1 RULE 18 UNSEALING SEARCH WARRANTS RÈGLE 18 DEMANDE D ANNULATION D UNE ORDONNANCE DE MISE SOUS SCELLÉS D UN MANDAT DE PERQUISITION General Rule Where an action by peace officers, state agents or those able to assist peace officers or state agents has been approved by judicial order such as a search warrant or other authorization and the sworn information in support of the judicially authorized activity has been sealed by judge s order pursuant to Section of the Criminal Code, the accused or his or her counsel may make application to the trial judge for an order that the sealed information be unsealed. Procedure to be Followed Notice to be Given (1) An application for the unsealing of an information in support of the issuance of an order described in sub-rule shall be made by serving a copy of the application on the Crown Prosecutor s office in the district in which the trial shall be held at least 15 days before the commencement of the trial. Filing of Notice and Application (2) Any application made under subrule shall be filed with the Court along with proof of service on the opposing party at least 10 days before the date set for trial. 2 Judicial Unsealing and Review Elimination of Other Sources (1) The trial judge, before embarking on an unsealing review, shall determine whether the information that was the basis of the sealing order is available from any other source than the sealed information. General Applications for Unsealing and Review Review of Sealed Material (1) If a determination is made that the information sought is not available from any other source, the trial judge shall review the application and supporting documents filed pursuant to rule to determine what portion of the information deposed falls under the provisions of Section 487.3(2) of the Criminal Code or any other statute allowing the sealing of such information. Judicial Editing (2) The trial judge shall then judicially edit the information that was the basis of the application and remove any information that falls under the provisions of Section (2) of the Criminal Code or any other statute authorizing the sealing of such information, after which the edited version of the sworn/affirmed information shall be given to the Crown Prosecutor at least ten days before trial. 3 Crown Request for Re-Editing (3) The Crown Prosecutor will then review the judicially edited version of the sworn/affirmed information and at least seven days before trial shall return the edited version to the trial judge: for disclosure to the accused, if he is unrepresented, and his or her counsel forthwith in the event he is represented, with a request to be allowed to make further Crown submissions on editing, notice of which shall be given to the accused or his counsel if represented or, in the alternative, with a notice to the Court and the other party(s) that it does not intend to rely on the evidence gained from the authorization or with a notice to the Court and the other party(s) that the Crown intends to enter a stay of proceedings. Facial Validity Hearing (4) At the trial, and in the event that the authorization and information in support of it is still a litigable issue, the judge shall hear submissions from the parties on the issue of the facial validity of the edited version of the information and shall determine whether, on those remaining depositions contained in the information, there would have been reasonable grounds supporting the issuance of the warrant or order under review. Audience sur la validité de l autorisation suivant la révision judiciaire 18.04(4) Advenant le cas où l autorisation et les renseignements donnant lieu à l autorisation demeurent une question en litige au moment du procès, le juge entendra les parties sur cette question et déterminera si les renseignements contenus dans la version caviardée du document, auraient constitué des motifs suffisants pour donner l autorisation ou rendre l ordonnance sujette à la révision. 3

4 Application for Unsealing to Establish Innocence at Stake (1) If a determination is made that the information sought is not available from any other source as outlined in Rule 18.03(1), and the application is based upon a claim of innocence at stake, the trial judge shall review the application and supporting documents filed pursuant to Rule with a view to determining whether the substance of the filed material provides some basis for concluding that the the innocence at stake claim is valid. Review of Sealed Material (2) If the trial judge determines that there is a valid basis to the claim of innocence at stake the judge shall then unseal the sealed sworn/affirmed information and review the contents to determine if the information is necessary to prove the innocence of the accused. 5 Judicial Editing (3) If the trial judge determines that information contained in the sworn information is necessary in order to establish innocence, the sworn/affirmed information shall be judicially edited in order to reveal only as much information as is essential to allow proof of innocence, after which the edited version of the sworn information shall be given to the Crown at least 10 days before trial. Crown Request for Re-Editing (4) The Crown Prosecutor shall then review the judicially edited version of the sworn information and at least 7 days before trial shall return the edited version to the trial judge: for disclosure to the accused, if he is unrepresented, and his or her counsel forthwith in the event that he is represented, for a request to be allowed to make further Crown submissions on editing, notice of which shall be given to the accused or his counsel if represented or, in the alternative, for the Crown Prosecutor to be given the opportunity to enter a stay of proceedings. 6 Validity Hearing (5) At the trial, the judge shall hear submissions from the parties on the issue of the facial validity of the edited version of the information and shall determine whether, on those remaining depositions contained in the information, there would have been reasonable grounds supporting the issuance of the warrant or order under review. Consent Editing Threshold Validity Concession (1) Where an application to unseal a judicial order referred to in Rule has been served upon the Crown Prosecutor pursuant to Rule and the Crown Prosecutor is of the view that the threshold requirements set out in Rule 18.03(1) has been met: a) in any case involving a General Application to unseal the sworn information, or b) in relation to an innocence at stake application the parties may notify the Court that Rule 18.03(1) has been met and that the parties have agreed to consent to provisional vetting. Révision par consentement 18.06(1) Lorsqu un avis de demande visé par la présente règle a été signifié à l avocat du poursuivant, conformément à la règle et que celui-ci est d avis que les exigences décrites à la règle 18.03(1) ont été rencontrées : a) dans le cas d une demande générale pour faire annuler une ordonnance de mise sous scellés, ou b) dans le cas d une demande fondée sur le principe de la démonstration de l innocence de l accusé les parties peuvent aviser la cour que les exigences de la règle 18.03(1) ont été rencontrées et qu elles consentent à une révision provisoire. 6

7 Crown Provisional Vetting (2) When the trial judge has been so notified, the judge shall, as soon as reasonably possible, and in any event at least 12 days before the trial, open the sealed packet and provide the Crown Prosecutor with a copy of the original sworn/affirmed information in order that it may be provisionally vetted by the Crown. Judicial Review (3) After review and provisional vetting by the Crown Prosecutor, the vetted copy of the sworn/affirmed information shall be returned to the trial judge at least 10 days before the trial in order for a final judicial determination to be made of the material, if any, that shall be edited from the information in order to protect any of the categories of information source(s) set out in Section 487.3(2) of the Criminal Code or any other statute allowing the sealing of such applications on the grounds that ends of justice would be subverted by the disclosure of the information. Return of Judicial Vetted Copy to Crown (4) When the final vetting of the information has been completed by the trial judge it shall be returned to the Crown Prosecutor at least 7 days before the trial for: disclosure to the counsel for the defense forthwith, to afford time for a request to be formulated to make further Crown submissions on editing, for the Crown Prosecutor to be afforded time to provide a notice to the Court and the other party(s) that it does not intend to rely on the evidence gained from the authorization or, in the alternative, for the Crown Prosecutor to be given the opportunity to enter a stay of proceedings. Révision provisoire par l avocat du poursuivant 18.06(2) Lorsque le juge a été ainsi avisé, il remet à l avocat du poursuivant, dès qu il est raisonnablement possible, et au moins 12 jours avant le procès, une copie du document original contenant les informations sous scellés pour lui permettre d effectuer une révision provisoire du document. Révision judiciaire 18.06(3) L avocat du poursuivant remet le document révisé au juge au moins 10 jours avant le procès afin que celui-ci effectue une dernière vérification des renseignements qui seront supprimés dans le but de protéger les sources de renseignement décrites au paragraphe 387.3(2) du Code criminel ou toute autre loi autorisant la mise sous scellés, au motif que la divulgation serait préjudiciable aux fins de la justice. Remise du document caviardé à l avocat du poursuivant 18.06(4) Lorsque la vérification visée par la règle 18.06(3) est complétée, le document caviardé sera remis à l avocat du poursuivant au moins sept jours avant le début du procès, pour divulgation immédiate à l avocat de l accusé, pour permettre à l avocat du poursuivant de demander à la cour de faire valoir d autres arguments concernant la révision judiciaire, de lui permettre d aviser la cour et l autre partie, que le poursuivant n a pas l intention de s appuyer sur la preuve obtenu par l exécution de l autorisation judiciaire, ou dans l alternative pour permettre au poursuivant d inscrire l arrêt des procédures. 7
