1 BY-LAW # Z A BY-LAW IN AMENDMENT OF THE CITY OF MONCTON DEVELOPMENT CHARGE BY-LAW BE IT ENACTED by the City Council of the City of Moncton as follows: The City of Moncton Development Charge By-law, being By- Law # Z-1519, ordained and passed on January 0, 00, and filed in the Westmorland County Registry Office on April 9, 00, as number 40031, is hereby amended as follows: 1. Repealing section 5 and replacing with the following: Imposition of development charge 5(1) Development charges listed in Schedule C shall be imposed and collected from an applicant prior to the approval of a subdivision plan by the development officer or the issuance of a development permit under the Zoning By-law. 5() For the development of components of benefiting areas as set out in Schedule B, Area Development Charges shall be calculated based on the Area Development Charge per weighted acre and imposed and collected from an applicant prior to the approval of a subdivision plan by the development officer or the issuance of a development permit under the Zoning By-law.. Adding the following section to Schedule A (Designated Municipal Services):. HUMPHREYS BROOK EAST BENEFITING AREA WHEREAS a development charge background study has been completed which identifies new infrastructure required to service the planned Humphreys Brook East growth area in the City of Moncton; AND WHEREAS a public consultation process, held to facilitate public input on the Humphreys Brook East Development Charge amending by-law, has been carried out; AND WHEREAS the charges imposed by this by-law are related to capital costs attributable to projects included or to be included in the capital budget and to capital projects required to service residential, commercial, industrial, or institutional designated lands in the Humphreys Brook East area; NOW THEREFORE, the City of Moncton designates the following services to be recoverable for the Humphreys Brook East benefiting area: (1) Transportation: Crossing at Humphreys Brook (culvert with minimum orifice area in excess of 4 square metres), left ARRÊTÉ n o Z ARRÊTÉ PORTANT MODIFICATION DE L ARRÊTÉ SUR LA REDEVANCE D AMÉNAGEMENT DE LA VILLE DE MONCTON Le conseil municipal de Moncton édicte : L Arrêté sur la redevance d aménagement de la Ville de Moncton, soit l arrêté n o Z-1519, fait et adopté le 0 janvier 00 et déposé au bureau de l enregistrement du comté de Westmorland le 9 avril 00 en tant que numéro 40031, est modifié ainsi : 1. L article 5 est abrogé et remplacé par ce qui suit : Imposition d une redevance d aménagement 5(1) Les redevances d aménagement énumérées à l annexe C seront imposées au demandeur et perçues auprès de lui avant l approbation d un plan de lotissement par l agent d aménagement ou la délivrance d un permis d aménagement sous le régime de l Arrêté de zonage. 5() Pour l aménagement des éléments des secteurs bénéficiaires indiqués à l annexe B, les redevances d aménagement sectorielles seront calculées en fonction des redevances d aménagement sectorielles par acre pondéré et seront imposées au demandeur et perçues auprès de lui avant l approbation d un plan de lotissement par l agent d aménagement ou la délivrance d un permis d aménagement sous le régime de l Arrêté de zonage.. L article qui suit est ajouté à l annexe A (Services municipaux désignés) :. SECTEUR BÉNÉFICIAIRE EST DU RUISSEAU HUMPHREYS ATTENDU qu une étude préliminaire sur les redevances d aménagement a été achevée, laquelle indique la nouvelle infrastructure nécessaire pour viabiliser le secteur de croissance est du ruisseau Humphreys dans la ville de Moncton; qu une consultation publique a eu lieu afin d obtenir l avis du public relativement à l arrêté modificatif sur la redevance d aménagement afférente au secteur de croissance est du ruisseau Humphreys; que les redevances imposées dans le présent arrêté se rapportent aux coûts d immobilisations attribuables aux projets inclus ou à inclure dans le budget d immobilisations et aux projets d immobilisations nécessaires pour viabiliser les terrains désignés résidentiels, commerciaux, industriels ou d établissements publics dans le secteur est du ruisseau Humphreys, À CES CAUSES, la Ville de Moncton indique que le coût des services qui suivent peut être recouvré à l égard du secteur bénéficiaire est du ruisseau Humphreys :

Adding in Schedule C (Development Charges per Benefiting Area), after Table 1, Tables.1 and., representing, respectively, Humphreys Brook East Benefiting Area (01 Rates) and Humphreys Brook East Benefiting Area Development Charges per Weighted Acre (01 Rates), attached hereto. (1) Transport : Franchissement du ruisseau Humphreys (ponceau d une ouverture minimale supérieure à 4 mètres carrés), voies de virage à gauche et à droite à la hauteur du boulevard Harrisville, et feux de circulation à la hauteur du boulevard Harrisville. 3. Deux nouvelles cartes, intitulées «. CARTES DES SECTEURS BÉNÉFICIAIRES EST DU RUISSEAU HUMPHREYS», et représentant, respectivement, les propriétaires fonciers et les zones de redevance d aménagement (ADC) A et B, ci-jointes sont ajoutées à l annexe B (Secteurs bénéficiaires), après la carte représentant le secteur bénéficiaire de Twin Oaks. 4. Le tableau 1 de l annexe C (Redevances d aménagement par secteur bénéficiaire) est abrogé et remplacé par le nouveau tableau 1, ci-joint. 5. Les tableaux.1 et. représentant, respectivement, le secteur bénéficiaire est du ruisseau Humphreys (taux de 01) et les redevances d aménagement sectorielles par acre pondéré pour le secteur est du ruisseau Humphreys (taux de 01), ci-joints, sont ajoutés après le tableau 1 de l annexe C (Redevances d aménagement par secteur bénéficiaire).
