12 PHELPS DODGE CONGO SPRL (PDC): PROJET PROPOSE DE KISANFU ETUDE D IMPACT ENVIRONNEMENTAL ET SOCIAL (EIES) ET PLAN DE GESTION ENVIRONNEMENTAL DU PROJET (PGEP) Document d information de Base et Invitation à commenter (Disponible en Anglais, Français et Swahili) INTRODUCTION Phelps Dodge Congo SPRL (PDC) détient un Permis de Recherche PR 815 (3,738 hectares), situé à environ 40 km à l Est de Kolwezi dans la Province du Katanga en République Démocratique du Congo (RDC). PDC propose d exploiter une mine et d installer les infrastructures requises pour le développement du gisement de cuivre et de cobalt (Projet de Kisanfu) et ceci exige un Permis d Exploitation. PDC a demandé à SRK Consulting (SRK), une compagnie de consultance environnementale et sociale indépendante, de mener l Etude d Impact Environnemental et Social (EIES) et d élaborer un Plan de Gestion Environnemental du Projet (PGEP). L EIES et le PGEP répondront aux exigences légales de la RDC, aux standards internationaux et à la politique environnementale et sociale de Freeport-McMoRan Copper & Gold. Les étapes de l EIES incluront le processus de consultation des parties prenantes où ces dernières seront identifiées et où il leur sera donné l opportunité de présenter leurs préoccupations, commentaires et suggestions sur le projet proposé de la mine de Kisanfu et le processus de l EIES. Freeport-McMoRan Copper & Gold (FCX) est la plus grande entreprise de cuivre cotée en bourse dans le monde. Ces activités minières sont centrées sur le cuivre, le cobalt, le molybdène et l or. Phelps Dodge Congo SPRL, une filiale de FCX, est une société congolaise qui a été créée le 26 Juin % de ses parts appartiennent à Freeport-McMoRan Exploration Corporation et 1% à Freeport-McMoRan Corporation. Le projet proposé de Kisanfu est détenu à 100% et sera développé par PDC. SRK Consulting (SRK) est une firme internationale et indépendante de consultance en Ingénierie et Environnement avec plus de 40 bureaux incluant celui de l Afrique du Sud et de la RDC (Lubumbashi). Le but de ce document d information de base est d informer les parties prenantes au sujet: Du projet proposé de Kisanfu; Du processus de l EIES et PGEP; De comment exprimer les commentaires sur le projet d EIES et PGEP. LE BUT DE CE DOCUMENT Si vous pensez que le projet proposé de Kisanfu peut d une façon ou d autre affecter votre vie ou peut vous intéresser, vous êtes donc une partie prenante dans l EIES. 1 Ce document fait partie des Termes de Référence. La 1 ère phase de l EIES est de présenter l opportunité aux parties prenantes de commenter sur le projet proposé. D autres opportunités seront offertes au cours du processus de l EIES et PGEP.

13 EMPLACEMENT DU PROJET Le projet proposé de Kisanfu est localisé dans la Province du Katanga, au Sud de la RDC, à environ 40 km à l Est de Kolwezi et 25 km de Tenke. Les villages situés dans et aux environs du projet proposé de Kisanfu sont: Kisanfu Gare, Kisanfu Koni, Mayeba, Adek, les villages pratiquant la pêche: Dikanda, Katontoka, Kawala et Mambo Kavula, et enfin Kawama composé de creuseurs artisanaux. Le village Mayeba est le village le plus proche des limites du Permis de Recherche, alors que Adek est situé à l intérieur du périmètre de la concession. L emplacement de la concession et des villages environnants sont présentés dans la Figure 1. Plusieurs sociétés minières opèrent dans les environs de la concession de Kisanfu. Les deux mines les plus proches de la concession, situées à l Ouest du projet, sont Kisanfu Mining PE661 (KIMIN) et La Minière de Kalumbwe-Myunga PE657 (MKM). La zone d étude est drainée par la Rivière Kisanfu qui coule vers le Sud à travers la concession. Une large zone marécageuse et de végétation existe le long des rivières Kando et Kisanfu. 14 DESCRIPTION DU PROJET Pour le développement initial du Projet proposé de Kisanfu, PDC envisage actuellement deux options. Ces deux options envisagées consistent au développement d une mine à ciel ouvert à l Est de la rivière Kisanfu, et ont en commun les aspects suivants. Ils: Traiteront approximativement 10 millions de tonnes de minerais durant la vie de la mine. Auront une durée de vie pour la mine d environ 7 à 10 ans suivant le taux de traitement du minerai choisi. Exigeront différents degrés de concentration des minéraux sur site. La différence entre ces deux options est présentée cidessous: Option 1: Cette option comprend une usine d enrichissement gravimétrique par liqueur dense (DMS). Les concentrés produits dans l usine seront ensuite traités hors du site dans des usines de traitement métallurgique au Katanga. Il est prévu la construction d un site à rejets miniers comprenant les stériles et des minerais à faible teneur pour un traitement minéralurgique futur. Option 2: Les minerais extraits pour cette option seront traités hors du site dans des usines se trouvant au Katanga. Il est prévu uniquement la construction d un remblai à stérile. COMPOSANT DU PROJECT PROPOSÉ Quelle est la relation entre Kisanfu et Tenke Fungurume Mining? Kisanfu et Tenke Fungurume Mining sont des projets différents avec des entités juridiques et des associés distincts. Kisanfu sera régit sous le Code Minier de la RDC tandis que TFM opère sous la Convention Minière Amendée et revue. Kisanfu est détenu à 100% par FCX ou ses filiales. Si un Permis d Exploitation est octroyé au Projet proposé de Kisanfu, le gouvernement de la RDC participera dans le projet comme l exige le Code Minier de la RDC. TFM est détenu à 80% par TF Holdings, et 20% par l état Congolais à travers la Gécamines. De l autre coté, TF Holdings est détenu à 70% par FCX ou ses filiales et a 30% par Lundin Mining Corporation ou ses filiales. Possibilités à long-terme Des possibilités à long terme existent, mais des études de faisabilité approfondies sont exigées. Méthode d exploitation minière: Mine à ciel ouvert utilisant principalement des méthodes traditionnelles avec des engins de surface à propulsion diesel, et des engins de chargement/ transport conventionnels si nécessaire. Certains dynamitages seront utilisées dans les sections où la roche minéralisée est la plus dure. Usine de traitement: Pour l Option 1, le minerai sera traité dans une usine d enrichissement (DMS) où les minerais de cuivre seront concentrés jusqu'à 25% et ou les concentrations de cobalt seront variable. Pour l Option 2, le minerai sera traité en dehors du site. Entreposage des rejets miniers Option 1: les stériles produits lors de l extraction du minerai et les rejets provenant de l usine de traitement seront entreposés sur site dans une zone à rejets miniers. Les stériles seront transportés par camion pendant que les rejets seront pompés par une tuyauterie. Option 2: les stériles seront stockés uniquement dans les remblais à stérile. Rejets de l usine: Les rejets seront constitués de résidus provenant de la roche minéralisée après extraction du métal recherché (ex. Cuivre). Les rejets peuvent dans le futur être retraités. IL EST TRÈS IMPORTANT DE NOTER QUE LES DÉTAILS DE LA DESCRIPTION DU PROJET PEUVENT CHANGER AVEC L ÉVOLUTION DE L ÉTUDE DE FAISABILITE DU PROJET. 3

15 C est quoi un minerai? Toute roche contenant un ou plusieurs mineraux, en particulier un métal, qui peut être économiquement exploités ou extraits. Les minerais métalliques sont généralement des oxydes, des sulfures, des silicates ou un métal natif (Ex. Cuivre natif). A ce stade, le projet proposé de Kisanfu n exploitera qu une portion de la matière minéralisée. Carrière: Une carrière possiblement située à l Ouest de la concession sera utilisée pour les matériaux de construction, pour les routes et autres infrastructures du projet. Electricité: l Electricité pour ce projet proviendra initialement des générateurs à diesel installés sur site et plus tard de la SNEL. La construction d une ligne électrique et d une station de distribution sera nécessaire. Voie d accès et transport: L accès principal au site se fera par le Nord sur une route de 15 km rejoignant la nationale N39. D autres voies d accès seront nécessaires sur site. Approvisionnement en Eau: L eau pour la mine et l usine de traitement (pour l option 1) proviendra de forages profonds et du système d'assèchement de la mine. L excédent en eau sera déversé dans les eaux de surfaces après qu elles soient traitées, si nécessaire, selon les exigences de la RDC et des standards internationaux. Kisanfu est une zone vierge (ce qui signifie que cette zone est encore inexploitée) et est assez eloigné des infrastructures existantes. Ceci exigera donc un investissement conséquent en infrastructure. Unité de traitement des eaux usées: Une usine de traitement des eaux usées sera construite dans le site minier pour traiter les eaux usées générées sur le site. Elimination des déchets: Les déchets domestiques et industriels seront éliminés des sites d'enfouissement dédiés. Les options d élimination des déchets dangereux seront étudiées en incluant les options sur site et hors site. Bassins de contrôle des eaux de ruissellement: Des bassins de contrôle des eaux de ruissellement seront utilisés pour gérer les contacts des eaux (l eau qui entre en contact avec les infrastructures de la mine, l usine et autres zones de la mine). Camp de la mine: Un camp sera construit pour la phase de construction et d exploitation du Projet. Autres infrastructures exigées: Bâtiment administratif; Entrepôts et magasins; Aire de stockage des minerais à faible teneur; Tuyauterie pour les rejets (option 1); Grillage de sécurité autour du site minier. Emploi: Pour l Option 1: Il est prévu lors de la phase de construction de l'usine qu il y aura environ 200 emplois temporaires. Une fois l'usine en fonction, cela permettra de créer 100 emplois permanents. Pour les Options 1 et 2: La mine emploiera environ 400 personnes au cours de la découverture. Le même nombre de personnes sera nécessaire pour exploiter la mine une fois que l extraction des minerais débutera. Le démarrage de la construction est prévu avant La première production est attendue avant ETUDES DÉJÀ FAITES SRK a réalisé des études environnementales et sociales pour le compte de PDC sur le projet Kisanfu au mois de Mars Ces études initiales ont déterminé les besoins futurs en études spécialisées concernant l évaluation des impacts environnementaux et sociaux, ainsi que sur le Plan de Gestion pour la continuité du Projet. PDC a aussi réalisé un audit annuel de son Plan d Atténuation et de Réhabilitation Environnemental pour son permis de recherche accordé en 2004 par le Gouvernement Congolais. PROCESSUS DE L EIES ET PGEP L EIES et le PGEP sont réalisés dans le but de s assurer que les conséquences environnementales et sociales du projet sont bien identifiées et que des plans sont mis en place par le promoteur pour gérer adéquatement les impacts. L EIES et le PGEP apporter une contribution précieuse aux décisions de planification du projet à la fois pour le développeur et les autorités. L EIES et PGEP du projet proposé de Kisanfu se conformeront: 4

16 Aux exigences légales de la RDC (Code Minier et Règlement Miner); Aux standards Internationaux de bonne pratique (IFC Performance Standards et Principe de l Equateur); et Aux politiques environnementales et sociales de FCX. ENGAGEMENT DES PARTIES PRENANTES L engagement des parties prenantes fait partie intégrale du processus de l EIES. Ce processus identifie les parties prenantes et leur donne l opportunité de donner leurs points de vue concernant le projet. Les commentaires et suggestions soulevés par les parties prenantes guident les études de l EIES ainsi que les prises de décisions. SRK planifie de réaliser deux séries de consultations. La troisième série interviendra après que le gouvernement ait pris sa décision sur l octroi du permis d Exploitation. Les parties prenantes sont encouragées à participer aux réunions et présenter leurs questions et préoccupations sur le projet proposé. Le tableau à la page 6 représente le processus de l EIES et PGEP, montrant les principales activités et l échéancier qui seront repris durant le processus de consultation des parties prenantes. ETUDES SPECIALISÉES Dans le cadre du processus de L EIES et PGEP, les spécialistes seront tenus de mettre à jours leurs précédentes études initiales, ainsi que de procéder à une évaluation des impacts. Les études spécialisées à inclure dans L EIES et PGEP se présentent comme suit: Climat, qualité de l air et gaz à effet de serre Eaux de surface et souterraine Géochimie Fermeture de la mine Sols et capacité du sol Ecologie aquatique et terrestre Bruits Transport Caractère visuel Socio-économie Archéologie et heritage Culturel IMPACTS POTENTIELS Le Projet proposé de Kisanfu peut avoir des impacts positifs et négatifs immédiat sur l environnement et les populations. Les impacts positifs potentiels incluent: Opportunité de développement économique dans la contrée et la région; Mise en oeuvre continue de projets de développement communautaire; Amélioration continue des infrastructures; Stimuler l'économie locale et régionale via les taxes payées par la mine; et Opportunité d emploi. Les impacts négatifs potentiels incluent: Augmentation de la poussière et du bruit provenant des activités minières et du transport; Perte de sol et terre agricole; Perte de la flore et de la faune; Changement dans l accès et la qualité de l eau; et Possible réinstallation des communautés. PDC proposes to establish a mine and associated infrastructure to mine the Kisanfu copper/cobalt deposit (Kisanfu Project or Project), and this will require a Mining Exploitation License. PDC has appointed SRK Consulting (SRK) as the independent consultant to undertake an Environmental Impact Study (EIS) and compile an Environmental Management Plan of the Project (EMPP). The EIS and EMPP will satisfy DRC legal requirements, international good practice standards and Freeport-McMoRan Copper & Gold environmental and social policies. The EIS process also includes a stakeholder engagement process, where stakeholders will be identified and given opportunities to raise their concerns, comments and make suggestions on the proposed Kisanfu Mine and EIS process. 20 PROJECT LOCATION The proposed Kisanfu Project is located in the Katanga Province, southern DRC, about 40km east of Kolwezi and 25 km from the town of Tenke. Villages close to the proposed Kisanfu Project include: Kisanfu Gare, Kisanfu Koni, Mayeba, Adek and the fishing villages: Dikanda, Katontoka, Kawala and Mambo Kuvula, as well as the artisanal mining camp Kawama. Mayeba Village is the closest village to the exploration license boundary, while Adek is situated within the license boundary. The location of the Kisanfu exploration license and nearby villages is shown in Figure 1. A number of mines have been established in the areas surrounding the proposed Project. The two closest mines located to the west of the Project are the CuCo Resources Kisanfu Mine PE661 (KIMIN) and the Miniére de Kalumbwe-Myunga Mine PE657 (MKM). The study area is drained by the Kisanfu River which flows southwards across the license boundary. A large area of wetland and riparian vegetation occurs along the Kisanfu and Kando Rivers. 21 PROJECT DESCRIPTION PDC is currently considering two options for the initial development of the proposed Kisanfu Project. These two options both consist of the development of an open pit mine to the east of the Kisanfu River, and have the following aspects in common. They: Will treat approximately 10 million tons of ore over the life of mine. Have a life of mine (LOM) of 7-10 years depending on the treatment rate eventually selected. Will require different degrees of mineral processing on site. The main differences between the two options are set out below: Option 1: This option has a Dense Media Separator (DMS) plant. Concentrate produced in the DMS plant will be processed off site at established processing plants in Katanga. It requires construction of a co-disposal facility for waste rock and reject material and a low grade stockpile for potential future processing. Option 2: The ore produced from this option will be processed off site at established processing plants in Katanga. It requires construction of a waste rock dump only. What is the relationship between Kisanfu and Tenke Fungurume Mining? Kisanfu and Tenke Fungurume Mining are separate projects with different legal entities and shareholders. Kisanfu will be governed under the DRC Mining Code, while TFM operates under its Amended and Restated Mining Convention. Kisanfu is 100% owned by FCX or its subsidiaries. If a Mining License is granted for the proposed Kisanfu Project, the DRC Government will also participate in the project per the DRC Mining Code. TFM is owned 80% by TF Holdings and 20% by the DRC state owned mining company Gécamines. In turn, TF Holdings is owned 70% by FCX or its subsidiaries and 30% by Lundin Mining Corporation or its subsidiaries. Longer-term Possibilities: Longer term possibilities exist but further feasibility studies are required. COMPONENTS OF THE PROPOSED PROJECT Mining method: Open pit mining mainly by traditional methods using diesel powered surface miners, if feasible and conventional loading/hauling units as necessary. Some blasting will be used in the harder sections of the ore body. Mineral processing plant: For Option 1, the mined ore will be processed in a Dense Media Separation (DMS) plant where the ore will be upgraded to a concentrate containing up to 25% copper and variable concentrations of cobalt. For Option 2, the mined ore will be processed off site. Mine waste facilities: Option 1: Waste rock produced from mining the ore and reject material generated from processing will be disposed on site in a co-disposal facility. Waste rock will be trucked to the facility, and reject material will be pumped by pipeline. Option 2: Waste rock will be disposed at a waste rock dump only. Mine reject material: Reject material consist of crushed rock left over after the metals of interest (e.g., copper) have been extracted from the mineral bearing ore. Reject material may be suitable for reprocessing in the future. IT IS IMPORTANT TO NOTE THAT THE PROJECT DESCRIPTION DETAILS MAY CHANGE AS THE PROJECT FEASIBILITY STUDY PROGRESSES. 3

22 What is ore? Ore is a mineral or an aggregate of minerals from which a valuable constituent, especially a metal, can be economically mined or extracted. Metal ores are generally oxides, sulfides, silicates or native metals (e.g., native copper). The proposed Kisanfu Project will only mine the oxide portion of the ore at this stage. Quarry: A quarry, possibly located in the western part of the license boundary, will be required for hard rock, gravel and sand for the construction of the project components, roads, etc. Electricity: Electricity for the project will initially be generated by diesel generators on site and later purchased from SNEL. The construction of power transportation and distribution infrastructure will be required. Access and haul roads: Main access to the project site will be from the proposed 15 km gravel haul road from the mine site to the N39 road north of the lease area. Additional on-site access roads will be required. Water supply: Water for the mine and processing plant (for Option 1 only) will be obtained from deep boreholes and from the dewatering system at the mine. Excess water may be released to surface waters, after it has been treated, if necessary, to DRC and international best practice standards. Kisanfu is a greenfield site (meaning that the land is undeveloped) and is fairly remote from established infrastructure. It will therefore require substantial investment in infrastructure. Waste disposal: Domestic and industrial waste will be disposed of at dedicated landfill sites. Disposal options for hazardous waste will be investigated, including on site and off site opportunities. Sewage treatment facility: A sewage treatment plant will be constructed on the mine site to treat sewage generated on site. Stormwater control dams: There will be stormwater control dams, which will be used to manage contact water (water that comes into contact with the mine infrastructure, the plant site and the other mine areas). Mine camp: A mine camp will be constructed for the construction and operation phases of the Project. Other infrastructure requirements: administrative facilities; warehouses and shops; low grade ore stockpile; pipelines for reject material (Option 1); security fence around the mine site. Employment: For Option 1: It is expected that during the construction of the DMS plant there will be approximately 200 temporary jobs. Once the plant is operating it will create 100 permanent jobs. For Option 1 and Option 2: The mine will employ about 400 people during its development and the same number of people will be needed to operate the mine once it starts production. Construction is planned to start before First production is expected before PREVIOUS STUDIES SRK completed environmental and social baseline studies on behalf of PDC for the proposed Kisanfu Project in March The baseline report sets out the requirements for further specialist work and environmental and social impact assessments, as well as management planning work that will be required for the continuation of the Project. PDC has also conducted annual audits of its Mitigation and Rehabilitation Plan for exploration granted in 2004 by the DRC Government. EIS AND EMPP PROCESS An EIS and EMPP is undertaken to ensure that the environmental and social consequences of a project are fully understood and that plans are put in place for the developer to adequately manage the impacts. The EIS and EMPP provide valuable input into project planning decisions both for the developer and authorities. The EIS and EMPP for the proposed Kisanfu Project will meet: DRC legal requirements (Code Minier, supported by the Mining Regulations and Annexes); International good practice standards (IFC Performance Standards and Equator Principles); and FCX s environmental and social policies. 4

23 STAKEHOLDER ENGAGEMENT Stakeholder engagement is an integral part of the EIS process. This process identifies stakeholders and provides them with an opportunity to express their views about the Project. Comments and inputs raised by stakeholders help guide the EIS studies, as well as Project decision-making. SRK plans to hold two rounds of engagement as part of the EIS process. A third round of engagement will follow after the Government has made a decision on the Mining License application. Stakeholders are encouraged to attend the meetings and raise their concerns and issues about the Project. The chart on page 6 represents the EIS and EMPP process, showing the key activities and timeframes that will be undertaken during the technical and stakeholder engagement processes. SPECIALIST STUDIES As part of the EIS and EMPP process, specialists will be required to update their previous 2009 baseline studies as well as carry out an impact assessment. Specialist studies to be included in the EIS and EMPP are as follows: Climate, air quality and greenhouse gases Surface water and groundwater Geochemistry and closure Soils and land capability Terrestrial and aquatic ecology Noise Transportation Visual Socio-economics Archaeological and Cultural Heritage POTENTIAL IMPACTS The proposed Kisanfu Project may have both positive and negative impacts on the surrounding environment and people. Kambi ya mgodi: kambi ya mgodi ita jengwa kwa kipindi cha ujenzi pia kile cha kazi. Phelps Dodge Congo proposes to convert this Exploration License into a Mining License and intends to establish an open pit mine and associated infrastructure to mine the Kisanfu copper/cobalt deposit. Phelps Dodge Congo is currently conducting a Feasibility Study for the proposed Kisanfu Project. Part of the Feasibility Study is an environmental and social impact study, which is required by the DRC Mining Code. The proposed project requires an environmental permit from the DRC Government before it can proceed. Phelps Dodge Congo has appointed SRK Consulting, as the independent consultant, to undertake the required Environmental Impact Study and compile an Environmental Management Plan of the Project. This study will ensure that all environmental and social impacts of the project are fully understood and that plans are put in place to help Phelps Dodge Congo manage them. Furthermore, SRK s study will satisfy DRC legal requirements, international good practice standards and Freeport- McMoRan s environmental and social policies. An important part of the environmental studies is stakeholder engagement. SRK will be holding a number of stakeholder engagement meetings in May 2012 to present and describe the proposed Kisanfu Project, outline the environmental permitting process and provide stakeholders with an opportunity to raise any comments, concerns, issues and suggestions about the proposed project and associated environmental process. 91 Option 1: PROJECT DESCRIPTION PDC is considering two options for the proposed Kisanfu Project: Open pit mine east of Kisanfu River Dense Media Separator (DMS) plant Concentrate produced in DMS plant will be processed off site Treat an estimated 10,000,000 tons of ore during the project life Co-disposal facility for waste rock and reject material Low grade ore stockpile for future processing Life of mine: 7-10 years Option 2: Open pit mine east of Kisanfu River Treat an estimated 10,000,000 tons of ore during the project life Ore produced will be processed off site Waste rock dump only Life of mine: 7-10 years NOTE: Infrastructure layout for both options will be similar, but for Option 2, there will be no DMS plant and the co-disposal facility will be for waste rock only
