2 EUROPEAN INSTRUMENTS / INSTRUMENTS EUROPÉENS Directive 2006/115/EC of 12 December 2006 Article 1 1. In accordance with the provisions of this Chapter, Member States shall provide, subject to Article 6, a right to authorise or prohibit the rental and lending of originals and copies of copyright works, and other subject matter as set out in Article 3(1). 2. The rights referred to in paragraph 1 shall not be exhausted by any sale or other act of distribution of originals and copies of copyright works and other subject matter as set out in Article 3(1). Article 2 1. For the purposes of this Directive the following definitions shall apply: (a) "rental" means making available for use, for a limited period of time and for direct or indirect economic or commercial advantage; (b) "lending" means making available for use, for a limited period of time and not for direct or indirect economic or commercial advantage, when it is made through establishments which are accessible to the public; (c) "film" means a cinematographic or audiovisual work or moving images, whether or not accompanied by sound. Article 3 1. The exclusive right to authorise or prohibit rental and lending shall belong to the following: (a) the author in respect of the original and copies of his work; (b) the performer in respect of fixations of his performance; (c) the phonogram producer in respect of his phonograms; (d) the producer of the first fixation of a film in respect of the original and copies of his film. Directive 2006/115/CE du 12 décembre 2006 Article 1er 1. Article 2 1. Aux fins de la présente directive, on entend par: a) "location" d objets, leur mise à disposition pour l usage, pour un temps limité et pour un avantage économique ou commercial direct ou indirect; b) "prêt" d objets, leur mise à disposition pour l usage, pour un temps limité et point pour un avantage économique ou commercial direct ou indirect, lorsqu elle est effectuée par des établissements accessibles au public; c) "film", une oeuvre cinématographique ou audiovisuelle ou une séquence animée d images, accompagnées ou non de son. Article 3 1. Le droit exclusif d autoriser ou d interdire la location et le prêt appartient: a) à l auteur, en ce qui concerne l original et les copies de son oeuvre; b) à l artiste interprète ou exécutant, en ce qui concerne les fixations de son exécution; c) au producteur de phonogrammes, en ce qui concerne ses phonogrammes; d) au producteur de la première fixation d un film, en ce qui concerne l original et les copies de son film. (a) Rental of a work means the rental of physical copies of the work to the public, for a commercial purpose, but does not include the rental of a computer program or sound recording which constitutes an integral part of another object where such other object is the primary object of the rental. 3 institution shall not be deemed to be renting for commercial purposes; The Minister may prescribe types of public libraries and types of educational institutions to which the provisions of this subsection shall apply. INTERNATIONAL TREATIES / TRAITÉS INTERNATIONAUX WIPO Copyright Treaty Article 7 (1) Authors of (i) computer programs; (ii) cinematographic works; and (iii) works embodied in phonograms, as determined in the national law of Contracting Parties, shall enjoy the exclusive right of authorizing commercial rental to the public of the originals or copies of their works. (2) Paragraph (1) shall not apply (i) in the case of computer programs, where the program itself is not the essential object of the rental; and (ii) in the case of cinematographic works, unless such commercial rental has led to widespread copying of such works materially impairing the exclusive right of reproduction. (3) Notwithstanding the provisions of paragraph (1), a Contracting Party that, on April 15, 1994, had and continues to have in force a system of equitable remuneration of authors for the rental of copies of their works embodied in phonograms may maintain that system provided that the commercial rental of works embodied in phonograms is not giving rise to the material impairment of the exclusive right of reproduction of authors. A Member shall be excepted from this obligation in respect of cinematographic works unless such rental has led to widespread copying of such works which is materially impairing the exclusive right of reproduction conferred in that Member on authors and their successors in title. In respect of computer programs, this obligation does not apply to rentals where the program itself is not the essential object of the rental. L auteur a le droit d exploiter son œuvre sous quelque forme que ce soit et d en tirer un revenu pécuniaire. Sous réserve des dispositions de la présente ordonnance, il a le droit exclusif de faire ou d autoriser de faire, notamment les actes suivants : la mise en circulation dans le public par location de l original ou des copies d œuvres audiovisuelles ainsi que la location commerciale de programmes d ordinateurs; Article 82. La mise en circulation des copies de l œuvre audiovisuelle sous forme de vidéogrammes aux fins de location pour l usage privé reste soumise à l autorisation des auteurs ou de leurs représentants. EGYPT / EGYPTE Law on intellectual property rights 82/2002 Article 147 The author and his universal successor shall have the exclusive right to authorize or prevent any form of exploitation of his work, particularly through reproduction, broadcasting, rebroadcasting, public performance, public communication, translation, adaptation, rental, lending or making the work available to the public in any manner, including through computers, internet, information networks, communication networks and other means. concept page 4/5

5 JORDAN / JORDANIE Copyright Law No. 22 of 1992 as last amended by Law N 52 of 2001 Article 9 The author shall have the right to financially exploit his work in whatever manner he chooses. Others shall not be entitled to exercise this right without the written authorization of same or his successors. Such authorization shall include: d) The right to grant authorization to utilize a reproduction or a number of reproductions to persons who exploit same through rental, lending and other practices related to presenting the work to the public. TUNISIA / TUNISIE Loi n du 24 février 1994 Article 9 bis Les droits patrimoniaux de l auteur représentent des droits exclusifs dont jouit l auteur de l œuvre, d exploiter son œuvre ou d autoriser son exploitation par autrui, en accomplissant l un quelconque des actes suivants : c) toute forme d exploitation de l œuvre en général, y compris la location commerciale de l original et de ses exemplaires. TURKEY / TURQUIE Law on Intellectual and Artistic Works n 5846 of 1951 as last amended by law n 5571 of 2006 Article 23 The exclusive right to rent, lend, put up for sale or distribute in any other way, the original or copies of a work, belongs to the author. The author has the exclusive right to import copies of a work that have been reproduced abroad with his permission and to exploit such works by distribution. Copies that are reproduced abroad may not under any circumstances be imported without the permission of the author and/or the holder of the right of distribution who has the author s permission. Provided that the authorities of rental and public lending remain with the author, the resale of specific copies following their first sale or distribution within the country by way of transfer of ownership as a result of the exercise of the distribution right by the right holder shall not infringe the right of distribution granted to the author. The distribution of a work or its copies by way of rental or lending, may not lead to a widespread copying of the work in a manner prejudicing the right of reproduction of the author. The rules and procedures regarding the application of this article shall be regulated with a by-law to be issued by the Ministry of Culture and Tourism. concept page 5/5
