Description Subsection 11(1) of the Immigration and Refugee Protection Act requires that a foreign national apply for and obtain a visa before entering Canada, except in such cases as are prescribed by the regulations. Paragraph 190(1)(a) of the Immigration and Refugee Protection Regulations exempts citizens of specific countries, as well as specific groups of foreign nationals, from the requirement to obtain a temporary resident visa. The current temporary resident visa requirement for the citizens of the Republic of Estonia has been in place since the Republic of Estonia regained its independence in August Description RÉSUMÉ DE L ÉTUDE D IMPACT DE LA RÉGLEMENTATION (Ce résumé ne fait pas partie du règlement.) As a result, foreign nationals who are citizens of the Republic of Estonia will no longer be required to obtain a temporary resident visa before entering Canada. The decision to lift the visa requirement for nationals of Estonia is based on the results of the ongoing monitoring of this country s conditions which began in September On May 1, 2004, the Republic of Estonia, the smallest and the northern most of the three Baltic States, joined the European Union. The Republic of Estonia is highly developed 1 and politically stable. Canada has the second largest Estonia community outside of Estonia and maintains a strong bilateral relationship with this country. Irregular migration is negligible and spurious refugee claims do not pose a threat to the integrity of Canada s social programs. Since 2004, the visa application refusal rate has remained consistently lower than 3%. In addition, public health and safety issues do not warrant the retention of the visa requirement. Alternatives There is no alternative to amending the regulations to exempt citizens of a country from the temporary resident visa requirement. Benefits and Costs Benefits Between 1999 and 2005, a total of 7,275 temporary resident visa applications were received. This exemption will facilitate their travel to Canada and may serve to strengthen ties to the existing community in Canada. It is anticipated that the removal of the temporary resident visa requirement will bring direct economic benefits by facilitating business exchanges and increasing tourism from the Republic of Estonia. Costs In the last five years, the Government of Canada has received an average of 1,000 applications per year. The foregone revenue associated with this fee exemption is estimated to be approximately $90,000 annually based on the current fees for single and multiple entry visas ($75/$150). There will be no implementation costs associated with this new measure. Currently, the visa delivery services are provided by the Immigration Section of the Canadian Embassy in Warsaw, Poland. The impact on human resources will be minimal as they will be reallocated to other services in Warsaw. (1) For the purposes of every provision of the Act that requires interest at a prescribed rate to be paid to the Receiver General, the prescribed rate in effect during any particular quarter is the total of (a) the rate that is the simple arithmetic mean, expressed as a percentage per year and rounded to the next higher whole percentage where the mean is not a whole percentage, of all amounts each of which is the average equivalent yield, expressed as a percentage per year, of Government of Canada Treasury Bills that mature approximately three months after their date of issue and that are sold at auctions of Government of Canada Treasury Bills during the first month of the quarter preceding the particular quarter, and (b) 4%. (2) For the purposes of every provision of the Act that requires interest at a prescribed rate to be paid or applied on an amount payable by the Minister to a person, the prescribed rate in effect during any particular quarter is the total of (a) the rate determined under paragraph (1)(a) in respect of the particular quarter, and (b) 2%. Description The Excise Act, 2001 (the Act ) came into force in It established a new legislative framework for the federal taxation of spirits, wine and tobacco products, and replaced the previous tax structure with an up-to-date approach that reflects current industry and administrative practices. Where a person fails to pay duty or other amounts under the Act to the Receiver General as and when required (or where the Minister of National Revenue owes an amount to a person), compound interest is payable at the prescribed rate in order to maintain the time-value of the amount owed. The Interest Rates (Excise Act, 2001) Regulations (the Regulations ) are necessary to establish the applicable rates of interest both for amounts owed to and by the Government under the new Act. The Regulations also harmonize the interest rate provisions under the Act with those of the Income Tax Act (the ITA ), the intended standard for all federal taxing statutes under the Government s Standardized Accounting initiative. The goal of this initiative is to simplify tax compliance by businesses through the harmonization of administrative provisions across federal taxing statutes. The interest and penalty provisions on amounts owed to and by the Government under the statutes previously governing the taxation of spirits, wine and tobacco products were different from those in the ITA in three principal ways: first, a penalty of 0.5% per month plus interest was imposed on amounts owed by a person, whereas the ITA imposes just interest and no penalty; second, in the case of amounts owed by a person to Her Majesty, the prescribed interest rate of the ITA was either 2% or 4% higher; and third, in the case of amounts owed by the Crown to a person, no interest was payable to the person or the prescribed interest rate was 2% lower than that payable under the ITA. The new Act does not impose a penalty on amounts owed by a person to the Government, thereby harmonizing the penalty provisions of the new Act on these amounts with those of the ITA. The Regulations are necessary to harmonize the prescribed rates of interest. Under the Regulations, the rate of interest is established quarterly. The base interest rate is the arithmetic mean, rounded to the next whole percentage, of the average equivalent Description (Ce résumé ne fait pas partie du règlement.) Le règlement harmonise également les dispositions concernant les intérêts à payer aux termes de la Loi avec celles de la Loi de l impôt sur le revenu (la «LIR»); cette dernière est considérée comme étant la norme en matière de législation fiscale dans le cadre de l initiative de comptabilité normalisée. Le but de cette initiative est de faciliter l observation des règles fiscales par les entreprises au moyen de l harmonisation de dispositions administratives à travers les lois fiscales. Les dispositions concernant les intérêts et pénalités applicables aux sommes dues au receveur général et aux sommes à payer par le ministre du Revenu national aux termes des lois qui autrefois régissaient la taxation des spiritueux, du vin et des produits du tabac étaient différentes de celles de la LIR principalement pour trois raisons : premièrement, une pénalité mensuelle de 0,5 % ainsi que des intérêts étaient calculés sur les sommes dues par une personne, alors qu aux termes de la LIR, seuls des intérêts sont à payer; deuxièmement, dans le cas de sommes dues par une personne à Sa Majesté, le taux d intérêt réglementaire de la LIR était supérieur de 2 % ou 4 %; troisièmement, dans le cas de sommes dues par la Couronne à une personne, soit aucun intérêt n était à payer à la personne, soit le taux d intérêt réglementaire était inférieur de 2 %. La nouvelle loi n impose pas de pénalités sur les sommes dues par une personne au gouvernement. Cela a pour effet d harmoniser les dispositions de la nouvelle loi relatives à ces sommes avec les dispositions semblables de la LIR. Le règlement est nécessaire afin d harmoniser les taux d intérêt réglementaires. Selon le règlement, le taux d intérêt est établi trimestriellement. Le taux de base représente la moyenne arithmétique, arrondie au point de pourcentage supérieur, du taux de 1412

The prescribed interest rate for amounts owed to Her Majesty is the base rate plus 4%; for amounts payable by the Minister, base plus 2%. All interest and yield rates are expressed as an annual percentage. As announced on June 24, 2003, the Regulations are deemed to come into force on July 1, 2003, the date on which the Act came fully into force. Alternatives The Regulations are required in order to bring into effect the underlying policy intent of applying interest on amounts owing or payable under the Act. No alternatives to the Regulations were considered, since legislation specifically provides for the rate of interest to be prescribed by regulation. Benefits and Costs Establishing interest rates for amounts owing both to and by the Government adds fairness to the tax system for all stakeholders. Harmonizing prescribed interest rates with those of the ITA will simplify tax compliance by businesses. Strategic environmental assessment A strategic environmental assessment has been conducted, and there are no important environmental effects associated with the Regulations. Consultation The enactment of the Act was the culmination of a comprehensive review of the federal legislative and administrative framework for the taxation of alcohol and tobacco products. The review was jointly undertaken by the Department of Finance and the Canada Customs and Revenue Agency (continuing as the Canada Revenue Agency the CRA ) and encompassed extensive consultations with other federal departments, affected industries, provincial governments and liquor boards and enforcement agencies. Draft regulations, including regulations respecting interest rates, were released in December 2001, at the time the legislation implementing the Act was tabled in Parliament. Description The Excise Tax Act (the Act ) imposes excise taxes on premiums in respect of insurance effected outside Canada (Part I of the Act), as well as on gasoline, aviation gasoline, diesel, aviation fuel, automobile air conditioners and heavy automobiles (Part III of the Act). Where a person fails to pay a tax imposed under the Act to the Receiver General as and when required (or where the Minister of National Revenue owes an amount to a person), compound interest is payable at the prescribed rate in order to maintain the time-value of the amount owed. In the federal budget tabled in the House of Commons on February 18, 2003, the Government of Canada proposed to begin the implementation of Standardized Accounting (an initiative aimed at simplifying tax compliance by businesses) by harmonizing, among others, provisions concerning the amount of interest and penalties payable on amounts owing under the Act (non-gst) and the Income Tax Act (the ITA ). There were then two fundamental differences between the interest and penalty provisions of these Acts: the Act imposed a 0.5% penalty per month on amounts owed by a person to Her Majesty under Part III of the Act (and a 5% penalty in the case of amounts owed by a person to Her Description 1 SOR/ DORS/91-19 RÉSUMÉ DE L ÉTUDE D IMPACT DE LA RÉGLEMENTATION (Ce résumé ne fait pas partie du règlement.) The Budget Implementation Act, 2003, which received Royal Assent on May 27, 2003, repealed penalties payable on amounts owed by a person to Her Majesty under the Act (non-gst), effective July 1, 2003, thereby harmonizing the penalty provisions of the Act with those of the ITA. The Interest Rates (Excise Tax Act) Regulations (the Regulations ) complement the legislative changes in Budget Implementation Act, 2003, and are necessary to harmonize the prescribed rates of interest.
