Does your country or region belong to such a ²customs union² and did it therefore indeed dismantle wholly or substantially all controls as mentioned in note 12? If so, does it nevertheless apply the provisions of Section 4 at the involved border(s)? Korea does not belong to "customs union". 2. Which are in your law: (i) the "competent authorities, administrative or judicial", and In our law, we surely have competent authorities" and "procedures". Since any right holder who wishes to have his Trademark rights or copyrights protected may request suspension of release of the goods to the Customs Service (article 146 bis (4,7) of the Customs Tax Law), the Customs Service corresponds to the authority of this question. (ii) the adopted "procedures" as meant in the first sentence of Article 51? There are two procedures adopted; (1) suspension of release by the request of IP right holder: Any trademark owner may request suspension of release by submitting required document to Customs Service which is the competent authorities executing the release of that goods (article 3-1(1) of Notification on importation exportation process for protecting Intellectual Property Rights) (2) suspension of release of goods which are likely to infringe on registered trademark rights: Trademark owner may register his trademark with Customs Service to have his trademark rights protected from importation/exportation of the goods infringing his trademark rights (article 146bis(2) of the Customs Tax Law/article 2-1(1) of 1

2 Notification on importation/exportation process for protecting Intellectual Property Rights). When a petition for the license of the importation or exportation of goods that are likely to infringe trademark rights is found, Customs shall inform the person who has registered his trademark rights regarding such petition (article 2-3(1) of Notification on importation/exportation process for protecting Intellectual Property Rights). When the trademark owner is notified of the importation or exportation of the goods that are likely to infringe his trademark rights, the owner may request, within ten working days, Customs Service to suspend the release of the goods. In that case, the owner must file a petition with the securities (article 2-3(3) of Notification on importation/exportation process for protecting Intellectual Property Rights). When the petition is filed to the Customs Service by the trademark owner, the Customs Service, if the goods are determined to be infringing goods, shall suspend the release of the goods (article 146 bis (5) of the Customs Tax Law//article 2-3(5) of Notification on importation/exportation process for protecting Intellectual Property Rights). 3. Do the procedures in your country or region apply also to: (i) parallel imported goods protected by trademark law and goods protected by copyright law (cfr. the above cited note 13)? Yes, they do. For parallel imported goods, the procedures 2.(ii) above are applicable in the following condition (article 1-3(5) of Notification on importation/exportation process for protecting Intellectual Property Rights); a. When the foreign and domestic owner are not the same legal entities such as same entity, 30% or more stock holder subsidiary, sales representative. b. An exclusive licensee who has been granted an exclusive license by foreign and domestic owner who are the same person, is not the same person with the foreign and domestic owners, manufactures and sells all the goods domestically without importing the genuine goods. (ii) such goods in transit (cfr. the above cited note 13) and goods which are to be exported (cfr. the last sentence of Article 51)? This question is particularly important as formerly customs authorities were only or mainly involved with the importation of goods. Yes, it also applies to such goods in transit or goods for exportation. 4. Are the procedures and the competent authorities for borderline measures to protect each of the above mentioned rights the same as in the situation dealt with in the above question 2? If not, please indicate the differences. Above procedures are applicable only to trademark rights and copyrights. 2

3 5. What are the answers for each of the above mentioned rights to the above questions 2(i) and 2(ii)? Yes and No. As indicated in the Answer for Question 4, it applies only to trademark and copyright and does not apply to any other rights mentioned in III. b). 6. The Groups are invited to describe the details, if any, which exist in their country or region, by law or in practice, relating to: (i) the adequate evidence and the sufficiently detailed description as required in the first sentence; According to the procedures above 2.(ii), (1) Any owner of the trademark or copyright who wishes to request suspension of release shall submit request documents containing following facts and documents proving that he is the lawful owner (article 127's 6 of Implement Decree of Custom Tax Law) a. names of the products or goods, importer/exporter and country originated from and heading for b. copy of Trademark Register and one specimen of Trademark c. the reasons of request d. any facts to prove infringement (2) The person who wishes to register trademark rights shall submit papers containing the following facts and a copy of certificate of registration of the trademark rights (article 127quinquies of Implement Decree of Custom Tax Law//article 2-1(1) of Notification on importation/exportation process for protecting Intellectual Property Rights) a. the owner who is entitled to use the trademark rights b. copy of Trademark Register and one specimen of Trademark c. name of importers/exporters and importing/exporting countries those are likely to infringe the trademark rights d. any facts to prove infringement * When the Customs Service requests to submit additional materials to admit the infringement, the person who has requested suspension of release shall submit the materials within ten working days from the date on which the request is served (article 3-10(1) of Notification on importation/exportation process for protecting Intellectual Property Rights). (ii) the reasonable period of information and the period in which the authorities will take action as required in the second sentence. When a petition is filed, after formality check, the Customs Service shall inform the person who has filed the petition within seven days from the date on which the 3

4 petition is filed (Article 2-1(3,4) of Notification on importation/exportation process for protecting Intellectual Property Rights). The registration with Customs Service will be valid for ten years or until the trademark right expires, whichever is sooner (article 2-2(1) of Notification on importation/exportation process for protecting Intellectual Property Rights). 7. The Groups are invited to describe the details, which exist in their country or region, by law or in practice, relating to: (i) the security or equivalent assurance as meant in the first and second sentence of par. (1); The person who requests suspension of release shall submit securities or bonds issued by a bonding company equal amount to 120 percent of the taxable value of the goods to the Customs Service (Article 3-1(4) of Notification on importation/exportation process for protecting Intellectual Property Rights). (ii) the release of goods on the posting of a security as meant in the first sentence of par. (1); The importer/exporter may challenge the suspension of the goods by submitting a petition for release the goods, together with supporting evidence of the authenticity of the goods and the goods and a bond equal to the amount of the bond posted by the trademark owner, plus an additional 25 percent of such amount (article 4-1(2) of Notification on importation/exportation process for protecting Intellectual Property Rights). (iii) the reasonable period of time as meant in the second sentence of par. (2); It is ten working days. 8. Are there any special details in your law or practice pertaining to the prompt notification meant in this Article 54? When the Customs Service suspends release of imported/exported goods, the Customs Service shall inform the person who requested the suspension and the importer/exporter immediately (article 3-3 of Notification regarding importation/expor-tation process for protecting Intellectual Property Rights). 9. The Groups are invited to describe the details, which exists in their country or region by law or in practice, relating to: (i) the way in which the applicant has to be served notice of the suspension; As a rule, the service will be made through facsimile, the Customs Service shall keep the record. But, for the case of the notice for the trademark owner, if the owners facsimile is not available then, the Authority will keep that fact in the record, and will use rapid registered mail. 4

5 (ii) the way in which the customs authorities have to be informed as formulate in the first part of Article 55; When the person who has requested suspension of release has taken any action to the court within ten days, he submit the evidence to prove the above mentioned action. (iii) the nature of the appropriate cases in which the time limit not exceeding ten working days is extended by another ten working days; Within ten working days, time limit to prove the fact that petitioner takes the legal action may be extended upon the petition by the owner, but cannot be exceed ten working days (article 3-5(1) of Notification regarding importation/exportation process for protecting Intellectual Property Rights). (iv) the way in which a review, including a right to be heard, as meant in this Article 55 is conducted; The person who are notified of the suspension can make a petition for review to the Customs Service. (v) the provisions prescribed in Article 50 paragraph 6? It does not exceed twenty working days. 10. Are there any arrangements, in the law or practice of your country or region, containing details pertaining to the compensation meant in Article 56? In the Answer 7, along with the securities, the petitioner will also submit the pledge to allow the Customs Authority to use the bond for the compensation occurred by wrongful detention. 11. The Groups are invited to describe the details, which exist in their country or region, by law or in practice, relating to: (i) the sufficient opportunity for the right holder for an inspection as meant in the first sentence of Article 57; (ii) same for the importer mentioned in the second sentence; When the right holder, importer/exporter or any interested party requests the inspection and gathering of samples in order to substantiate his claims, the Customs Service shall give the owner opportunity to inspect as long as there are no trade secret issues involved (article 3-8 of Notification regarding importation/exportation process for protecting Intellectual Property Rights). (iii) the information meant in the last sentence. No related provision exists. 12. The Groups are invited to indicate whether under their law the competent authorities may provide the information meant in the last sentence of Article 57. 5

But the law indicates that the Authority will notify the petitioner, owner, the receipt of the petition of the import/export license which is likely to infringe the registered trademark or copyright. 13. Are the authorities in your country or region required to take Ex Office Action as meant in this Article? If so, please describe the details, which exist by law or in practice, relation to: (i) the seeking of information meant under (a); Under article 3-7, article 3-8, article 3-10 and article 4-2-2, the relevant Customs Branch may seek any information from the right holder, relevant Government Authority in order to suspend the release of goods. (ii) the notification and the suspension meant under (b); No related provision exists. (iii) the exemption of liability meant under (c). No related provision exists. 14. The Groups are invited to describe the details, which exist in their country or region, by law or in practice, relating to: (i) the destruction (or is destruction prohibited under your constitution?) and disposal of infringing goods; Petitioner, owner, of course, may seek the court order to destroy and disposal of infringing goods. (ii) border measures against "materials and implements" as mentioned in Article 46? No related provision exists. (iii) exceptional circumstances (cases) as meant in the last sentences or Articles 59 and 46. No related provision exists. 15. Does the law or actual practice in your country or region indeed exclude De Minimis imports as meant in Article 60? Please give details, if any. This Notification is not applicable to small quantities of goods of a non-commercial nature such as travelers' personal luggage, consignments, etc. (article 1-1(2) of Notification regarding importation/exportation process for protecting Intellectual Property Rights). 16. Do you consider the border measures as formulated in TRIPS sufficient? If not, which measures should in your opinion be added in TRIPS? 6

7 The above TRIPS provisions related to the border measures are sufficient as a whole, but provisions regarding parallel imported goods may be more detailed. 17. Apart from the measures which in your opinion are still to be added in TRIPS: which difficulties and/or insufficiencies do particularly exist in your opinion in the law and practice of your own country or region, and what are your proposals for improvement? As mentioned above, our Law, Decree and Indication are currently applicable only to trademarks and copyrights, but the corresponding provisions applicable to other IP rights such as patents, industrial designs, etc. need to be established. Résumé I. Introduction Depuis qu'il devenait un signataire des accords OMC/ TRIPs en 1994, le Gouvernement Coréen a fait des efforts considérables à protéger, à appliquer des droits intellectuels de propriété et à harmoniser ses lois avec les accords OMC/ TRIPs. Comme un de tels efforts, le Gouvernement Coréen amendait Customs Tax Law ( "CTL") pour renforcer la protection de frontière et, par ce moyen, restreindre efficacement la circulation illégale des marchandises d'ipr en Corée et en dehors de la Corée. L'amendement à CTL et ses réalisations des règlements (connus comme Notifications, révisés dernièrement dans La notification No.94-44, du 6.Décembre.1997) ont renforcé l'autorité et contrôlent du service douanier de la Corée (" KCS ") sur la circulation des produits d'ipr à la frontière. Depuis janvier 1999, il y a douaniers travaillant à travers la Corée dans sept maisons principales de douane, trente et une maisons de douane, douze bureaux de section et des états-majors de KCS. Parmi eux, à peu près 240 douaniers travaillent en travers du pays comme les officiers responsables des affaires d'ipr.(overview on Korea Customs Service publié par KCS en février 1999). II. La protection du KCS pour IPR Parmi les divers droits intellectuels de propriété, le KCS protège essentiellement le droit de marques et le droit d'auteur aux frontières par trois mécanismes d'application. Aucune mesures ou règlements d'application spécifique n'existent pour la protection d'autres droits de la propriété intellectuelle telles que brevet. Les trois mécanismes d'application sont comme suit: En premier, le KCS opère un système d'enregistrement de la marque. Tout détenteur de droit qui veut obtenir la protection spécifique du KCS peut enregistrer ses droits de marque avec le KCS. En second, une personne qui revendique le droit de marque ou le droit d'auteur de supériorité (indépendamment de l'enregistrement du KCS) peut déposer les documents requis et entreposer la demande et le KCS saisit certaines cargaisons illégales des marchandises. En troisième, si l'infraction est découverte dans les trois (3) mois après qu'une déclaration d'importation est approuvée par le KCS, le KCS peut ordonner à l'importateur de récupérer les marchandises illégales à un entrepôt désigné de la douane. 7

8 1. Système d'enregistrement de Marque avec le KCS Parmi trois mesures d'application ci-dessus, le système de l'enregistrement de marque de KCS a été une méthode primaire pour protéger des droits de marque aux frontières. Le système de l'enregistrement de marque de KCS est seulement disponible pour des marques qui ont été auparavant inscrites avec le Bureau de la Propriété Industrielle de la Corée. L'enregistrement est efficace pour dix ans ou jusqu'à ce que le droit de marque soit suspendu, si n'importe lequel survient avant. Depuis le 25 mars 1998, un total de marques a été inscrit par le KCS pour une variété de produits comme habillement, chaussures, produit de cosmétique et montres. (Cette statistique est fourni par la Division de Coopération Intellectuelle du KCS pour Joint Conference of the Trademark Right Holders and Gouvernment Organizations). Avec l'enregistrement de douanes, s'il y a des raisons valables de soupçonner que l'importation de marchandises de marque porte atteinte au droit de marque, le KCS n'acceptera pas la déclaration d'importation et, au lieu de cela, retiendra la cargaison pour l'inspection. De plus, le KCS livrera une notification temporaire de mise en retenue à l'importateur et aussi au détenteur de marque. Les cargaisons peuvent être retenues jusqu'à dix (10) jours ouvrables (sauf les jours fériés officiellement et les dimanches) par le reçu de la notification de la part du détenteur de marque. Durant ces dix jours, le détenteur peut contrôler la cargaison pour déterminer si les marchandises contenues de telle cargaison sont enfreintes. Si l'inspection révèle que les marchandises importées sont illégales, le détenteur de marque peut présenter une pétition et afficher l'engagement nécessaire avec le KCS pour retenir davantage la cargaison. Un engagement peut consister en liquide, garantie ou caution, délivrés par une entreprise garantie, égale à 125 pourcentages de la valeur taxable de la cargaison. Quand la pétition est en même temps présentée avec l'engagement requis, le KCS revoit la pétition et détermine s'il continue à retenir la cargaison. Le KCS notifiera sa décision à l'importateur et aussi au détenteur de marque. Principalement, le délai est jusqu'à dix (10) jours ouvrables par le reçu de telle notification de la part du détenteur de la marque. Cependant, si le détenteur de la marque présente le témoignage du procédé d'un tribunal concernant la cargaison, en incluant un ordre d'injonction préliminaire ou un dossier d'un procès principal, avec un délai de 10 jours, le KCS peut retenir la cargaison jusqu'à ce que la résolution judiciaire soit rendue. Il est pratiquement très difficile d'obtenir l'injonction préliminaire, le détenteur de la marque fait enregistrer normalement un procès principal à obtenir une décision pour détruire les marchandises illégales. Entre-temps, durant le délai de dix jours supplémentaires de retenue, l'importateur peut défier la retenue de la cargaison en soumettant à une pétition pour la livraison de la cargaison, et aussi en soutenant la preuve 8

9 d'authenticité de la cargaison et un engagement égal à la somme de l'engagement affiché par le détenteur de la marque, plus un supplément de 25 pourcentages. (i.e. 150 pourcentages de la valeur taxable de la cargaison) Si une tel contre-pétition est soumise par l'importateur, le détenteur de la marque sera aussi notifié, et le KCS reverra alors le cas et déterminera si telle pétition devrait être accordée. De plus, le détenteur de la marque sera permis de soumettre la preuve supplémentaire au KCS pour soutenir sa revendication. Le KCS déterminera dans les quinze (15) jours si la contrepétition de l'importateur devrait être accordée. 2. La requête précisée pour la retenue sans l'enregistrement Quand un détenteur de la marque/du droit d'auteur est conscient d'une cargaison spécifique de marchandises qui porte atteinte aux droits de la marque ou aux droits d'auteur, il peut spécifiquement demander que le KCS retienne la cargaison précisée, indépendamment de l'enregistrement. Comme les droits d'auteur ne peuvent pas être inscrits au KCS, ce mécanisme devient la méthode principale selon le CTL pour protéger les droits d'auteur. Pour demander que le KCS retienne une cargaison enfreinte, la pétition pour la retenue doit être soumise dans les vingt (20) jours avant que les marchandise soient entrées ou avant que la déclaration d'exportation soit faite. La pétition devrait être en même temps présentée avec l'engagement requis. 3. Le Recouvrement de la Cargaison Enfreinte Dans le cas où l'infraction est découverte dans les trois (3) mois après que la déclaration d'importation/d'exportation a été acceptée par le KCS, le KCS peut ordonner que les marchandises soient récupérées et placées dans un entrepôt désigné de la douane. Quand l'ordre est émis, un avis sera envoyé à l'importateur. L'importateur qui reçoit l'ordre est exigé de livrer les marchandises, à ses frais, à l'entrepôt désigné de la douane dans les sept jours dès le reçu de l'avis. Quand les marchandises arrivent à l'entrepôt, le KCS contrôlera les marchandises pour déterminer la nature et l'étendue de l'infraction ou autre violation. Le Bureau douanier peut alors prendre une de deux actions: 1) libérer les marchandises après la correction et la modification de violation; ou 2) commander les marchandises à être détruites ou revenues à l'exportateur. Tous frais pour telles procédures seront donnés par l'importateur. Malgré le fait que la mesure ci-dessus est fournie selon CTL, parce que le KCS a des difficultés en déterminant si une marque ou un droit d'auteur a été enfreint légalement, le KCS normalement n'initie pas les mesures ci-dessus dans des cas réels d'infraction. 9

10 4. Divers Le CTL ne pénalise pas des transgresseurs d'ipr au-delà de la saisie possible de marchandises piratées. Selon CTL, le KCS a pourtant un large pouvoir discrétionnaire d'examiner des cargaisons illégales de sa propre initiative sans avoir une pétition ou une demande du détenteur de la marque. Quand le KCS détermine que les cargaisons portent atteinte clairement au droit valable de la marque, l'affaire doit être transférée au bureau du Procureur pour les procédés plus criminels. III. Concluant des remarques Bien que le KCS fournisse des outils significatifs pour la protection des droits de propriété intellectuelle aux frontières, c'est les efforts vigoureux de détenteur du droit qui font travailler de tels outils. De plus, depuis que les règlements et lois Coréens pour la protection d'ipr, en comprenant le CTL, sont toujours en train de se développer, les efforts et l'intérêt du détenteur du droit d'ipr pour la meilleure mise en application de la loi douanière feront les actuelles lois de la taxe douanière et ses structures plus convenables pour la protection d'ipr dans l'avenir. pour la meilleure mise en application de la loi douanière. Zusammenfassung 1. Gehört ihr Land oder ihre Region zu so einer Zollunion und baute es daher tatsächlich die Grenzüberwachung wie in Note 12 erwähnt ganz oder im wesentlichen ab? Wenn ja, wendet es dennoch die Vorschriften von Abschnitt 4 an den betroffenen Grenze an? Nein. South Korea gehört nicht zu so einer unter den Abschnitt 4 des Teils des TRIPS "Zollunion". 2. Welche sind in Ihrer Rechtsordnung (i) die zuständigen Verwaltungs-oder Justizbehörden? Die Mitglieder sehen nach den nachstehenden Bestimmungen Verfahren vor, in denen ein Rechtsinhaber, der triftige Gründe zu der Annahme hat, dass es zur Einfuhr von nachgeahmten Markenwaren oder unerlaubt hergestellten urheberrechtlich geschützten Waren kommen kann, bei den zuständigen Verwaltungs- oder Justizbehörden schriflich beantragen kann, dass die Zollbehörden die Überlassung dieser Waren voraussetzen. Die Zollbehörden sind die zuständigen Verwaltungsbehörden. (ii) die Verfahren Es gibt zwei Verfahren - Die nach einer Forderung der Rechtsinhaber Verschiebung der Einfuhr Wenn der Rechtsinhaber eine Verschiebung der Einfuhr ausführen will, soll diese Tatsache an das Zollamt abgegeben werden. - Die Verschiebung der Einfuhr für nachgeahmte Markenwaren 10

11 a) Bei der Verletzung eines Urheberrechts ermittelt das Zollamt unmittelbar an den Rechtsinhaber oder Exporter im Herstellungsland. b) Wenn der Rechtsinhaber eine Einfuhrmitteilung erhalten hat, kann er mit einer Hypothek innerhalb der 10 Tagen eine Verschiebung der Einfuhr fordern. c) Nach der Feststellung einer nachgeahmte Markenwaren kann die Einfuhr von betroffenen Markenwaren verschoben werden. 3. Werden die Verfahren in ihrem Land auch auf (i) parallel importierte Waren, die durch Markenrecht und Waren, die durch Urheberrecht geschützt sind (siehe die oben zitierte Fussnote 13) angewendet? Für die parallel impotierten Waren wird folgendes Verfahren angewendet. a) Wenn der Rechtsinhaber für die Waren eingetragener Marken nicht identisch ist. b) Wenn die Verwaltungsbehörden eine Tatsache der Einfuhr von nachgeahmten Markenwaren ist. (ii) Transitwaren (siehe die oben zitierte Fussnote 13) und Ware, die ausgeführt werden sollen (siehe den letzten Satz von Artikel 51) angewendet? Die oben genannten Verfahren gelten für Transitwaren und Waren, die ausgeführt werden soll. 4. Sind die Verfahren und die zuständigen Behörden für Grenzmassnahmen für jedes der oben erwähnten Rechte die gleichen wie in den oben in Frage 2 behandelten Fällen? Wenn nicht, sollen die Unterschiede angegeben werden. Die oben erwähnten Verfahren sollen zum Markenrecht und Urheberrecht angewendet werden. 5. Welches sind die Antworten für jedes der oben erwähnten Rechte zu den oben gestellten Fragen 2(i)und 2(ii)? Die oben genannten Verfahren gelten für Transitwaren und Waren. Sie sollen nicht aber für geographische Angaben sowie gewebliche Muster, Patente angewendet werden. 6. Die Gruppen werden gebeten, gegebenenfalls die Einzelheiten zu beschreiben, welche in ihrem Land oder ihrer Region in der Gesetzgebung vorgesehen sind oder in der Praxis angewandt werden mit Bezug auf (i) Die angemessenen Beweise und die hinreichend genaue Beschreibung, wie im ersten Satz gefordert; Die Rechtsinhaber, welche Verfahren nach Artikel 51 einleiten wollen, müssen angemessene Beweise, d.h. nach dem Recht des Einfuhrlandes dem ersten Anschein nach eine Verletzung des Rechts des Rechtsinhabers 11

12 (ii) sowie eine hinreichend genaue Beschreibung der Waren für die Zollbehörden beibringen. Die angemessene Frist für die Mitteilung und den Zeitraum, für welchen die Zollbehörden Massnahmen treffen werden, wie im zweiten Satz gefordert. Die zuständigen Behörden müssen dem Antragsteller innerhalb 7 Tagen die Annahme von Antrag mitgeteilt werden. 7. Die Gruppen werden gebeten, die Einzelheiten zu beschreiben, welche in ihrem Land oder ihrer Region in der Gesetzgebung vorgesehen sind oder in der Praxis angewandt werden mit Bezug auf: (i) Die Kaution oder entsprechende Sicherheitsleistung im Sinne des ersten und zweiten Satzes von Absatz 1; Für die Überlassung von Waren muss der Antragsteller die Kaution dieser Waren in einer Höhe von 120% ausreichen. (ii) Die Freigabe der Waren gegen Stellung einer Kaution im Sinne des ersten Satzes von Absatz 1; Der Einführer oder der Empfänger kann ein Antrag stellen, wenn er alle Voraussetzungen für die Einfuhr erfüllt hat und 25% Kaution innerhalb einer angemessenen Frist abgegeben hat. 8. Gibt es in Ihrer Gesetzgebung oder Praxis besondere Einzelheiten bezüglich der in Artikel 54 vorgesehenen umgehenden Mitteilung? Nein. Dem Einführer und dem Antragsteller muss die Aussetzung der Überlassung der Waren umgehend mitgeteilt werden. 9. Die Gruppen werden gebeten, die Einzelheiten zu beschreiben, die in ihrem Land oder ihrer Region in der Gesetzgebung oder Praxis im Zusammenhang mit den folgenden Punkten vorgesehen sind: (i) Die Art und Weise, in der dem Antragsteller die Mitteilung zuzustellen ist; Die Mitteilung wird im Normalfall dem Antragsteller per Fax zugestellt. Wenn dies nicht möglich ist, muss die Mitteilung sofort per Einschreiben zugestellt werden. (ii) Die Art und Weise, in der die Zollbehörden, wie im ersten Teil von Artikel 55 vorgesehen, informiert werden müssen; Wenn der Antragsteller innerhalb 10 Tagen aufgrund einer einstweiligen gerichtlichen Massnahme eingeleitet hat, dann muss ein Beweis abgegeben werden. (iii) Die Voraussetzungen, die erfüllt sein müssen, damit gegebenenfalls die Frist von 10 Arbeitstagen um weitere 10 Tage verlängert werden kann; Aufgrund einer gerichtlichen Massnahme die nicht innerhalb 10 Tagen eingeleitet wird, soll Antragsverlängerung von Aussetzung der Überlassung der Waren innerhalb letzterer Zeitraum mitgeteilt werden. (iv) Die Art und Weise, in der eine Überprüfung, die das Recht zur Äusserung einschliesst, im Sinne von Artikel 55 durchgeführt wird; Wenn der Bescheid der Aussetzung der Überlassung der Waren nicht mitgeteilt wird, kann man eine Überprüfung der Zollbehörden fordern. 12

13 (v) Die in Artikel 50, Paragraph 6 beschriebenen Vorschriften? Es sollen 20 Tagen nicht überschritten. 10. Gibt es in der Gesetzgebung oder Praxis Ihres Landes oder Ihrer Region Vorschriften, die Einzelheiten bezüglich der in Artikel 56 vorgesehenen Entschädigung enthalten? Der Antragsteller kann die Kautionen nach Frage 7 und für den durch die rechtswidrige Zurückhaltung von Waren entstandenen Schaden leisten. 11. Die Gruppen werden gebeten, die Einzelheiten zu beschreiben, welche in ihrem Land oder ihrer Region in der Gesetzgebung vorgesehen sind oder in der Praxis angewandt werden mit Bezug auf: Die hinreichende Gelegenheit für den Rechtsinhaber für eine Beschau im Sinne des ersten Satzes von Artikel 57; Desgleichen für den im zweiten Satz erwähnten Einführer; Damit der Rechtsinhaber seine Behauptungen substantiieren kann, sind die zuständigen Behörden ferner beifugt, dem Einführer eine entsprechende Gelegenheit zu geben, diese Waren beschauen zu lassen. 12. Die Gruppen werden gebeten anzugeben, ob nach ihrem Recht die zuständigen Behörden die im letzten Satz des Artikels 57 vorgesehene Auskunft erteilen können; Dafuer gibt es keine Gesetzgebung. Aber die zuständigen Behörden dem Rechtsinhaber, dem Antragsteller die Namen und die Anschriften des Absenders, des Einführes und des Empfaengers sowie Menge der betroffenden Waren mitteilen können. 13. Müssen die Behörden in Ihrem Land oder Ihrer Region von Amts wegen tätig werden, so wie in diesem Artikel vorgesehen? Wenn ja, wird gebeten, die Einzelheiten zu beschreiben, welche in der Gesetzgebung vorgesehen oder in der Praxis angewandt werden mit Bezug auf: (i) Das Einholen von Auskünften im Sinne von a); Die Zollhörden können von zuständigen Behörden Auskünfte für die Aussetzung der Überlassung der Waren einholen. (ii)(iii) Die Mitteilung und Aussetzung im Sinne von b); Die Befreiung von der Haftung im Sinne von c); Dafür gibt es keine Gesetzgebung. 14. Die Gruppen werden gebeten, Die Einzelheiten zu beschreiben, welche in ihrem Land oder ihrer Region in der Gesetzgebung vorgesehen sind oder in der Praxis angewandt werden mit Bezug auf: (i) Die Vernichtung oder Zerstörung (oder ist eine solche unter Ihrer Verfassung verboten?) und die Verfügung über die rechtsverletzenden Waren; Der Antragsteller und Rechtsinhaber können die Vernichtung oder Zerstörung und die Verfügung über die rechtsverletzenden Waren bitten. 13

14 (ii)(iii) Zollmassnahmen gegen Materialien und Werkzeuge, wie in Artikel 46 er-wänt; Dafür gibt es keine Gesetzgebung. 15. Nimmt die Gesetzgebung oder die Praxis in Ihrem Land oder Ihrer Region tatsächlich Einfuhren geringer Mengen im Sinne von Artikel 60 von der Anwendung der Bestimmungen aus? Ja. Die Gesetzgebung in Süd Korea nimmt tatsächlich Einfuhren geringer Mengen im Sinne von Artikel 60 von der Anwendung der Bestimmungen aus. 16. Sind Sie der Auffassung, dass die zollrechtlichen Massnahmen, wie sie im TRIPS Abkommen vorgesehen sind, ausreichen? Wenn nicht, welche Massnahmen sollten nach Ihrer Meinung den TRIPS Vorschriften hinzugefügt werden? Die Auffassung der zollrechtlichen Massnahmen über parallel importierte Waren wird sich in die Zukunft verstärken. 17. Abgesehen von den Massnahmen, die nach Ihrer Meinung noch TRIPS hinzugefügt werden sollen, welche Schwiergkeiten oder Unzulänglichkeiten bestehen nach Ihrer Meinung insbesondere in der Gesetzgebung und Praxis Ihres eigenen Landes oder Ihrer eigenen Region, und welche Verbesserungsvorschläge haben Sie zu machen? Die Auffassung gilt zur Zeit nur zum Markenrecht und Urheberrecht. Es sollten in der Gesetzumgebung erweitert werden. 14
