1 Annex 03, page 1 PROPOSITIONS DE MODIFICATIONS À APPORTER À LA CLASSIFICATION DE NICE PAYS/ORGANISATION: France / institut National de la Propriété Industrielle DATE: Octobre Ajouter matériel informatique 1 This proposal is consistent with current USPTO policy of classifying Computer hardware in Class 9 as set forth in the U.S. ID Manual. i 10 Ajouter jouets sexuels Par analogie avec l'entrée déjà : poupées érotiques [poupées sexuelles] 2.1 Under current USPTO policy, USPTO requires customers to specify the common commercial names of the Sex toys, e.g., vibrators, handcuffs, etc., and classifies the goods in Class 10 only when they are used for direct sexual stimulation. ii USPTO generally favors adopting this new entry in the Nice Alphabetical List ensuring classification of all sex toys in Class 10 whether the goods are for direct sexual stimulation, such as vibrators, or indirect sexual stimulation, such as handcuffs or blindfolds Changer jouets jouets* 2.2 If the proposal to add Sex toys in Class 10 is adopted, USPTO supports this proposal to modify Toys (Basic No ) in Class 28.

As an alternative to the proposed deletion, USPTO suggest modifying Basic No to Electrical insulating rubber gloves in Class 17.

4 Annex 03, page 4 6 The term dispensers for dog waste bags in Class 21 is overbroad and may include goods in multiple classes, e.g., fixed dispensers of metal for pet waste bags in Class 6, fixed dispensers not of metal for pet waste bags in Class 20, v and pet waste bag dispensers for attachment to dog leashes in Class 18, (shown below). 21 Ajouter distributeurs de sacs pour déjections canines Choix de la classe 21 par analogie avec les distributeurs de papier hygiénique. This proposal is consistent with current USPTO policy, as set forth in the U.S. ID Manual, of classifying Outsource service provider services according to the nature and purpose of the outsourced service being rendered vi. 35 Ajouter gestion administrative externalisée d'entreprises [domiciliation d'entreprises] Ce service consiste pour une entreprise à gérer des travaux administratifs (tels la réception et la gestion du courrier, l'accueil téléphonique personnalisé et les travaux de secrétariat) pour le compte d'une autre entreprise en contrepartie d'une compensation financière. In addition to Outsource service provider in the field of office functions in Class 35, USPTO suggests also adding a new indication covering Outsource service provider in the field of information technology in Class 42. These two new indications would make clear that outsourced services are not uniformly classified as business services. Instead, outsourced services, like franchising services, are classified in the same class as the particular services provided by the outsource service provider, see General Remarks, Services (d). Furthermore, USPTO suggests a proposal to add a new subsection (e) to the General Remarks on Services, e.g., Services rendered by third parties on an outsourced basis are in principle classified in the same class as the particular services provided by the outsource service provider (e.g., outsource service provider services in the field of office functions (Class 35), information technology (Class 42), food preparation (Class 43), etc.).

Please see, for example: xing; and earch/howsearchworks/crawlingindexing.html USPTO suggests modifying the proposal from web site indexing to Internet indexing for others to distinguish these services from a different type of web indexing, which involves indexing (or creating an alphabetized list) of the contents of a single website only. The suggested modification also makes clear that Internet indexing for the purpose of improving one s own search engine is not considered a service. USPTO also suggests re-classifying Internet indexing for others in Class 42 as a computer technology service.

USPTO suggests modifying the proposal to indicate a specific type of waste recovery, such as Energy recovery from waste [transforming nonrecyclable materials to useable forms of energy]. Nice Classification system users may refer to this specific indication in Class 40 and analogize other types of waste recovery to it for classification purposes.

Therefore, the services indicated in the fill-in-the-blank portion must be definite under USPTO identification and classification policy.
