2 2 Art. 1 DEFINITION DE LA COUPE CHAPITRE I : DISPOSITIONS GENERALES L Intercontinental Le Mans Cup est une coupe composée de 7 épreuves* : Sebring (12 heures, Etats Unis, série ALMS) 19 mars 2011 Spa (6 heures, Belgique, série LMS) 8 mai 2011 «24 Heures du Mans» (24 heures, France) 11 et 12 juin 2011 Imola (6 heures, Italie, série LMS) 3 juillet 2011 Silverstone (6 heures, Royaume Uni, série LMS) 11 septembre 2011 Road Atlanta (1000 miles, Etats Unis, série ALMS) 1er octobre 2011 Chine TBA (6 heures, Chine) 12 novembre 2011 * Calendrier provisoire susceptible de modifications Un classement par points est établi pour les Concurrents (classement teams) et les marques (classement constructeurs). Art. 1 DEFINITION OF THE CUP CHAPTER I GENERAL CONDITIONS The Intercontinental Le Mans Cup is a Cup consisting of 7 races (*) : Sebring (12 hours, USA, ALMS Series) 19th March 2011 Spa (6 hours, BEL, LMS Series) 8th May 2011 «24 Heures du Mans» (24 hours, FRA) 11th and 12th June 2011 Imola (6 hours, ITA, LMS Series) 3rd July 2011 Silverstone (6 hours, UK, LMS Series) 11th September 2011 Road Atlanta (1000 miles, USA, ALMS Series) 1st October 2011 Chine TBA (6 hours, China) 12th November 2011 * Provisional calendar subject to possible modifications A classification by points will be drawn up for the competitors (teams classification) and the marks (manufacturers classification). Art. 2 ORGANISATION 2.1 Organisation : Le présent règlement définit les modalités d inscription, éligibilité et classement de la Coupe. Chaque épreuve ILMC sera régie par le règlement sportif de la série hôte (ALMS, LMS, Asian Le Mans Series). L ACO se réserve le droit de modifier le présent règlement et tous les règlements affiliés à sa discrétion à tout moment pour garantir la sécurité, l équité sportive, ou toute autre raison visant à protéger les intérêts de l ACO et des épreuves régies par ses règlements. 2.2 Respect des règlements : Par le fait même de leur inscription et de leur participation à l ILMC, les Concurrents et les Conducteurs s'engagent à respecter les règlements en toutes circonstances. 2.3 Comité d'organisation : Jean Claude PLASSART Président de l Automobile Club de l Ouest Patrick PETER Président de Le Mans Endurance Organisation Scott ATHERTON Président de l American Le Mans Series Art. 2 ORGANISATION 2.1. Organisation : The present regulation defines the terms and conditions of registration, eligibility and the classification criteria for the Cup. Each ILMC event will be run according to the sporting regulations of the host series (ALMS, LMS, and Asian Le Mans Series). 3 3 4.2 Catégories "LE MANS" Grand Tourisme Endurance : a/ Groupe "LM" GTE Pro b/ Groupe "LM" GTE Am Un nouveau système d acquisition de données sera mis en service pour l année 2011.Il est obligatoire pour tous les concurrents ILMC, même si la série hôte ne l impose pas. Les informations seront transmises aux concurrents en décembre "LE MANS" Grand Touring Categories : a/ "LM" GTE Pro Group b/ "LM" GTE Am Group A new data acquisition system will be introduced for the 2011 season. It is mandatory for all ILMC entrants even if it is not imposed by the host series. Information will be sent to entrants in December Art. 5 Inscriptions 5.1 Demandes d inscription (concurrents et constructeurs) Seuls les documents originaux de la demande d inscription (avec l ensemble des documents demandés) doivent être adressés le mercredi 19 janvier 2011 (minuit) au plus tard, la date d expédition faisant foi, à l adresse suivante (télécopies et s non acceptés) : Intercontinental Le Mans Cup Bulletin d inscription saison 103 rue Lamarck Paris France c.vilatte@lemans.org Tel : Limitation des inscriptions (concurrents) : Un concurrent ne peut pas inscrire plus de 2 voitures dans un même groupe : La licence de Concurrent 2011 fera foi. 5.3 Réunion du Comité de Sélection : fin janvier Concurrents sélectionnés par le Comité de Sélection et invités à participer à l Intercontinental Le Mans Cup. Critères de sélection : a/ Les critères suivants sont à la discrétion du Comité de Sélection. b/ Liste non exhaustive et sans ordre de priorité. Notoriété du concurrent (constructeur, équipe assistée par un constructeur, équipe privée de renom, écurie privée) Participation(s) aux "24 Heures du Mans" et aux Séries Le Mans Palmarès des concurrents Pilotes désignés Qualité des voitures Intérêt technique Situation juridique ou financière avec l'a.c.o. et son environnement Maintien de la participation des concurrents "privés" etc. 5.5 Inscription officielle (concurrent et constructeur) : Une demande de participation devient une "inscription officielle" lorsque le Concurrent a reçu la confirmation de l'organisateur. Celle ci ne peut intervenir que dès lors que la somme due au titre de l inscription considérée (saison ou course) a été intégralement payée. 5.6 Cession d'une inscription : interdite. L'Organisateur reprendra l'inscription d un Concurrent qui ne peut honorer son invitation. 5.7 Caractéristiques de la voiture : La catégorie et le groupe d'une voiture sélectionnée ne peuvent pas être modifiés. Les caractéristiques techniques d'une voiture (portées sur la Fiche d Homologation ACO), ne peuvent pas être changées moins d un mois avant une course, sauf cas de force majeure apprécié par l'organisateur. Le concurrent devra désigner un modèle de voiture pour la saison Intercontinental Le Mans Cup complète. Toute modification de modèle de la voiture ne pourra se faire que sur accord du Comité Sport au moins un mois avant l épreuve concernée. Art 5 Registrations 5.1 Registration forms: entrants and manufacturers Only the original documents of the registration form (with all documents requested) should be sent by Wednesday 19th January (midnight) at the latest (the postal date is proof) to the following address: Intercontinental Le Mans Cup Full season registration 103 rue Lamarck Paris France c.vilatte@lemans.org Tel : Inscriptions (Competitors) An entrant cannot register more than two cars in the same group: the entrant s 2011 licence will be taken as proof Selection Committee meeting : end of the January Entrants selected by the Selection Committee and invited to take part in the Intercontinental Le Mans Cup Selection criteria a/ The following criteria are at the discretion of the Selection Committee. b/ Non exhaustive list without order of priority. Renown of an entrant (manufacturer, team helped by a manufacturer, wellknown private team, private team) Participation in the Le Mans 24 Hours and the Le Mans Series Entrant s results Nominated drivers Quality of the cars Technical interest Legal or financial situation with the ACO and its environment Maintenance of the participation of private entrants etc. 5.5 Official registration (entrant and manufacturer) A registration form becomes an «official registration after the Competitor has received confirmation from the Organizer. Furthermore, the entry is only considered as official after the registration fees were paid (season or race). 5.6 Conceding an entry: forbidden The Organizer will take back the registration from a competitor unable to honour his invitation. 5.7 Characteristics of the car : The category and group of a selected car cannot be modified. The technical characteristics or a car (on the ACO homologation form) cannot be changed less than a month before a race except in the case of force majeure duly recognized by the Organizer. The competitor must nominate the model of the car for the full Intercontinental Le Mans Cup season. Any modification to the model or the car can only be carried out with the agreement of the Sports Committee at least a month before the event in question. 5.8 Conditions financières concurrents (par voiture) : Seules les demandes d inscription pour la saison intégrale (inclus 24 Heures du Mans) sont admises. les 5.8 Financial conditions for entrants (per car) : Only entry forms for the whole season (including the Le Mans 24 Hours) are accepted. a) Droit d'inscription* : HT (+ TVA si applicable) Le droit d inscription à la saison comprend le droit d inscription aux 7 épreuves de l ILMC. Il n est pas restituable. a) Registration fee* : tax not included (+VAT if applicable) The registration fee for the whole season includes the entry fee for all 7 ILMC events. It is non refundable.

4 4 Si une voiture est refusée lors des Vérifications Techniques, le droit d'inscription ne sera pas remboursé. b) Avance sur carburant et autres Frais Techniques et Fournitures* : HT uros (+ TVA si applicable) Celle ci comprend : L avance sur frais techniques des «24 Heures du Mans» : voir règlement particulier des 24 Heures du Mans L avance sur carburant et autres frais techniques des autres épreuves. * Les frais d inscriptions et techniques de la Journée Test des 24 Heures du Mans ne sont pas inclus (conditions et inscriptions Journée Test : voir règlement particulier des 24 Heures du Mans 2011). 5.9 Echéancier concurrents : a) Acompte sur droit de participation HT (+ TVA si applicable) (Inclus frais de dossier 500 HT +TVA si applicable non remboursable) Pour tous les concurrents déposant une demande de participation à l ILMC Paiement le 17 janvier 2011 dernier délai : Tout concurrent non sélectionné se verra rembourser de l acompte sur droit de participation, frais de dossier déduits de la somme. b) Droit de participation Par tous les concurrents invités par le Comité de Sélection : HT (+ TVA si applicable) acompte HT (+ TVA si applicable) = uros HT (+ TVA si applicable) Le montant final à verser sera communiqué à chaque concurrent après confirmation des inscriptions) Paiement avant le 16 février 2011, dernier délai : Apres cette date le concurrent sera retiré de la liste des invités. c) Avance sur Frais Techniques Par tous les concurrents invités par le Comité de Sélection : L avance sur carburant et autres frais techniques est payable selon l échéancier suivant : HT (+ TVA si applicable) : le 1er mars au plus tard HT (+ TVA si applicable) : le 6 avril au plus tard pour les 24 Heures HT (+ TVA si applicable) : le 31 août au plus tard Les sommes non dues au titre de l avance sur frais techniques seront restituées a l issue de la dernière course de l année d) Garantie de participation à l intégralité de la Coupe Pour tous les concurrents invités par le Comité de Sélection : La participation à toutes les courses de l Intercontinental Le Mans Cup est obligatoire. En cas de non participation à une course d une voiture engagée en ILMC, une pénalité financière de sera appliquée pour chaque non participation (sauf cas de force majeure à la discrétion du Collège des Commissaires Sportifs). En garantie de l engagement du concurrent de participer à toutes les épreuves du calendrier, une garantie devra être présentée par le concurrent, d un montant de Modalités de la garantie : Les concurrents devront adresser à l ILMC, au plus tard le 30 avril 2011 : soit un dépôt avec consignation entre les mains de l ILMC d un montant de , soit une caution solidaire émanant d un établissement de crédit notoire solvable avec un établissement sur le territoire français ou d un tiers If a car is refused at scrutineering, the registration fee will not be refunded. b) Advance on fuel and other technical expenses and supplies*: tax not included (+VAT if applicable). This includes: Advance on technical expenses for the 24 Heures du Mans (see the 2011 Supplementary Regulations) Advance on fuel and other technical expenses for the other events. *Entry and technical expenses for the Le Mans 24 Hours Test Say are not included (conditions and entry for the Test Day: see the 24 Heures du Mans supplementary regulations). 5.9 Competitors payment schedule : a) Advance on entry fee tax not included (+VAT if applicable). (includes dossier expenses 500, tax not included (VAT if applicable) For all competitors sending in a registration form for the ILMC. Final date for payment: 17th January 2011 Any competitor who is not selected will have the advance on his registration fee reimbursed minus dossier expenses. b) Right to participate For all competitors accepted by the Selection Committee tax not included advance of tax not included = tax not included (VAT where applicable) Each competitor will be informed of the final sum to be paid after confirmation of his entry. Payment before 16th February at the latest After that date the competitor will be scratched from the entry list. c) Advance on technical expenses For all competitors accepted by the Selection Committee : The advance on fuel and other technical expenses must be paid according to the following schedule : tax not included by 1st March at the latest tax not included by 6th April at the latest for the 24 Heures tax not included by 31st August at the latest. Sums not due in terms of the advance will be refunded after the last race of d) Guarantee of participation in the whole Cup For all competitors accepted by the Selection Committee : Participation in all the Intercontinental Le Mans races is obligatory. Should a car entered in the ILMC not take part in a race, a financial penalty of will be imposed for each failure to participate (except in the case of force majeure decided by the Stewards of the Meeting). A surety of , tax not included, must be lodged as a guarantee of undertaking by the entrant to take part in all the events on the calendar. Terms of the guarantee: Competitors must send the ILMC by 30 th April 2011 at the latest: Either a deposit to be lodged with the ILMC of Or a guarantee from a well known credit worthy organization with a branch on French territory, or from a credit worthy third party accepted by the ILMC (the model of the guarantee is annexed to the present

Pour 2011 uniquement : En raison des nombreuses nouveautés réglementaires techniques, un concurrent pourra demander par écrit au Comité Sport (par sport@lemans.org et sport2@lemans.org) une dérogation pour l épreuve de Sebring (non application de la pénalité financière de au moins un mois avant l épreuve. Cette demande devra être accompagnée des éléments permettant d établir clairement que la voiture concernée ne pourra pas être prête pour cette épreuve. Cette dérogation ne pourra être accordée qu aux nouveaux modèles de voitures ou modèles ayant nécessité des modifications importantes entre 2010 et 2011 afin de répondre aux nouveaux règlements Conditions financières constructeur (par constructeur) : Seules les demandes d inscription pour la saison intégrale (inclus les 24 Heures du Mans) sont admises. A/ Droit d'inscription : HT (+ TVA si applicable) Tout constructeur représenté par un concurrent, et n ayant pas adressé sa demande d inscription et versé son droit d inscription ne marquera pas de points au classement constructeur Echéancier constructeurs : Paiement intégral de l inscription constructeur le 16 février 2011 dernier délai Modalités de paiement Tous les paiements (concurrents et constructeurs) doivent être effectués par virement bancaire uniquement, le justificatif bancaire avec les noms du Concurrent et du donneur d ordre est obligatoire. Paiements sur le compte de la SA S.S.P.A.C.O. Banque : CREDIT MUTUEL LE MANS Compte : Code Banque : Code Guichet : N : IBAN : FR BIC : CMCIFR2A 5.13 Dossier de candidature : Il doit être accompagné de : a/ Paiement de l acompte sur droit de participation de HT + TVA si applicable (+ copie d ordre de virement, dont 500 HT + TVA si applicable, non remboursable) b/ Photocopie de la Licence Internationale du Concurrent 2011 : Le libellé de la Licence présentée sera le seul retenu pour les documents officiels (25 caractères maximum sont autorisés y compris les espaces) c/ Copie de la Fiche d'homologation A.C.O. de la (des) voiture(s) ; d/ Photographies de la voiture (3/4 AV et 3/4 AR, intérieur de l'habitacle, etc.) ; e/ Explications détaillées susceptibles d'éclairer le choix du Comité de Sélection ; f/ Des noms, prénoms et palmarès de chacun des pilotes (3 maximum par voiture) ; 5.14 Forfait Tout forfait concurrent ou constructeur sélectionné ne fera l objet d aucun remboursement. Art. 6 ATTRIBUTION DES POINTS 6.1 Classement Teams : On entend par team un concurrent (licence concurrent faisant foi), c'est àdire la personne physique ou morale qui engage la ou les voiture(s). 2 voitures maximum peuvent être engagées par un même concurrent dans une catégorie. Les points seront attribués indépendamment pour chaque catégorie ("LM" P1, "LM" P2, "LM" GTE Pro, "LM" GTE Am). regulations). For 2011 only: Because of the numerous new technical innovations an entrant can ask the Sports Committee by (sport@lemans.org or sport2@lemans org) for a waiver for the Sebring event (non application of the penalty) at least a month before the event. This request must be accompanied by proof that clearly establishes the fact that the car cannot be ready in time for the event. This waiver can only be applied to new cars or cars that have had to undergo considerable modifications between 2010 and 2011 to comply with the new regulations Financial conditions for manufacturers (per manufacturer) : Only entry forms for the whole season (24 Heures du Mans included) will be considered. A/ Entry fee : tax not included (VAT if applicable). Any manufacturer/constructor represented by an entrant who has not sent in his registration form and not paid his registration fee will not score points in the manufacturers championship Payment schedule : The full payment of the manufacturers entry fee must be settled by 16 th February at the latest Payment schedule All payments (competitors and manufacturers) must be sent by bank transfer only. The bank justification with the name of the competitor and payer is obligatory. Payment to be made out to the SA S.S.P.A.C.O. account. Banque : CREDIT MUTUEL LE MANS Compte : Code Banque : Code Guichet : N : IBAN : FR BIC : CMCIFR2A Registration form : It must be accompanied by: a/ Entry fee of tax not included (VAT if applicable) + a copy of the payment order, including 500 euros tax not included + VAT if applicable, non refundable. b/ A photocopy of the entrant s 2011 international competition licence. The name on the licence will be the only one used on official documents (25 characters max. allowed spaces included). c/ Copy of the ACO homologation form of the car (s). d/ Photographs of the car (s) ¾ front, ¾ rear (cockpit interior etc). e/ Detailed explanation to help the Selection Committee in its choice. f/ Name, first name and results of each driver (3 maximum per car) Withdrawal No refund will be given in the case of the withdrawal of a competitor or manufacturer. Art 6 POINTS ALLOCATION 6.1 Teams classification By team is meant a competitor (competitor s licence as proof): namely a person or entity that enters the car (s). 2 cars maximum can be entered by the same competitor in a category. Points will be awarded independently for each category (LM P1, LM P2, LM GTE Pro and LM GTE Am).

6 6 Les points seront attribués au team en fonction du classement de la voiture du team ayant obtenu le meilleur classement (1 voiture marque les points du team) lors de chaque épreuve. Les points attribués au team seront déterminés en fonction du classement de la catégorie de l épreuve, tous concurrents confondus, engagés ou non en ILMC. Barème du classement teams pour les 6 épreuves hors 24 Heures du Mans : Points will be awarded to the team according to the classification of the car of the team that has obtained the best result (1 car scores points for the team) in each event. The points awarded to the team will be decided according to the classification of the category of the event all entrants combined whether entered in the ILMC or not. Points table for the teams classification for the 6 events: Le Mans 24 Hours not included. Positions Points Pole position 1 Les douze premiers marquent les points figurant dans le tableau ci dessus. Dans les cas où un team serait classé treizième ou au delà, il marquerait également 1 point. Pour marquer des points, les teams devront être classés et remplir les conditions inscrites dans les règlements sportifs des épreuves concernées (24 Heures du Mans, LMS, ALMS ou Asian Le Mans Series selon l épreuve d accueil). Pour les 24 Heures du Mans 2011, les points seront attribués selon le barème suivant : The first twelve will score points according to the table above. In the cases where a team finished thirteenth and beyond it will also score 1 point. To score points the teams must be classified finishers and comply with the sporting regulations of the events concerned (Le Mans 24 Hours, ALMS, LMS, Asian Le Mans Series depending on the event). For the Heures du Mans points will be awarded as follows: Positions Points Pole position 1 Les douze premiers marquent les points figurant dans le tableau ci dessus. Dans les cas ou un team serait classé treizième ou au delà, il marquerait également 2 points. 6.2 Classement constructeurs : Ce classement est réservé aux catégories LM P1 et GTE. Par «constructeur (s)», il convient d entendre l association constituée par le constructeur du châssis et celui du moteur, c est à dire par la ou les personne (s) physique (s) ou morale (s) détenant les droits de propriété intellectuelle sur le châssis et sur le moteur, dont les noms figurent sur la Fiche d Homologation validée par l ACO. S il s agit de deux constructeurs différents, le nom du constructeur du châssis doit toujours précéder celui du constructeur du moteur. Les fiches d'homologation ACO en cours de validité à ce jour seront, le cas échéant, modifiées en conséquence Seuls les constructeurs engagés (art et 5.11) pourront marquer des points dans le classement constructeur. Pour le classement constructeurs LM P1, seules marqueront des points les deux voitures engagées en ILMC d un même constructeur (quel que soit le concurrent) ayant obtenu le meilleur classement, à l issue de chaque épreuve (cumul des points des 2 voitures) dans la même catégorie. Pour le classement constructeurs GTE, un classement sera établi après chaque course, catégories GTE Pro et GTE Am confondues. Seules marqueront des points les deux voitures engagées en ILMC d un même constructeur (quel que soit le concurrent) ayant obtenu le meilleur classement, à l issue de chaque épreuve (cumul des points des 2 voitures) dans le classement GTE (GTE Pro et GTE Am confondues). Les points attribués seront déterminés en fonction du classement de la catégorie de l épreuve, tous concurrents confondus dans la catégorie, engagés ou non en ILMC. Barème du classement constructeur pour les 6 épreuves hors 24 H du Mans : The first 12 will score points as laid out in the above table. Teams finishing thirteenth and beyond will score 2 points. 6.2 Manufacturers classification : This classification is reserved for the LM P1 and GTE categories. The definition of a manufacturer is the association between the chassis constructor and the engine builder: namely, the person (people) or named entity holding the intellectual property rights to the chassis and engine whose names appear on the homologation form validated by the ACO. If it is a question of two different manufacturers, the name of the chassis constructor must always precede that of the engine builder. The ACO homologation forms valid that day will, if necessary, be modified as a result. Only manufacturers entered (Art 5.10 and 5.11) can score points in the manufacturers classification. Only the two cars entered in the ILMC by the same manufacturer can score points in the LM P1 manufacturers classification (whoever the entrant): namely, those that have obtained the highest position at the end of each event (addition of the points of the 2 cars) in the same category. For the GTE Manufacturers classification, a classification will be established after each race GTE Pro and GTE Am combined. Only the two cars entered in the ILMC by the same manufacturer can score points in the manufacturers classification (whoever the entrant): namely those that have obtained the highest position at the end of each event (addition of the points of the 2 cars) in the GTE classification (GTE Pro and GTE Am combined). The points awarded will be determined according to the results of the category in the event all entrants combined in the category whether or not they are entered in the ILMC. Tout moteur, tel que défini à l Article 18.9 du Cahier des Charges ACO, doit être scellé par les Commissaires Techniques avant d être utilisé par le concurrent lors d une épreuve. Toute rupture d un ou plusieurs scellés doit être préalablement approuvée par les Commissaires Techniques sous peine de sanction pouvant aller jusqu à l exclusion. La rupture de tout scellé sera considérée comme un changement de moteur. Le remplacement d un moteur doit être signalé aux commissaires techniques par les concurrents. En cas d accident ou de force majeure qualifiés comme tels par le Collège des Commissaires Sportifs (la charge de la preuve incombe au concurrent) les pénalités pourront ne pas être appliquées. Au cours d une épreuve, afin de permettre uniquement le réglage des jeux des soupapes, le concurrent pourra demander officiellement aux Commissaires Techniques, l autorisation de rompre les scellés des couvre culasses. Cette opération doit obligatoirement avoir lieu en sa présence et ne doit donner lieu à aucun remplacement de pièces (sauf le (les) joint(s) de couvre culasse(s)). Une fois cette opération effectuée, ce dernier procédera à nouveau à la pose des scellés sur la pièce concernée. Lors de l épreuve suivante, les moteurs précédemment scellés ne seront pas scellés à nouveau. Temps d utilisation des moteurs : Pour les groupes LM GTE Pro et LM GTE Am uniquement : Un bonus de points sera attribué par épreuve en fonction de la durée d utilisation des moteurs pour 6 épreuves de l ILMC (les 24 Heures du Mans ne permettent pas d obtenir de point bonus moteur mais les heures moteur effectuées sont comptabilisées pour les épreuves suivantes) : 6.3 The seals on the engine Each engine will be linked with the chassis. This operation must take place in the presence of a scrutineer and allows for no part replacement (except for the cylinder head joint(s)). Once the work has been done, the scrutineer will again affix seals to the part in question. During the next race, engines previously sealed will not be sealed again. Cependant le temps d utilisation du moteur total de l épreuve sera comptabilisé dans le relevé diffusé à l issue de chaque épreuve, même si la voiture n est pas classée. Le temps ainsi comptabilisé pourra donc être pris en compte pour l épreuve suivante. Un moteur sera considéré comme utilisé pour la première fois lorsque le transpondeur de chronométrage de la voiture aura montré qu elle a quitté la voie des stands. L utilisation et le remplacement d un moteur n est possible que si : il est signalé aux commissaires techniques par le concurrent, les scellés n ont pas été enlevés. Daniel Perdrix Pour ce faire, il devra adresser à l ILMC, une requête dûment motivée précisant clairement les points sur lesquels il souhaite l interprétation. Pour être recevable cette requête devra être accompagnée d une somme de HT (+TVA si applicable) qui sera consignée et sur laquelle seront débités les frais d organisation et de fonctionnement de ce comité de réglementation. Ledit comité de réglementation devra statuer au plus tard dans les huit jours de la réception de la requête adressée à ILMC. Les décisions du comité de réglementation ne sont pas susceptibles d appel et auront valeur réglementaire. Art.9 PUBLICITE a/ Les concurrents doivent apposer sur leur voiture, et ce avant les essais qualificatifs, la publicité de l Organisateur selon le schéma ci dessous. Les patchs Intercontinental Le Mans Cup devront obligatoirement être cousus sur les combinaisons des pilotes et des mécaniciens en respectant les règles de sécurité de la FIA et les schémas ci dessous. Les patchs des séries hôtes (LMS, ALMS, Asian Le Mans Series) ne sont pas obligatoires pour les concurrents ILMC. Art 8 RELATIONS WITH THE ORGANISATION AND THE REGULATORY COMMITTEE All entrants, manufacturers and drivers who want to obtain clarifications on a point of the regulations that they contest may seize the regulatory committee made up of three people: 1. The Intercontinental Le Mans Cup patches must be sewn on the drivers suits and the mechanics overalls while respecting the FIA safety regulations and the schemas below. The patches of the host series (LMS, ALMS, Asian Le Mans Series) are not obligatory for the ILMC competitors.

11 11 Concurrent et/ou ses pilotes et/ou son équipe pris avant, pendant ou après la course et les manifestations qui y sont liées. L autorisation accordée par le concurrent à l ACO est d une durée minimale de dix ans tacitement et indéfiniment renouvelable par période de deux années. Le concurrent est informé que s il souhaite mettre un terme à cette autorisation, il lui appartient d adresser un courrier recommandé à l ACO en respectant un préavis de deux mois précédent la date anniversaire de chaque période contractuelle autorisée. Cette date anniversaire est fixée au 1er novembre précédant la fin de chaque période contractuelle autorisée. Tout retrait d autorisation d exploitation des «Images et Sons» ne pourra en aucun cas avoir pour effet de mettre un terme anticipé aux autorisations d exploitation des «images et Sons» concédés par l ACO antérieurement au retrait d autorisation. La présente autorisation d exploitation des «Images et Sons» consentie par le Concurrent est indépendante du droit d exploitation des manifestations et compétitions sportives organisées par l ACO conformément aux dispositions de l article L du Code du sport Droits d auteur / dessins et modèles Le Concurrent cède, à titre non exclusif et gratuit, au profit de l ACO, l ensemble des droits de propriété intellectuelle portant sur le nom d équipe, les appellations, dessins, modèles ou logos associés à l équipe et à la/aux voiture(s) de l équipe (ci après les «Créations») utilisés par le Concurrent avant, pendant ou après la course et/ou les manifestations qui y sont liées, et ce pour le monde entier, pendant la durée de la protection légale des Créations d après la législation française. Ces droits comportent en particulier : Le droit de reproduction, permanent ou provisoire, le droit d adaptation, le droit de traduction, le droit de commercialisation, sur tous supports (notamment livres, livrets, affiches, cartes postales, voitures miniatures, DVD, jeu vidéo, produits de l habillement ou de la maison et autre produits dérivés, etc.), dans tous réseaux commerciaux et sous toutes marques, en vue notamment de l exploitation et de la vente en ligne ou hors ligne des Créations ainsi que de leur utilisation à des fins d information, de démonstration, de promotion ou de publicité,, et ce notamment dans le cadre d opérations promotionnelles, culturelles, de presse et/ou de relations publiques, Le droit de communication au public, dans tous lieux accessibles au public, notamment par télédiffusion, cablo distribution, diffusion par satellite, diffusion en ligne et de façon générale, par tous vecteurs ou réseaux (notamment analogiques ou numériques, de télécommunication et informatiques, en ce compris le réseau internet), en vue notamment de l exploitation commerciale des Créations et/ou de leur utilisation des fins d information, de démonstration, de promotion, de publicité, et ce notamment dans le cadre d opérations promotionnelles, culturelles, de presse et/ou de relations publiques, Il est expressément précisé que l ACO pourra exploiter les Créations de manière directe ou indirecte et qu elle pourra concéder à titre non exclusif les Créations à des sous traitants, à des licenciés ou à tout tiers de son choix. Ces droits comportent en particulier le droit de reproduction, d utilisation, d apposition et, plus généralement, d exploitation sous quelque forme que ce soit, à titre gratuit ou onéreux des Marques. The authorization of use of the Images and Sounds granted by the Competitor hereby is fully and totally independent from the ACO s right to operate the events and sporting contests it organises, in accordance with Article L of the French Sport Code Author s rights /designs and models rights The Competitor hereby assigns to ACO on a non exclusive and royalty free basis all intellectual property rights related to the team s name, the designations, designs, models or logos associated to the team and to the car(s) of the team (hereafter referred to as the Creations ) used by the Competitor before, during and after the race and/or all events connected to the race for the entire legal protection period of the Creations. The rights granted include in particular, without limitation: The reproduction right, permanent or temporary, the right of adaptation, the right of translation, the right of marketing, on any supports (in particular, without limitation, books, notebooks, posters, postcards, scale model cars, DVD, video games, clothes or household products, and other spin off products), in any commercial networks and under any brands and/or trademarks, in particular for the purposes of the exploitation and commercialisation of the Creations, off line or on line, as well as their utilisation, presentation, promotion and advertising, in particular, without limitation within promotional, cultural, press and/or public relations events; The right of representation in any public place notably by television broadcasting, cablo distribution, downloading and more generally by any vectors or networks (notably, without limitation, analogical or digital, telecommunication or computing, including Internet network), in particular for the purposes of the commercial exploitation of the Creations as well as their utilisation, presentation, promotion and advertising, in particular, without limitation within promotional, cultural, press and/or public relations events. It is expressly acknowledged and agreed that the ACO shall be entitled to use and operate the Creations, either directly or indirectly, and that the ACO shall be entitled to grant, on a non exclusive basis, the Creations to sub contractors, licensees as well as any other third parties designated by the ACO. The authorization of use of the Creations granted by the Competitor hereby is fully and totally independent from the ACO s right to operate the events and sporting contests it organise, in accordance with Article L of the French Sport Code Trademarks The Competitor hereby grants to ACO a non exclusive, royalty free license, on all trademarks related to the name of the team and the associated designations, designs, models or logos (hereafter referred to as the Trademarks ) used by the Competitor before, during and after the race and/or all events connected to the race, for the territory of protection of the Trademarks and during all the duration of their legal protection. These rights contain in particular, without limitation, the right of reproduction, use, apposition and, more generally, of exploitation in any form, on a royaltyfree basis or not, of the Trademarks. It is expressly reminded that the ACO is allowed to use and operate the Trademarks, either directly or indirectly, and that the ACO shall be entitled to grant, on a non exclusive basis, the Trademarks to sub contractors, licensees as well as any other third parties designated by the ACO.

12 12 La présente autorisation d exploitation des «Marques» consentie par le Concurrent est indépendante du droit d exploitation des manifestations et compétitions sportives organisées par l ACO conformément aux dispositions de l article L du Code du sport Garanties Le Concurrent garantit être titulaire des droits de propriété intellectuelle afférents aux Créations et aux Marques. Il garantit en outre que les Créations et les Marques ne contrefont ni ne portent atteinte à des droits de tiers quels qu ils soient. D une manière générale, le Concurrent garantit à l ACO la jouissance et l exercice paisible des droits cédés sur les Images et les Sons, Créations et les Marques. Le Concurrent s engage à garantir et indemniser l ACO ainsi que ses cessionnaires ou ayants droits contre toute réclamation, demande d interdiction d exploitation et/ou dommages et intérêts, action en contrefaçon et/ou en annulation, action violation du droit à l image, et d une façon générale contre toute action émanant de tiers quels qu ils soient. En particulier, le Concurrent s engage à rembourser l ensemble des frais (y compris d avocats) condamnations que l ACO pourrait être amené à payer et à l indemniser du préjudice subi. Le Concurrent s engage également à obtenir de ses sponsors, pilotes, équipes et constructeurs qu ils respectent l article 1 ci dessous, qu ils autorisent l ACO à exploiter dans les conditions définies aux articles 2.1, 2.2 et 2.3 ci dessus les Images et Sons, Créations et Marques. En cas de non respect de la présente stipulation, le Concurrent s engage à rembourser l ensemble des dommagesintérêts (frais compris d avocats) et condamnations que l ACO pourrait être amené à payer et à l indemniser du préjudice subi du fait de l inexécution de cette obligation Divers L ACO sera libre de concéder ou de concéder les droits qui lui sont cédés par le Concurrent. La présente cession lie les successeurs et ayants droits des parties. Dans l hypothèse où l une quelconque des clauses de la cession serait déclarée inapplicable, irrégulière ou nulle, par quelque juridiction et pour quelque cause que ce soit, et ce par une décision devenue définitive, cette clause serait supprimée sans qu il en résulte la nullité de l ensemble de la cession, dont toutes les autres clauses demeureraient en vigueur. 3 L'utilisation de tout système propre aux concurrents, visant à localiser un véhicule sur la piste, et à suivre son évolution au moyen de liaisons par satellites, et éventuellement diffuser ces informations via Internet, est soumise à l'approbation de l'organisateur. The authorization of use of the Trademarks granted by the Competitor hereby is fully and totally independent from the ACO s right to operate the events and sporting contests it organise, in accordance with Article L of the French Sport Code Representations and warranties The Competitor represents and warrants that he has the full and entire ownership of the intellectual property rights related to the Creations and the Trademarks. He also represents and warrants that neither the Creations nor the Trademarks infringe and/or harm the rights of any third parties. Generally, the Competitor represents and warrants to the ACO the free and exclusive use and exercising of the rights transferred over the Images and Sounds, the Creations and the Trademarks. The Competitor undertakes to guarantee and to compensate the ACO as well as its transferees and successors against any claim, request for banning of use and/or damages, action for forgery and/or invalidation, action for breach of a right to images and, generally, against any action emanating from any third parties whatsoever. In particular, the Competitor undertakes to reimburse all of the damages, expenses (including attorneys fees) and fines that the ACO may be obliged to pay and to compensate it for the prejudice suffered. The Competitor also undertakes to obtain from its sponsors, drivers, team and constructors the guarantee that they will respect Art. 1 below and they authorise the ACO to exploit and operate, under the terms and conditions mentioned above in articles 2.1, 2.2 and 2.3, the Images and Sounds, the Creations and the Trademarks. In case of breach of this obligation, the Competitor undertakes to reimburse all of the damages, expenses (including Attorneys fees) and fines that the ACO may be obliged to pay and to compensate it for the prejudice inferred from the breach of this contractual obligation Miscellaneous ACO shall be free to transfer or to grant the rights, which have been granted to it by the Competitor. This assignment binds the successors and assignees of the Parties. If one or several of the provisions of this contract should be unenforceable, annulled or declared invalid by the definitive decision of any jurisdiction and for whatever reason, the result would not be the invalidity of the whole assignment of rights; the affected provisions of this contract shall be deleted and the other provisions shall remain into force. 3 The use of all systems specific to the competitors, with a view to situating a vehicle on the track, and following its progression by means of satellite linkups, and possibly broadcasting this information via the internet, is subject to the organiser's approval.
