4 AGREEM NTBETWBENTHEGOVE~ENTOFTHE UNITED S'l'ATES OF AMERICA AND 1'IJE GOVERNMENT OF THE KINGDOM OF MOROCCO REGARDING MUTUAL ASSISTANCE BETWEEN THEIR CUSTOMS ADMINISTRATIONS The Government of the United States of America and the Government of the Kingdom of Morocc~ hereinafter referred to as "the Patties"; CONSIDERING that offenses against cu~toms commercial interests of their respective cow1tries; laws are prejudicial to the economic, fiscal and CONSIDERING the importance of assuring the accurate assessment of customs duties and other taxes; RECOGNIZING the need for international cooperation in matters related to the administration and enforcement of the customs laws of their respective countries; HAVING REGARD to the international conventions containing prohibitions, restrictions and special measures of control in respect of specific goods; CONVINCED that action against customs offenses can be made more effecuve by cooperation between their Customs Administrations; and HAVING REGARD to the Recontmendation of the Customs Cooperation Council regarding Mutual Administrative Assistanoe of December 5, J 953; HAVE AGREED as follows:

5 For the purposes of the present Agreement: ARTICLE 1 DEFINITIONS 1. the tenn "Customs Administration.. means, in the United States of America, United States Customs and Border Protection and United States Immigration and Customs Enforcement, Department of Homeland Security, and in the Kingdom of Morocco, Administration of Customs and Indirect Taxes of the Ministry of Economy and Finance; 2. the term 11 customs laws.. means the laws and regulations enforced by the Customs Administrations concerning the importation, exportation, and transit or circulation of goods or goods under the custody or control of customs as they relate to customs duties, charges, and other taxes or to prohibitions, restrictions, and other similar controls respecting the movetnent of controlled items across national boundaries; 3. the term "information 11 means data in any form, documents, records, and reports or certified copies thereof; 4. the tenn "offense" means any violation or attempted violation of the customs laws; 5. the term "person" means any natural or legal person; 6. the term "property 11 means assets of every kind, whether corporeal or incorporeal, movable or immovable, tangible or intangible, and legal documents or instruments evidencing title to or an interest in such assets; 1. the term "provisional measures" includes "seizure 11 or "freezing,'' which means: a. temporarily.prohibiting the conversion, disposition, movement, or transfer of property~ or b. temporarily assuming custody or control of property on the basis of an order issued by a court or competent authority, or other means; 8. the term "forfeituren means the deprivation of property by order of a court or competent authority and includes confiscation where applicable; 9. the term "requesting Administration" means the Customs Administration that requests assistance; 10 the term "requested Administration" means the Customs Administration from which assistance is requested.

6 ARTICLE2 SCOPE OF AGREEMENT 1. The Parties, through their Customs Administrations, shall assist each other, in accordance with the provisions of this Agreement, in preventing, investigating, and repressing any offense. 2. Each Customs Administration shall execute requests for assistance made pursuant to this Agreement in accordance with and subject to the limitations of its domestic law and regulations, and within the limits of its competence and available resources. 3. This Agreement is intended solely for mutual assistance between the Parties; the provisions of this Agreement shall not give rise to a right on the part of any private person to obtain, suppress. or exclude atty evidence, or to impede the execution of a request. 4. This Agreement is intended to enhance and supplement mutual assistance practices in effect between the Parties. No provision in this Agreement may be interpreted in a manner that would restrict agreements and practices relating to mutual assistance and cooperation in effect between the Parties. ARTICLE3 SCOPE OF GENERAL ASSISTANCE 1. Upon request, a Customs Administration shall provide assistance in the fom1 of information in order to ensure the enforcement of the customs laws and the accurate assessment of customs duties and other taxes by the Customs Administrations. 2. UpQn request or upon its own initiative. a Customs Administration may provide assistance in the form of infommtion, including but not limited to information concerning: a. methods and techniques of processing passengers and cargo; b. the successful application of enforcement aids and techniques; c. enforcement actions that might be useful to suppress offenses and. in particular, special means of combating offenses; and d. new methods used in committing offenses.

The Customs Administrations shall cooperate in: a. establishing and maintaining channels of communication to facilitate the secure and rapid exchange of infom1ation; b. facilitating effective coordination; c. the consideration and testing of new equipment or procedures; and d. any other general admini~trative matters that may from time to time require their joint action. ARTICLE4 SCOPE OF SPECIFIC ASSISTANCE 1. Upon request, the Customs Administrations shau infonn each other whether goods exported from the territory of one Party have been lawfully imported into the territory of the other Party. If requested, the information shall contain the customs procedure used for clearing the goods. 2. Upon request. a Customs Administration shall exercise special surveillance of: a. persons known to the t equesting Party to have committed a customs offense or suspected of doing so, particularly those moving into and out of its territory; b. goods either in transport or in storage identified by the requesting Party as giving rise to suspected illicit traffic toward or through its territory; and c. means of transport suspected of being used in offenses within the territory of the requesting Party. 3. Upon request, the Customs Administrations shall furnish to each other information regarding activities that may result in offenses within the territory of the other Party. In situations that could involve substantial damage to the economy, public. health, public security, or similar vital interest of the other Party, the Customs Administrations~ wherever possible, shall supply such information without being requested to do so. Nothing in this Agreement otherwise precludes the Customs Administrations from providing on their own initiative information regarding activities that may result in offenses within the territory of the other Party. 4. The Parties may provide assistance through the use of provisional measures and forfeiture, and in proceedings involving property subject to provisional measures

8 or forfeiture. 5. The Parties may, consistent with this Agreement and with other agreements between them pertaining to the sharing and disposition of forfeited assets: a. dispose of property, proceeds~ and instrumentalities forfeited as a result of assistance provided under this Agreement in accordance with the domestic law of the Party in control of the property, proceeds. and instrumentalities; and b. to the extent permitted by their respective domestic laws, and without regard to the requirement of reciprocity, transfer forfeited property, proceeds, or instrumentalities, or the proceeds of their sale, to the other Party upon such tenns as may be agreed. ARTICLES INFORMATION AND DOCUMENTS I. Upon request, tbe. Customs Administrations shall provide information relating to transportation and shipment of goods showing value, destination, and disposition of those goods. 2. A requesting Administration may request originals of files, documents, and other materials only where copies would be insufficient. Upon request, the requested Administration shall provide properly certified copies of such files, documents, and other materials. 3. Unless the requesting Administration specifically requests originals or copies, the requested Administration may transmit computer-based information in any form. The requested Administration shall supply all information relevant for interpreting or utilizing computer--based information at the same time~ 4. If the requested Adminisu-ation agrees, officials designated by the requesting Administration may examine. in the offices of the requested Adntinistration, information relevant to an offense and make copies thereof or extract information therefrom. 5. Originals of files, docwnents, and other materials that have been transmitted shall be returned at the earliest opportunity; any rights of the requested Party or of third parties relating thereto shall remain unaffected.

9 ARTICLE6 WITNESSES 1. The requested Administration may authorize its employees to appear as witnesses in judicial or administrative proceedings in the territory of the other Party and to produce files, documents, or other materials or certified copies thereof. 2. Where a customs official requested to appear as a witness is entitled to diplomatic or consular immunity. the requested Party may agree to a waiver of immunity under such conditions as it determines to be appropriate. ARTICLE? COMMUNICATION OF REQUESTS l. Requests pursuant to this Agreement shall be made in writing (including ) directly between officials designated by the respective Customs Administrations. Information deemed useful for the execution of requests shall accompany the request. In urgent situations, oral requests may be made and accepted, but shall be promptly confinned in writing (including ) as expeditiously as possible, but no later than 10 days from the date of the oral request. 2. Requests shall include: a. the name of the authority making the request; b. the nature of the matter or proceedings; c. a brief statement of the facts and offenses involved; d. the reason for the request; and e. the names and addresses of the parties concerned in the matter, or pr~ing, if known.

10 ARTICLES EXECUTION OF REQUESTS 1. The requested Administration shall take all reasonable measures to execute a request and shall endeavor to secure any official measure necessary for that purpose. 2. If the requested Administration is not the appropriate agency to execute a request, it shall promptly transmit it to the appropriate agency and so advise the requesting Administration. 3. The requested Administration shall conduct to the fullest extent possible such inspections, verifications, fact-finding inquiries~ or other investigative steps, including the questioning of experts, witnesses, and persons suspected of having committed an offense, as are necessary to execute a request. 4. Upon request, the requested Party shall authoriz~ to the fullest extent possible, officials of the requesting Party to be present in the territory of the requested Party to assist in execution of a request. 5. Upon request, the. requesting Administration may be advised of the time and place of action to be taken in execution of a request. 6. The requested Administration shall comply with a request that a certain procedure be followed to the extent that such procedure is not prohibited by the domestic law of the requested Party. ARTICLE9 LIMITATIONS OF USE 1. Information obtained under this Agreement shall be afforded the same degree of confidentiality by the receiving Party tbat.it applies to similar information in its custody. 2. Information obtained under this Agreement may only be used or disclosed for the purposes specified in this Agreement, including use by the receiving Party in any proceedings. Such information may be used or disclosed for other purposes or by other authorities of the receiving Party if the supplying Customs Administration has expressly approved such use or disclosure in writing. 3. Information received by either Party shall upon request of the supplying Party. be treated as confidential. The reasons for such a request shall be stated.

11 4. Titis Article shall not preclude the use or disclosure ofinfonnation to tlte extent that there is an obligation to do so under the domestic criminal law of the receiving Party in connection with a criminal prosecution. The receiving Party shall give advance notice of any such proposed disclosure to the supplying Party. 5. Infonnatioo made public in the territory of the receiving Party under paragraphs 2 and 4 of this Article may be used for any purpose. ARTICLE 10 EXEMPTIONS 1. Where a requested Party determines that granting assistance would infringe upon its sovereignty, security, public policy or other substantive national interest, or would be inconsistent with i-ts domestic law and regulations, including any legal requirement te1ating to non--compliance with guarantees regarding limitations on use or confidentiality, it may refuse or withhold assistance, or may grant it subject to the satisfaction of certain conditions or requirements. 2. If the requesting Administration would be unable to comply if a similar request were made by the requested Administration. it shall draw attention to that fact in its request. Compliance with such a request shall be at the discretion of the requested Adntinistration. 3. The requested Administration may postpone assistance on the ground that it will interfere with an ongoing investigation, prosecution~ or proceeding. In such instance, the requested Administration shall consult with the requesting Administration to determine if assistance can be given subject to such terms or conditions as the requested Administration may require. 4. In the event that a request cannot be complied with, the requesting Administration shall be promptly notified and provided with a statement of the reasons fur postponement or denial of the request. In order to provide assistance in the future the Requested Administration will also communicate recommendations to the Requesting Administration.

12 ARTICLE 11 CO SIS 1. The Requested Party shall normally pay all costs relating to the execution of the request, with the exception of expenses for experts and witnesses and the costs of translation, interpretation and transcription. 2. If during the execution of a request it becomes apparent that completion of the execution of the request will entail expenses of an extraordinary nature, the Customs Administrations shall consult to determine the terms and conditions under which execution may continue. ARTICLE 12 IMPLEMENTATION OF THE AQRBEMENT 1. The Customs Administrations of the Parties shall: a. communicate directly for the purpose of dealing with matters arising out of this Agreement; b. after consultation~ issue any administrative directives necessary for the implementation of this Agreement; and e. endeavor by mutual accord to resolve problems or questions arising from the interpretation or application of the AgreemenL 2. Disagreements for which no solutions can be found will be settled by diplomatic means. 3. The Customs Administrations of the Parties agree to meet periodically as necessary at the request of either Party in order to review the implementation of this Agreement. ARTICLE 13 APfLJCATION This Agreement shall be applicable to the Customs territories of the Parties as defined in their domestic legal and administrative provisions.

13 ARTICLE 14 ENTRY INTO FORCE AND TERMINATION 1. This Agreement shall apply provisionally upon signature. 2. Each Party shall notify the other in writing and through diplomatic channels of the completion of the procedures required under its Constitution or its domestic procedures governing the final entry into force of this Agreement, which shall take effect on the first day of the second month after the date of notification. 3. Either Party may terminate this Agreement at any time by notification through diplomatic channels. The termination shall take effect three months from the date of notification of termination to the other Party. Ongoing proceedings at the time of termination shall nonetheless be completed in accordance with the provisions of this Agreement. 4. This Agreement may be amended at any time by mutual written agreement.

Le terme «infraction» designe toute violation ou tentative de violation de Ia legislation douaniere; 5. Le terme «personne» designe toute personne physique ou morale; 6. Le terme «biens» designe tous avoirs de toute nature, corporels ou incorporels, mobiliers ou immobitiers. materiels ou immateriels, ainsi que les documents ou instruments juridiques etablissant le droit de propriet6 sur ces avoirs ou une participation dans ceux.-ci ; 7. L'expression «mesures conservatoires» comprend Ia «saisie» ou le «blocage», c'est-adire le fait : a. d'empkher provisoirement Ja conversion; la disposition, Ia circulation ou Ia cession de biens; ou b. d'obtenir la garde ou le controie provisoire de biens en se fondant sur une decision rendue par une juridiction ou autorite competente, ou par d'autres moyens ; 8. Le terme «perte par confiscation >> d6signe Ja decheance du droit de propri6te ordonnee par une juridiction ou autorit~ competente et comprend Ia confiscation, le cas echeant ; 9. L'expression «administration requerante» designe I' Administration des Douanes presentant une denjande d'assistance ; 10. L'eKpression «administration requise >> designe l'admittistration des Douanes recevant une demande d'assistance. ARTICLE2 PORTEE DEL' ACCORD

17 1. Les Parties se protent mutuellement assistance par l'internwdiaire de leurs Adn1inistrations des Douanes dans Ia prevention, t'investigation et Ia repression de toute infraction, conformement aux dispositions du present Accord. 2. Chaque Administration des Douanes execute les demandes d'assistance presentees en vertu du present Accord, seton ses legislations et reglementations internes et sous reserve de celles--ci, dans les limites de sa competence et des ressources disponibles. 3. Le present Accord est destine uniquement a I' assistance mutuelle entre les Parties ; les djspositions de celle -ci ne donnent aucun droit a une personne privee d'obtenir, de supprimer ou d'6carter un element de preuve quelconque, ni d'entraver!'execution d'une demande d'assistance. 4. Le present Accord est destine a renforcer eta completer les pratiques en matiere d'assistance mutuetle existant entre les Parties. Nulle disposition de cet Accord ne pourra etre interpretee d'une maniere qui viendrait restreindre l'application des Accords et pratiques ayant trait a ('assistance mutuelle et a Ia cooptration existant entre les Parties. ARTICLEJ PORTEE DE VASSJ8TANCE GENERALE 1. Sur demande, une Administration des Douanes prate son assistance sous forme de communication d'informations aux fins d'assurer Ia mise en application de Ia legislation douaniere et l'imposition exacte, par les Administrations des Douanes, des droits de douane et autres taxes. 2. Sur demande ou de sa propre initiative,. une Administration des Douanes peut preter assistance sons forme de communication d'informations et notamment, mais sans s~y limiter. celles concernant : a. les methodes et techniques de traitement des passagers et marchandises ; b.!'application r6ussie des moyens et techniques de repression ; c. Jes mesures de repression pouvant etre utiles a Ia lutte contre les infractions et, en particulier, les moyens de lutte speciaux ; et d. les nouvelles methodes utilisees dans Ia commission d'infraetions. 3. Les Administrations des Oouanes cooperent : a. a la creation et au maintien des voies de communication destittees a: faciliter un echange d'informations, rapide et sat; b. a Ia facilitation d'une coordination efficace ; c. 8: Ia prise en consideration et 1\ l'examen de nouveaux materiels ou de nouvelles procedures ; et d. sur toutes autres questions administratives d'ordre general pouvant, de temps en temps, requerir leur action conjointe.

18 ARTICLE4 PORTEE DEU ASSISTANCE SPEClFIOUE 1. Sur demande. les Administrations des Douanes s'informent mutuellement sur le point de savoir si les marchandises exportees du territoire d'une Partie ont ete importees en toute legalite sur leterritoire de )'autre Partie. En cas de demande~ les informations contiendront Ia procedure douaniere suivie pour passer ces marchandises en douane. 2. Sur demande, une Administratioo de Douanes exerce une surveillance speciale sur : a. les personnes connues de Ia Partie requerante pour avoir commis une infraction dooaniere ou SOUJ)90nnees de l'avoir commise. en particujier les personnes entrant et sortant de son territoire ; b. les marchandises en transit ou entreposees identift6es par la Partie requerante comme doonant lieu a des soupyons de trafic illicite en direction de son territoire ou sur celui--ci ; et c. les moyens de transport soup\x)jlnes d'etre utilises dans Ia commission d'infractions a l'interieur du territoire de Ja Partie requerante. 3. Sur demande,les Administrations de Douanes se fournissent mutuellement des infonnations concernant Jes activites pouvant resulter en des infractions commises sur le territoire de l'autre Partie. Dans tes cas pouvant faire intervenir un prejudice substantiel cause a l'economie., a Ia sante publique, a Ia securite publique, ou autre inte~t fondamental similaire de rautre Partie. les Administrations des Douanes foumissent alors ces informations dans Ia limite du possible sans en avoir ete prealablement sollicitees. Nutle disposition du present Accord n'emp&be par aiueurs Ies Administrations des Douanes de fournir de leur propre initiative des renseignements concernant des activites qui peuvent entrainer des infractions sur le territoire de I' autre Partie. 4. Les PartieS peuvent se ~er assistance au moyen de mesures conservatoires et de confiscation, ainsi que lors de procedures faisant intervenir des biens soumis a des mesures conservatoires ou a confiscation. S. Les Parties peuvent, conformement au present Accord eta d'autres Accords cooclus entre elles ayant trait au partage eta Ia disposition d'avoirs confisques: a. disposer de biens, produjts et instruments cqnfisques par suite de }'assistance pretee en vertu du present Accord conformement au droit interne de Ia Partie ayant le controie desdits biens, produits et instruments ; et b. dans Ia mesure autorisee par leurs droits internes respectifs et sans consid~ation de Ia condition de reciprocite, ceder les biens. produits ou instruments ainsi confisques, ou le produit de leur vente, a I' autre Partie seton les modatites convenues. ARTICLES INFORMATIONS ET DOCUMENTS t. Sur demande, les Administrations des Douanes fournissent les infonnations afferentes au transport eta!'expedition de marchandises, en indiquant Ia valeur, Ia destination et resort de celles*ci.

19 2. VAdministration des Douanes requerante ne peut demander Ia communication d'originaux. de dossiers. documents et autres donnees que da~s les cas oil des copies seraient insuflisantes. Sur demande.!'administration requise fournit des copies doment certif!ces conformes de ces dossiers, documents et autres donnees. 3. A moins que l' Adntinistration requmnte ne demande expressement Ia communicatiolt d'originaux. ou de copies. 1' Administration requise pourra transmettre des informations informatisees sous quelque forme que ce soit. L' Administration requise foumit egalement en m~me temps toutes informations pertinentes a!'interpretation ou a!'utilisation de ces informations informatlsees. 4. Avec l'accord de I' Administration requise, les fonctionnaires designes par I' Administration requerante peuvent examiner. dans les bureaux de I' Administration requise, les informations pertinentes relatives A une infraction ainsi qu'en faire des copies ou en extraire des informations. 5. Les originaux de dossiers. documents et autres donnees transmis soot retournes des que possible ; tous les droits de Ia Partie requise ou de tiers les concernant restent non affectes. ARTICLE6 TEMOINS t. L' Administration requise peut autoriser ses fonctionnaires A comparaitre en qualite de temoins dans des procedures judiciaires ou adtninistratives se deroulant sur le territoire de l'autre Partie, ainsi qu'a produire des dossiers, documents ou autres donnees. ou des copies certifiees oonformes de ceux--ci. 2. Dans le cas oil un fonctionnaire des Douanes requis de comparaitre en qualite de ten1oin se trouve fonde a beneftcier de rimmunite diplomatique ou consulaire, Ia Partie requise peut consentir a renoncer au benefice de cette immunite dans les conditions qu'el1e juge appropriees. ARTICLE7 COMMUNICATION DES DEMANDE8 1. Les demandes faites en vertu du present Accord soot presentees par ecrit ( inclus), directement entre les fonctionnaires deslgnes par les Administrations des Douanes respectives ; eues soot accompagnees de toutes informations jugees utiles a leur execution. Dans les situations urgentes, des denlandes verbales peuvent egalement etre presentees et acceptees, mais doivent ~re sans delai confinnees par ecrit (e.. mail inclus) le plus tot possible, au plus tard dans les 10 jours suivant Ia date de Ia presentation de Ia demande verbal e. 2. Ces demandes oomprennent les renseignements suivants : a. La designation de l'autorite auteur de la demande ; b. La nature de Ia question ou de Ia procedure en cause ;

20 c. Un bref enonc~ des faits et des infractions concernees ; d. Le motif de Ia demande ; et e. L' Administration requise prend toutes les mesures raisonnables pour executer une demande et s'efforce d obtenir toute mesure ofticielle necessaire a cette fin. 2. Si 1' Administration requise n'est pas l'organisme approprie pour executer une demande, elle Ia transmet sans dejai a t'organisme competent et en infonnera I' Administration requerante. 3. L'Administration requise procede, dans toute Ia inesure du possible. a toutes les inspections, verifications, enquetes factuelles. ou aut~ mesures d'enquate, y compris l'interrogatoire d'experts de temoins et autres personnes soup~onnees d'avoir commis une infraction, necessai~ a ex6cuter une demande. 4. Sur demande, la Partie requise autorise, dans toute Ia tnesure du possible, les ~ponsables de Ia Partie requerante a etre presents sur le territoire de Ia Partie requise pour aider a I' execution d.'une demand e. 5. Sur demande, I' Administration requerante peut atre informe de fheure et du lieu de l'action a prendre en execution d'une demande. 6. ARTICLE9 LIMITES A L'UTILISATION 1. L'information obtenue en vertu du present Accord est accord6e le nteme niveau de confidentialite par Ia Partie beneflciaire que cetui qu'elle accorde a des informations sirnilaires en sa possession. 2. Les informations obtenues en vertu du present Accord ne peuvent C!:tre utilisees ou communiquees qu'aux fins y specifiees. notamment pour Putilisation qui en sera faite par Ia Partie beneftciaire dans toutes proc&lures. Ces informations peuvent etre utilisees ou communiquees a d'autres fins ou par d'autres autorites de Ia Partie beneficiaire avec le consentement express et ecrit de I' Administration des Douanes les ayant foumies, concernant cette utilisation ou communication. 3. Les informations reyues par l'une ou l'autre Partie sont. a Ia demande de Ia Partie les ayant fournies, traitees en tant qu'informations confidentielles. Les motifs d'une telle requc!:te sont indiques. 4. Le present Article ne vient pas em~cher!'utilisation ou Ia communication d'infom1ations dans Ia mesure oil il existe une obligation de le faire dans Ia loi penale nationale de Ia Partie

21 bentficiaire, dans le cadre de poursuites penates. Celle-ci informe alors prealablement de cette communication envisagee Ia Partie qui foumit les infonnations. 5. Les informations rendues pubtiques sur le territoire de Ia Partie beneftciaire confonnement aux pamgraphes 2 et 4 du present Article peuvent etre utilisees a toutes fins utiles. ARTICLEJO EXEMPTIONS 1. Dans le cas ou Ia Partie requise estime que l'octroi de l'assistance porterait atteinte a sa souverainete. a sa securite, a Ia politique publique ou a tout autre interet national fondamental. ou encore serait contraite a ses legislations et reglementations internes, y compris les exigences legales relatives a Ia non-conformite avec Jes garanties concernant les restrictions apportees a l'utilisation ou au caraetere confidentiel, elle peut alors refuser ou deeliner de prater cette assistance, ou Ia subordon~r a Ia satisfaction de certaines conditions ou exigences. 2. Si 1' Administration requemnte ne pourrait pas donner suite a une dentande similaire faite par l'administmtion requise, elle le signale dans sa demande. La satisfaction d'une telle demande est, alors, laissee a Ia discretion de I' Administration requise. 3. L' Ado1inistration requise peut reporter!'assistance au motif que celte-ci interfererait avec une enquete, des poursuites ou une procedure en cours. Dans ce cas, 1' Administration requise consulte I'Administration requ6rante aux fins de determiner si cette assistance peut etre accordee sous reserve des modalites ou conditions que l' Administration requise pourrait imposer. 4. Dans le cas ou H ne peut 8tre donne suite a une demande d assistance, l' Administrati.on requerante en est alors infonnee sans delai avec indication des motifs du report ou de refus d'assistanee. Pour satisfaire une telle assistance a l'avenir, I' Administration requise communiquera egalement des recommandations a!'administration requerante. ARTICLEll FRAIS 1. La Partie requise prend normalement a sa charge tous les frais relatifs a!'execution de Ia demande, a l'exception des frais afferents aux experts et temoins, ainsi que les frais de traduction, d'interpretation et de transcription. 2. Si. au coors de l'execution d'une demande, il apparait que celle-ci va entratner des fmis de nature extraordinaire, les Administrations des Douanes se consuttent alors aux fins de determiner Jes modalites et conditions dans Jesquelles cette execution peut se poursuivre.

22 ARTICLE12 MISE EN OEUVRE DEL' ACCORD 1. Les Administration des Douanes des Parties: a. Communiquent directement entre elles en vue de regler toutes questions relevant du present Accord ; b. Adoptent, apres consultation, toutes directives administrative& necessaires a Ja mise en reuvre du present Accord ; et c. S'efforcent, par accord mutuel, de resoudre les problemes ou questions touchant a!'interpretation ou a &'application dudit Accord. 2. Les differends pour lesquels aucune solution ne peut etre trouvee seront reg1es par Jes voies diplomatiques. 3. Les Administrations des Douanes des Parties s'engagent a se tencontrer periodiquement si necessaire a Ia requete de l'une ou l'autre Partie aux fins d'examiner Ia mise en aruvre_du present Accord. ARTICLE13 APPLICATION Le present Accord est applicable aux territoires douaniers des Parties tels qu'its sont definis dans leurs dispositions legales et administrative& internes. ARTICLE 14 ENTREE EN VIGYEYR ET DENONCIA;TION 1. Le present Accord s'applique provisoirement des Ia signature. 2. Chaque Partie notifie a l'autre, par ecrit et par les voies diplomatique&, l'accomplissement des procedures requises par sa constitution ou ses procedures nationates regissant I' entree en vigueur definitive du present Accord, qui prendra effet Je premier jour du deuxieme mois suivant Ia date de Ia notification. 3. Chacune des Parties peut denoncer le present Accord a tout moment, par notiftcation presentee par les voies diplomatiques. Cette denonciation prend effet lll'expiration d'un delai de trois mois a compter de Ia date de cette notification de denonciation a!'autre Partie. Les procedures en cours lors de Ia denonciation sont neanmoins achevees conformement aux dispositions du present Accord. 4.
