1 ÉBAUCHE DU PLAN DE LOTISSEMENT (Recommandation concernant le lotissement rue Desjardins) Propriété localisée sur une partie du lot 30, concession 2 de l ancien canton de Cambridge (À l intérieur du village de Limoges, agrandissement de la rue Desjardins) NUMÉRO DE FILIÈRE: 070-S Lundi le 1 décembre 2014

2 INTRODUCTION: M. Michel Desjardins, président de Ontario Inc., a soumis une demande d approbation d une ébauche de plan de lotissement, relativement à la propriété décrite comme le bloc 20, plan 50M284, située à l extrémité est de la rue Desjardins dans le village de Limoges. L ébauche démontre un projet d environ 11 unités d habitation divers. (9 unifamiliales et 2 jumelés) Ce développement serait une continuité de la rue Desjardins jusqu au boulevard Bourdeau. (Voir annexe 1) CONDITIONS D=APPROBATION: Nous retrouvons en annexe 2, toutes les conditions d=approbation que le développeur doit remplir afin de recevoir l=approbation finale sur son projet. La municipalité doit s=assurer qu une entente de lotissement est signée entre la municipalité et le développeur. Pour ce faire, le développeur doit rencontrer les conditions de la municipalité, avant d=enregistrer le plan final. À ce jour, la majeure partie des conditions sont remplies, sauf quelques une qui doivent être discuté entre le développeur et le conseil. POINTS IMPORTANTS DE L=ENTENTE: Le service de l=aménagement du territoire (SAT) a préparé une entente type pour le lotissement proposé à l=intérieur de la municipalité. Cette entente peut être modifiée au besoin. Pour le lotissement de M. Desjardins, nous avons modifié quelques articles, afin de rencontrer ses besoins et ceux de la municipalité. Ci-dessous nous avons une liste des points importants qui ont été modifiés pour cette entente. Service d=électricité: Le standard typique pour tout nouveau lotissement dans la municipalité est que le service d=électricité doit être souterrain. Le service sera sous-terrain. Bordures de béton et trottoirs: Le standard typique pour tout nouveau lotissement dans la municipalité est que le développeur installe des bordures de béton et des trottoirs (si nécessaire) dans tous les nouveaux lotissements. Le SAT a demandé au développeur d installer des bordures (mountables curbs). Ce genre de bordure permet au constructeur de situer l entrée de la maison où il est pratique, dépendant du plan de la maison. Le SAT a décidé d éliminer les trottoirs sur la rue Desjardins, car la planification doit ce faire sur une plus grande échelle. Nous savons que des trottoirs demandent un entretien considérable, alors il vaut mieux planifier à grande échelle l installation des trottoirs afin de réduire les coûts d entretien. Le SAT soulève qu il serait nécessaire de regarder l installation de trottoir sur le boulevard Bourdeau, soit un chemin collecteur. Le problème est qu il n y a pas d installation d égout pluvial actuellement sur le boulevard Bourdeau, rendant difficile la localisation des trottoirs. À cause que la municipalité n a pas de règlement sur la réhabilitation locale, nous devrons travailler avec le développeur pour séparer les coûts des travaux sur le boulevard Bourdeau. Gazon: Le standard typique pour tout nouveau lotissement dans la municipalité est de tourber la cour avant de toutes les nouvelles propriétés. Le SAT maintient cette recommandation et demande que la cour avant soit tourbée dans l année suivant le permis d occupation. Entrée sur les terrains: Le Service a demandé que tous les entrées sur les terrains soient pavées dans les 12 mois après

3 l émission du permis d occupation d une nouvelle résidence. Le recouvrement devra se faire à partir de la rue jusqu au mur avant de la maison. Arbre dans la cour avant: Le Service a demandé que tous les terrains est un arbre dans la cour avant. Cet arbre devra être planté dans l année suivant l émission du permis d occupation. Une liste des arbres qui ne sont pas permis dans la cour avant est inscrite dans l entente. Lumières de rue: Le développeur s engage à installer 3 lumières en respectant la réglementation à ce sujet et le standard de la municipalité. Le SAT est d avis que peut-être 4 lumières seraient plus appropriés. Aussi, nous devons avoir des lumières de style LED, maintenant que la municipalité a décidé d aller de l avant avec ce genre de lumière. Égouts pluviaux: Le lotissement sera sur les égouts pluviaux jusqu à l intersection avec le boulevard Bourdeau. Conditions spéciales: Nous devons discuter de certaines conditions avec le développeur concernant : - Nous ne pouvons forcer pas le développeur en ce qui touche l accès des véhicules lourds lors de la construction car l également, l accès au Royal Court est à partir du boulevard Bourdeau, par contre, nous demanderons au développeur d utiliser la rue Giroux si Brigil Construction est d accord de leur laisser le droit de passer à travers leur lotissement. - Nous devons inclure une entente de construction des services du boulevard Bourdeau. Cette entente doit déterminer les responsabilités et les coûts des travaux et séparer ce montant à partir des divers propriétaires, dont le lotissement Desjardins. Achèvement des travaux de construction: Les travaux de construction du lotissement devront être complétés 24 mois suivant la signature de l entente. La somme d argent pour les fins de parc: N/A Enregistrement de l entente: Le développeur aimerait que l entente soit enregistrée par son avocat au lieu de celui de la municipalité, afin d économiser sur les frais légaux. Le service n a aucune objection envers cette requête. Assurance, lettre de crédit et lettre contre-hypothèque: Le développeur nous fournira une copie du certificat d=assurance et nous soumettra une lettre de crédit équivalent à 50% des travaux à titre de garantie bancaire. 4

4 COMMENTAIRES DES SERVICES MUNICIPAUX Le service de la voirie ne voit aucune objection au plan proposé. Le service de la trésorie nous indique que les futurs propriétaires auront un frais capital à payer pour les services municipaux, lors des émissions des permis de construction. Le service des incendies nous demande d=inclure dans l=entente que les bornes fontaines aient des connections rapides Asteamer port et que le test de pression et que le codage approprié soient fait par le développeur. COMMENTAIRES DU SERVICE DE L=AMÉNAGEMENT DU TERRITOIRE: L=ébauche du plan de lotissement présenté par Ontario Inc. rencontre l=ensemble des critères d=évaluation identifiées dans la Loi sur l=aménagement du territoire pour l=analyse d=un plan de lotissement, incluant notamment les critères reliés à la sécurité, au bien-être, à la santé et à la commodité. Le SAT a aussi eu une rencontre de pré-construction avec le développeur et ses agents. Nous en sommes venus à bon terme et tout le monde semble savoir exactement la procédure à suivre lors de la construction. RECOMMANDATION DU SERVICE DE L'AMÉNAGEMENT DU TERRITOIRE: Le SAT recommande au conseil municipal de permettre au maire et à la greffière de signer l entente de lotissement avec Ontario Inc. et de confirmer que toutes les conditions d approbation ont été remplies. 6 Annexe 2 1. That this approval applies to the draft plan prepared by Annis, O Sullivan, Vollebekk Limited, dated November 2nd, 2012, signed by Dan R. Vollebekk, OLS, for the property described as Block 20, Plan 50M284 in the Nation Municipality, County of Russell, which shows a total of: - 10 lots for single detached dwelling units: being Lots 1 through 10 inclusive; - 3 blocks intended for one foot reserves, being Block 11, 12 & 13; - 1 Street 2. That the owner agrees to enter into a subdivision agreement with the Nation Municipality. 3. That the owner transfers to the local municipality 5% of the lot area of the property for park purposes or a monetary compensation of 5% of the value of the land being part of the Plan of Subdivision. 4. The Owner shall grade and landscape all lots so that no lots will create erosion problems to neighbouring properties, and this, to the satisfaction of The Nation Municipality. 5. The Owner agrees to restore existing adjacent streets and other services which may be disturbed by the development of the plan. 6. Any person who, prior to draft approval, entered into a purchase and sale agreement with respect to lots or blocks created by this subdivision, shall be permitted to withdraw from such agreement without penalty and with full refund of any deposit paid, up until the acknowledgement noted below. The Owner shall provide The Nation Municipality with an acknowledgement from those purchasers who signed before the plan was draft approved, that the plan had not received draft approval by The Nation Municipality. The Owner agrees that the purchase and sale agreements signed prior to draft approval shall be amended to contain a clause to notify purchasers of this fact. 7. Upon draft plan approval, municipal services within the plan of subdivision may be installed provided appropriate financial security, insurance, and a letter of indemnity are posted to the satisfaction of The Nation Municipality. 8. Prior to registration of the plan of subdivision, The Nation Municipality shall be satisfied that the processing fee, if required, has been paid in full. 9. The Owner agrees to satisfy all requirements of Canada Post, concerning the installation of new community mailbox, if applicable, and to the satisfaction of The Nation Municipality. 10. That the owner informs the purchaser, following the registration of each lot or block, of the development charge that has been paid or that requires to be paid for each lot or block in question. The development charge will be determine at the time of the lot or block transfer and will be billed at that time. The state of the account will need to indicate that it is subject to some changes conforming to the Act on development charges and to the Act on School development charges. 11. The Subdivision agreement will need to indicate that the conditions are bond to the property and hold the future property owners. 12. That the subdivision agreement between the Owner and the municipality be registered against the lands to which it applies once the plan of subdivision has been registered. 13. Prior to registration of plan of subdivision, The Nation Municipality is to be satisfied that Conditions 1 to 12 have been fulfilled. 14. That where the relocation or removal of any existing onsite and/or adjacent utility facility, including electrical, gas, telephone and cablevision is required as a direct result of the development, the owner shall pay the actual cost associated therewith to the satisfaction of the appropriate utility authority. 15. That the Owner may be required to enter into an Electrical Servicing Agreement with the hydro provider incorporating such terms and conditions as the hydro provider deems appropriate. The Developer shall, if required, provide at its cost, registered easements for the hydro provider plant. The need for easements will depend on the electrical servicing design. All costs for relocation, protection or encasement of any existing hydro provider plant affected by this development, will be the responsibility of the developer. 16. That the subdivision agreement between the Owner and the municipality contain a provision, with wording acceptable to (Bell Canada, Enbridge, etc ) requiring that the Owner enter into a Servicing Agreement with (Bell Canada, Enbridge, etc...) complying with any underground servicing conditions imposed by the municipality. If no such conditions are imposed the Owner shall advise the municipality of the arrangement made for such servicing. 17. That the owner implement the final version of the Storm Water Site Management Plan and describe how it is to be implemented in accordance with the current Stormwater Management Practices to the satisfaction of the Municipality of The Nation, the United Counties of Prescott Russell and the South Nation Conservation. 7

That the owner agrees to prepare a Sediment and Erosion Control Plan and indicate how it is to be implemented to the satisfaction of the Municipality of the Nation, the United Counties of Prescott and Russell and to the South Nation Conservation, appropriate to the site conditions, prior to undertaking any site alterations (filling, grading, removal of vegetation, ect.) and during all the phases of the site preparation and construction in accordance with the current Best Management Practices for Erosion and Sediment Control. 19. That the owner agrees to prepare a lot grading and drainage plan and indicate how it is to be implemented to the satisfaction of The Municipality of the Nation, the United Counties of Prescott and Russell and the South Nation Conservation. 20. That the subdivision agreement between the owner and the municipality shall contain wording acceptable to the South Nation Conservation that conditions 17, 18 and 19 will be implemented. 21. The owner shall provide the final plan intended for registration on diskette in a digital format that is compatible with the technical requirements of the United Counties of Prescott and Russell GIS system. 22. That the developer accepts to reconstruct Desjardins street turning circle to match the future street and to be responsible of all the fees related to this matter. 23. That the developer agrees to come into an agreement with the municipality concerning it s participation of the construction of municipal services and road for Bourdeau Boulevard and Dolores Street. 24. That the civic address numbering be submitted for review and approval to the United Counties of Prescott and Russell to ensure compliance with the 911 database system That prior to the signing of the final plan, the United Counties of Prescott and Russell are to be satisfied that Conditions No. 1 to 24 have been fulfilled. 8
