L élaboration de la norme IPSAS 32 Objectif : traitement comptable des «service concession arrangements» (SCA) dans les comptes du concédant Mars 2008 : Consultation Paper. 33 réponses dont 4 françaises mission des normes comptables, ministère du budget (DGFiP), ministère de la santé (direction des hôpitaux et de l organisation des soins), Cour des comptes Février 2010 : Exposé sondage («ED 43»). 33 réponses dont 4 françaises (CNoCP, DGFiP, Cour des comptes, Mazars) Septembre 2011 : norme IPSAS 32, téléchargeable sur le site de l IFAC. Le principe retenu IPSAS 32 «is intended to mirror IFRIC 12» (AG1) Rappel: le choix fondateur du «comité du secteur public» de l IFAC (appelé «IPSAS Board» en 2004) d aligner les IPSAS sur les IAS/IFRS. Choix actuellement discuté dans le contexte de l élaboration du cadre conceptuel des normes comptables du secteur public. 3
Périmètre (1/3) The SCA is a contract between a grantor and an operator in which: 1. The operator uses the SCA asset to provide a public service on behalf of the grantor for a specified period of time 2. The operator is compensated for its services over the period of the SCA Compensation by: 1. Making payments to the operator (the «financial liability model») 2. Granting the operator the right to earn revenue from thirdparty users of the SCA (the «grant of a right to the operator model») 4
Périmètre (2/3) Remarques: 1. Pas de définition du «public service» 2. A grantor: a «public sector entity». Rappel: les IPSAS excluent de leur champ d application les entreprises publiques («Government Business Enterprises» GBE). Le périmètre d application des IPSAS recoupe en substance le secteur public non marchand. Discussions en cours sur ce périmètre. 5
Périmètre (3/3) Definition of a SCA asset A SCA asset is an asset used to provide public services in a SCA arrangement, asset provided by the operator or the grantor Examples given on AG4: roads, bridges, tunnels, prisons, airports, water distribution facilities, energy supply and telecommunication networks Rationale for not using the IFRIC 12 term of «infrastructure» (BC9): infrastructure used in IPSASs in ways that may not be fully compatible with IPSAS 32; in some jurisdictions, meaning of «infrastructure» differs from that used in IFRIC 12.Despite of different wordings, the term «SCA asset» is intended to cover the same types of assets as envisaged in IFRIC 12. 6
Comptabilisation de l actif (1/2) The grantor shall recognize the asset if: 1. controls and regulate what services the operator must provide with the asset, to whom it must provide them, and at what price; and 2. The grantor controls any significant residual interest in the asset at the end of the term of the arrangement. Initial Measurement of the asset at its fair value (AG 30) Subsequent measurement: IPSAS 17 on PPE and IPSAS 31 on intangible assets The grantor follows impairement testing (IPSAS 21 and IPSAS 26) 7
Comptabilisation de l actif (2/2) Remarque : la norme IPSAS ne fait pas allusion aux contrats prévoyant une obligation de maintien en bon état pendant toute la durée du contrat et aux conséquences éventuelles de ces clauses sur la comptabilisation de l actif. Pour les cas où l actif existe préalablement à l accord de concession, la norme IPSAS 32 précise que la comptabilisation se limite à un reclassement de l actif dans la catégorie «actifs concédés» et il n y a pas de comptabilisation d un passif. 8
Comptabilisation du passif (1/3) The grantor shall recognize a liabilitiy at the same amount as the SCA asset 1. In the «financial liability model»: a financial liability (IPSAS 29 on financial instruments). Mirrors the financial asset in IFRIC 12 2. In the «grant of the right to the operator model»: the unearned portion of the revenue arising from the exchange of assets between the grantor and the operator (the exchange is regarded as a transaction that generates revenue) (IPSAS 9 on revenue)). Mirrors the intangible asset in IFRIC 12. 9
Le passif (2/3) «grant of a right model» Abandon de la «performance obligation» qui avait été retenue dans l ED 43 Dans IPSAS 32, le raisonnement comptable a été mené, par analogie, dans le cadre de la norme IPSAS 9 «produits des opérations avec contrepartie directe» qui demande la comptabilisation d un revenu dans le cas d un échange d actifs dissemblables. Dans l IPSAS 32, ce revenu n est pas comptabilisé en totalité dès le début de la concession. Il est classé parmi les dettes en «produit constaté d avance». L alternative consistant à ne pas reconnaître de passif et à constater une augmentation de l actif net (ou une diminution du passif net) n a pas été retenue (Cf. «basis for conclusions»). 10
Le passif (3/3) «grant of a right model» Basis for conclusions: the IPSAS Board considered whether the credit should be accounted for as liability, as a direct increase to net assets/equity or as a revenue: 1. The grantor does not have a liability because the SCA is an exchange of assets 2. The credit is not a direct increase of net assets because it is not one of the components of net assets as defined in IPSAS 1 3. The credit represents revenue. However, until the criteria for recognition of revenue have been satisfied, the credit is recognized as a liability. 11
