1 1 TERMS AND CONDITIONS I. Interpretation/Subject of the contract The following conditions shall apply to the contractual relationship between Kunjani Student Placement Agency CC (referred to hereafter as Kunjani, we, us and our ) and the individual applying for a placement through Kunjani (referred to hereafter as you, applicant and your ). The ensuing contract is binding on the applicant upon registration. The content of the contract is related to the services offered by Kunjani, which can be viewed on Other meanings: Placement means the procurement of an internship post by Kunjani for the Trainee/Volunteer with a suitable organization Internship means the voluntary work or internship at the organization where you will be volunteering and in which you are placed. Organization means the specific company or establishment where you do your volunteer work or internship and includes all people within the control of that organization. By transacting with us via our website and / or signing this agreement you agree to be bound by these conditions. II. Services offered i. Upon successful registration, the applicant is entitled to make use of the extensive services provided by Kunjani, which can be viewed online. ii. Kunjani reserves the right to change or amend the contents of the service package at short-notice. iii. Kunjani is entitled to accept an offer to procure a placement for an applicant. III. Additional procured services i. Contracts, entered into by you and a third party, which are facilitated by Kunjani (for example: accommodation, car rental, ), are exclusively between you and the third party suggested by Kunjani. ii. Kunjani will not be liable for any losses, damages or harm suffered by you in respect of or regarding the services of the third party suggested or arising

2 2 from any contract between you and such third party. IV. Internship agreement The relationship between you and the organization with which you will be doing your internship is regulated by a separate contract (internship agreement). V. Placement i. After the receipt of your completed registration application, the procedure of procurement is started by Kunjani and will continue for a period for no longer than 12 weeks. ii. The procurement of an internship is guaranteed by your acceptance of the offer by the organization. If you refuse the first offer of internship, the procedure of procurement may be restarted after consultation about the reasons for the refusal. iii. If the application is received by Kunjani less than 12 weeks before the internship starts, Kunjani will try to finish the procedure of procurement within that time period. There is however no guarantee that placement will take place in these circumstances. VI. Due date, payment and rescission internship i. Kunjani will obtain an oral confirmation for the placement of the Trainee/Volunteer from the host organization, oral confirmation of an accommodation offer that Kunjani considers suitable for the Trainee/Volunteer if required, and shall secure a language school course if required. Once you have accepted an internship offered by Kunjani you will receive the internship agreement between you and the organization for signature. ii. On signed receipt of the internship agreement by the applicant and host company / organization, the placement fee, being 450 euros, will be payable by you to Kunjani. iii. On receipt of your payment in the predetermined Kunjani account, the internship agreement between yourself and host company will be validated and will be legal and binding. iv. Should you unilaterally decide to resile from the internship agreement 20 days or more before the start date of internship, you will be liable for and forfeit an administrative fee of 225 euros to us. The balance of 225 euros will be refunded to you. v. Should you unilaterally decide to resile from the agreement within 20 days of the start of the internship (or after), you will forfeit the full amount of 450 euros. VII. Change of internship place i. Kunjani is serving an exact procurement. ii. In the event that the internship is not up to the standard that is agreed in the internship agreement, we are willing to arbitrate between the parties. iii. Generally it is not possible to change the place of internship. However, in the case that the parties do not come to a conclusion and the internship cannot be maintained, Kunjani will assist in a change of placement at its discretion.

3 3 VIII. Disclaimer of warranty and liability i. Kunjani incurs liability only in the event of intent or gross negligence in the performance of our duties and obligations in terms of the agreement. ii. Kunjani does not warrant or guarantee that the student will be placed in an internship or obtain accommodation, a visa or any other requirement whatsoever in respect of his/her stay or work/internship in South Africa. Kunjani shall especially not be liable or responsible towards the Trainee/Volunteer for the issue of a Visa, any difficulties whatsoever arising from residency in South Africa, travel to or from South Africa, approval of career advancement, and the extent of insurance benefit. [To ensure a correct Visa application, it is necessary to start the application procedure no later than 8 weeks before the accession of the internship. If an adequate insurance coverage does not exist, Kunjani is not liable for any claim] iii. Kunjani shall not be liable for any damages and/or injuries whatsoever that may be suffered by the Trainee/Volunteer which are caused by a third party, especially by traffic and general life risks. The Trainee/Volunteer will be liable to any third party, including the organization, in respect of any contractual or delictual liability and/or claim whatsoever and howsoever arising, and the Trainee/Volunteer hereby indemnifies Kunjani in respect of any such claim and/or liability. iv. Kunjani will not be liable towards the Trainee/Volunteer in respect of the cancellation of the internship contract with the organization. In such an event will use its best endeavours to procure an alternative placement of the Trainee/ Volunteer at an additional charge of 100 euros. Kunjani IX. Place of jurisdiction and applicable law The business relations shall be exclusively subject to the laws of the Republic of South Africa. The place of jurisdiction shall therefore be within the republic of South Africa. X. Severability cause In the event that any term or condition hereof should be or become invalid, this shall not affect the validity of the remaining terms or condition. Interprétation - Objet du contrat Les conditions suivantes s appliqueront à l accord contractuel entre Kunjani Student Placement Agency CC (ci-après désigné par Kunjani, nous, et notre ) et la personne demandant un placement via Kunjani (ci-après désignée par vous, candidat, bénévole et votre ). Les conditions suivantes constituent un contrat légal à force obligatoire dès votre inscription. La nature du contrat est liée aux services offerts par Kunjani qui sont décrits sur Autres précisions: Placement : désigne l offre par Kunjani d un stage, d un travail bénévole ou d un internat auprès d une organisation appropriée, Stage : désigne le travail bénévole ou internat auprès de l organisation où vous serez placé. Organisation : désigne la compagnie ou institution spécifique où vous effectuerez votre stage bénévole ou votre internat et inclut toutes les personnes au sein de cette organisation. En effectuant une transaction sur le site et/ ou en signant cet accord, vous acceptez les conditions d utilisation définies ci-après. XII. Services offerts i. Après une inscription réussie, le candidat jouira de la totalité des services offerts par Kunjani, qui peuvent être vus sur le site web. ii. Kunjani se réserve le droit de modifier ou d amender le contenu de l ensemble de ses services à court-terme. iii. Kunjani a le droit d accepter un poste afin d offrir un placement à un candidat. XIII. Services supplémentaires offerts i. Tout contrat facilité par Kunjani entre vous et un tiers (par exemple : logement, location de voiture, ) est exclusivement entre vous et le tiers suggéré par Kunjani. ii. Kunjani ne sera pas responsable pour quelque perte, dommage ou blessure que ce soit, subi(e) par vous lors de l utilisation des services du tiers suggéré ou bien découlant d un quelconque contrat entre vous et ce tiers.

5 5 XIV. Convention de stage La relation entre vous et l organisation dans laquelle vous ferez votre stage est régulée par un contrat distinct (une convention de stage). XV. Placement i. Après réception de votre dossier d inscription complet, la procédure de placement est lancée par Kunjani, pour une période qui ne dépassera pas 12 semaines. ii. Un stage est garanti par votre acceptation d un stage offert par une organisation. Si vous refusez la première offre, la procédure de placement pourra être relancée après discussion sur la raison de votre refus. iii. Si votre candidature est reçue par Kunjani moins de 12 semaines avant le début du stage, Kunjani s efforcera de conclure la procédure de placement pendant cette période. Toutefois, Kunjani ne peut garantir que le placement sera possible dans ces circonstances. XVI. Date de paiement, paiement et annulation stage i. Kunjani obtiendra une confirmation orale pour le placement du stagiaire/ bénévole auprès de l organisation d accueil, et aussi la confirmation orale d une offre de logement que Kunjani considère comme approprié au stagiaire/bénévole si cela est requis. Kunjani pourra arranger des cours en école de langue si nécessaire. Une fois que vous aurez accepté l offre de stage de Kunjani, vous recevrez pour signature la convention de stage entre vous et la compagnie. ii. Les frais de placement de 450 euros pour les services de Kunjani seront dus dès réception de la convention de stage signée entre candidat et organisation d accueil. iii. A réception de votre paiement sur le compte de Kunjani, la convention de stage entre vous-même et l organisation d accueil sera validée et deviendra légale et liante. iv. Dans le cas où vous décidiez unilatéralement de résilier l accord conclu 20 jours ou plus avant le début du stage, vous resterez redevable de frais administratifs d un montant de 225 euros. Les 225 euros restants vous seront remboursés. v. Dans le cas où vous décidiez unilatéralement de résilier l accord conclu à moins de 20 jours du début du stage, vous resterez redevable de la totalité de votre règlement, à savoir 450 euros. XVII. Changement de stage i. Kunjani vous propose une offre de stage précise. ii. Dans le cas où le stage n est pas du niveau déterminé par la convention de stage, nous acceptons de servir d arbitre entre les parties. iii. En général, il est impossible de changer de lieu de stage. Toutefois, dans le cas où les parties ne peuvent atteindre une solution et que le stage ne peut être continué, Kunjani se réserve le droit de choisir d offrir son assistance pour un changement de stage. XVIII. Responsabilités i. Kunjani ne pourra être tenu responsable que dans les cas où nous serions coupables de grave négligence dans l exécution de nos devoirs et obligations liés au contrat.

Kunjani ne garantit nullement que le candidat obtiendra une place de stage, un logement, un visa ou un autre élément essentiel de son séjour ou de son stage/ bénévolat en Afrique du Sud. En particulier, Kunjani ne sera pas tenu responsable de la non-obtention d un visa de séjour pour le candidat/ bénévole, de difficultés quelles qu elles soient qui pourraient découler de sa résidence temporaire en Afrique du Sud, de son voyage vers et de l Afrique du Sud, de son avancement professionnel et de l étendue de sa couverture d assurance. [Afin d obtenir un titre de séjour valable, il est nécessaire de lancer la procédure au moins 8 semaines avant le début du stage. Si le candidat n a pas d assurance maladie/ voyage adéquate, Kunjani ne pourra en aucun cas être tenu pour responsable en cas de réclamations] Kunjani ne sera pas tenu pour responsable de quelque dommage et/ou blessure que ce soit au candidat/ bénévole et causé par un tiers, en particulier dans le cas d un accident de la circulation et des risques de la vie en général. Le candidat/ bénévole sera responsable devant un tiers, y compris son organisation d accueil, d un manquement contractuel ou d un délit et/ ou d une plainte dans quelque circonstance que ce soit, et le candidat/ bénévole décharge par la présente Kunjani d une plainte quelconque et/ou d une faute. Kunjani ne sera pas responsable envers le candidat/ bénévole en cas d annulation du stage par l organisation d accueil. Dans l éventualité d un tel évènement, Kunjani fera de son mieux pour offrir un stage de remplacement au candidat/ bénévole pour un montant de 100 euros supplémentaires. XIX. Lieu de juridiction et loi applicable Les relations d affaires seront soumises exclusivement aux lois de la République d Afrique du Sud. Le lieu de juridiction sera donc le sein de la République d Afrique du Sud. XX. Cause de rupture Si un ou plusieurs termes ou conditions sont ou deviennent nuls, la validité des autres termes ou conditions n en est pas affectée. XXI. Traduction Cette traduction n est donnée qu à titre indicatif et n a pas de valeur légale.
