2 2004/AGRI/001 Preliminary Impact Assessment Statement Common market organisation for bananas 1. Au niveau du régime interne, il faudra apprécier si le maintien de l aide compensatoire aux producteurs communautaires est justifié dans sa forme actuelle. Le soutien communautaire aux producteurs européens est un élément clé de la viabilité sociale, économique et environnementale des régions ultrapéripheriques productrices de bananes (Guadeloupe, Martinique, Canaries et, en mesure moindre, Madère, Crète et Chypre). 2. OBJECTIVE OF THE PROPOSAL What is the overall policy objective in terms of expected impacts? Il n y a pas d options identifiées à ce stade. Il semble de pouvoir exclure d ores et déjà des propositions visant à modifier le régime des échanges avec les pays tiers (v. supra point 1). 4. 4 2004/AGRI/003 Preliminary impact assessment statement Rural Development policy post PROBLEM IDENTIFICATION The proposal aims at ensuring the continuation and reinforcement of a sustainable rural development (RD) policy covering all rural areas throughout the EU, including the new MS, for the next programming period The proposal will define the framework and legal instrument to implement Community rural development policy post The new policy and measures are designed to tackle economic, social and environmental problems in rural areas. In the CAP reform process, RD has been established as the second pillar of the CAP since Agenda It accompanies the economic and social adjustment resulting from CAP reform, putting at the same time more emphasis on the sustainability and the multifunctionality of the EU agriculture. In doing so, RD policy makes a significant contribution to the Community s economic and social cohesion objective. 2. OBJECTIVE OF THE PROPOSAL The overall policy objectives of the new RD instrument are as follows : to increase the competitiveness of the agricultural sector through support for restructuring, to enhance the environment and countryside through support for land management, to enhance the quality of life in rural areas and to promote diversification of economic activities through measures going beyond the farm sector. 3. POLICY OPTIONS In the current programming period two funding sources are available for RD: EAGGF Guarantee and EAGGF Guidance. Outside of objective 1 regions RD is co-financed by EAGGF Guarantee under heading 1b of the financial perspectives. In objective 1 regions RD (except the 4 so-called accompanying measures) are co-financed by EAGGF Guidance as a structural fund and fall under heading 2 for structural actions. The existence of a double delivery system for the same policy with different implementation rules is experienced as a major source of complication and administrative burden for both MS and the Commission. To end this, Guidance will be moved to merge with Guarantee funds under the future CAP heading. The reasons for this are mainly three : There is a strong link between the reform of the 1 st pillar and the support for targeted policies under the 2 nd pillar. The MTR CAP reform introduces a shift in resources from the 1 st to the 2 nd pillar through modulation, which is easier to realise within the same heading. In principle all rural areas are affected by CAP reform, so the EU RD policy should be available to all rural areas throughout the EU. The current RD measures will be grouped per theme, their content will be where necessary adapted and simplified, the current multi-annual programming approach will be kept with an adapted and simplified financial management and control system similar to that being elaborated for the structural funds.

5 Another option could be to fully integrate the RD policy in the cohesion policies, the RD fund becoming one of the EU structural funds. However, for the reasons explained above, the option to keep a separate policy and funding instrument for RD is preferable. 4. IMPACTS POSITIVE AND NEGATIVE It is expected that the CAP reform will entail adaptation problems of the agricultural sector. The RD policy, as the 2 nd pillar of the CAP will help mitigate these problems and help farmers to adapt faster to the changing internal and international context, while the new RD policy puts more emphasis on sustainability. Therefore there should not be negative effects in terms of economic, social and environmental consequences. At the same time, since all EU rural areas would benefit from RD, the whole rural community and all the EU rural areas should be positively affected from the new policy in general terms. It should also help political and practical acceptance by both certain Member States and farm organisations of the on-going process of CAP reform. The new RD policy will be of particular significance for many of the new Member States who are characterised by a far higher dependence on agriculture than most of the EU-15 and where significant restructuring of the agricultural sector can be expected in the coming years, with consequent pressures for not only farmers but the wider rural area too. 5. FOLLOW-UP The basic options of the new proposal were discussed and agreed within the interservice task force for future cohesion policy. The proposal is in practice the next step of the already agreed package on CAP reform in the Council (political agreement in Luxembourg on ). 6 2004/COMP/011 Preliminary Impact Assessment Prolongation and amendment of the Community guidelines on State aid for rescuing and restructuring firms in difficulty Associated DGs: AGRI, FISH, TREN, SJ, ENTR, MARKT, ECFIN, EMPL 1. PROBLEM IDENTIFICATION Describe the problem that the policy/proposal is expected to tackle: The current guidelines expire in October 2004 and thus have to be prolonged or replaced. As rescue and restructuring aids have been identified as being highly distortive, and in the light of different Council conclusions which called for a reduction and reorientation of State aids towards more horizontal objectives (e.g. R&D), it remains necessary to have strict guidelines in place. 2. OBJECTIVE OF THE PROPOSAL What is the overall policy objective in terms of expected impacts? The policy objectives remain the same as in the current guidelines putting in place a strict control over these highly distortive forms of aids. Such aids can only be accepted if strict conditions are fulfilled. The proposed new guidelines will be modeled on the current guidelines, while clarifying certain points which have caused problems in the past. Such clarification will increase legal certainty. 3. POLICY OPTIONS What policy options are available to reach the objective? What range of alternatives will be considered? Given that the basic principles of State aid control are set out in the Treaty, it is not so much a question of policy options as of choosing the most efficient means to ensure that the principles of the Treaty are properly respected. To this end, the adoption of new guidelines will be conducted in close dialogue with the Member States. How have the principles of subsidiarity and proportionality been taken into account? State aid control is an exclusive Commission competence. However, as usual in State aid matters, new soft law proposals are discussed with Member States during multilateral meetings. 4. IMPACTS POSITIVE AND NEGATIVE On a preliminary basis, what are the likely positive and negative impacts of the selected options, particularly in terms of economic, social and environmental consequences? Who would be affected? Avoidance of undue distortion of competition. The establishment of a clearer framework for State aid control regarding rescue and restructuring operations will also increase legal certainty. The proposed new guidelines will also propose a simplified procedure to speed up the treatment of rescue cases which do not pose significant competition concerns at Community level. This should also enable the Commission to focus its resources on more complex or difficult cases.

7 5. FURTHER ANALYSIS What further analysis is proposed? An analysis of the problems encountered in applying the current guidelines has been done. Is a consultation planned? On what basis? Member States will be consulted using the established procedures in the field of State aids (multilateral meetings). 6. FOLLOW-UP Is a formal extended assessment recommended? Justification if not? No, as the revision of the current guidelines is rather an exercise of a technical nature, which does not change the underlying principles, which are based upon constant Commission practice since 1994, building upon the State aid rules laid down in the Treaty and the case law of the Courts.

PROBLEM IDENTIFICATION Describe the problem that the policy/proposal is expected to tackle: According to Art. 95 of the Cotonou Agreement, a review of its provision shall take place five year after its signature, i.e. as of 28 February The partners shall notify each other of the provisions they wish to be reviewed 12 months before the five year period is completed, i.e. by 29 February At this stage, no substantive changes to the main body of the Agreement are expected to be proposed by the EU. However, the review provides an opportunity for improving the technical efficiency in the financial co-operation between the ACP and the EU, by providing more flexibility in financing global initiatives from the European Development Fund and to support the Commission s efforts in the context of the RELEX Reform, i.e. by supporting deconcentration. Under the current Agreement, in particular its technical annex, efficiency gains are hampered mainly by the specific definition of the role of the National Authorising Officer. Moreover, allocation decisions for global initiatives require extremely cumbersome and time consuming procedures. The review of Cotonou also takes place in parallel to the discussion on the Commission proposal to fully incorporate the financial co-operation with the ACP into the Community Budget. This so-called budgetisation will provide opportunities for increasing the efficiency and effectiveness of EU aid to the ACP and should help to counter the trend in marginalising the ACP in the political areas of the Union. A proposal on budgetisation has been made by the Commission in October In case of a favourable decision by Council and EP before the above deadline, certain provisions of the Agreement will have to be adapted to align them to the Community financial regulations. Budgetisation will address most of the problems and opportunities for efficiency gains mentioned further above. Indicate potentially unsustainable trends associated with the problem: No direct economic, social or environmental trends are associated with the problem, but there are indirect negative economic and social effects associated to the fact that financial co-operation with the ACP is less efficient and effective than it could be. Indicate the potential inconsistencies between the three dimensions or with other policies Not applicable. 2. OBJECTIVE OF THE PROPOSAL What is the overall policy objective in terms of expected impacts? The overall objective of the EU proposals for amending the provisions of the Cotonou Agreement is to increase the efficiency and effectiveness of financial co-operation with the ACP in order to fully exploit the opportunities provided by it. 3. POLICY OPTIONS What is the basic approach suggested to reach the objective? Rationalising the financial co-operation with the ACP by reassessing the role of the National Authorising Officer and to increase the flexibility for financial allocation decisions. What policy instruments have been considered? Improvements in efficiency and effectiveness are intended in the context of the Reform of the external service. Further efficiency as well as effectiveness gains in the co-operation with the ACP require amendments to the

9 technical provisions of the Cotonou Agreement. The only other option is not to amend and thereby to forego potential efficiency and effectiveness gains. In what way do the options identified respect the subsidiarity and proportionality principles? The subsidiarity and proportionality principles do not apply. The proposal concerns amendment to an existing international Agreement between the EU and the ACP countries. Which options can be excluded at this an early stage? The option of not proposing an amendment of the Agreement and hence not to propose improvements in efficiency and effectiveness has not been considered as option. 4. IMPACTS POSITIVE AND NEGATIVE On a preliminary basis please indicate the expected positive and negative impacts of the selected options, particularly in terms of economic, social and environmental consequences? The increase in the overall efficiency and effectiveness of EU aid to the ACP is expected to have a positive indirect impact on the economic and social development of the partner countries and on the reputation of EU aid to the ACP. Please indicate who is affected and possible severe impacts on a particular social group, economic sector or region (inside or outside the EU), in the short term; in the medium and long term? The whole of the ACP countries are expected to benefit from increases in efficiency and effectiveness of EU aid in the medium to long run. 5. FOLLOW-UP What preparatory steps have already been taken (consultations, studies)? Various information sessions have been held with ACP institutions in the context of the proposal for budgetisation of the EDF. The ACP countries will be officially notified of the EU proposal on amendments to the Agreement by the deadline of 28 February Is an extended assessment recommended? Yes/no No. The proposal is not suitable for an extended impact assessment. Is a consultation planned? Yes Formal negotiations will be held between the EU and the ACP from May 2004 onwards.

10 2004/DEV/003 Preliminary Impact Assessment Statement Regulation on Forest Law Enforcement, Governance and Trade (FLEGT) 1. PROBLEM IDENTIFICATION Describe the problem that the policy/proposal is expected to tackle: The EU Action Plan for Forest Law Enforcement, Governance and Trade (FLEGT) is designed to tackle the problem of illegal logging and the associated trade in illegally-harvested timber. Indicate potentially unsustainable trends associated with the problem, - Economically: Developing countries are losing revenues worth an estimated 10-15bn as a result of illegal logging and the associated trade. Illegal logging is also closely intertwined with corruption, which has very damaging economic consequences for developing countries. - Socially: Frequent abuses of human rights have been documented in association with illegal activities in the forest sector. Rural communities are frequently robbed of their productive assets and traditional lands; illegal logging is often linked to organised criminal gangs and the military, who use intimidation and violence to ensure their activities go unchallenged. - Environmentally Illegal logging has extremely damaging impact on the environment. National parks and water catchment areas are degraded; access roads made by loggers open up forests to hunting pressures, and this has partly contributed to the bush meat crisis in Africa. Indicate the potential inconsistencies between the three dimensions or with other policies EC development co-operation aims to ensure sustainable development, good governance, rule of law, respect for human rights, and sustainable environmental management. All of these principles are violated by the problems, which the FLEGT initiative proposes to address. 2. OBJECTIVE OF THE PROPOSAL What is the overall policy objective in terms of expected impacts? The FLEGT initiative will reduce illegal logging in wood producing countries, and close the EU market to illegally harvested timber. 3. POLICY OPTIONS What is the basic approach suggested to reach the objective? The Commission proposes to introduce a voluntary licensing scheme, under which partner countries would certify that all exports of timber to the EU come from legal sources. This will allow illegally harvested timber to be excluded from the EU market. What policy instruments have been considered? A regulation is proposed to set up the above-mentioned voluntary licensing scheme.

11 In what way do the options identified respect the subsidiarity and proportionality principles? The options identified respect the principle of subsidiarity because the Commission has competence for all matters concerning trade. A regulation is necessary to implement the proposed licensing scheme because a strong legal instrument is needed to exclude illegal timber from the EU market. Which options can be excluded at this an early stage? During the extensive public and interservice consultations which contributed to the preparation of this initiative, numerous policy options were considered and discarded. Amongst those rejected was a proposal to introduce a unilateral EU ban on illegally harvested timber (for reasons of enforceability), and on a proposal to set up an EUbased licensing body to verify that timber had been legally harvested in third countries (for reasons of national sovereignty). 4. IMPACTS POSITIVE AND NEGATIVE On a preliminary basis please indicate the expected positive and negative impacts of the selected options, particularly in terms of economic, social and environmental consequences? Economic consequences: Positive: The initiative will help developing countries to recover the vast revenues that they are currently losing to illegal logging. If well-used, these revenues will contribute to poverty alleviation programmes. Negative: 1. EU wood-processing and retailing companies which rely on timber harvested illegally in third countries will be required to find alternative sources of raw materials. 2. Setting up licensing schemes to verify timber has been harvested legally will require an initial financial outlay. If successful, the schemes should become self-financing, but funds will be needed to support initial phases of the work. Social consequences: Positive: 1. Reforms to improve governance in wood-producing countries will improve living conditions for many rural communities which are penalised by existing legal frameworks and forest concession systems. Negative: 2. There is a risk that enhanced law enforcement in wood-producing countries will penalise poor and marginalise groups of people. Actions are planned to mitigate against this threat. Environmental consequences: Positive: The initiative will help to slow the loss of the world s remaining tropical and temperate forests. Negative: No negative environmental impacts are envisaged. Please indicate who is affected and possible severe impacts on a particular social group, economic sector or region (inside or outside the EU), in the short term; in the medium and long term? None. 5. FOLLOW-UP What preparatory steps have already been taken (consultations, studies)? The policy proposal has been prepared with wide stakeholder consultations.

12 In April 2002 the Commission hosted a stakeholder workshop to inform the preparation of the Communication on an EU Action Plan for Forest Law Enforcement, Governance and Trade. Since publishing this Communication in May 2003, further stakeholder consultations have been launched. DG Enterprise has hosted a series of meetings with the private sector to inform them about the proposals. A series of workshops on forests and governance, hosted by the London-based Royal Institute of International Affairs, is been used as a stakeholder forum to consult and further elaborate the Action Plan. Presentations and consultations are also planned with developing countries. There have been consultative contacts made with Indonesia, Malaysia, Argentina, Brazil and Russia. Contact and consultation with African countries will begin at the Africa Ministerial Conference for Forest Law Enforcement, Governance in Cameroon later this month. Further consultations are planned in the months ahead. Preparatory studies have been funded by DG Environment and the Dutch and UK governments. Funds have been reserved in the Tropical Forest Budget Line allocation for 2003 and 2004 to support implementation of the proposal. We plan to address many of the existing gaps in information and knowledge required to implement the proposal using these funds. DG Environment will provide funds for an assessment of further options to support implementation of the proposed course of action. A terms of reference is being prepared, and the work will commence in early 2004 at the latest. Is an extended assessment recommended? Yes/no No. Draft Council conclusions on the Communication on EU FLEGT initiative (Action Plan) should be agreed by COREPER the week of October 6 and initial Council conclusions are expected to be adopted later this month. In parallel, the EP is currently reviewing the Action Plan and will issue a report later this year. There is wide acceptance amongst the European stakeholders that action needs to be taken to stop illegal logging and the trade in illegal timber. Is a consultation planned? Yes/no Yes. A process of consultation informed preparation of the Communication. Further consultations and studies are now ongoing.

PROBLEM IDENTIFICATION Describe the problem that the policy/proposal is expected to tackle: La necessité de renforcer l'espace culturel européen est rendue encore plus aigue dans la perspective d'une Europe élargie à 25 Etats, soit près de 500 millions de citoyens. En effet, il est nécessaire d'encourager les opérateurs culturels à coopérer au-delà des frontières nationales, car la plupart des activités culturelles en Europe sont encore souvent exercées dans des limites nationales, ou bien dans le cadre d'une coopération limitée à deux pays. Or, la coopération culturelle en Europe est un élément essentiel de la cohésion de notre espace commun. L'Union européenne doit jouer un rôle d'encouragement à la mobilité des acteurs culturels européens, à la circulation des oeuvres et des produits culturels, et au dialogue interculturel. Pour jouer ce rôle, des actions d'encouragement financier sont nécessaires, notamment en raison de la structure fragile des opérateurs culturels. 2. OBJECTIVE OF THE PROPOSAL What is the overall policy objective in terms of expected impacts? Assurer la mise en oeuvre de l'article 151 du TCE, qui donne pour mission à la Communauté de contribuer à l'épanouissement des cultures des Etats membres dans le respect de leur diversité nationale et régionale, tout en mettant en évidence l'héritage culturel commun. Pour cela, l'objectif d'action global est d'encourager la coopération culturelle en Europe. Il s'agit pour l'union d'encourager la coopération entre les Etats membres et, si nécessaire, d'appuyer et compléter leur action en faveur de l'amélioration de la connaissance et de la diffusion de la culture et de l'histoire des peuples européens, de la conservation et la sauvegarde du patrimoine culturel d'importance européenne, des échanges culturels non commerciaux, et de la création artistique et littéraire. 3. POLICY OPTIONS What is the basic approach suggested to reach the objective? What policy instruments have been considered? Un nouveau programme de soutien financier à la coopération culturelle, qui se substituerait à l'actuel programme Culture 2000, semble l'instrument le plus approprié, sachant que le principe de subsidiarité et l'article 151 du TCE limitent, voire interdisent d'autres développements de l'action communautaire dans le domaine de la coopération culturelle. Toute possibilité d'harmonisation des dispositions législatives et règlementaires est exclue. Compte tenu des résultats des consultations, évaluations et études, il apparaît que nous devons proposer des mécanismes recentrés sur les actions possédant une réelle valeur ajoutée européenne, et éviter de soutenir des actions de dimension locale ou nationale.sur cette base, nous souhaitons proposer un instrument qui tout en tirant parti de l'expérience passée en matière de coopération culturelle, se présente comme un programme de troisième génération (c'est-à-dire fondant une étape nouvelle par rapport aux programmes sectoriels Kaléidoscope, Ariane, Raphaël, et au programmme cadre Culture 2000) In what way do the options identified respect the subsidiarity and proportionality principles? La valeur ajoutée européenne d'un programme communautaire de soutien financier à des projets de coopération culturelle entre opérateurs européens a été illustrée par les programmes qui se sont succédés depuis 1995 (voir évaluations). Elle a aussi été soulignée par la résolution du Conseil du 19 décembre 2002, relative notamment à la question de la valeur ajoutée européenne dans le domaine culturel. 4. Des impacts positifs sont attendus sur le secteur de l'environnement, à travers le soutien au patrimoine culturel européen. 5. 15 24/09/2003 NEW COMMUNITY PROGRAMME IN LIFELONG LEARNING (EDUCATION AND TRAINING) PRELIMINARY ASSESSMENT STATEMENT 1. Problem identification The proposed programme will provide Community support for transnational cooperation in the field of lifelong learning. It follows up the current Socrates and Leonardo da Vinci programmes which expire in The key changes to the needs addressed by the existing programmes are: The important role of lifelong learning in the European knowledge economy, and specifically its contribution towards achieving the Lisbon target for 2010 and beyond. The increasing importance of a lifelong and lifewide learning perspective at Community level and within Member States. The need to support the Bologna and Copenhagen processes aiming at increased Europeanisation of Member States higher education and vocational education and training systems. Unsustainable trends if the new programme were not to exist: Greater isolation of Member State education and training systems, and their constituent institutions / participants, or restricted links between them, and reduced cooperation / synergy. More incompatibilities between education and training systems, creating obstacles to mobility and cooperation across national borders, hence under-use of the learning opportunities available at European level. Domination by the larger and central Member States and relative isolation of peripheral states. Reduced opportunities for candidate countries to participate in European cooperation projects as part of pre-accession strategy. 2. Objective of the proposal The objectives of the proposal are divided into five: 1. To contribute through lifelong learning to the development of the European Union as an advanced knowledge society, with sustainable economic development, more and better jobs and greater social cohesion. 2. To promote the dimension of active citizenship and European citizenship within and through lifelong learning. 3. To contribute to the development of European education and training systems so that they become a world quality reference. 4. To improve the quality of the opportunities available within Member States for lifelong learning. 5. To facilitate adaptation to industrial changes, in particular through vocational training and retraining, and to improve initial and continuing vocational training in order to facilitate vocational integration and reintegration into the labour market. 3. Policy options The basic approach proposed to reach the objectives is a single framework programme covering education and training, with specific programmes focusing on different aspects of learning and a series of measures focusing on cross-cutting topics. Various alternative designs have been considered. The option selected was judged to respond best to the range of policy and practical developments in education and training within Europe, to be as compatible as possible with existing structures for education and training, and to provide sufficient flexibility to adapt to changes in future needs up to the expiry of the programme in 2013.

16 The principle of subsidiarity is strictly respected, in that the proposal follows closely the requirements of the Treaty (Articles 149 and 150) not to stray into the content of education and training systems, nor to seek to harmonise them. The proposal focuses on the advantages to be achieved through more effective and widespread cooperation in the field between institutions and individuals in the Member States and candidate countries. 4. Impacts positive and negative The main positive impacts of the new programme are expected to be: More extensive and better quality cooperation between education and training systems, institutions and actors in the Community. Increased volume and better quality of mobility of individual learners, teachers and trainers. Development of a European dimension in education and training in the Community. Improved quality of education and training systems and of learning provision, notably of teaching and training. Improved language skills among European citizens. Better adaptation of citizens to social change, notably of workforce to industrial change. Promotion of innovation, economic competitiveness and entrepreneurial spirit. Improved transparency, recognition and portability of qualifications throughout the Community. Promotion of equality between men and women and equal opportunities for disabled persons, and contribution to the fight against racism and xenophobia. Contribution to preparation of candidate countries for accession to the EU. Since the programme focuses on European added value in education and training, and is therefore additional to existing activity, likely negative impacts are necessarily limited. The chief risk is of diversion of effort if the administrative procedures are disproportionately burdensome in relation to the level of funds involved. 5. Follow-up The proposal is based on over 15 years' experience in education and training cooperation programmes at European level, which have been widely and strongly appreciated by those involved in them. It draws strongly on the experience of the past, through an extensive series of in-depth evaluations of different aspects of the existing programmes, through national reports on the implementation of these programmes, and through the experience of the programme administrators at central and at national levels. The proposal also draws on the outcomes of a public consultation on the options for the new generation of programmes, which ran from November 2002 to February The consultation was based around a discussion document which set out a series of 13 key questions. It was open to each citizen and institution in the countries concerned and beyond, in web and paper formats, and produced some 750 responses. A full analysis of the consultation responses is underway and will be published in late An extended impact assessment report will be produced that integrates the ex ante evaluation requirements of the Financial Regulation.

17 23/09/ PROBLEM IDENTIFICATION Nouveau programme en faveur de la jeunesse post 2006 Preliminary Assessment Statement La proposition s'inscrira dans la continuité du programme Jeunesse en l'adaptant au nouveau contexte découlant principalement du processus du Livre Blanc sur la Jeunesse. Le Conseil de Lisbonne a souligné que les systèmes éducatifs doivent offrir des possibilités d'étude et de formation conçues en fonction de groupes cibles et des différentes étapes de la vie, notamment des jeunes. La Déclaration de Laeken de 2001 a précisé notamment que l Union doit répondre en particulier au défi de rapprocher les citoyens, et en premier lieu les jeunes à la réalité européenne et aux institutions européennes. Le processus de Barcelone a déclaré que les futures générations des jeunes doivent être préparées à une coopération plus étroite entre les pays- partenaires euro-méditerranéenes. Le Conseil Jeunesse de mai 2002 a adopté le Cadre de Coopération européenne dans le domaine de la Jeunesse, dont les quatre priorités sont: la participation, l information, le volontariat et une meilleure connaissance de la jeunesse. La Convention européenne a proposé un article spécifique (art. III 182) qui prévoit des actions dans le domaine de la jeunesse et souligne l'importance des échanges des jeunes et des animateurs socioéducatifs ainsi que l'importance de la participation des jeunes à la société. En outre la Convention prévoit également (article III-223 point 5) la création d'un Corps de jeunes volontaires européens d'aide humanitaire. Le soutien aux ONG qui sera couvert par une base légale spécifique en vigueur jusqu'en 2006, sera integré dans la la nouvelle base légale pour le domaine de la jeunesse. Dans le cadre des différents séminaires d évaluation réalisés sur les Actions du Programme jeunesse et ainsi que dans plusieurs groupes de travail au niveau européen il a été mis en évidence la nécessite d'assurer la continuité du Programme, notamment dans les aspects liés à la mobilité, le volontariat, au soutien des animateurs socio-éducatifs, au soutien aux ONG et aux actions dans les pays tiers. En outre l'accent a été mis sur la nécessité d'ajouter un volet permettant la participation citoyenne des jeunes. La nécessité de proposer un nouveau programme dans le domaine de la jeunesse réside dans la portée européenne de celui-ci, les échanges, la mobilité des jeunes, le Service Volontaire Européen, sont des initiatives qui ne peuvent être menées que par l'impulsion donnée au niveau européen. La prise de conscience de la citoyenneté européenne par les jeunes bénéficiaires contribue à la construction européenne, et doit être complétée par davantage de participation active des jeunes dans la société en générale et dans les affaires européennes en particulier. En outre à l'horizon , l'union européenne sera un espace géographique beaucoup plus étendu et diversifié ce qui devrait accentuer la nécessité d'avoir un programme qui permette aux jeunes en général d'acquérir dans un cadre informel des compétences leurs donnant le sentiments d'appartenance à l'europe. 2. OBJECTIVE OF THE PROPOSAL L objectif politique de la proposition visera à mettre en œuvre l art «à favoriser le développement des échanges de jeunes et d animateurs socio-éducatifs ainsi que les priorités définies par le Conseil dans le cadre de coopération européenne dans le nouveau programme.

18 Les objectifs globaux du programme sont les suivants: Promouvoir la citoyenneté active des jeunes; L'impact attendu est que les jeunes participent davantage activement à la vie de leurs société et de la construction européenne en profitant pleinement de leur citoyenneté européenne. Promouvoir la solidarité des jeunes afin de renforcer la cohésion sociale; L'impact attendu est que les jeunes s'engagent en plus grand nombre dans des activités solidaires au niveau européen. Favoriser la compréhension mutuelle des peuples à travers les jeunes, L'impact attendu est que le programme permette le développement d'une société plus tolérante, consciente de sa diversité et ouverte sur la culture des pays en dehors des pays de l'union. Contribuer au développement de systèmes de qualité en soutien aux activités des jeunes; L'impact attendu est de mieux structurer et d'améliorer les systèmes notamment d'améliorer la capacité d'organisation des jeunes. Favoriser la coopération européenne en matière de politiques de jeunesse. L'impact attendu est d'améliorer la mise en réseau entre les différents acteurs du monde de la jeunesse notamment au niveau politique et d'augmenter le dialogue structuré avec les jeunes. 3. POLICY OPTIONS Le projet de base légale répondra aux impératifs politiques dont les principaux éléments sont les suivants: Le programme doit soutenir la coopération politique dans le domaine de la jeunesse, cette volonté ayant été clairement affichée par les Etats membres lors du Conseil éducation jeunesse de mai Les Etats membres ont également mis en exergue la nécessité de préserver la spécificité du domaine de la jeunesse, notamment par le biais d un programme spécifique. Le programme s'inscrit dans le suivi du Livre Blanc adopté par la Commission en novembre 2001 et accueilli favorablement par les E.M en février Les différentes consultations organisées avec les partenaires du monde de la jeunesse ont également insisté sur la nécessité de préserver la spécificité du domaine de la jeunesse et de garantir la continuité du programme actuel avec le nouveau programme en y introduisant les nouveautés émanant du processus du Livre Blanc "un nouvel élan pour la jeunesse". L'approche qui sera retenue pour la structure du nouveau programme dans le domaine de la jeunesse présente un programme spécifique pour la jeunesse. Une des options étudiées était la fusion des domaines de la jeunesse, de l éducation et de la formation. Cette option a été écartée, car elle ne correspondait pas à la nécessité de garantir l'identité du domaine de la jeunesse. La proposition respectera totalement la subsidiarité et le principe de proportionnalité, et le programme sera principalement mis en œuvre par les autorités nationales. Cette approche est en accord avec l'intérêt manifesté par les Etats membres dans le cadre de la coopération européenne dans le domaine de la jeunesse. 4. IMPACT POSITIVE NEGATIVE Les principaux impacts prévus sont : Contribution au développement de la société civile et de la démocratie Contribution au développement des politiques nationales pour la jeunesse Contribution à l'apprentissage inter culturel Amélioration de la participation citoyenne des jeunes

19 Complémentarité avec les politiques nationales de jeunesse Amélioration de la participation du monde de la jeunesse en tant qu'élément de la société civile et la réalisation d une démocratie participative Promotion de l esprit d initiative, de la coopération entre les jeunes et le franchissement des diversités Promotion de la solidarité, la tolérance, de la lutte contre le racisme et la xénophobie En tant que programme promouvant des initiatives pour les jeunes et ayant un impact très bénéfique au niveau social, il n'y a pas d'impact négatif prévu. 5. FOLLOW-UP Le contenu du projet de base légale prendra en compte les résultats de la consultation publique sur la nouvelle génération de programmes réalisée, les études d'impacts du programme Jeunesse réalisés par les Etats membres, et une série de groupes de travail et séminaires ad-hoc avec les acteurs du domaine de la jeunesse. Le projet de base légale prévoira également les mécanismes habituels de suivi ainsi que l'évaluation à mi-parcours et ex-post. Une analyse d impact approfondie sera faite (EIA integrating ex-ante requirements).

PROBLEM IDENTIFICATION Describe the problem that the policy/proposal is expected to tackle: Notre problematique est comment renforcer la compétitivité de l'industrie audiovisuelle européenne. L industrie européenne de l audiovisuel est caractérisée par une forte fragmentation des structures productives/distributives et des marchés encore séparés en territoires nationaux. Cette fragmentation trouve son origine dans l absence d une véritable stratégie d entreprise face à l internationalisation du secteur audiovisuel. Parallèlement, le sous-investissement dans la phase du développement des œuvres aussi bien que dans la phase de la distribution et de l exploitation renforce le manque de compétitivité de l industrie audiovisuelle européenne. Il existe encore des déficits structurels dans ce secteur. Les marchés nationaux européens sont caractérisés par une "double bipolarisation" : La programmation télévisuelle consiste principalement en des œuvres d'origine nationale ou américaine; en règle générale ce sont les œuvres d'origine nationale qui dominent (ceci est expliqué par l application de la directive «télévision sans frontières»); Le cinéma est dominé (à des degrés différents selon les Etats membres) par les films d'origine américaine, les parts marché restantes étant prises principalement par des films d'origine nationale. Dans les deux cas, les œuvres européennes d'origine non-nationale occupent la troisième place, loin derrière les œuvres d'origine nationale ou américaine. La faiblesse de l'europe réside ainsi dans la circulation insuffisante des films et programmes non-nationaux. Face à ces enjeux, les objectifs recherchés restent inchangés: soutenir l'industrie audiovisuelle européenne en termes de croissance et d'emploi, améliorer sa compétitivité aux niveaux européen et mondial, renforcer le marché intérieur de l'union en assurant le maintien et la promotion de la diversité culturelle. 2. OBJECTIVE OF THE PROPOSAL What is the overall policy objective in terms of expected impacts? Assurer la mise en oeuvre de l'article 157 du TCE ; soutenir l'industrie audiovisuelle européenne en termes de croissance et d'emploi, améliorer sa compétitivité aux niveaux européen et mondial, renforcer le marché intérieur de l'union en assurant le maintien et la promotion de la diversité culturelle. La proposition visera à atteindre les objectifs suivants: l'amélioration de la compétitivité du secteur audiovisuel européen, y compris des petites et moyennes entreprises, sur le marché européen et international, en soutenant le développement, la distribution et la promotion des œuvres audiovisuelles européennes, en tenant compte du développement des nouvelles technologies; le renforcement des secteurs qui contribuent à l'amélioration de la circulation transnationale des œuvres européennes; le respect et la promotion de la diversité linguistique et culturelle en Europe;la mise en valeur du patrimoine audiovisuel européen, en particulier sa numérisation et sa mise en réseau; le développement du secteur audiovisuel dans les pays ou les régions à faible capacité de production audiovisuelle et/ou à aire linguistique ou géographique restreinte et le renforcement de la mise en réseau et de la coopération transnationale entre petites et moyennes entreprises; la diffusion de nouveaux types de contenus audiovisuels mettant en œuvre les nouvelles technologies. 3. 21 Une nouvelle génération de programmes destinés au secteur audiovisuel, qui se substituerait à l'actuel programme MEDIA Plus, semble l'instrument le plus approprié. Compte tenu des résultats actuels des consultations, évaluations et études, il apparaît que la meilleure approche consiste en proposer un instrument qui tout en tirant parti de l'expérience passé en matière de soutien du secteur audiovisuel se présente comme un programme de quatrième génération (c'est-à-dire fondant une étape nouvelle par rapport aux programmes précédents, MEDIA I, MEDIA II et MEDIA Plus) In what way do the options identified respect the subsidiarity and proportionality principles? La valeur ajoutée européenne d'un programme communautaire a été illustrée par les programmes qui se sont succédés depuis des années 80 (voir évaluations). La réponse communautaire à la crise du marché européen des programmes audiovisuels date, en effet, de la fin des années 80 et du début des années 90. Alors que se mettait en place le marché unique européen, en cinq ans d activité le Programme MEDIA I ( ) a stimulé la collaboration transnationale parmi les producteurs, les distributeurs et les diffuseurs établis dans les Etats de l Union. Doté d une enveloppe financière plutôt modeste (200 M. d ECU), le Programme MEDIA I a permis aux professionnels des Etats membres de renforcer leur position sur leur marché national et, en même temps, d accéder à des nouvelles formes de collaboration transnationale (coproductions, coopération transfrontalière, partenariats, regroupement d entreprises, etc.).cette approche a continué lors de MEDIA II et MEDIA Plus. 4. Des impacts positifs sont attendus : Pour la compétitivité : le caractère du secteur audiovisuel européen d une Europe élargie impliquera un besoin continue d une stratégie de développement et du renforcement de l industrie. Les industries audiovisuelles des nouveaux Etats membres nécessiteront une stratégie adaptée d encouragement pour améliorer la compétitivité des industries audiovisuelles face à la concurrence mondiale. Pour la croissance et l emploi : Ce secteur est en pleine croissance (cf. fiche C1). Une stratégie visant à renforcer la compétitivité aura un impact important sur la création des emplois dans le secteur ; une partie de cette stratégie consisterait en la formation des professionnels du secteur audiovisuel afin de leur donner les connaissances et les compétences nécessaires, notamment à l égard des nouvelles technologies dont l utilisation deviendront de plus en plus importante. Cette approche aura également des effets positifs pour la création des PMEs dans ce secteur. Pour le gouvernance économique : Une stratégie adaptée de soutien du secteur aidera l établissement d un tissu industriel adéquat, essentiel pour la création d emplois et l établissement d une économie locale fleurissante. Cette stratégie prendrait en compte les besoins spécifiques des pays ou régions à aire linguistique ou géographique restreinte. 5.
