2 Quelques rappels importants: 1. La distinction entre MTI et PTC peut être réalisée par le CAT de l EMA dont c est un des rôles (art 17 REG 1394/2007) 2. Un MTI-PP est d abord un MTI et doit répondre à la définition des MTI 3. La réglementation MTI-PP est une dispense et doit rester une exception

11 CD34 usage non homologue On the basis that: - the product consists of autologous bone marrow derived CD34+ cells -the bone marrow derived CD34+ cells are not intended to be used for the same essential function -The product is intended for the treatment of refractory angina via stem-cell induced angiogenesis in ischemic area of heart tissue by non-haematological differentiation of bone marrow-derived mononuclear cells into vascular cells and/or by paracrine effect of the stem cells -The EMA/CAT considers that the product falls within the definition of a tissue engineered product

12 Fraction stroma-vasculaire Autologous, non-manipulated lipoaspirate containing adipocytes and stromal vascular fraction intended to act as a natural autologous lipofiller Not ATMP 31/05/2012

13 On the basis that: - the product is composed of non-manipulated adipocytes in their natural environment (stromal vascular fraction) - the product acts as a natural, autologous filler, intended to be used for the same essential function in the recipient site as in the donor site (restoration of subcutaneous fat tissue) The EMEA/CAT considers that the product does not fall within the definition of an advanced therapy medicinal product as provided in Article 2(1)(a) of Regulation (EC) No 1394/2007.

18 Ne correspond pas à un MTI-PP Vecteur de transfert de gènes pour une utilisation in vivo Banques de lignées cellulaires allogéniques Cellules ou tissus xénogéniques

21 Conclusions 1. La distinction entre PTC et MTI est faite au niveau européen selon le cadre réglementaire en vigueur 2. L autorisation d un MTI-PP est accordée par chaque état membre 3. La réglementation française est aujourd hui en place pour répondre à toutes les demandes
