236 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 CHAPTER E-0.2 REG 11 The Education Act, 1995 Clause 3(2)(g) Minister s Order, dated May 2, 2002 (Filed May 6, 2002) PART I Title and Interpretation Title 1 These regulations may be cited as The Teacher Certification and Classification Regulations, 2002. Interpretation 2(1) In these regulations: applicant means an applicant for a teacher s certificate; («demandeur») approved means approved by the minister; («agréé») certifying official means an employee of the department appointed by the minister as the certifying official for the purposes of these regulations; («agent d attribution des brevets») educational institution means an educational institution that provides approved post-secondary education, and includes any approved college, institute or university other than The University of Saskatchewan and The University of Regina; («établissement d enseignement») post-secondary education means education or training beyond a complete Saskatchewan Grade 12 or an equivalent level of education approved for the purposes of certification of teachers; («études postsecondaires») probationary teacher s certificate means a probationary teacher s certificate issued pursuant to section 10; («brevet d enseignement probatoire») Professional A Teacher s Certificate means a Professional A Teacher s Certificate issued pursuant to section 5; («brevet d enseignement professionnel A») Professional B Teacher s Certificate (Endorsed) means a Professional B Teacher s Certificate (Endorsed) issued pursuant to section 6; («brevet d enseignement professionnel B (avec mention)») provisional teacher s certificate means a provisional teacher s certificate issued pursuant to section 9; («brevet d enseignement provisoire») recognized means recognized by the minister; («reconnu») teacher s certificate means a teacher s certificate issued pursuant to Part II; («brevet d enseignement»)

238 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 Technical Teacher s Certificate (Endorsed) means a Technical Teacher s Certificate (Endorsed) issued pursuant to section 8; («brevet d enseignement technique (avec mention)») the university means The University of Saskatchewan or The University of Regina; («l université») Vocational Teacher s Certificate (Endorsed) means a Vocational Teacher s Certificate (Endorsed) issued pursuant to section 7; («brevet d enseignement en formation de métier (avec mention)») year of graduate study means at least 30 semester hours of study at the university or other approved educational institution. («année d études supérieures») (2) Unless otherwise stated, all references in these regulations to university degrees, graduate study or years of graduate study refer to the degrees, standards or programs of the university. (3) The requirements of the university are to be used as a guide in appraising programs of education or professional training from other educational institutions. PART II Certification Application for certification 3 Every applicant for a teacher s certificate shall: (a) apply to the certifying official in the form provided by the department; and (b) submit to the certifying official: (i) evidence satisfactory to the certifying official that the applicant meets the requirements set out in this Part for the issuance of a teacher s certificate; (ii) a written statement: (A) stating whether the applicant has at any time been convicted of, or is presently charged with: (I) any criminal offence of a sexual nature; or (II) any criminal offence involving a minor; (B) if a conviction or charge is disclosed pursuant to paragraph (A), providing the details of the conviction or charge; (C) authorizing a criminal record search respecting the applicant;

PARTIE II Attribution des brevets Demande d attribution d un brevet 3 Celui qui demande un brevet d enseignement: a) présente sa demande à l agent d attribution des brevets en la formule fournie par le ministère; b) remet à l agent d attribution des brevets: (i) la preuve que l agent d attribution de brevets juge satisfaisante établissant qu il remplit les conditions énoncées dans la présente partie pour la délivrance d un brevet d enseignement, (ii) une déclaration écrite: (A) indiquant s il a été déclaré coupable des infractions suivantes, ou s il en est actuellement accusé: (I) une infraction criminelle d ordre sexuel, (II) une infraction criminelle à l égard d un mineur, (B) donnant les détails de la déclaration de culpabilité ou de l accusation visée à la division (A), le cas échéant, (C) autorisant une recherche dans son casier judiciaire,

240 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 (D) stating whether the applicant has held a qualification to teach that has at any time been suspended or cancelled; and (E) if a suspension or cancellation is disclosed pursuant to paragraph (D), providing the details of the suspension or cancellation; and (iii) any other information or document that the certifying official may require. Issuance of teacher s certificate 4(1) The certifying official may issue a teacher s certificate to an applicant if the certifying official is satisfied that: (a) the applicant meets the requirements set out in this Part for the issuance of a teacher s certificate; (b) the applicant has paid the fees prescribed in The Education Regulations, 1986 for the issuance of an original teacher s certificate; and (c) there are no reasonable grounds to refuse to issue a teacher s certificate to the applicant. (2) Subject to subsection (3), a teacher s certificate issued pursuant to this Part: (a) is permanent; and (b) remains in force unless suspended or cancelled pursuant to The Education Act, 1995. (3) Clause (2)(a) does not apply to: (a) a provisional teacher s certificate; or (b) a probationary teacher s certificate. Professional A Teacher s Certificate 5(1) The certifying official may issue a Professional A Teacher s Certificate to an applicant who: (a) holds a Bachelor of Education degree or an equivalent approved degree; or (b) holds an approved degree and has completed at least 48 semester hours of approved teacher education, including the practicum, at the university or any other approved educational institution. (2) A Professional A Teacher s Certificate confers eligibility to teach at any grade from kindergarten to Grade 12. Professional B Teacher s Certificate (Endorsed) 6(1) The certifying official may issue a Professional B Teacher s Certificate (Endorsed) to an applicant who: (a) holds: (i) a degree in fine or applied arts, music, engineering science or technology, or in any other approved area of specialization, from the university or any other educational institution; or

THE SASKATCHEWAN GAZETTE, MAY 10, 2002 241 (D) indiquant s il a déjà détenu un brevet de compétence en enseignement qui a été suspendu ou annulé, (E) donnant les détails de la suspension ou de l annulation visée à la division (D), le cas échéant, (iii) tout autre renseignement ou document que l agent d attribution des brevets exige. Délivrance d un brevet d enseignement 4(1) L agent d attribution des brevets peut délivrer un brevet d enseignement à un demandeur s il est convaincu: a) que le demandeur remplit les conditions prévues à la présente partie pour la délivrance de brevets d enseignement; b) que le demandeur a versé les droits de délivrance d un brevet d enseignement initial prévus dans le règlement intitulé The Education Regulations, 1986; c) qu il n existe aucun motif raisonnable pour refuser de délivrer un brevet d enseignement au demandeur. (2) Sous réserve du paragraphe (3), le brevet d enseignement délivré sous le régime de la présente partie: a) est permanent; b) demeure en vigueur, à moins qu il ne soit suspendu ou annulé sous le régime de la Loi de 1995 sur l éducation. (3) L alinéa (2)a) ne s applique pas: a) aux brevets d enseignement provisoires; b) aux brevets d enseignement probatoires. Brevet d enseignement professionnel «A» 5(1) L agent d attribution des brevets peut délivrer un brevet d enseignement professionnel «A» au demandeur qui: a) soit est titulaire du baccalauréat en éducation ou d un diplôme équivalent agréé; b) soit est titulaire d un diplôme agréé et a accompli au moins 48 heuressemestre d études en éducation agréées, notamment le stage pratique, à l université ou à tout autre établissement d enseignement agréé. (2) Le brevet visé au paragraphe (1) donne à son titulaire le droit d enseigner les classes de la maternelle à la douzième année. Brevet d enseignement professionnel «B» (avec mention) 6(1) L agent d attribution des brevets peut délivrer un brevet d enseignement professionnel «B» (avec mention) au demandeur qui, à la fois: a) est titulaire: (i) soit d un diplôme en beaux-arts, en arts appliqués, en musique, en sciences de génie, en techniques de génie ou dans tout autre domaine de spécialisation agréé, soit de l université ou de tout autre établissement d enseignement,

242 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 (ii) a national or state diploma or certificate in any approved area of specialization which confers professional status and which is recognized as being equivalent to a bachelor s degree in length and quality of training; and (b) has completed at least 48 semester hours of approved teacher education, including the practicum, at the university or any other approved educational institution. (2) The certifying official shall endorse a Professional B Teacher s Certificate (Endorsed) with the applicant s area of specialization. (3) A Professional B Teacher s Certificate (Endorsed) confers eligibility on the applicant to teach the area of specialization endorsed on the certificate and related areas of specialization at any grade from kindergarten to Grade 12. Vocational Teacher s Certificate (Endorsed) 7(1) Subject to subsection (2), the certifying official may issue a Vocational Teacher s Certificate (Endorsed) to an applicant who: (a) holds a journeyperson s certificate that: (i) is in an approved trade; or (ii) is issued pursuant to regulations made pursuant to The Apprenticeship and Trade Certification Act, 1999; and (b) has completed at least 30 semester hours of approved teacher education, in addition to the practicum, at the university or any other approved educational institution. (2) The certifying official shall not issue a Vocational Teacher s Certificate (Endorsed) to an applicant unless the trade to which the applicant s journeyperson s certificate relates is taught as a subject in a school in Saskatchewan. (3) The certifying official shall endorse a Vocational Teacher s Certificate (Endorsed) with the trade identified in the applicant s journeyperson s certificate or other certificate of competency. (4) A Vocational Teacher s Certificate (Endorsed) confers eligibility on the applicant to teach the trade endorsed on the certificate at any grade from kindergarten to Grade 12. Technical Teacher s Certificate (Endorsed) 8(1) The certifying official may issue a Technical Teacher s Certificate (Endorsed) to an applicant who: (a) has completed a program of studies in an approved technology of not less than two years duration at an approved educational institution, specializing in an area that is taught as a subject in a school in Saskatchewan; (b) has 24 months of recognized work experience in the area of the approved technology; and (c) in addition to the practicum, has completed at least 30 semester hours of approved teacher education at the university or any other approved educational institution.

(2) L agent d attribution des brevets assortit le brevet visé au paragraphe (1) de la mention du domaine de spécialisation de son titulaire. (3) Le brevet visé au paragraphe (1) donne à son titulaire le droit d enseigner dans le domaine de spécialisation qui y est indiqué et dans les domaines de spécialisation connexes, aux classes de la maternelle à la douzième année. Brevet d enseignement en formation de métier (avec mention) 7(1) Sous réserve du paragraphe (2), l agent d attribution des brevets peut délivrer un brevet d enseignement en formation de métier (avec mention) au demandeur qui, à la fois: a) est titulaire d un certificat d ouvrier spécialisé: (i) soit dans un métier agréé, (ii) soit qui est délivré en application des règlements pris en vertu de la loi intitulée The Apprenticeship and Trade Certification Act, 1999; b) a accompli au moins 30 heures-semestre d études en éducation agréées, en plus du stage pratique, à l université ou à tout autre établissement d enseignement agréé. (2) L agent d attribution des brevets ne peut délivrer le brevet visé au paragraphe (1) à un demandeur que si le métier auquel son certificat d ouvrier spécialisé se rapporte est une matière enseignée dans une école en Saskatchewan. (3) L agent d attribution des brevets assortit le brevet visé au paragraphe (1) de la mention du métier visé par le certificat d ouvrier spécialisé ou autre certificat de compétence de son titulaire. (4) Le brevet visé au paragraphe (1) donne à son titulaire le droit d enseigner le métier qui y est indiqué aux classes de la maternelle à la douzième année. Brevet d enseignement technique (avec mention) 8(1) L agent d attribution des brevets peut délivrer un brevet d enseignement technique (avec mention) au demandeur qui, à la fois: a) a terminé un programme d études dans un domaine de technologie agréé d une durée minimale de deux ans dans un établissement d enseignement agréé, s étant spécialisé dans un domaine enseigné comme matière dans une école en Saskatchewan; b) possède 24 mois d expérience de travail reconnue dans le domaine de la technologie agréé; c) a accompli au moins 30 heures-semestre d études en éducation agréées, en plus du stage pratique, à l université ou à tout autre établissement d enseignement agréé.

244 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 (2) The certifying official shall endorse a Technical Teacher s Certificate (Endorsed) with the applicant s area of specialization. (3) A Technical Teacher s Certificate (Endorsed) confers eligibility on the applicant to teach the area of specialization endorsed on the certificate at any grade from kindergarten to Grade 12. Provisional teacher s certificate 9(1) An applicant who received his or her education in an approved educational institution other than the university is eligible to apply for a teacher s certificate if the applicant: (a) has high school qualifications equivalent to Saskatchewan Grade 12 standing; (b) has professional, general and specific education equivalent to that required for certification of persons educated in Saskatchewan; and (c) has obtained a teaching position in Saskatchewan. (2) Any teacher s certificate issued to a person pursuant to subsection (1) is to be designated as a provisional teacher s certificate and may be issued subject to any conditions that the certifying official considers appropriate. (3) A provisional teacher s certificate is valid for one year and may be replaced with the corresponding permanent teacher s certificate on the completion of 190 days of successful teaching experience and the removal of any conditions attached to the provisional teacher s certificate. (4) The provisional teacher s certificate confers on the applicant the same eligibility to teach as the applicant s corresponding permanent teacher s certificate. (5) Notwithstanding subsections (1) to (4), if Saskatchewan has entered into an agreement with another province or a territory providing for the certification of teachers from that province or territory in Saskatchewan, a provisional teacher s certificate may be issued to an applicant in accordance with that agreement. Probationary teacher s certificate 10(1) A board of education or the conseil scolaire may apply to the certifying official, in the form provided by the department, for the issuance of a probationary teacher s certificate if the board of education or the conseil scolaire is unable to fill a teaching position with a person who possesses a teacher s certificate that is valid for that position. (2) The certifying official may issue a probationary teacher s certificate to a person if the certifying official: (a) receives a written application pursuant to subsection (1); and (b) is satisfied that the board of education or the conseil scolaire has made all reasonable efforts to fill the position with a person who possesses, or who is eligible for, a teacher s certificate that is valid for that position. (3) A probationary teacher s certificate issued pursuant to subsection (2) is valid until the end of the academic year in which it is issued.

(3) Le brevet visé au paragraphe (1) donne à son titulaire le droit d enseigner le domaine de spécialisation qui y est indiqué aux classes de la maternelle à la douzième année. Brevet d enseignement provisoire 9(1) Le demandeur qui a étudié dans un établissement d enseignement agréé autre que l université peut demander un brevet d enseignement s il remplit les conditions suivantes: a) il possède une formation scolaire équivalente au diplôme de douzième année de la Saskatchewan; b) il a fait des études professionnelles, générales et particulières équivalentes aux études exigées pour l attribution de brevets aux personnes éduquées en Saskatchewan; c) il a obtenu un poste d enseignant en Saskatchewan. (2) Tout brevet d enseignement délivré à une personne en vertu du paragraphe (1) est désigné brevet d enseignement provisoire et peut être assorti des conditions que l agent d attribution des brevets estime indiquées. (3) Le brevet d enseignement provisoire demeure en vigueur pendant un an et peut être remplacé par le brevet d enseignement permanent correspondant après que son titulaire ait réussi à acquérir 190 jours d expérience en enseignement et après que toutes les conditions dont il pouvait être assorti aient été supprimées. (4) Le brevet d enseignement provisoire donne à son titulaire le droit d enseigner au même titre que son brevet d enseignement permanent correspondant. (5) Malgré les paragraphes (1) à (4), si la Saskatchewan a conclu une entente avec une autre province ou un territoire qui prévoit l attribution de brevets en Saskatchewan aux enseignants de cette province ou de ce territoire, un brevet d enseignement provisoire peut être délivré à un demandeur conformément à l entente. Brevet d enseignement probatoire 10(1) Une commission scolaire ou le conseil scolaire peut présenter une demande à l agent d attribution des brevets, en la formule fournie par le ministère, pour l attribution d un brevet d enseignement probatoire, si la commission scolaire ou le conseil scolaire ne réussit pas à combler un poste d enseignant avec le titulaire d un brevet d enseignement valide pour le poste. (2) L agent d attribution des brevets peut délivrer le brevet visé au paragraphe (1) à une personne s il: a) reçoit une demande écrite en vertu du paragraphe (1); b) est convaincu que la commission scolaire ou le conseil scolaire a fait tous les efforts raisonnables pour combler le poste avec le titulaire d un brevet d enseignement valide pour ce poste ou par une personne qui y est admissible. (3) Le brevet d enseignement probatoire délivré en vertu du paragraphe (2) demeure en vigueur jusqu à la fin de l année scolaire de sa délivrance.

246 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 Teacher s certificate issued pursuant to former regulations 11 Notwithstanding any other provision of these regulations, if, on the day before the day on which this section comes into force, a person holds any of the following teacher s certificates issued pursuant to former regulations made pursuant to The School Act or The Education Act, that teacher s certificate remains valid in accordance with the terms of the teacher s certificate until it is cancelled or suspended in accordance with The Education Act, 1995: (a) a permanent teacher s certificate; (b) a provisional teacher s certificate; (c) a probationary teacher s certificate. PART III Classification Classification 12(1) A board of education or the conseil scolaire shall place a teacher in Class C if the teacher holds a probationary teacher s certificate but does not meet the qualifications of subsection (2). (2) A board of education or the conseil scolaire shall place a teacher in Class I if the teacher: (a) has completed two years of recognized post-secondary education; and (b) holds a probationary teacher s certificate. (3) A board of education or the conseil scolaire shall place a teacher in Class II if the teacher: (a) has completed a minimum of two years of recognized post-secondary education and holds one of the following certificates: (i) a Standard A Certificate issued pursuant to former regulations made pursuant to The School Act or The Education Act; (ii) a Standard B Certificate (Endorsed) issued pursuant to former regulations made pursuant to The School Act or The Education Act; or (b) has completed a minimum of three years of recognized post-secondary education and holds a probationary teacher s certificate. (4) A board of education or the conseil scolaire shall place a teacher in Class III if the teacher: (a) has completed a minimum of three years of recognized post-secondary education and holds one of the following certificates: (i) a Standard A Certificate issued pursuant to former regulations made pursuant to The School Act or The Education Act;

(5) A board of education or the conseil scolaire shall place a teacher in Class IV if the teacher: (a) has completed a minimum of four years of recognized post-secondary education and holds: (i) a Professional A Teacher s Certificate; or (ii) a Professional B Teacher s Certificate (Endorsed); or (b) has completed sufficient training so that only one year of additional university education is required to complete a four-year degree and holds one of the following certificates: (i) a Vocational Teacher s Certificate (Endorsed); (ii) a Technical Teacher s Certificate (Endorsed). (6) A board of education or the conseil scolaire shall place a teacher in Class V if the teacher has completed a minimum of five years of recognized post-secondary education and holds the certificates and degrees mentioned in one of the following clauses: (a) a Professional A Teacher s Certificate, a Bachelor of Education degree or a degree recognized as equivalent to a Bachelor of Education degree, and a second bachelor s degree; (b) a Professional A Teacher s Certificate, an approved bachelor s degree and one year of graduate study; (c) a Professional A Teacher s Certificate and an approved four-year bachelor s degree other than a Bachelor of Education degree; (d) a Professional B Teacher s Certificate (Endorsed) and an approved four-year bachelor s degree other than a Bachelor of Education degree; (e) a Vocational Teacher s Certificate (Endorsed) and a Bachelor of Education degree or a degree recognized as equivalent to a Bachelor of Education degree; (f) a Technical Teacher s Certificate (Endorsed) and a Bachelor of Education degree or a degree recognized as equivalent to a Bachelor of Education degree.

Provisional designation 13 The designation of provisional on a teacher s certificate pursuant to section 9 or clause 11(b) is to be disregarded for the purposes of classification pursuant to section 12. Classification and employment status 14 Notwithstanding the system of classification provided for pursuant to section 12, the classification of any teacher: (a) continuing in the employ of the same board of education after June 30, 1968 is not to be less favourable than the classification provided for in the salary schedule in effect in the school year ending June 30, 1968, under which the teacher was employed and classified, for as long as the teacher remains continuously in the employ of the same board of education or, if a change in jurisdiction has occurred, in the employ of a succeeding board of education; (b) continuously employed in teaching service in Saskatchewan on and after December 30, 1978 is not to be less favourable than the classification provided for in Saskatchewan Regulations 303/68; and (c) continuously employed in teaching service in Saskatchewan on and after the coming into force of these regulations is not to be less favourable than the classification provided for in The Teacher Certification and Classification Regulations, being chapter E-0.1 Reg 2 of The Revised Regulations of Saskatchewan.

252 THE SASKATCHEWAN GAZETTE, MAY 10, 2002 Date of reclassification 15(1) Whichever of the following dates occurs first after a teacher has met the requirements for reclassification is the effective date of the teacher s reclassification: (a) May 1; (b) September 1 or the school opening date, if the school opening date is before September 1; (c) January 1; (2) The date on which a teacher meets the requirements for reclassification is the date of the final test or examination which qualifies the teacher for the classification. (3) It is the responsibility of the teacher to furnish the board of education with evidence of his or her qualifications within the greater of the following periods: (a) 120 days after the day on which the teacher has met the requirements for reclassification; or (b) 120 days after the day on which the teacher commences his or her duties with the board of education. (4) If an appeal to the Teacher Classification Board is filed pursuant to subsection 271(1) of The Education Act, 1995: (a) within six months after the date of issue of the first salary cheque based on the classification granted by the employing board of education, the effective date of the reclassification determined by the Teacher Classification Board is the date determined pursuant to subsection (1); (b) after the expiration of the six-month period mentioned in clause (a), the effective date of the reclassification determined by the Teacher Classification Board is the date on which the appeal is received by the Teacher Classification Board. PART IV Repeal and Coming into Force R.R.S. c.e-0.1 Reg 2 repealed 16 The Teacher Certification and Classification Regulations are repealed. Coming into force 17 These regulations come into force on the day on which they are filed with the Registrar of Regulations.

R.R.S. c.a-10 Reg 1, new section 23 2 Section 23 of The Agricultural Implements Regulations, 1982 is repealed and the following substituted: Interpretation re model year 23(1) In section 28 of the Act and in these regulations, model year, with respect to an implement, means: (a) the model year of the implement as designated by the manufacturer of that implement; or (b) if no model year is designated by the manufacturer of that implement: (i) the calendar year in which the implement was manufactured, if the implement was manufactured between January 1 and October 31; or (ii) the calendar year after the year in which the implement was manufactured, if the implement was manufactured between November 1 and December 31. (2) For the purposes of clause (1)(b), an implement is deemed to be manufactured on a certain date if the manufacturing of that implement is completed on that date. Coming into force 3 These regulations come into force on the day on which they are filed with the Registrar of Regulations.
