This Bill clarifies the powers of the Minister of Finance to declare an individual tax exempt. The Bill also corrects errors. Résumé Le présent projet de loi vise à clarifier la définition de l expression «propriété admissible». Il vise également à clarifier le pouvoir du ministre des Finances de déclarer une exemption relative à l imposition des particuliers. Enfin, le présent projet de loi corrige certaines erreurs. 2 BILL 46 AN ACT TO AMEND THE SENIOR CITIZENS AND DISABLED PERSONS PROPERTY TAX RELIEF ACT The Commissioner of Nunavut, by and with the advice and consent of the Legislative Assembly, enacts as follows: 1. The Senior Citizens and Disabled Persons Property Tax Relief Act is amended by this Act. 2. (1) The definition disabled person in section 1 is amended by striking out Civilian War Pensions and Allowances Act (Canada) and substituting Civilian Warrelated Benefits Act (Canada). (2) The definition eligible property in section 1 is repealed and the following substituted: eligible property means (a) a mobile unit, (b) a residential unit, or (c) a parcel of land and a residential or mobile unit, if the parcel of land falls within the meaning of the Property Assessment and Taxation Act and is owned or leased by the same person who owns the unit; (propriété admissible) (3) Section 1 is amended by adding the following definition in alphabetical order: residential unit means property principally used for residential purposes that falls within Property Class 7(i) or Class 8 to Class 11 as established by section 13, or an equivalent class established by section 15 of the Property Assessment and Taxation Act: (unité résidentielle) 3. Section 4 is repealed and the following substituted: Exemption in general taxation area 4. (1) The Minister of Finance may exempt the eligible property of senior citizens or disabled persons in the general taxation area from all or part of the taxes payable in respect of the eligible property. Qualification for exemption (2) To qualify for an exemption made under subsection (1), a senior citizen or disabled person must (a) be the owner or part owner of the eligible property; (b) ordinarily reside on the eligible property; and (c) comply with all prescribed criteria.

3 Consequential Amendments 4. Section 4 and subsection 5(2) of An Act to Amend the Senior Citizens and Disabled Persons Property Tax Relief Act, S.Nu. 2006, c. 12, are repealed. Coming into force 5. Section 4 of this Act is deemed to have come into force June 15, 2006.

4 PROJET DE LOI N o 46 LOI MODIFIANT LA LOI SUR L EXONÉRATION DE L IMPÔT FONCIER DES PERSONNES ÂGÉES ET DES PERSONNES HANDICAPÉES Sur l avis et avec le consentement de l Assemblée législative, la commissaire du Nunavut édicte : 1. La présente loi modifie la Loi sur l exonération de l impôt foncier des personnes âgées et des personnes handicapées. 2. (1) La définition de «personne handicapée» figurant à l article 1 est modifiée par suppression de «Loi sur les pensions et allocations de guerre pour les civils (Canada)» et par substitution de «Loi sur les prestations de guerre pour les civils (Canada)». (2) La définition de «propriété admissible» figurant à l article 1 est abrogée et remplacée par ce qui suit : «propriété admissible» Selon le cas : a) une unité mobile; b) une unité résidentielle; c) une parcelle et une unité résidentielle ou mobile, si cette parcelle s entend au sens de la Loi sur l évaluation et l impôt fonciers et si elle est prise à bail par le propriétaire de l unité ou si elle lui appartient. (eligible property) (3) L article 1 est modifié par insertion, suivant l ordre alphabétique, de la définition qui suit : «unité résidentielle» Propriété servant principalement à des fins résidentielles au sens de la catégorie de propriétés 7(i) ou des catégories 8 à 11, établies par l article 13, ou une catégorie équivalente établie par l article 15 de la Loi sur l évaluation et l impôt fonciers. (residential unit) 3. L article 4 est abrogé et remplacé par ce qui suit : Exonération dans la zone d imposition générale 4. (1) Le ministre des Finances peut exonérer la propriété admissible des personnes âgées ou des personnes handicapées dans la zone d imposition générale, de la totalité ou d une fraction de l impôt exigible à l égard de cette propriété. Conditions d exonération (2) Pour satisfaire aux conditions de l exonération accordée en vertu du paragraphe (1), la personne âgée ou la personne handicapée doit, à la fois : a) être propriétaire ou copropriétaire de la propriété admissible;

5 b) résider habituellement dans la propriété admissible; c) se conformer à tous les critères réglementaires. Modifications corrélatives 4. L article 4 et le paragraphe 5(2) de la Loi modifiant la Loi sur l exonération de l impôt foncier des personnes âgées et des personnes handicapées, L.Nun. 2006, ch. 12, sont abrogés. Entrée en vigueur 5. L article 4 de la présente loi est réputé être entré en vigueur le 15 juin 2006.
