8 MODALITES GENERALES DE REGLEMENT GENERAL PAYMENT TERMS AND CONDITIONS MODES DE REGLEMENT METHODS OF PAYMENT Les règlements peuvent s'effectuer : a) Par prélèvements automatiques sur compte bancaire, b) Par chèques bancaires ou postaux c) Par virements bancaires : pour les virements bancaires provenant de l'étranger, les usagers sont tenus de stipuler "frais à la charge de l'émetteur". Dans les cas b) et c), les règlements sont libellés au nom de : Aéroports de la Côte d'azur Compte BNP - Nice Code banque : Code guichet : Compte N /59 d) Par versements en espèces, en Euros, auprès de nos services. e) Par cartes bancaires pour certains services de l aéroport Les effets de commerce (billets à ordre, traites, lettres de change, etc...) ne sont pas acceptés par Aéroports de la Côte d Azur. 9 DELAIS DE REGLEMENT TERMS OF PAYMENT Nos factures sont payables à 30 jours, date d émission. Our bills are payable in 30 days, date of issue. PENALITES EN CAS DE RETARD DE REGLEMENT PENALTIES FOR LATE PAYMENT En cas de retard ou de non paiement, des pénalités de retard sont exigibles le jour suivant la date de l échéance figurant sur la facture au taux de 12 %, sans qu un rappel soit nécessaire et viendront s ajouter à la clause pénale prévue contractuellement. Ce taux résulte de l application de la loi LME n du 4 août 2008 dans son article 21 qui a modifié l article L du code de commerce en fixant le taux minimum de pénalités de retard à trois fois le taux de l intérêt légal. En outre, un tel retard emportera annulation immédiate et irréversible de toutes les réductions de prix qui auraient été consenties au client et entraînera la déchéance du terme ainsi que la transmission du dossier au service contentieux qui procèdera au recouvrement d office de l intégralité de la créance due par tout moyen de droit. Tous frais connexes à la procédure sont répercutables, à la charge pleine et entière du débiteur. Aéroports de la Côte d Azur se réserve le droit de prononcer la résolution du contrat de plein droit du fait de l inexécution de l obligation de payer dans les délais requis, sans sommation, ni formalité. Les règlements dont le recouvrement est assuré par voie contentieuse seront affectés par priorité aux factures les plus anciennes. In case of delay or of not payment, penalties of delay are owed in the daytime according to the date of expiry date appearing on the bill in the 12 % rate, without a recall being necessary and will come to be added to the penalty clause envisaged by contract. 10 FRAIS DE FACTURATION ET DE CONTENTIEUX EXPENSES OF INVOICING AND OF BONE OF CONTENTION Tarifs applicables au 1er janvier 2011 Tariffs in force at January 1, frais de facturation Cas particulier des redevances aéronautiques. Les redevances aéronautiques sont facturées périodiquement aux usagers: * basés ou disposant de locaux sur l aéroport * abonnés pour l abri de leur aéronef, * dont les redevances sont prises en compte par des consignataires accrédités, * réguliers, bénéficiant d un agrément de Aéroports de la Côte d Azur que celle-ci a la faculté de retirer à tout moment, * n entrant pas dans les catégories précitées mais ayant garanti leur paiement en acceptant le prélèvement automatique sur compte bancaire. Dans ce dernier cas exclusivement, les frais bancaires relatifs à ce mode de règlement sont à la charge de l usager, Pour les autres usagers, les redevances aéronautiques sont facturées à chaque mouvement et doivent être payées obligatoirement avant tout décollage. En cas de non paiement comptant, la facture sera adressée en fin de mois à l usager, majorée d une somme forfaitaire pour frais de facturation, soit 15,00 HT Cette somme forfaitaire ne dispense pas des frais de contentieux prévus ci-dessous. 2 - frais de contentieux Ces frais sont destinés à couvrir les coûts de traitement des dossiers d impayés par le Service contentieux, au delà de la 2ème lettre de relance. Le montant des frais de contentieux est fixé forfaitairement à 52,00 HT. De même que pour les frais de facturation, il est rappelé que les frais de contentieux sont appliqués automatiquement, dès que le dossier est transmis au service contentieux, c est-à-dire après la 2ème relance. En ce qui concerne les contentieux liés à des redevances aéronautiques, conformément à la procédure prévue par l article R du Code de l Aviation Civile, il peut être procédé à la saisie conservatoire de l aéronef jusqu à consignation du montant des sommes en litige. 1 - expenses of invoicing. 11 2 - expenses of bones of contention. These expenses are intended to cover the costs of treatment of the files of unpaid debts by contentious Service, beyond of the 2nd letter of revival. The sum of expenses of bones of contention is fixed 52,00 ex. VAT. As well as for expenses of invoicing, one reminds of him that expenses of bones of contention are automatically applied, as soon as the file is transmitted in contentious service, that is to say after the 2nd revival. As regards bones of contention linked to aircraft charges, in accordance with the procedure envisaged by the article R of the Code of Civil aviation, he can be undertaken the sequester of property of the plane up to consignment of the sum of sums in litigation. GARANTIE DES CREANCES DEBT SECURITY 1 - Activité Aéronautique a) Redevances domaniales Garantie égale à trois mois de redevances sous forme de dépôt de garantie réactualisable non productif d intérêts. b) Redevances aéronautiques Compagnie régulière : un mois de redevances aéronautiques estimées sous forme de garantie bancaire à première demande ou dépôt de garantie. Compagnies charters ou en période d observation suite à redressement judiciaire : pré-paiement. 2 - Activité commerciale Toute activité commerciale exercée sur l Aéroport Nice Côte d Azur est soumise au versement d un dépôt de garantie équivalent à trois mois de redevances commerciales estimées, ou au quart du minimum garanti. 1 - Aeronautical activity a) Estate charges Guarantee equal to three months charges in the form of a renewable deposit not subject to interest. b) Aeronautical charges Regular airlines: estimated aeronautical fees for one month in the form of a first class bank guarantee or a deposit Charter airlines or airlines in an observation period following legal redress: pre-payment. 2 - Commercial activity Any commercial activity carried out in Nice-Côte d Azur Airport is subject to payment of a deposit equal to estimated commercial charges for three months, or to a quarter of the minimum guarantee. LITIGES DISPUTES En cas de litiges sur les conditions d application tarifaire c est la version française qui fait foi. 12 AEROPORT NICE COTE D AZUR NICE-COTE D AZUR AIRPORT Redevances pour SERVICES PUBLICS A EROPORTUAIRES Airport public services charges Conformément au décret n du 20 juillet 2005, relatif aux redevances pour services rendus sur les Aéroports (Art R à R 224-5), l ensemble des redevances ci-après correspondent aux services rendus : aux exploitants d aéronefs à leurs prestataires de service à l occasion de l usage : de terrains, d infrastructures, d installations, de locaux, d équipements aéroportuaires fournis par l exploitant d aérodrome dans la mesure où cet usage est directement nécessaire, sur l Aérodrome, à l exploitation des aéronefs ou à celle d un service de transport aérien. In compliance with French Decree no dated 20th July 2005, relating to the charges for services provided in Airports (Art R to R 224-5), all the following charges correspond to services provided for: aircraft operators and their service providers when using: land, infrastructures, facilities, premises, and airport equipment provided by the airport operator insofar as said use is directly necessary, in the Airport, for the operating of aircraft or for that of an air transport service. 12

14 Informations à fournir par les compagnies aériennes Information to be provided by the airlines 1 DOCUMENTS RELATIFS AUX AERONEFS DOCUMENTS RELATING TO THE AIRCRAFT Dans le mois qui précède la venue de l'aéronef pour les compagnies programmées ou avant la facturation pour l aviation générale et d affaires, une copie des documents suivants est à adresser au : SERVICE DES REDEVANCES AEROPORTUAIRES Aéroports de la Côte d Azur Aéroport Nice Côte d'azur - BP 3331 F NICE CEDEX 3 redevances-anca@cote-azur.aeroport.fr TEL : +33 (0) FAX : +33 (0) SITA : NCERAXH Le Certificat de Limitation de Nuisance (CLN) comportant les indications de motorisation et les mesures de bruit associées La liste de flotte certifiée par la DGAC pour les compagnies françaises ou l autorité compétente pour les compagnies étrangères. Le Certificat de Transporteur Aérien (AOC : Air Operator Certificate) avec la flotte concernée afin de constater le type de mouvement en vol commercial. Si tel est le cas, pour les Compagnies Françaises, une attestation émanant de la compagnie certifiant que celle-ci effectue plus de 80% de son trafic à l'international (en vue de l'exonération de la TVA). Le numéro de TVA intracommunautaire pour les Compagnies ressortissantes de l Union Européenne. En l absence de ces documents, aucun avoir rétroactif ne sera établi. AOC: Air Operator Certificate with the fleet in question in order to ascertain the type of commercial flight movement. If it is the case, a certificate from the airline attesting that more than 80% of its traffic is processed at international (for VAT exemption tax). The intra-community VAT number for European airlines. Without these documents, no retroactive credit note can be issued. 14

15 2 PARAMETRES DE CALCUL DE LA REDEVANCE D ATTERRISSAGE PARAMETERS FOR CALCULATING THE LANDING CHARGE Les deux paramètres propres à chaque aéronef établis à partir des documents transmis sont : La Masse Maximum au décollage (MMD portée au Certificat de Navigabilité) arrondie à la tonne supérieure Le groupe acoustique. D'une façon générale afin de maintenir le fichier des immatriculations constamment à jour, il doit être signalé avant l'exploitation d un vol toute modification de la composition ou des caractéristiques de la flotte. Les mises à jour seront prises en compte à la date de réception des documents, et applicables pour la période non facturée, sans effet rétroactif sur les facturations antérieures. En l'absence de ces informations pour une immatriculation inconnue, la redevance d'atterrissage sera calculée de la façon suivante : Masse Maximum au décollage du modèle le plus lourd du type avion considéré selon les informations présentes dans les fichiers de l Aéroport Nice-Côte d Azur Conformément à l arrêté du 26 février 2009, article 3 -II Les aéronefs sont classés en 6 groupes acoustiques... et il appartient à l exploitant ou, à défaut, au propriétaire d aéronef de fournir à l exploitant de l aérodrome à sa demande les documents justificatifs nécessaires à son classement. A défaut de fourniture de ces documents, l aéronef est classé dans le groupe I. If the document is not provided, the aircraft is classified in group 1." 15

16 3 TRANSMISSION DES DONNEES RELATIVES A UN MOUVEMENT FORWARDING OF DATA RELATING TO A MOVEMENT Quelle que soit la nature de son trafic, l'exploitant aérien ou son représentant qui peut être l'organisme d'assistance, doit communiquer au service des redevances, à l'avance ou une heure maximum après le mouvement la décomposition du chargement en passagers, fret et poste par escale, via le réseau SITA (Messages de chargement : LDM et SLS). En l'absence de ces informations la facturation sera établie au maximum de la capacité de l'aéronef et aucun avoir rétroactif ne sera établi. If this information is not available, the invoice shall be drawn up in line with the maximum capacity of the aircraft and no retroactive credit can be draw up. 4 INFORMATIONS DIVERSES MISCELLANEOUS INFORMATION Les informations susceptibles d'avoir un impact sur la facturation doivent être transmises au service des redevances : - Changement d'adresse de facturation. - Changement de code IATA ou OACI. - Changement d'assistant. - Changement concernant la propriété ou l'exploitation d'un aéronef. - En cas de problème technique d'un aéronef, joindre impérativement la copie du compte rendu d'incident technique justifiant l'immobilisation de l'appareil. 17 A) Redevance d'atterrissage Landing charge Tarifs applicables du 1er avril 2011 au 31 mars 2012 Tariffs in force from April 1, 2011 to March 31, ) TAUX DE LA REDEVANCE D ATTERRISSAGE LANDING CHARGE RATES La redevance d'atterrissage inclut la redevance de balisage. La redevance est due pour tout aéronef qui effectue un atterrissage et est calculée d'après la masse maximum au décollage portée sur le certificat de navigation de l'aéronef (ou sur le Registre Veritas), arrondi à la tonne supérieure. Modulation acoustique : Conformément à l Arrêté du 26/02/2009, sauf en ce qui concerne les aéronefs militaires français, les taux de la redevance d atterrissage sont affectés d un coefficient de modulation en fonction du groupe acoustique de l aéronef et de l heure d atterrissage (heure locale). A défaut de fourniture de ces documents, l aéronef est classé dans le groupe 1. En l absence de transmission du groupe acoustique de l aéronef, aucun avoir rétroactif ne sera établi. Landing charge includes ground lighting charge. Charges are due for any aircraft that makes a landing and are calculated in line with the maximum take-off weight shown on the aircraft s certificate of airworthiness (or as stated in the Veritas Register), rounded up to the nearest tonne. Acoustic modulation: In accordance with the order of , except in the case of French military aircraft, rates of landing tax are modified using a modulation coefficient according to the aircraft's acoustic group and the landing time (local time). 17

18 It is the responsibility of the aircraft operator, or failing this the aircraft owner, to provide the aerodrome operator with the requested justifying documents required to classify the aircraft. If the document is not provided, the aircraft is classified in group 1. No retrospective credit note will be issued if the aircraft's acoustic group is not communicated. 20 B) Redevance de stationnement avions Aircraft parking charge Tarifs applicables du 1er avril 2011 au 31 mars 2012 Tariffs in force from April 1, 2011 to March 31, ) TAUX DE LA REDEVANCE DE STATIONNEMENT AVION AIRCRAFT PARKING CHARGE RATES La redevance de stationnement avions est due par tout aéronef stationnant sur les aires de trafic (postes de stationnement). Elle est calculée par tonne et par heure avec un forfait pour 0 à 18 tonnes, la masse à considérer étant la masse maximale au décollage portée sur le Certificat de Navigabilité de l Appareil. Le délai de franchise est fixé pour tout appareil stationnant sur l aire de stationnement à 1h15. La durée de stationnement est décomptée pour tout aéronef entre l heure d atterrissage et l heure de décollage. Aircraft parking charge is paid by all aircraft parking on terminal aprons. It is calculated per metric tonne and per hour with a set price from 0 to 18 tonnes and based on the maximum take off weight shown on the aircraft Certificate of Airworthiness.
