1 Les principes de participation des citoyens étant déjà acquis et désormais admis partout dans le monde, l accent sera mis sur les difficultés structurelles qui nécessitent la mise en place de mécanismes pour mettre en œuvre ces principes. L accès à l information dépend des lois qui garantissent ce droit, et leur application. Tous les pays du Maghreb ont adopté des lois de lutte contre la corruption qui favorisent la participation des citoyens et l accès à l information, mais souvent les mécanismes d application ne suivent pas par manque de moyens et pas nécessairement par volonté de ne pas appliquer. Parmi les mécanismes à mettre en œuvre on peut retenir trois axes : - La société civile : mouvement citoyen qui manque de moyens et de ressources humaines d où un besoin en formation, perfectionnement. - La presse- média : qui a besoin d un renforcement par la spécialisation. - Les institutions publiques : qui ont besoin qu on leur précise qu elles doivent intégrer dans leur mission la communication avec le public comme une obligation. Par conséquent, il y a un programme à développer. Les approches participatives pour améliorer la responsabilisation dans la gestion publique La participation citoyenne pour améliorer la responsabilisation dans la gestion publique et la reddition des comptes est encouragée. Une loi relative au mouvement associatif permet aux citoyens de s organiser librement. Cependant les faibles moyens dans différents domaines (moyens matériels humains financiers...) constituent une entrave à l efficacité de la participation citoyenne. La principale faiblesse d une participation citoyenne efficace en matière de responsabilisation et de reddition des comptes dans la gestion publique réside essentiellement dans la faiblesse de l expertise des ressources humaines. Cette faiblesse empêche et entrave les associations à acquérir l information utile et la lecture et l interprétation de cette information.

2 Tant que la société civile ne s'approprie pas les instruments d'investigation avec suffisamment d'expertise, elle dépendra toujours de l information qu'on voudra bien lui donner, spécialement pour les fraudes et la corruption qui,aujourd'hui, se greffent dans des opérations complexes et utilisent des réseaux suivant des montages complexes, non apparents et difficiles à détecter. On peut cependant y remédier par des formations et des perfectionnements des membres des associations pour renforcer leur capacité. Ceci est valable pour l utilisation des nouvelles techniques d information et communication. Engagement des citoyens et amélioration de leur participation Pour favoriser l engagement des citoyens pour l amélioration de la participation à la responsabilisation, il faut définir et mettre en œuvre une politique de communication efficace qui soit à même de transmettre l information économique, financière et comptable. Cette politique de communication doit faire un compromis entre : - La rigueur des données financières, comptables et économiques qui est souvent trop technique et juridique, qui obéit à des normes professionnelles, et, - Le langage simple et accessible à l ensemble des citoyens. Ce juste compromis doit être toujours recherché pour favoriser une bonne compréhension des données afin que les citoyens puissent se faire une idée précise de la situation et réagir en connaissance de cause. A ce sujet, on peut citer quelques exemples simples :

3 Dans notre droit financier, il existe plusieurs incriminations financières et d ordre comptables mais non comptables : c est le cas de l irrégularité en droit budgétaire qui est punissable financièrement mais pas pénalement, c est aussi le cas de la faute de gestion. Cependant, l opinion publique admet difficilement et n accepte pas que les irrégularités et fautes ne donnent pas lieu à des poursuites pénales, car elle juge la sanction financière insuffisante. Par ailleurs, l opinion publique n accepte pas non plus que les dysfonctionnements et la mauvaise organisation des services publics soient punissables uniquement sur le plan administratif. Il faut ajouter que l absence d une presse spécialisée, capable à la fois d assimiler les informations techniques complexes et de les répercuter simplement auprès des citoyens, n aide pas ces derniers à cet accès des informations ;il faut y remédier. Sans une presse spécialisée en investigation et sans une société civile organisée, la participation des citoyens pourrait rester formelle. C'est là le défi majeur pour une réelle et efficace participation citoyenne aux affaires publiques.

4 Citizens participation principles are already acquired and admitted by all countries in all over the world, structural problems that require set up mechanism to implement these principles will be highlighted. Access to information depends on the laws that guarantee this right, but also mechanisms to ensure their applications. All countries in Maghreb have adopted laws against corruption promoting citizens participation and access to all information, but often application mechanisms don t follow, because of lack of means, and not necessarily because of will of not applying. Among the mechanisms to be implemented, three axes can be retained: - Civil Society: Citizen movement and lack of means and human resources. - Press and media: that needs strength training and specialization. - Public institutions: that need precisions on the fact that they have to incorporate communication with the public in their mission as obligation. Then, there is a program to be developed. Participative approaches to improve the responsibility in public management The citizen participation to improve the responsibility in the public management and the statement of accounts is encouraged. A law relating to the associative movement allows the citizens to be freely organized. However the limited resources in various fields (material means - human - financial ) constitute an obstacle to the efficiency of the citizen participation. The principal weakness of an efficient citizen participation in responsibility and statement of accounts in public management lies primarily in the weakness of the expertise of human resources. This weakness prevents and blocks associations to acquire useful information and the reading and the interpretation of this information. As long as the civil company does not adapt the instruments of investigation and sufficient expertise, it will always depend on information which one will want to give him well,

5 especially on the frauds and the corruption which today are grafted in the complex operations and use networks according to the complex assemblies, no apparent and difficult to detect. Without a press specialized in investigation and an organized civil society, the participation of the citizens could remain formal. It is there the challenge for real and effective citizen participation in the public affairs. One can however remedy by trainings and improvements of the members of associations to reinforce their capacity. This is valid for the use of the new techniques of information and communication. Commitment of the citizens and improvement of their participation To support the commitment of the citizens for the improvement of the participation in the responsibility, it is necessary to define and implement an effective policy of communication which is capable of transmitting economic, financial and countable information. This policy of communication must make a compromise between: - The rigour of the financial, countable and economic data which is often too technical and legal, which obeys to professional standards, and - The language simple and accessible to the citizens. This right compromise must be always required to support a good comprehension of the data so that the citizens can have a precise idea of the situation and react with full knowledge of the facts. On this topic, we can illustrate with some simple examples: In our financial law, there are several financial incriminations of accountant order but not accountant: it is the case of the irregularity in budgetary law which is punishable financially but not penalty, it is also the case of the fault of management. However, the public opinion admits hardly and does not accept that the irregularities and faults do not give place to penal suing, because it considers the financial sanction insufficient. In addition, the public opinion does not accept either that the dysfunctions and the bad organization of the public services are punishable only on the administrative level.

6 It should be added that the absence of a specialized press, capable of assimilating complex technical information and transmitting it in a simple way does not help citizens easy access to this information; and this must be remedied. Without a press for a specialized investigation and without an organized civil society, the effective participation could remain formal. There is challenge of real and efficient participation.
