6 ARRÊTÉ N O Z-8 UN ARRÊTÉ CONCERNANT L ADOPTION DE L ARRÊTÉ DE ZONAGE DE LA VILLE DE DIEPPE BY - LAW No. Z-8 A BY-LAW TO ADOPT THE CITY OF DIEPPE ZONING BY-LAW ATTENDU QUE l'article 72 de la Loi sur l'urbanisme exige l'examen quinquennal d'un arrêté du plan municipal et de zonage, ET ATTENDU QUE des mesures ont été prises pour faire un tel examen et qu'une révision est proposée avec cet arrêté, PAR CONSÉQUENT, le conseil de la, en vertu de l'autorité qui lui est conférée par la Loi sur l'urbanisme, L.R.N.-B. 1973, c. C-12 édicte ce qui suit : 1. L'arrêté n o Z-8 intitulé UN ARRÊTÉ CONCERNANT L ADOPTION DE L ARRÊTÉ DE ZONAGE DE LA VILLE DE DIEPPE est adopté. 2. WHEREAS Section 72 of the Community Planning Act requires that a Municipal Plan and Zoning By-law be reviewed every five years, AND WHEREAS measures have been undertaken to perform this review and this bylaw is hereby proposed, THEREFORE BE IT ENACTED by the Council of the under the authority vested in it by the Community Planning Act R.S.N.B C-12, as follows: 1. By-law No. Z-8 entitled A BY-LAW TO ADOPT THE CITY OF DIEPPE ZONING BY-LAW is hereby adopted. 2. This by-law may be cited as the City of Dieppe Zoning By-law. 3. The legislative provisions and schedules below form an integral part of this by-law. 1

7 PARTIE OBJET CHAMP D'APPLICATION ET RÈGLES D INTERPRÉTATION SECTION 1 SCOPE AND INTERPRETATION 1. 1 PURPOSE Le présent arrêté : divise la municipalité en zones; sous réserve des pouvoirs conférés exclusivement à la Commission, précise : (i) les usages auxquels peuvent être affectés les terrains,bâtiments et constructions situés dans une zone, (ii) les normes obligatoires relatives à l utilisation du sol, ainsi qu à l installation, à l'édification, à la modification et à l'usage des bâtiments et constructions; interdit l'usage, l'installation, l'édification ou la modification des terrains, bâtiments ou constructions non conformes aux fins et aux normes mentionnées dans le présent arrêté Pour la commodité de la lecture, le présent arrêté indique les mesures à la fois en unités du système métrique et en unités du système impérial. Cependant, en cas d'incompatibilité entre ces mesures, la mesure métrique l'emporte. 1.2 CLASSIFICATION Pour l'application du présent arrêté, la municipalité se divise en zones délimitées sur la carte ci-jointe à l annexe "A" et intitulée Carte de zonage de la ville de Dieppe, datée du 31 janvier Les zones mentionnées à l annexe «A» sont classées et désignées comme suit: This By-Law: divides the municipality into zones; prescribes, subject to powers reserved in the Commission: (i) the purposes for which land, buildings and structures in any zone may be used, and (ii) standards to which land use, and the placement, erection, alteration and use of buildings and structures must conform; and prohibits the use, placement, erection or alteration of land, buildings or structures other than in conformity with the purposes and standards of this By-law For the purposes of convenience, the measurements contained in this By-law include both metric and imperial; however, where a discrepancy exists between a metric and an imperial measurement, the metric measurement shall prevail CLASSIFICATION For the purposes of this By-law, the municipality is divided into zones as delineated on the map attached as Schedule "A", entitled Zoning Map and dated January 31, The zones on Schedule "A" are classified and referred to as follows: zone d habitations unifamiliales (zone R1); zone d habitations bifamiliales Single Unit Dwelling (R1 zone); Two Unit Dwelling (R2 zone); 2

12 condition que ces conditions ou ces exigences soient respectées; Nonobstant toute autre disposition du présent arrêté, les usages suivants sont permis dans toutes les zones: (i) un mini-parc ou un parc local; (ii) un parc linéaire; (iii) un usage récréatif municipal; (iv) un usage d'interprétation des lieux d'intérêt naturel (v) ou scientifique; un usage aux fins des services publics; (vi) un jardin communautaire. 1.8 POUVOIRS DU CONSEIL Malgré toute autre disposition du présent arrêté, il est interdit d'édifier dans la municipalité un bâtiment pour lequel le conseil estime que des mesures satisfaisantes n'ont pas été prises en ce qui concerne l'alimentation en électricité, l'alimentation en eau, l'évacuation des eaux usées, la voirie ou tout autre service ou installation S'il estime qu'un bâtiment ou une construction est délabré, dangereux ou inesthétique, le conseil peut : soit en exiger l'amélioration, l'enlèvement ou la démolition aux frais du propriétaire; ou soit acquérir la parcelle sur laquelle se trouve le bâtiment ou la construction. 1.9 POUVOIRS DE LA COMMISSION Malgré toute autre disposition du présent arrêté, il est interdit d'édifier un bâtiment ou une construction sur tout emplacement où l'édification pourrait être normalement permise par le présent arrêté si la Commission estime qu'il est impropre en raison de la nature de son sol ou de sa topographie, notamment parce qu'il est permitted subject to the fulfilling of such conditions or requirements; Notwithstanding any other provisions of this By-law, the following uses shall be permitted in any zones: (i) a local or mini park; (ii) (iii) a linear park; a municipal recreational use; (iv) interpretive uses associated with areas of natural or scientific interest; (v) (vi) a utility use; and/or a community garden POWERS OF THE COUNCIL Notwithstanding any other provision of this By-law, no building may be erected in the municipality in respect of which, in the opinion of the Council, satisfactory arrangements have not been made for the supply of electric power, water, sewerage, streets or other services or facilities When, in the opinion of Council, a building or structure is dilapidated, dangerous, or unsightly, the Council may: require the improvement, removal or demolition of such building or structure at the expense of the owner thereof; or acquire the parcel of land on which such building or structure is located POWERS OF THE COMMISSION Notwithstanding any other provision of this By-law, no building or structure may be erected on any site where it would otherwise be permitted under this By-law when, in the opinion of the Commission, the site is marshy, subject to flooding, excessively steep or otherwise unsuitable by virtue of its soil or topography. 7

(specified sexual activities) «affiche» Construction, dispositif, lumière, peinture ou autre représentation ou objet naturel utilisé pour identifier, annoncer ou mettre en évidence un objet, un endroit, une activité, une personne, un établissement, une organisation, une firme, un groupe, une marchandise, une profession, une entreprise, une industrie ou un commerce, ou qui montre ou comprend des lettres, ouvrages, modèles, bannières, drapeaux, fanions, insignes, dispositifs ou représentations utilisés comme annonce, indicateur ou une publicité, et qui est destiné à être vu à distance ou à partir d un terrain de stationnement. (sign, freestanding) 2.2 DEFINITIONS "accessory building" means a subordinate building or structure on the same lot as the main building and devoted exclusively to an accessory use, but does not include a building attached in any way to the main building; (bâtiment accessoire) "Act" means the Community Planning Act, for the Province of New Brunswick; (Loi) "adult arcade" means an establishment where, for any form of consideration, one or more motion picture projectors, slide projectors, or similar machines for viewing by five or fewer persons each are used to show films, motion pictures, video cassettes, slides, or other photographic reproductions that are characterized by an emphasis upon the depiction or description of specified sexual activities or specified anatomical areas; (salle de jeux électronique pour adultes) "adult cabaret" means a nightclub, bar, restaurant, or similar establishment that features live performances that are characterized by the exposure of specified anatomical areas or by specified sexual activities; (cabaret pour adultes) "adult entertainment" means adult arcades, adult cabarets, swingers club, adult motion picture theatres, adult retail outlets/bookstores, escort services and massage parlors; "adult motion picture theatre" means an establishment where, for any form of consideration, films, motion pictures, video cassettes, slides, or other photographic reproductions are shown which are characterized by an emphasis on the depiction or description of specified sexual activities or specified anatomical areas; (salle de cinema pour adultes) "adult retail outlet / bookstore" means an establishment with the principal purpose to offer for sale or rent, for any form of consideration, any of the following: books, magazines, periodicals, or other printed matter, or photographs, films, motion pictures, video cassettes, slides, or other visual representations that are characterized by an emphasis upon the depiction or description of specified sexual activities or specified anatomical 12

(sign, canopy) «affiche, tableau ou panneau d'affichage» désigne une surface sur laquelle un message temporaire ou de la publicité est affiché, dont le but est d'informer le public destinée à porter une information et/ou une publicité de nature temporaire, à la connaissance du public; (reading panel or board) «agence d'escorte» désigne un établissement où, moyennant toute forme de contrepartie, sont fournies des escortes en vue du plaisir sexuel et qui est caractérisé par l'importance accordée à des activités sexuelles précises. (escort service) «agence de location de véhicules» Établissement où les membres du grand public peuvent prendre des dispositions pour louer des véhicules automobiles, peut comprendre l'entreposage de jusqu'à huit (8) véhicules sur place à tout moment. (vehicle rental agency) «aire brute de plancher» La superficie totale d un bâtiment au-dessus et au-dessous du niveau areas; or instruments, devices, or paraphernalia that are designed for use in connection with sexual activities; (établissement de vente au detail ou librairie pour adultes) "agricultural use" means the use of any land, building or structure, other than a kennel or cattery, for the production and sale of food, fibre or flora products or the breeding and handling of animals and includes retail or market outlets for the sale of perishable agricultural goods or for the sale of animals; and may include a barn, stable or other accessory building used to house animals other than household pets; (usage agricole) "air transport use" means the use of buildings and land for or supporting aviation services and infrastructure and includes airports, airfields, hangars, maintenance shops for fixed- or rotarywing aircraft, and flight schools; (usage de transport aérien) "attached building" means a building otherwise complete in itself, which shares one or more walls or part of a wall, above grade, in common with an adjacent building or buildings; (bâtiment attaché) "automobile dealership" means the use of buildings and land for the sale or rental of passenger vehicles including cars, light trucks, vans, motorcycles, powerboats, RV s and trailers for same; and includes an automobile sales room and a vehicle rental agency; and may include an outdoor display court and/or a repair and service facility for vehicles sold or rented from the site; (concession d automobiles) "automobile sales room" means an automobile dealership contained entirely within a building, but does not and shall not include the outdoor storage of merchandise or an outdoor display court; (salle de montre d automobiles) "bed and breakfast / tourist home" means a single detached dwelling in which overnight accommodation and meals (usually breakfast, but occasionally other meals as well) are provided for the travelling public; (gîte du passant ou foyer touristique) "beverage room" includes a lounge or other premises licensed for the serving of alcoholic beverages; (débit de boisson) 13
