 79 ème Cours (arabe) Journée de formation sur la protection des réfugiés Le 3 décembre à Genève, l Institut a organisé, à la suite de sa première édition tenue en 2013, une journée spéciale de formation en matière de la protection des réfugiés, adressée au personnel des Missions Permanentes auprès de l ONUG. Cette initiative, mise sur pied grâce à la coopération du HCR et au soutien de l Office Fédéral Suisse pour les Migrations, avait été sollicitée pour faire face à connaissance insuffisante en matière du personnel périodiquement affecté à l ONUG. La session n a pas seulement fourni une orientation complète sur les questions les plus actuelles du droit des réfugiés et de sa protection, mais elle a offert une occasion pour un débat constructif sur des questions comme les migrations mixtes, la protection internationale et la sécurité nationale. La session s est tenue sous la direction du Dr. Jean-François Durieux et du Dr. Steven Wolfson, Chef de la Formation du Centre HCR à Budapest. Le Vice-Président de l Institut, Prof. Michel Veuthey, y a contribué par une présentation sur le DIH et le droit des réfugiés. COURS SUR LE DROIT INTERNATIONAL DES REFUGIES Á L INTERIEUR DE LEUR PROPRE PAYS (IDP) Du 24 au 29 novembre, l Institut a organisé son 10 ème Cours sur la problèmatique des personnes déplacées dans leur propre pays (IDP), avec la collaboration du Bureau du Représentant Spécial du Secrétaire Général des Nations Unies pour les Droits des personnes déplacées dans leur propre pays, Dr. Chaloka Beyani, qui a participé au cours en tant que rapporteur. Ce cours, donné en anglais, a vu la participation de fonctionnaires de différents pays interessés au problème de la protection de ceux qui, à l intérieur de leur pays, ont dû laisser leur maison pour survivre aux effets de conflits, de désordres internes ou de catastrophes naturelles. Le cours a pu être réalisé grâce au soutien de la Brookings Institution de Washington et du Haut Commissariat des Nations Unies pour les Réfugiés. COURS SUR LE DROIT INTERNATIONAL DES MIGRATIONS En 2014 l Institut a organisé à Sanremo, en étroite collaboration avec l Organisation Internationale des Migrations et grâce au soutien de l Office Fédéral Suisse pour les Migrations, le 10 ème Cours sur le droit international des migrations en langue anglaise, qui s est déroulé du 29 septembre au 3 octobre. Le cours a vu la participation de fonctionnaires, experts et représentants impliqués dans le traitement des problèmatiques de migrations et d asile dans différents pays du monde. COURS INTERNATIONAL SUR LE DROIT ET LA PROTECTION JURIDIQUE EN CAS DE CATASTROPHES NATURELLES Un nouveau cours sur le droit international applicable aux situations de catastrophes naturelles s est déroulé du 28 avril au 2 mai. Le cours pilote a été organisé en collaboration avec la Fédération Internationale des Sociétés de la Croix-Rouge et du Croissant-Rouge et avec le Consortium des Universités engagées dans le Projet sur le Droit 18

20 International des Désastres, c est-à-dire: l Université Roma Tre, l Université de Boulogne, la Scuola Superiore Sant Anna et l Université Uninettuno. Les conférences d ouverture ont été présentées par le Dr. Edoardo Valencia-Ospina, Rapporteur Spécial pour la Commission de Droit International pour les personnes touchées par des catastrophes naturelles, et par le Prof. Walter Kaelin, Représentant du Secrétaire Général des Nations Unies pour les Droits des personnes déplacées dans leur propre pays. Le cours, tenu en langue anglaise, a pu compter sur la participation de 34 représentants, la plupart en provenance de Sociétés Nationales de Croix-Rouge et du Croissant-Rouge, et a connu un grand succès. Suite à la réussite de la première édition, un cours similaire a été organisé en collaboration avec la Fédération Internationale des Sociétés de la Croix- Rouge et du Croissant-Rouge et avec le Programme pour le Développement des Nations Unies (UNDP). Un soutien financier fut attribué par l Allemagne à la Fédération qui nous en a fait bénéficier. Le cours s est tenu à Sanremo du 8 au 12 décembre, et avait pour but de répondre aux nombreuses questions sur les aspects juridiques d un phénomène malheureseument croissant, celui de la protection de ceux qui sont frappés par des catastrophes naturelles, ou causées par de changements climatiques ou par des désastres provoqués par l homme. Un nombre important de représentants de pays particulièrement exposés à ces catastrophes, tels que Bangladesh, Cambodge, Kenya et Malawi a participé à ce cours. PROGRAMME EN PARTENARIAT AVEC L UNIVERSITÉ DE NICE Durant l année académique l Institut a organisé, en collaboration avec l Institut de Droit de la Paix et du Développement de l Université de Nice, un Diplôme Universitaire en Droit International Humanitaire. Le diplôme prévoit une série de modules de formation, en langue anglaise et française, auxquelles ont pu participer les étudiants soit auprès des deux institutions, soit en ligne. 54 jeunes diplomés et fonctionnaires d organisations concernés par les questions humanitaires, ont suivi cette formation, en provenance de France, Italie et différents pays francophones (Canada, Côte d Ivoire, Mali, Sénégal), dont 42 inscrits en lignes, et 12 residentiels. Le programme, organisé pour la seconde année selon le projet HUMANMED qui s est cloturé en 2011, a remporté un grand succès. 19
