To facilitate, through an international transfer program, the repatriation of offenders found guilty of criminal offences. FOREIGN NATIONALS 2. Foreign national inmates within the jurisdiction of the Service are entitled to all the rights, privileges and amenities afforded to all offenders. In addition, they are entitled to contact with their consular representatives and they may have access to the international transfer program. LIMITATION 3. International transfers may be carried out only between and the countries (specified in Annex "A") with which a valid transfer of offenders agreement exists. PROCESSING OF APPLICATIONS 4. All applications for transfer shall be processed individually, without delay and on an ongoing basis by the Service. 5. An application may be withdrawn as set out in Annex "B". OBJECTIF DE LA POLITIQUE 1. Faciliter, grâce à un programme de transfèrements internationaux, le rapatriement des délinquants qui ont été reconnus coupables d'infractions criminelles. As soon as possible upon admission, every offender whose country of citizenship has a valid transfer of offenders agreement with shall be informed of the substance of the agreement and of the Transfer of Offenders Act and Regulations. 7. Every transfer shall be initiated by a written application submitted by the offender to the Solicitor General of, through the operational unit. TRANSFERS FROM CANADA - RESPONSIBILITIES 8. Operational units shall be responsible for ensuring that: a. the documentation requirements, the Transfer of Offenders Act and relevant transfer agreement (and memorandum of understanding, where applicable) as specified in Annex "C" are adhered to; b. any pertinent information of a sensitive nature not normally contained in a. above is included; and c. the duly completed application and supporting documentation, signed by the head of the operational unit, or delegate, are transmitted to the appropriate Regional Headquarters. 9. It shall be the responsibility of the appropriate Regional Headquarters to: a. coordinate all applications for transfer including those of offenders under provincial and territorial jurisdictions; TRANSFÈREMENTS HORS DU CANADA 6. It shall be the responsibility of National Headquarters to: a. prepare a ministerial submission and present it to the Solicitor General for decision; b. advise the foreign state of the Solicitor General's decision; c. where appropriate, transmit the application package and the Solicitor General's approval to the foreign state; d. advise the applicant, in writing, of the consequences of a transfer from, including the manner in which his or her sentence would be administered in his or her country of citizenship upon receipt of a statement to that effect from the foreign state; e. request that the applicant, having reviewed the consequences of the transfer, as stated in d. above, reiterate in writing his or her consent to transfer; and b. d'assurer la qualité et l'intégralité des documents de demande et d'appui; et c. de transmettre à l'administration centrale les documents de demande signés par le sous-commissaire de la région ou son délégué. 10. Upon receipt of an application for transfer to, National Headquarters shall ensure that: a. the quality and completeness of the application and supporting documentation conform to the requirements of the Transfer of Offenders Act and relevant transfer agreement; b. the offence for which the offender has been convicted constitutes a criminal offence in, or would constitute a criminal offence if committed in ; c. the sentence is one that can be administered under the laws and procedures of, including the application of any provision for reduction of the term of confinement by parole, mandatory supervision or otherwise; d. the applicant's criminal history is brought to the attention of interested parties; e. the applicant's eventual reintegration into Canadian society is assessed (by the completion of a community assessment); f. de demander l'accord de l'état étranger sur le transfèrement. Regional Headquarters shall ensure and coordinate the provision of information from operational units (as required in e., g. and h. above) for transmittal to National Headquarters. 13. Once an application for transfer has been completely processed, National Headquarters shall: a. prepare a ministerial submission and present it to the Solicitor General for final decision; b. advise the foreign state of 's decision and, where appropriate, of the manner in which the applicant's sentence would be administered in ; and c. advise the applicant of 's decision and, where appropriate, of the manner in which his or her sentence would be administered in, with a request that his or her consent to the transfer be reiterated in writing. f. que la citoyenneté du demandeur est vérifiée et confirmée; g. s'il y a lieu, qu'une autorisation provinciale est demandée; et h. que toute autre mesure jugée nécessaire est prise (par les unités opérationnelles) pour se conformer aux exigences de chaque cas. 12. Notwithstanding the foregoing, for administrative purposes, consent may not be withdrawn: Bolivia, Mexico, Peru a. upon the dispatch of escort personnel to effect an offender's transfer. United States b. when reiterated by an offender in writing, before a magistrate and in the presence of an attorney. France c. upon an offender's submission of such in writing to either state. Austria, Cyprus, Denmark, Finland, Greece, Luxembourg, Netherlands, Spain, Sweden, Switzerland, Turkey, United Kingdom d. upon verification of such by a designated official. 11 Date Annex/e C 542 Page: 1 of/de 3 INTERNATIONAL TRANSFERS TRANSFÈREMENTS INTERNATIONAUX DOCUMENTATION REQUIREMENTS FOR THE TRANSFER OF FOREIGN OFFENDERS FROM CANADA. BASIC INFORMATION A transfer application package shall be comprised of the information (and specific documents where applicable) as set out below: a. A duly completed application for transfer, that is, Schedule I, Transfer of Offenders Regulations. b. Personal data: full name (including maiden name), aliases, ethnic origin, appearance (photograph, height, weight, and other identifying features); copy of fingerprints; date and place of birth; address in country of citizenship. c. Family data: name, address and relationship of family members and close relatives in the receiving country. d. Citizenship data: evidence of foreign citizenship (birth certificate, citizenship certificate and the like); passport number if available. e. Case history: family and social background, criminal history (FPS), medical summary (medical and psychiatric needs), institutional adjustment, security requirements, and future correctional needs. DOCUMENTS REQUIS POUR LE TRANSFÈREMENT DE DÉLINQUANTS ÉTRANGERS HORS DU CANADA RENSEIGNEMENTS FONDAMENTAUX Une demande de transfèrement doit fournir les renseignements indiqués ci-après (et les documents précis, s'il y a lieu). a. Données sur la citoyenneté: preuve de la citoyenneté étrangère (certificat de naissance, certificat de citoyenneté et documents semblables); numéro du passeport, si possible. e. Antécédents: antécédents familiaux, sociaux et criminels (SED); information d'ordre médical (besoins sur les plans médical et psychiatrique); adaptation au milieu carcéral; exigences en matière de sécurité et besoins futurs sur le plan correctionnel.

Offence data: the nature and circumstances of the offence(s); the name of the investigating police agency; a police report where available; in drug related offences, provide details as to the nature, quantity and value. g. Sentence data: detailed sentence computation, that is, form CSC 353 entitled "Sentence Administration Data for Offenders Transferred from "; reasons for sentencing; where available a statement of the facts upon which the sentence was based; the court through which the offender was convicted. h. A certified true copy of the warrant(s) of committal. i. Confirmation that the judgement is final, in other words, that the appeal period has expired and that no appeal or other proceedings are pending. j. Confirmation that there are no outstanding charges nor any other police interest. ADDITIONAL INFORMATION In addition to the basic information requirements, a transfer application package shall include any information and/or document specifically required by individual countries listed below: f. Confirmation qu'il n'y a aucune accusation en instance ni aucun autre intérêt policier. RENSEIGNEMENTS SUPPLÉMENTAIRES Toute demande de transfèrement doit comprendre, en plus des renseignements fondamentaux requis, les renseignements ou documents exigés par chaque pays, soit:
