1 HSBC Premier Chinese New Year Lucky Draw Terms and Conditions These Terms and Conditions govern the HSBC Bank Canada HSBC Premier Chinese New Year Lucky Draw) running from 12:00pm PST 24 January 2014 to 11:59pm 28 February 2014, inclusive (the Lucky Draw ). Please read these Terms and Conditions carefully as they explain how you can enter to win one of forty-six (46) $2,000 Air Canada Gift Cards.* DEFINITIONS 1. When used in these Terms and Conditions, the phrases set-out below mean the following: (a) (b) Prize means a $2000 Air Canada Gift Card. There are a total of 46 prizes (one per Participating Branch) available to be won. Limit of one prize per Lucky Draw winner. HSBC means HSBC Bank Canada. (c) HSBC Subsidiary means HSBC Securities (Canada) Inc. s division HSBC InvestDirect 1, HSBC Investment Funds (Canada) Inc. 2 and/or HSBC Global Asset Management (Canada) Limited. 3 (d) (e) (f) New Money means a Client investment of CA$10, or more in a Qualifying Account (as defined below) during the Promotional Period (as defined below), said funds not having ever been previously invested or otherwise on deposit with HSBC or any of its subsidiaries. Qualifying investments include non-registered GICs and Term Deposits. Deposits into chequing and savings accounts are not eligible for the Lucky Draw. Client means a person who is a new or existing HSBC Premier client of a Participating Branch as at the Lucky Draw Closing Date (as defined below). This includes HSBC Retail and HSBC Advance clients who upgrade to HSBC Premier during the Promotional Period. Participating Branches means the HSBC branches listed at the end of these terms and conditions. (g) Promotional Period means from 12:00pm PST on 24 January 2014 to 11:59pm PST on 28 February 2014 (the Lucky Draw Closing Date ), inclusive. The Lucky Draw is only open to residents of British Columbia, Alberta and Ontario, Canada who have reached the age of 19 years or older. Employees, representatives and agents of HSBC and any of its subsidiaries and affiliates and advertising agencies (including members of their immediate families) and those with whom they are domiciled are not eligible for the Lucky Draw. 3. New and existing HSBC Premier Clients shall be given one (1) ballot for every CA$10,000 of New Money that they invest in a single Qualifying Account during the Promotional Period. Ballots will be issued on the Lucky Draw Closing Date and automatically entered into the Lucky Draw. The New Money must remain invested in a Qualifying Account as at the Lucky Draw Closing Date to be eligible for the Lucky Draw. 4. No purchase necessary. Individuals meeting the requirements set-out in section 2 (above) may enter the Lucky Draw by hand delivering an original and handwritten essay to an HSBC representative at one of the Participating Branches in British Columbia, Alberta or Ontario. There is a limit of five (5) essays per no purchase entrant during the Promotional Period (regardless of the number of Participating Branches). Mechanical reproductions of essays will not be accepted. No purchase entrants will be provided with one (1) ballot for each handwritten essay received by a Participating Branch up to a maximum of five (5) entries per no purchase entrant. Essays must be handwritten on a single 8.5 x 11 sheet of paper, contain a minimum of 200 words and answer the question what are the key benefits of HSBC Premier? Please include your name, mailing address, address and phone number. 5. The Lucky Draw is available only at the Participating Branches during the Promotional Period. 6. The Lucky Draw will be made by a physical draw of entered ballots at each Participating Branch at 12:00pm PST on March 31, OTHER CONDITIONS 7. The Lucky Draw may be amended, extended or cancelled at the sole discretion of HSBC at any time without notice. 8. HSBC reserves the right to refuse or terminate any individual s participation in the Lucky Draw if HSBC or its subsidiaries suspects or discovers that the individual is abusing the proper and intended operation of the Lucky Draw, is violating the present rules or is committing fraud. Furthermore, HSBC reserves the right to refuse or terminate any individual s participation in the Lucky Draw if the New Money investment is determined, in the discretion of HSBC, to be made illegally or for an illegal purpose. 9. Certain of the services offered by HSBC and its subsidiaries may be restricted or unavailable to you if you move to, or are located in, certain jurisdictions within or outside of Canada, due to the local laws of that jurisdiction. Other HSBC Holdings plc subsidiaries may, however, be able to provide similar services and products to you in that jurisdiction. 10. The opening of a Qualifying Account shall remain subject to HSBC s and its subsidiaries account opening requirements applicable to the type of account being opened. PUBLIC

Selected entrants will be notified by a Relationship Manager by telephone if they have won a Prize beginning at 12:00pm PST on 31 March The chances of winning are dependent upon the number of eligible ballots submitted at each of the Participating Branches during the Promotional Period. 13. Selected entrants must correctly answer a mathematical skill testing question, without mechanical or other aid, in the time provided by HSBC prior to being declared a prize winner. 14. Selected entrants will have to take delivery of the Grand Prize at the relevant Participating Branch within five days of HSBC sending a notice that the prize is ready to be picked-up. 15. If any selected entrant is not reached after three phone calls or has not returned a phone message within 48 hours, or if any selected entrant does not respond correctly to the mathematical skill testing question in the time given, or fails to sign and return HSBC s declaration and release form within the specified time, or if a selected entrant fails to take delivery of a Prize within five days of HSBC sending a notice that the prize is ready to be picked-up, the selected entrant will be disqualified and an alternate entrant will be drawn from all the remaining eligible ballot entries at the relevant Participating Branch. 16. The Prize must be accepted as offered and no substitution is allowed. The Prize is not transferable or convertible to cash. If a prize winner does not accept a Prize as offered, another entrant will be selected by HSBC. Prizes may not be exactly as described. Neither HSBC nor its affiliates, subsidiaries, sponsors, suppliers or otherwise make any warranty, representation or guarantee, express or implied, in relation to a Prize, including without limitation quality, merchantability or fitness for a particular purpose. 17. Before being declared a winner, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within ten (10) business days of notification HSBC s declaration and release form, which (among other things): (i) confirms compliance with these terms and conditions; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases HSBC and the Participating Branches and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the Releasees ) from any and all liability in connection with this promotion, the selected entrant s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of the selected entrant s name, address, voice, statements about the promotion, essay(s) and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by HSBC or on its behalf in any manner whatsoever, including print, broadcast or the internet. If the selected entrant: (a) fails to correctly answer the skill-testing question; and/or (b) fails to return the properly executed release within the specified time, then he/she will forfeit the Prize and HSBC reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible ballots. 18. By participating in this Lucky Draw, entrants agree unconditionally to these Lucky Draw Terms and Conditions. Entrants further agree to be bound by the decisions of HSBC regarding these Terms and Conditions or in any way relating to this Lucky Draw, as may be determined by HSBC in its sole discretion, which decisions will be final and binding in all respects. 19. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement. 40. 12 汇 丰 卓 越 理 财 春 节 幸 运 大 抽 奖 之 条 款 及 条 件 15. 如 果 3 通 电 话 仍 未 能 联 络 上 获 抽 中 的 幸 运 儿, 或 获 抽 中 的 幸 运 儿 未 能 于 48 小 时 内 回 覆 我 们 的 电 话 留 言, 或 获 抽 中 的 幸 运 儿 未 能 于 限 时 内 正 确 回 答 数 学 技 能 测 试 题, 或 获 抽 中 的 幸 运 儿 未 能 于 汇 丰 发 出 领 奖 通 知 的 5 天 之 内 领 取 奖 品, 该 幸 运 儿 的 资 格 会 被 取 消, 汇 丰 会 于 相 关 分 行 馀 下 的 参 加 者 中 抽 出 另 一 位 幸 运 儿 16. 得 奖 者 必 须 接 受 奖 品, 奖 品 不 可 替 换 转 让 或 兑 换 现 金 如 果 得 奖 者 不 接 受 奖 品, 汇 丰 会 另 行 抽 出 一 位 参 加 者 奖 品 未 必 完 全 如 所 述 一 样 汇 丰 其 联 营 机 构 附 属 公 司 赞 助 商 供 应 商, 或 其 他 相 关 人 士, 没 有 明 文 或 含 示, 为 与 奖 品 相 关 的 事 项, 包 括 但 不 限 于 质 量 可 销 性 或 合 适 性 等, 作 出 保 证 声 明, 和 担 保 17. 获 抽 中 的 幸 运 儿 被 正 式 公 布 为 得 奖 者 之 前, 必 须 :(a) 在 没 有 机 器 或 其 他 协 助 之 下, 正 确 回 答 一 道 数 学 技 能 测 试 题 ; 及 (b) 在 收 到 汇 丰 通 知 的 10 个 营 业 日 之 内, 签 署 及 寄 回 得 奖 者 声 明 及 免 除 责 任 书 ( 连 同 其 他 资 料 ) 给 汇 丰 :(i) 确 认 遵 守 这 些 条 款 及 条 件 ;(ii) 确 认 同 意 接 受 汇 丰 颁 发 的 奖 品 ;(iii) 免 除 汇 丰 参 加 抽 奖 活 动 的 分 行 相 关 活 动 的 主 管 董 事 代 理 人 代 表 继 任 人, 及 委 任 人 ( 统 称 被 免 除 责 任 人 ), 与 本 抽 奖 活 动 相 关 及 获 抽 中 的 幸 运 儿 因 参 与 抽 奖 活 动, 及 / 或 获 颁 奖 品 和 正 确 或 错 误 使 用 奖 品 或 其 任 何 部 分, 而 引 起 的 任 何 或 全 部 责 任 ; 及 (iv) 同 意 汇 丰 无 需 通 知 或 提 供 补 偿, 将 获 抽 中 幸 运 儿 的 姓 名 地 址 声 音 有 关 抽 奖 活 动 的 声 明 文 章 及 / 或 照 片, 或 类 似 的 资 料, 刊 登 复 製, 及 / 或 作 为 其 他 用 途, 汇 丰 可 以 使 用 印 刷 广 播, 或 互 联 网 等 任 何 形 式, 将 上 述 资 料 製 作 为 汇 丰 或 汇 丰 授 权 的 宣 传 品 或 广 告 如 果 获 抽 中 的 幸 运 儿 :(a) 未 能 正 确 回 答 数 学 技 能 测 试 题 ; 及 / 或 (b) 未 能 于 规 定 时 间 内 寄 回 适 当 签 署 的 免 除 责 任 书, 其 奖 品 将 会 被 没 收, 而 汇 丰 可 以 保 留 权 利, 酌 情 于 馀 下 合 资 格 参 加 者 中 抽 出 另 一 位 幸 运 儿 18. 参 加 幸 运 抽 奖, 即 表 示 参 加 者 无 条 件 同 意 本 抽 奖 活 动 的 条 款 及 条 件 另 外, 亦 表 示 参 加 者 同 意 接 受 汇 丰 按 本 幸 运 抽 奖 条 款 及 条 件, 或 任 何 与 本 抽 奖 活 动 有 关 事 宜 而 所 作 的 决 定 约 束 该 等 决 定 为 最 终 决 定 并 具 有 约 束 力 19. 幸 运 抽 奖 受 适 用 的 法 律 及 条 例 规 管 20. 除 非 与 参 加 者 另 有 协 议, 参 加 幸 运 大 抽 奖, 每 位 参 加 者 明 确 同 意, 汇 丰 及 参 与 抽 奖 活 动 的 分 行 其 代 理 商 及 / 或 代 表, 可 以 储 存 共 享 和 使 用 参 加 者 在 呈 交 参 加 抽 奖 活 动 文 章 时 一 併 提 供 的 个 人 资 料, 这 些 资 料 只 可 作 抽 奖 活 动 的 行 政 之 用, 使 用 时 须 符 合 汇 丰 及 汇 丰 隐 私 政 策 ( 可 到 参 阅 ) 的 规 定 如 果 对 抽 奖 活 动 有 任 何 问 题, 请 向 参 与 活 动 的 汇 丰 分 行 业 务 代 表 查 询 参 与 抽 奖 活 动 的 分 行 大 温 地 区 1. 时 代 坊 Aberdeen Centre Hazelbridge Way, Richmond BC V6X 4J7 2.
