Annex 03, page 1 PROPOSITIONS DE MODIFICATIONS À APPORTER À LA CLASSIFICATION DE NICE PAYS/ORGANISATION: France / institut National de la Propriété Industrielle DATE: Octobre 2013 09 Ajouter matériel informatique 1 This proposal is consistent with current USPTO policy of classifying Computer hardware in Class 9 as set forth in the U.S. ID Manual. i 10 Ajouter jouets sexuels Par analogie avec l'entrée déjà : poupées érotiques [poupées sexuelles] 2.1 Under current USPTO policy, USPTO requires customers to specify the common commercial names of the Sex toys, e.g., vibrators, handcuffs, etc., and classifies the goods in Class 10 only when they are used for direct sexual stimulation. ii USPTO generally favors adopting this new entry in the Nice Alphabetical List ensuring classification of all sex toys in Class 10 whether the goods are for direct sexual stimulation, such as vibrators, or indirect sexual stimulation, such as handcuffs or blindfolds. 28 280024 Changer jouets jouets* 2.2 If the proposal to add Sex toys in Class 10 is adopted, USPTO supports this proposal to modify Toys (Basic No. 280024) in Class 28.
Annex 03, page 2 11 Ajouter photophore [éclairage] Il s'agit d'une lampe munie d'un réflecteur. 3.1 The Nice Alphabetical List includes Lanterns for lighting (Basic No. 110041) and Lamps (Basic No. 110040). It is unclear how the photophore [éclairage] differs from the existing indications. Should the proposed wording be added to the Nice Alphabetical List under existing Basic No. 110041? If the Committee of Experts adopts the proposed wording, USPTO suggests removing the brackets and incorporating the purpose of the goods into the indication to distinguish it from the proposed wording photophore [coupe] in Class 21. 3.2 This proposal is consistent with current USPTO policy of classifying Candle holders in Class 21 as set forth in the U.S. If the Committee of Experts adopts the proposed wording, USPTO suggests incorporating the purpose of the goods into the indication, e.g., photophore pour recevoir une bougie, to distinguish it from the proposed wording photophore [éclairage], in Class 11.
4 This proposal is consistent with current USPTO policy of classifying Jewelry findings in Class 14 as set forth in the U.S. ID Manual. iv 5.1 USPTO has also proposed to add Oven mitts and Pot holders to the Alphabetical List in Class 21. Please see USPTO Specific Proposals, Category 1, Prop. Nos. 11 and 12. 5.2 Insulating gloves are typically comprised of rubber and worn by workers who are exposed to high voltage electrical equipment to insulate their hands from the electrical current. Please see, for example: https://www.osha.gov/sltc/etools/ele ctric_power/ppe_insulatinggloves_slee ves.html 17 170049 Supprimer gants isolants Termes imprécis. trop USPTO classifies Insulating gloves in Class 17 because both the Class 17 Heading and the Alphabetical List refer to insulating materials. Basic No. 170049, Insulating gloves, shows that certain goods, which are typically classified according to function, are instead classified in Class 17 when such goods have insulating properties. As an alternative to the proposed deletion, USPTO suggest modifying Basic No. 170049 to Electrical insulating rubber gloves in Class 17.
Annex 03, page 4 6 The term dispensers for dog waste bags in Class 21 is overbroad and may include goods in multiple classes, e.g., fixed dispensers of metal for pet waste bags in Class 6, fixed dispensers not of metal for pet waste bags in Class 20, v and pet waste bag dispensers for attachment to dog leashes in Class 18, (shown below). 21 Ajouter distributeurs de sacs pour déjections canines Choix de la classe 21 par analogie avec les distributeurs de papier hygiénique. As discussed in the 22nd Session of the Committee of Experts, the existing Alphabetical List entries covering various types of dispensers should be reviewed and potentially modified to make clear the classification principles applicable to these types of goods.
Annex 03, page 5 7 This proposal appears to refer to outsourced office function services. This proposal is consistent with current USPTO policy, as set forth in the U.S. ID Manual, of classifying Outsource service provider services according to the nature and purpose of the outsourced service being rendered vi. 35 Ajouter gestion administrative externalisée d'entreprises [domiciliation d'entreprises] Ce service consiste pour une entreprise à gérer des travaux administratifs (tels la réception et la gestion du courrier, l'accueil téléphonique personnalisé et les travaux de secrétariat) pour le compte d'une autre entreprise en contrepartie d'une compensation financière. In addition to Outsource service provider in the field of office functions in Class 35, USPTO suggests also adding a new indication covering Outsource service provider in the field of information technology in Class 42. These two new indications would make clear that outsourced services are not uniformly classified as business services. Instead, outsourced services, like franchising services, are classified in the same class as the particular services provided by the outsource service provider, see General Remarks, Services (d). Furthermore, USPTO suggests a proposal to add a new subsection (e) to the General Remarks on Services, e.g., Services rendered by third parties on an outsourced basis are in principle classified in the same class as the particular services provided by the outsource service provider (e.g., outsource service provider services in the field of office functions (Class 35), information technology (Class 42), food preparation (Class 43), etc.).
8 This proposal appears to refer to web indexing, or Internet indexing, which are computerized searching services typically rendered by a search engine service provider to collect data about new websites, documents, and content available on the Internet for the purpose of adding that data to the search engine s index. Please see, for example: http://en.wikipedia.org/wiki/web_inde xing; and https://www.google.com/intl/en/insides earch/howsearchworks/crawlingindexing.html USPTO suggests modifying the proposal from web site indexing to Internet indexing for others to distinguish these services from a different type of web indexing, which involves indexing (or creating an alphabetized list) of the contents of a single website only. The suggested modification also makes clear that Internet indexing for the purpose of improving one s own search engine is not considered a service. USPTO also suggests re-classifying Internet indexing for others in Class 42 as a computer technology service.
The term "waste recovery appears vague and appears to include recycling and reuse of discarded items. USPTO suggests modifying the proposal to indicate a specific type of waste recovery, such as Energy recovery from waste [transforming nonrecyclable materials to useable forms of energy]. Nice Classification system users may refer to this specific indication in Class 40 and analogize other types of waste recovery to it for classification purposes.
The classification of the services listed as excluded from Class 45 is consistent with USPTO s current policy. i 009 Computer hardware ii 010 Adult sexual stimulation aids, namely, {indicate type, e.g., artificial penises, penis enlargers, vibrators, benwa balls, artificial vaginas} Note: Sexual accessories that are not for direct stimulation, such as blindfolds, arm and leg restraints, handcuffs, etc. are classified according to what they are or material composition. iii 021 Candle holders
Annex 03, page 9 iv 014 Jewelry findings v 006 Fixed dispensers of metal for pet waste bags 020 Fixed dispensers not of metal for pet waste bags vi 000 Outsource service provider in the field of {indicate service, e.g., food preparation, medical billing, IT consulting, etc.} [Outsource service provider services are different from outsourcing services in Class 35 in that classification depends on the services being rendered by the outsource service Note: Outsourcing services involve arranging of service contracts or procurement of goods for others. Outsource service provider activities are classified according to nature/purpose of the outsourced service being rendered. Therefore, the services indicated in the fill-in-the-blank portion must be definite under USPTO identification and classification policy.
