1 Michael Fischer Froriep Aux jeunes professionnels du droit fiscal Octobre 2013 Newsletter Young IFA Network (YIN) Activités 2013 et 2014 Chères et chers collègues, Le Young IFA Network (YIN) a été créé en 2005 pour promouvoir l'activité des jeunes membres de l'ifa dans le domaine fiscal international. Le but du YIN en Suisse est d'encourager ses jeunes membres et de leur permettre de nouer des contacts et de se créer un réseau. Nous nous réjouissons de vous faire part des informations suivantes et vous invitons à participer à nos activités futures. Congrès de l'ifa 2013 à Copenhague "YIN is alive and kicking", ce qui a été démontré une fois encore à Copenhague. Cette année, YIN Suisse a pu poursuivre le programme "Assistants au congrès IFA". A ce titre, YIN remercie vivement l'étude bâloise Ludwig + Partner d'avoir permis à Giedre Lideikyte-Huber, assistante à l'université de Genève, de participer gratuitement à ce congrès. Notamment grâce à l'engagement des sponsors, YIN Suisse a reçu le "YIN Award" 2011 de la branche la plus active dans le monde. Activités du YIN au congrès IFA Les évènements du YIN tiennent une place importante au sein du calendrier du congrès. Comme il est de coutume, le YIN Meet & Greet a eu lieu le dimanche (568 participants à Copenhague). Le lundi matin, le Fun Run a réuni 265 inscriptions. Le YIN Seminar a eu lieu mardi sous la présidence de Jacques de Sasseville (485 participants). Enfin, le point culminant a été atteint le mercredi avec la traditionnelle YIN Party qui a

2 regroupé 609 participants. Pour la première fois, un groupe LinkedIn "IFA Copenhague" a été créé pour l'occasion. 408 personnes s'y sont inscrites avant la fin du congrès. Le YIN Committee représente les branches YIN de tous les pays et organise les évènements YIN lors des congrès. Cette année, l'executive Committee a reconnu le YIN Committee comme un "IFA Committee", lui conférant ainsi le statut d'organe officiel du "Central IFA". Vous trouverez de plus amples informations au sujet du YIN Committe à la page internet suivante: Swiss IFA Award 2014 Dans le but de stimuler les publications internationales par des experts fiscaux suisses, le comité de l'ifa Suisse a introduit un prix de CHF 10'000 pour récompenser les travaux d'excellence portant sur des sujets qui seront traités lors des futurs congrès IFA. Il est prévu de publier l'article récompensé dans un magazine international. La description détaillée des conditions de participations et des thèmes sont annexés à la présente Newsletter. IFA President YIN Scientific Award Afin de mettre en valeur plus avant le YIN, l'ifa Central a introduit ce nouveau prix pour le congrès IFA Celui-ci a vu le jour suite à l'initiative du Président honorifique Dr Markus Desax et des YIN Committees. Les membres du YIN qui sont âgés de 35 ans au plus sont invités à soumettre un article publié en anglais (et comportant un maximum de 10'000 mots sans compter les notes de bas de page) jusqu'au 1 er mars Le prix consiste en un montant de 1'000.- et en la prise en charge des frais relatifs à la participation au congrès IFA. La remise du prix aura lieu au congrès, lors du YIN Meet & Greet. Les conditions de participation sont jointes à la présente Newsletter. Appel à candidature pour les rapporteurs au congrès IFA 2015 Nous vous invitons à déposer votre candidature pour être rapporteur de votre pays au congrès IFA 2015 qui se tiendra à Bâle. Les thèmes sont les suivants: - The use of tax measures in the area of research and development (R&D) - Taxation and fundamental rights: taxpayer s procedural rights in a globalized world

3 Prochain évènement YIN Le prochain évènement YIN aura lieu mardi, 29 octobre 2013 à chez EY à Genève. Le thème traité sera: "Erosion de la base d'imposition et transfert de bénéfices: les impacts en matière de prix de transfert". 4 Swiss IFA Award 2014 In order to encourage publications of Swiss tax professionals in international fiscal law, the IFA Swiss Board has instituted an Annual Prize in the amount of CHF 10'000 for an academic paper dealing with one of the subjects of the next IFA Congress. It is further intended that the award winning paper will be published in an international magazine close to the Congress. The Swiss IFA Award 2014 will be awarded for a paper devoted to one of the following subjects of the forthcoming Congress in Mumbai: Main Subjects Cross border Outsourcing Issues, Strategies and Solutions Qualification of Taxable Entities and Treaty Protection Seminar Subjects UN Matters UN and OECD Differences in Model and Transfer Pricing Indirect Transfers of Assets The Taxable Residence of Companies VAT Implications of Outsourcing & Cost Sharing Arrangements Taxation and Non Tax Treaties The following rules apply to the competition: The paper must be written in English. It should include a maximum of characters including blanks and footnotes. The paper must not consist of a national report and must not need to fully cover one of the aforementioned subjects, but may be restricted to an interesting or a disputed aspect thereof. It must include both the Swiss and international views on the chosen topic. The Jury only accepts papers that fulfill the standards for scientific writing. The paper s subject should be registered by 1 December 2013 with Professor Madeleine Simonek, Universität Zürich, Rechtswissenschaftliches Institut, Rämistrasse 74/20, 8001 Zürich, madeleine.simonek@rwi.uzh.ch. The paper must be submitted by 28 February 2014 to the same address. It will be evaluated by a Jury that will consist of academics appointed by the Board of the IFA Swiss Branch. 5 Rules on the competition for the IFA President YIN Scientific Award 1. The IFA President YIN Scientific Award shall be awarded for an article published in a qualified medium, furthering the understanding of international fiscal law or comparative tax law, providing practical solutions to problems arising in cross border transactions or situations. 2.Only YIN members under 35 years of age on the 31st of July of the year in which the Award is assigned may compete. 3. The article must have been published in a tax periodical of international distribution, a liber amicorum (or mélange or Festschrift) with international authors, a collection of international contributions to seminars or of master theses, and the like, in the calendar year before the year in which the Award is assigned. Only individual papers bearing the name of the author may be submitted to compete for the Award. Articles submitted by several authors are excluded. 4. Articles may be entered by the authors themselves, but the Branches of IFA or even individual members, domiciled in countries where an IFA Branch does not exist, may submit articles not directly submitted by its author. 5. The Jury will only accept original work making either a theoretical or a practical contribution to the study of the effects of taxation, whether it concerns international taxation or comparative tax law. 6. Only articles written in English will be accepted. 7. Articles should not exceed about 10,000 words (footnotes excluded). The choice of subjects is unlimited. These articles should not be or have been submitted to compete for the Mitchell B Carroll Prize or the Maurice Lauré Prize of IFA. 8. The Jury will consist of at least three and no more than five members having a PhD degree and being 45 years of age or younger in the year in which the Award is assigned. The members of the Jury are appointed for a period of 3 years by the Permanent Scientific Committee of the IFA from amongst the IFA membership. 9. The winner will receive a memento, a certificate and an invitation to attend the Congress during which the Prize is awarded, as well as an amount of Euro 1,000, delivered by the IFA President at the annual IFA congress' YIN Meet and Greet session. In addition to the recommendation for the Award, the Jury can issue honorable mentions. 10. The Jury's decision shall be made known at least two months before the appropriate IFA Congress. 11. Articles entered for the Award should be submitted with six (hard) copies and due reference to the medium of publication, on or before the 1st of March of the year in which the Award is assigned. 23 July 2013
