PURPOSE The purpose of this instruction is to outline the notification procedures required when an inmate's case is under consideration by the Immigration Division. 2. RESPONSIBILITY The Institutional Sentence Administrator, or the staff designated to discharge the O&A function in institutions that have no Sentence Administrators, is responsible for carrying out the procedures outlined in this instruction. 3. NOTIFICATION PROCEDURE a. If an inmate appears to be subject to the provisions of the Immigration Act on the matter of deportation, a completed Form 67 IMM shall be forwarded to the Immigration Division. - b. Upon request by Immigration Officers or the Immigration Division, certified copies of the Warrant of Committal of any inmate whose case is under consideration for deportation or other action shall be furnished. 1. RESPONSABILITÉ L 'administrateur des sentences de l'établissement, ou le personnel désigné è exécuter les tâches de l'o&a dans les établissements oû il n'y a pas d 'administrateur des sentences, est chargé d'appliquer les procédures énoncées dans la présente instruction. 3. PROCÉDURE DE NOTIFICATION a. Si un détenu semble être sujet aux dispositions de la Loi sur l'immigration en ce qui concerne l'expulsion, une formule 67 IMM dûment remplie doit être envoyée è la division de l'immigration. b. Sur la demande des agents d 'immigration ou de la division de l'immigration, des copies conformes du mandat d 'incarcération de tout détenu dont le cas est étudié en vue de son expulsion ou d'autres mesures devront être fournies..../2

3 DI No. 352 'July 27, 1977 c. The criminal record furnished will be according to the information on file on the day on which Form 67 IMM is completed. d. A medical certificate shall be furnished in certain cases, as indicated in Note 2 of Form 67 IMM. e. Form 67 IMM will be forwarded in duplicate to the Regional Office of. the, at the appropriate regional address as indicated at - Annex "A" of this instruction. f. At the discretion of the Institutional Director, an officer may be present at interviews between inmates Officers. g. If an inmate who is liable to deportation is transferred to a provincial mental hospital, the, Department of Manpower and Immigration, at the appropriate regional address as shown at Annex "B" shall be notified. Also the hospital authorities shall be advised that such an inmate must not be released without an official order-signed by the Institutional Director. Si un détenu qui est passible d'expulsion est transféré à un hôpital psychiatrique provincial, il faut en aviser le directeur de l'immigration du ministère de la Maind'oeuvre è l'adresse régionale appropriée, telle qu'indiquée à l'annexe "B". De même, les autorités de l'hôpital devront être avisées que le détenu en question ne doit pas être libéré sans un avis officiel signé par le directeur d'établissement.
