1 ELEVATOR AND FIXED CONVEYANCES ACT Pursuant to section 19 of the Elevator and Fixed Conveyance Act, the Commissioner in Executive Council orders as follows: 1. The annexed Fixed Conveyances Regulations is hereby made and established. 2. Order-In-Council 1986/63 is revoked. 2 FIXED CONVEYANCES REGULATIONS Interpretation Définitions RÈGLEMENTS SUR LES 1. In these Regulations, Application "contractor" means a person registered under section 6 of these Regulations who is engaged by an owner to design, construct, install, repair, maintain or test a fixed conveyance; «entrepreneur» "fixed conveyance" has the same meaning as in the Act; «transporteur fixe» "inspector" means an inspector appointed under section 3 of the Act and includes the chief inspector. «inspecteur" 2.(1) These Regulations apply to the installation, operation, maintenance, and inspection of fixed conveyances, with the exception of (a) a fixed conveyance installed in a private residence; (b) a hand powered dumbwaiter. Devices in Schedule I 3. These Regulations apply to devices listed in Schedule I. Codes 4. The codes as listed with exceptions in Schedule II are hereby adopted. Reference to a code 5. A reference in a code adopted by these Regulations to the National Building Code or to the Canadian Electrical Code is deemed to be a reference to that Code as it applies in the Yukon. Registration of contractor 6. No person, firm or corporation shall install, service, or maintain a fixed conveyance unless registered as a 1. Un code qui s applique au présent règlement et qui réfère par renvoi au Code national du bâtiment (Canada) ou au Code canadien de l électricité est considéré être un renvoi à ces codes, tels qu ils s appliquent au Yukon. Qualifications of personnel 7. The applicant who intends to register must satisfy the chief inspector with respect to the competence of its personnel, its ability, its resources, and its knowledge of the codes listed in Schedule II. Installation and maintenance 8. The contractor shall be capable of, or shall employ a mechanic or technician who is capable of, installing and maintaining each fixed conveyance for which the contractor is responsible. Fee and form of registration 9. Registration shall be in a form prescribed by the chief inspector and subject to an annual registration fee, or suspension if not in compliance with these Regulations. Emergency evacuation 10. Notwithstanding section 6, an owner or owner s agent, if trained, may perform emergency evacuation. Plans 11. Prior to constructing or altering a fixed conveyance, the owner or the owner s agent shall submit plans to an inspector, which (a) must show conformance with these Regulations, (b) must be sealed by a professional engineer, registered in the Yukon, and (c) shall be in a form acceptable to the inspector. Initial inspection and tests 12. Prior to being placed in service, the new or altered fixed conveyance shall be subject to an initial inspection and tests. Compétences du personnel 7. Modalités et frais d inscription 9. L inscription doit respecter les modalités prescrites par l inspecteur en chef, comprenant, entre autres, le paiement de frais annuels. L inscription peut également être suspendue si le présent règlement n est pas respecté. Évacuation d urgence 10. Malgré l article 6, un propriétaire ou son mandataire peut procéder à une évacuation d urgence s il possède la formation. Plans 11. Avant la construction ou la modification d un transporteur fixe, le propriétaire ou son mandataire doit soumettre à un inspecteur des plans : a) démontrant que ce qui est proposé est conforme au présent règlement; b) sur lesquels apparaît le sceau d un ingénieur inscrit au Yukon afin d y pratiquer sa profession; c) selon les modalités qu il a prescrites. Essais et première inspection 12. Le transporteur fixe, qu il soit neuf ou modifié, doit faire l objet d une première inspection et d essais avant d être mis en service. 3

4 Authorisation by inspector 13. The initial inspection and tests shall be conducted by a person employed by, or authorised by an inspector. Correction of deficiencies 14. Deficiencies noted during the initial inspection and tests shall be corrected before the device is placed in service. Installer s Declaration 15. Prior to the initial inspection, the registered contractor performing the installation must submit an Installers Declaration certifying that the device is installed in compliance with and according to the registered drawings and the applicable codes. Safety inspections at intervals 16. Periodic safety inspections by an inspector shall be conducted at intervals, as set out by the chief inspector. Fees 17. Fees for a periodic inspection will be charged as set out in section 19. Responsibility of owners and contractors 18. It is the owner s and registered contractor s responsibility to ensure that: (a) no person, firm or corporation shall be assigned or undertake work that they have not been registered for under section 6 and have experience in; (b) a fixed conveyance is in safe operating condition; (c) a log book is provided in the machine room to record all the maintenance, service, and alterations performed on a fixed conveyance; (d) accidents are reported to an inspector, as per section 12 of the Act; (e) an "Elevator Inspection Certificate" is installed Autorisation par un inspecteur 13. L entrepreneur qui est inscrit et qui effectue l installation doit, avant la première inspection, soumettre le formulaire intitulé «Déclaration suite à l installation d un transporteur fixe», attestant que l installation de l appareil s est fait conformément aux dessins enregistrés ainsi qu aux codes pertinents. Inspections périodiques 16. Des inspections de sécurité périodiques doivent être effectuées à intervalles, telles qu établies par l inspecteur en chef. Droits 17. Les droits à payer pour une inspection périodique sont ceux énumérés à l article 19. Responsabilité du propriétaire et de l entrepreneur 18. Le propriétaire ainsi que l entrepreneur inscrit ont la responsabilité de s assurer : a) qu aucune personne, entreprise ou personne morale n entreprenne un travail ou qu un travail lui soit attribuée, pour lequel elle n a pas les compétences et pour lequel elle n est pas inscrite conformément l article 6; b) qu un transporteur fixe est en état de fonctionner de façon sécuritaire; c) qu un carnet de contrôle se retrouve à la salle des machines et qu il y soit inscrit les entretiens et les modifications effectués sur un transporteur fixe; d) d informer un inspecteur de tout accident, conformément à l article 12 de la loi; 4

6 Initial inspection 20. The fee for an initial inspection is three times the fee set out in section 19. Special inspection 21. The fee for a special inspection is two times the fee set out in section 19. Inspector s expenses 22. When a special inspection is requested by the owner of a fixed conveyance or of any class or classes thereof, the owner shall remit to the Department, in addition to the fee set out in section 21, the expenses incurred by the inspector at the current rate, according to the Yukon Government travel directive. Responsibility of payment 23. Each owner of a fixed conveyance or of any class or classes thereof shall be responsible for the payment of the inspection fee. Fees not paid 24. If an inspection fee is not paid within 90 days of the date of the issue of the invoice for the inspection, the chief inspector may require that the fixed conveyance be taken out of service. Application of seal 25. Where a fixed conveyance is required to be taken out of service under section 24 an inspector shall, on the direction of the chief inspector, seal the main service switch of the fixed conveyance or the inspector shall take out of service any fixed conveyance, when an inspection reveals deficiencies, and shall not be reactivated without the inspector s approval. Prohibitions 26. No person shall: (a) break or remove a seal affixed to a fixed conveyance pursuant to section 25 except on the authority of an inspector; or (b) operate a fixed conveyance that is sealed pursuant to section 25. Apposer les scellés 25. Lorsqu un transporteur fixe doit cesser d être utilisé en vertu de l article 24 ou lorsqu une inspection révèle des défauts ou des vices, un inspecteur doit apposer les scellés sur le commutateur principal. Le transporteur fixe ne peut alors être remis en marche qu avec l autorisation d un inspecteur. Interdictions 26. Nul ne doit : a) briser ou enlever les scellés apposés sur le transporteur fixe en vertu de l article 25, à moins d obtenir l autorisation de le faire de la part d un inspecteur; 6

7 Seal broken 27. Where a seal affixed pursuant to section 25 is broken, or removed without the authority of an inspector, the owner of the fixed conveyance shall forthwith notify the chief inspector in writing of the break or removal. Offences and penalties 28. Section 21 of the Act applies to these Regulations concerning the prosecution of offences and the penalties to be applied. The following devices are designated as fixed conveyances to which these Regulation apply: (a) passenger elevators; (b) freight elevators; (c) power dumbwaiters; (d) escalators; (e) inclined passenger lifts; (f) belt lift type man lifts (g) aerial tramways (reversible aerial ropeways); (h) chair lifts; (i) ski tows (T-bars, J-bars, and platter lifts); (j) rope tows; (k) speed walks; (l) speed ramps; (m) freight platform lifts; (n) power type man lifts; (o) personnel hoists; (p) handicapped lifts; (q) gondola lifts, and (r) amusement rides. ANNEXE I 1.
