Suivant acte reçu par Me. Dharamraj Pentiah, notaire, les vingt quatre septembre et premier octobre deux mille neuf, enregistré et transcrit au Vol : 7509 No 58, la SOCIETE JHUBOO a vendu à BARACHOIS VILLAS une portion de terrain de la contenance de DEUX CENT QUARANTE SIX MILLE QUATRE CENT QUATORZE METRES CARRES ET QUARANTE CENTIEMES (246,414.40m2), soit CINQUANTE HUIT ARPENTS TRENTE HUIT PERCHES (58A38Ps) située au quartier de la Rivière Noire, lieudit Tamarin (Le Barachois), distraite de la Propriété le Barachois, mentionnée au paragraphe 1 qui précède. Cette vente a eu lieu pour et moyennant le prix principal de CENT SOIXANTE QUINZE MILLIONS CENT QUARANTE MILLE ROUPIES (Rs 175,140,000.) dont le dit acte contient quittance. A cet acte, il a été stipulé ce qui est ci-après littéralement transcrit : Au susdit rapport dudit Monsieur JAMES CHUNG KING SOW, arpenteur juré, il a été fait observer que l accès du terrain serait créé sur la bande de terre (teinte en orange sur le plan annexé) formant partie du surplus de la Propriété le Barachois appartenant à la Société «R.Jhuboo & Cie». La dite société accorderait un droit de passage en faveur de la portion de terrain présentement décrite pour accéder à la Route Publique de Rivière Noire (Rivière Noire Road A3). 3. La SOCIETE JHUBOO a depuis accepté de conférer à BARACHOIS VILLAS une servitude sur une portion de terrain plus étendue que celle sur laquelle le susdit accès à la portion de terrain ci-dessus mentionnée est situé. Annuler le droit d accès conféré comme stipulé en l exposé qui précède, ce qui est expressément accepté par les représentants de BARACHOIS VILLAS ; et 2. Constituer au profit de la portion de terrain de la contenance de DEUX CENT QUARANTE SIX MILLE QUATRE CENT QUATORZE METRES CARRES ET QUARANTE CENTIEMES (246,414.40m2), soit CINQUANTE HUIT ARPENTS TRENTE HUIT PERCHES (58A38Ps) mentionnée en l exposé qui précède, appartenant à BARACHOIS VILLAS suivant titre transcrit au Vol : 7509 No 58, qui sera le fonds dominant, ce qu acceptent les représentants sus nommés de BARACHOIS VILLAS, sur une portion de terrain de la contenance de TROIS MILLE SEPT CENT CINQUANTE ET UN METRES CARRES (3,751m2), tel qu indiqué au plan qui demeure annexé aux présentes après due mention d annexe y faite par le notaire soussigné, et faisant partie de la Propriété le Barachois, mentionnée en l exposé qui précède, qui sera le fonds servant, à titre de servitude perpétuelle et gratuite, un droit de passage pour piétons et véhicules de toutes sortes ainsi que le droit d y faire passer, par voie aérienne ou souterraine, des tuyaux, conduits et autres réseaux pour la fourniture d eau, d électricité de services de communication et autre services et aussi le droit de planter et aménager les abords de la route qui y sera créée. L accès au fonds dominant se fera par le biais d un pont au dessus de la rivière qui sépare le fonds dominant du fonds servant à cet endroit et tel qu indiqué sur le susdit plan. Page 6 of 8

17 La servitude ainsi établie s exercera en tout temps et à toute heure au gré de BARACHOIS VILLAS, par ses représentants, son personnel, ses employés, ouvriers et autres; elle s exercera dans l avenir au gré ses ayants droit et ayants cause, des propriétaires qui lui succèderont et dans les mêmes conditions.- Les frais d aménagement et d entretien de la route et du reste de la portion de terrain objet de la présente servitude, ainsi que du susdit pont, seront exclusivement à la charge de BARACHOIS VILLAS. NOTA: Pour la perception des droits d enregistrement seulement, les parties déclarent évaluer à CENT ROUPIES la servitude ainsi consentie. 25 PROPOSED IRS PROJECT AT TAMARIN BY BARACHOIS VILLAS COMPANY LTD (ENV/12/1376) 1. All other necessary permits/clearances from the relevant authorities including clearance from the Supreme Court and Conservator of Forests for the construction of the proposed bridge and cart path shall be obtained and all the conditions attached therewith shall be scrupulously observed. 2. The development shall be undertaken as per the mitigating measures stated in the EIA report and the additional information submitted, unless as otherwise advised therein. 3. The Department of Environment shall be informed in writing of the date of commencement of works for monitoring purposes. A detailed programme of work shall be submitted to the Department of Environment, Ministry of Environment prior to the start of works. 4. In accordance with section 18(2)(l) of the Environment Protection Act 2002, the proponent shall submit to the Director of Environment, an environmental monitoring plan for approval prior to start of works. The proponent shall thereafter submit reports on the implementation accordingly 5. The proponent shall adopt energy- saving devices and eco- friendly practices such as recycling plants, renewable energy supply (solar energy and photovoltaic cells) and other similar facilities. 6. Appropriate precautionary means shall be incorporated in the design of the development so as to mitigate any risk of flooding along Rivière du Rempart. The buildings and other structures shall be designed to resist the dynamic lateral loads during cyclones and flooding. 7. The promoter insolido with his team of consultants involved in the preparation of the EIA shall be liable for any damage including flooding of the river plain. 1

26 8. The wetland area especially those bordering the Rivière du Rempart shall be protected and maintained. No backfilling of the wetlands shall be allowed. 9. All native plants present in the site shall be well tagged, preserved and maintained through removal of alien invasive species around these plants. No disturbance shall be caused to the migratory birds visiting the site. The use of native plants shall be considered in the landscaping and restoration of the site. 10. The mangrove stand situated on the left bank of the river reserve shall be preserved as mangrove is a protected species under the Fisheries & Marine Resources Act No dredging and excavation shall be allowed in the mangrove area. 11. Desilting works and the removal of the rock impoundment in the pond shall be carried with utmost care so that there are least disturbances to the fauna. The adjoining sites shall be effectively protected against sediment entrainment with geo-textile screen, installed in double layers around the whole dredging site and regularly maintained. There shall be no silt/ mud entrainment in the adjoining Rivière du Rempart. 12. The promoter shall monitor the state of the environment at the pond, Rivière du Rempart, river estuary and Tamarin Bay including the current patterns after the implementation of the project and shall submit reports on same to this Ministry as per the approved environmental monitoring plan. 13. The setbacks of all the infrastructures shall be at least 16m from the Rivière du Rempart and the nearby feeder. The wastewater treatment plant, pumping station/lifting station shall be relocated to observe a setback of 30m from the water courses. 14. Engineering details of the access and works pertaining to the T-Junction on Black River Road A-3 shall be submitted to Road Development Authority for approval prior to start of works. Drainage system to avoid accumulation of surface water at the junction shall be provided. Appropriate traffic and safety measures shall be taken during execution of works. No parking shall be allowed during construction and afterwards along the Road A.3. Directional/Traffic signs and street lighting system 2

27 shall be provided to the satisfaction of the Road Development Authority and Traffic Management and Road Safety Unit. 15. The construction of the bridge and cart path shall not have any negative impact on the feeder and the wetland and shall not impede overflow during rainstorms. 16. If during the implementation of this project, any environmental nuisance or negative impact ensues, the proponent shall accordingly inform this Ministry immediately and shall redress the harm caused at its own cost and to the satisfaction of this Ministry. 17. During the construction phase, the site of works shall be properly fenced and maintained so as to prevent any construction material and debris to have access to the water bodies. 18. No waste of any type shall be allowed to have access directly or indirectly to any water body including the drains. 19. Solid wastes and non-compostable wastes shall be collected and disposed of to the satisfaction of the Local authority. 20. All green wastes shall be composted. 21. All wastewater generated shall be directed to the proposed treatment plant. The promoter shall ensure that the operation and maintenance of the treatment plant are carried out by specialists or a specialist firm. The quality of effluents that emanate from the treatment plant shall not exceed the maximum permissible limits as set for irrigation standards. No untreated wastewater shall be discharged to the environment. Detailed design report and drawing including L-profiles of the disposal system as per the guidelines and format of the Wastewater Management Authority shall be submitted to the Wastewater Management Authority for approval before construction. 22. Appropriate drains shall be provided for the evacuation of storm water so as to avoid flooding of the site and adjoining areas. The design of the entire surface drain network and silt trap/stilling basin including clear indications of low points that is lieu of eventual discharge of water shall be duly signed by a Registered Professional Engineer and shall have the 3

28 prior approval of the Ministry of Public Infrastructure, Land Transport and Shipping and the District Council of Black River. 23. All electric motors such as compressors, pumps, and stand-by generator shall be housed in sound proof enclosures. The noise level shall be within the permissible limits as per the Standards for Noise promulgated under the Environment Protection Act. 24. Necessary measures shall be taken during all the phases of the project, including site preparation, construction and operation so as not to cause any nuisance to the public and surrounding environment. 25. Necessary measures must be taken to prevent any hydrocarbon spills from vehicles and from the stand-by generator and diesel storage tanks to infiltrate through the soil so as to avoid the contamination of the underground and surface waters and eventually the river and lagoon. 26. The refrigerants used in the cold rooms, chilled water systems and airconditioning units shall be ozone-friendly with an Ozone Depleting Potential value of zero. 27. Necessary fire fighting devices shall be made available at all times as per the recommendations of the Government Fire Services 28. The site shall be landscaped properly and ornamental plants and trees shall be planted to upgrade and enhance the aesthetics. The botanical sanctuary shall be properly created and maintained. 29. Detailed elevation plans of the development shall be approved by Black River District Council and the proponent shall provide community benefits as per planning obligations to the full satisfaction of Government. 30. Any proposed deviation shall be subject to an application to the Director of Environment. No deviation or part thereof shall be executed prior to the determination of the application by the Director. 4

41 PROPOSED RESIDENTIAL MORCELLEMENT AT TAMARIN Report of Survey of Terrestrial Flora and Fauna The site is bordered along the northern and western boundaries by Rivière du Rempart and along its southern and eastern boundaries by Rivière du Rempart feeder. Both the river and the feeder open into the Tamarin Estuary. The site consists mainly of a relatively high basaltic plateau with river plains almost surrounding it. The survey was carried out by: walking along the track bordering Rivière du Rempart walking along the track leading to the plateau and the paths opened by the surveyor recording the plants and animals seen or heard. While walking along the tracks, the vegetation on the slopes also was noted. More time was spent in the buildable areas marked Zones 1,2,3,4 & 5 delineated as shown on the layout plan below (Figure 1). Figure 1: Layout Plan 1

42 Flora The vegetation is typical of a degraded lowland savanna where alien invasives of the Fabaceae family are the dominant plant species. A list of the plants recorded is given in annex enclosed at the end of the report. The Pongame (Pongamia pinnata) is the dominant plant species along the river bank with some sparse Eucalyptus blanc (Eucalyptus tereticornis), Bois noir (Albizia lebbeck), Prune Malgache (Flacourtia indica), Poivre marron (Schinus terebinthifolius), Cassie de Manille (Pithecellobium dulce), Cassie ā piquant blancs (Aacacia nilotica) and Lilac (melia azedarach), as shown in Figure 2 below. Figure 2 Vegetation along river bank A few Terminalia arjuna are present in Zone 5 while the Manglier (Rhizophora mocronata) and the Fougère des mares (Acrostichum aureum ) are present in the water and its surroundings in association with Voundre (Typha domingensis) and Herbe siflette (Paspalidium geminatum) which is common in low land marshy area. The riverine plains especially in Zones 4 and 5 consist essentially of grasslands where the Chiendent patte poule (Eleusine indica) and Herbe polisson (Heteropogon contortus) are widespread and predominant. However, in Zone 4 there is a dominance of the Guimauve créole (Waltheria indica) (see Figure 3 below). Figure 3 Guimauve créole bush The Chromolaena odorata, Euphorbia hirta, Herbe tourterelle (Wikstroemia indica), Liane d argent (Argyreia nervosa), Poc poc (Passiflora foetida) and Ipomoea obscura ) are also present among the grasses. Scattered in the grassland in Zone 4 there are a few isolated Eucalptus trees and the Bois sandal (Santalum album) while there are several coconut trees (Cocos nucifera) and young Dattiers (Phoenix dactylifera ) in Zone 5 a shown on Figure 4 below. 2

43 Figure 4 Coconut trees in Zone 5 The most salient feature in Zone 3 is the presence of several old Mango trees (Mangifera indica) planted on either side of a track a shown on Figure 5 below. Figure 5 Mango Trees along track in Zone 3 The vegetation along the slopes is made up mainly of the highly invasive Acacia (Leucaena leucocephala) and the Aloès (Frucraea indica ) with the Tamarinier (Tamarindus indica), Bois Tortue (Morinda citrifolia ), the Piquant sappan (Acacia concinna), the Tecoma stans an invasive which is gaining lot of ground in low land areas. These can be seen in the photographs enclosed in Figures 6and 7 below. Figure 6 Acacia along slopes Figure 7 Tecoma stans The slope in places is covered with Piquants tac-tac as shown in Figure 8 below. 3

44 Figure 8 Piquants tac-tac Around the abandoned thatched roof hut, besides the dominant Guimauve créole and tall Eucalyptus trees the Poivrier marron (Schinus terebinthifolius), the Saponaire (Catharanthus roseus),the pawpaw tree (Carica papaya) and the Ricin (Ricinus communis) have also been recorded. These are shown in Figure 9 below. Figure 9 Guimauve créole with Eucalyptus The ridge supports most of the species recorded in the grassland and slopes except that there are denser bushes of Acacia, Cassie de Manille, a good population of Bois Sandal as shown in Figure 10 below; the Bois pipe (Hilsenbergia petiolaris) and the Vieille Fille (Lantana camara) are relatively more common. 45 Fauna A few landbird species, all introduced, namely the Indian mynah (martin) ( Acridotheres tristis), the Sparrow (moineau) (Passer domesticus), the Red whiskered bulbul (condé) ( Pycnonotus jocusus), the Madagascar Fody (Foudia madagascariensis), the barred ground dove (Geopelia striata) were seen; ring-necked parakeets (Psittacula krameri) were also heard during the walk-through survey. Regarding mammals, one hare, the Black-naped hare (Lepus nigricollis) was sighted. On the invertebrate side, two butterfly species namely the African migrant (Catopselia florella) and the Common leopard (Phalanta phalantha) were seen flying over low bush and near the river. Both butterflies are common widespread species. Assessment and Mitigating measures Most of the plants listed in the study area are introduced plants and most of which are highly invasive. The Bois sandal and Bois pipe which are introduced species, sometimes categorised as native species by some botanists, have colonized the project area and are common in dry lowland areas. The project area, therefore, does not have any plant species of conservation value. All the birds and butterflies encountered are common exotics. The hare, the only mammal recorded, is an introduced species. The animal diversity in terms of conservation value is therefore rated as insignificant to low. The only sensitive area is the river bank. The governing regulations, inter alia the Forests and Reserves Act 1983 governing River Reserves will be strictly followed. However, the bushes of alien invasive plant species could be removed with the permission of the Forestry Services and replaced for example, by the native Bois de reinette ( Dodonaea viscosa ), the endemic Bois à poudre ( Maytenus pyria ) and Baume de l ile plate ( Psiadia viscosa ), the Bois cabri ( Clerodendrum heterophyllum ) which is endemic to Mauritius and Reunion islands and which are known to be good colonisers, being given that they thrive well in this dry and hot environment. Conclusion From the observations recorded in the preceding parts of the report, it can be concluded that the project is not going to have any negative impact on the biodiversity and habitats being given that it will be carried out in an area which has been heavily disturbed by human activities and where exotic species have encroached. On the contrary, taking into account that the highly noxious invasive plant colonies would be controlled and replaced by native species, the habitat will be positively improved and will attract more biodiversity, especially birds and butterflies. 5

125 Environment Protection (Environmental Standards for Noise) Regulations 1997 GN 17/1997 THE ENVIRONMENT PROTECTION ACT 1991 Regulations made by the Minister under sections 36 and 74 of the Environment Protection Act These regulations may be cited as the Environment Protection (Environmental Standards for Noise) Regulations In these regulations- db(a) Leq the equivalent A-weighted sound pressure level measured in decible; "factory" has the same meaning as in section 71 (1)(a) and (b)(i), (ii), (iii), (iv), (v), (vi), (viii), (ix), (x), (xi), (xii) of the Occupational Safety, Health and Welfare Act; industrial noise means noise generated by a factory; (b) "neighbourhood noise" means any noise other than- (a) (b) (c) industrial noise; power station noise; or noise made by an aircraft, an animal or traffic; power station noise" means noise emitted by a station that generates electricity for supply by way of trade. Amended by [GN No. 115 of 2003] 3. The environmental noise standards shall be the standards specified in the Schedule. 4. Regulation 3 shall not, for a period of 2 years, as from the commencement of these regulations, apply to industrial noise if the activity generating such noise has already started at the commencement of these regulations. 5. (1) Noise measurements shall, as far as practicable be effected one metre from the nearest opening of any residential building facing the noise source and at 1.5 metres above the ground or floor level.

126 (2) The measurement methods and equipment used shall be those approved by the enforcing agency. 6.
