ABSTRACT The decision to hold an Extraordinary Session of the General Fisheries Commission for the Mediterranean (GFCM) was made by the twenty-eighth session of the Commission (October 2003). The mandate of this session was: to review the implications of the entry into force of the 1997 amendments to the GFCM Agreement and to adopt Financial Regulations for the autonomous budget; to assess the GFCM programme of work and the autonomous budget for 2005; to agree upon a selection procedure for the Executive Secretary; and to adopt criteria for new headquarters, as well as to review issues connected to the functioning of the Commission. The Commission adopted its Financial Regulations and debated on the official currency to be used for the autonomous budget. It decided to freeze the proposed posts of aquaculture expert and of statistician in the Secretariat and agreed that the post of Executive Secretary would be covered by the autonomous budget. The Commission further adopted by consensus the autonomous budget for 2005, as well as a procedure for the selection of the Executive Secretary; and criteria for the selection of GFCM new headquarters. The Commission agreed to postpone the review of several practical, institutional and legal issues regarding its functioning to the next GFCM ordinary session, early December RÉSUMÉ La décision de tenir une session extraordinaire de la Commission générale des pêches pour la Méditerranée (CGPM) a été prise par la vingt-huitième session de la Commission (octobre 2003). La Commission a adopté son règlement financier et discuté de la monnaie officielle à utiliser pour le budget autonome. 9 1 OPENING OF THE SESSION 1. The General Fisheries Commission for the Mediterranean (GFCM) held an Extraordinary Session in St Julians, Malta, from 19 to 23 July The Session was attended by delegates from 17 Members of the Commission. The list of delegates is given in Appendix B to this report. 3. The Session was called to order by Mr Abdelatif Berraho, Chairperson of the Commission, who welcomed the participants and in particular, Mr George Pullicino, Minister of Rural Affairs and the Environment, Malta. On behalf of the Commission, he expressed special appreciation for his presence at the opening of this Session. 4. Mr George Pullicino, Minister of Rural Affairs and the Environment, welcomed the participants to the Extraordinary Session. He recalled the special characteristics and importance of fisheries for all the bordering Mediterranean countries and referred to the considerations of the specificities of the region in the formulation of a Mediterranean Action Plan in the framework of the European Community. After stressing the role of bodies such as GFCM to ensure the strong cooperation between Mediterranean countries which is needed, he referred to the number of issues that the Extraordinary Session will have to consider. He recalled the content of the Ministerial Declaration of the Conference on the Sustainable Development of Fisheries in the Mediterranean which was held in Venice in November One of the issues to be discussed was the location of the headquarters of the Commission. In this respect, Minister Pullicino reiterated the offer to host these headquarters in Malta and referred to the unique characteristics which made Malta the ideal site to host these headquarters. 5. On behalf of the Director-General of FAO, Mr Jacques Diouf, and of Mr Ichiro Nomura, Assistant Director-General, Fisheries Department, FAO, Mr Pulvenis de Séligny, Director of the Fishery Policy and Planning Division of the Fisheries Department, thanked the Government of Malta and the Maltese people for hosting the Session and the European Community for providing support. 6. Mr Pulvenis de Séligny highlighted the importance of that Session which would bring to an end the process that had started in 1989 and conclude an interim period of almost seven years. With the entry into force of the amendments to the GFCM Agreement, the autonomous budget would contribute decisively to strengthen the Commission institutionally and operationally and reinforce its functional autonomy. He recalled the efforts made by the Commission during the last years to face rising challenges. He mentioned the need for vigorous action by Members in such areas as cooperation, communication, participation in the work of the Commission and implementation and enforcement of its decisions. He called for the Members to build on the present momentum to fulfill the expectations of the many stakeholders, and stressed the commitment of FAO to continue giving all its support to this common endeavour (Appendix D). ADOPTION OF THE AGENDA AND ARRANGEMENTS FOR THE SESSION 7. The Heads of Delegations introduced themselves and their respective advisors.

10 2 8. The delegate of Malta stated that a proposal made by all Members of the European Union concerning the selection of the Secretary would be considered under Agenda Item 6. The proposal was distributed to Members. 9. Upon request by the European Community (EC), the Ministerial Declaration of the Conference on Sustainable Development of Fisheries in the Mediterranean held in Venice in November 2003 was made available to delegates. 10. The Commission agreed to a suggestion by the Secretary to add the Report of the Coordinating meeting of the Sub-Committees of the Scientific Advisory Committee (SAC) (17 November 2003) as document GFCM:ES/2004/Inf The Commission agreed to reverse the order of agenda items 5 and 4. The Commission agreed that Agenda Item 8 should also consider the issues related to the FAO Regional projects in supporting the scientific and technical activities of the Commission. 12. The Agenda attached as Appendix A to this report was adopted with the aforementioned changes. 13. The documents which were submitted to the Commission are listed in Appendix C. STATUS OF THE GFCM AGREEMENT AS AMENDED IN The Agenda Item was introduced by the Secretariat based on document GFCM:ES/2004/2. The document reviewed the process which led to the entry into force of the autonomous budget on 29 April The Secretariat summarized the various factors that were taken into account for the calculation of the scale of contribution as adopted at the 25th Session of the Commission and presented an updated table of the latter, attached as Appendix E. 15. Members were invited to validate by the next ordinary session the wealth and fishery production figures used in the calculation of the scale of contribution. 16. The Status of acceptance of the amendments relative to the autonomous budget and related matters were reviewed. The Commission was informed that Algeria and Morocco had ratified the agreement as amended and the relevant instruments are to be deposited soon with the Director-General. Japan was expected to finalize the process of ratification within the month. 17. The Commission was informed by the Legal Office on the current dual situation where a number of Members are bound by the new text of the Agreement, as modified by the amendments involving new obligations, while other Members continue to be bound by the GFCM Agreement as it stood prior to those amendments. The Legal Office recalled that, from a legal point of view, having regard to principles of international law as embodied in the Vienna Convention on the Law of Treaties, nothing would prevent the Commission from agreeing that all Members could participate in the discussions. However, whether or not this approach could be taken was a matter for the Commission to decide. Several Members expressed their concern on a possible dual legal regime within the Commission, in particular with regard to budgetary issues.

11 3 18. Following a debate on the matter, the Commission decided that all Members could participate in the discussions. However, the Commission acknowledged that only Members having deposited the instruments of acceptance of the amendments involving new obligations would be able to vote on matters covered by the amendments which came into force on 29 April 2004, should a vote be required. PROPOSED FINANCIAL REGULATIONS FOR THE GFCM 19. The Commission considered document GFCM:ES/2004/4 Proposed Financial Regulations for the General Fisheries Commission for the Mediterranean in light of a number of introductory observations made by the Secretariat. Thus, the Commission noted that the proposed Financial Regulations would cover the financial administration of the Commission in respect of the activities financed by the autonomous budget, to the exception of any contributions made available by the Organization to be paid within the limits of the biennial budget. The Commission noted that the proposed Scale of Contributions would be appended to the Financial Regulations, in accordance with Article IX, paragraph 3 (b) of the revised GFCM Agreement. The Commission was informed that the Financial Regulations would be reported to the Finance Committee in accordance with Article II, paragraph 13 of the revised GFCM Agreement. 20. In the ensuing debate, a range of specific issues were clarified. The Commission noted that proposed Financial Regulation V.4 on the currency of assessment and the currency of payment of the contributions could be reconsidered at a subsequent stage, in light of further consultation with the concerned services of the Organization. The European Community and the European Union Member States renewed their preference for using Euro as the official currency for the GFCM autonomous budget. 21. Much debate surrounded the issue of the level of the amount to cover the Organization s costs as per proposed Financial Regulation III.5. The Commission was informed that the proposed autonomous budget would take the form of a Trust or Special Fund, as per FAO Financial Regulation 6.7, and, consequently, that any financial obligations for the Member Nations of FAO involved in the acceptance of such funds would have to be covered through project servicing costs. The Commission was also informed that a level of 6.0 % for such costs had been proposed, but that such level could be reduced in the event that a post of Administrative Assistant were to be approved in the context of the proposed budget. The Commission was further informed that the current level of support costs was set by the Governing Bodies of FAO, on the recommendation of the Finance Committee, and that the Secretariat had no authority to deviate from the decisions taken by the Members of the Organization. 22. Some delegations recalled that in the case of the Indian Ocean Tuna Commission (IOTC), which did not have an Administrative Assistant, the amount to cover the Organization s costs had been set at a rate lower than 6.0%. While noting the observations made by the Secretariat, the Commission strongly recommended to the Finance Committee that the amount to cover the Organization s servicing costs be set at 4.5%, as was the case with IOTC. On possible voluntary contributions, several Members pointed out that they would strongly prefer not to have a percentage of administrative costs applied on, or, if unavoidable, the lowest level possible should be applied.

12 4 23. The Commission approved the proposed Financial Regulations as set out in Appendix F. The specific issues, referred above in paragraphs 20 and 22 would need to be considered by FAO, possibly before the Twenty-ninth Session of GFCM. 24. The delegation of the European Community, supported by several Members, pointed out that the Executive Secretary should be able to monitor and oversee the budget at any time necessary and upon request of any GFCM Member. The Secretariat acknowledged that all measures should be taken in order to address this concern, and to allow the Executive Secretary to exercise his functions efficiently. The representative of the FAO Legal Office confirmed that there was no impediment from a legal point of view. FORECAST OF THE GFCM TOTAL BUDGET FOR 2005 AND BUDGET LINE ALLOCATION 25. The Secretariat presented this agenda item on the basis of document GFCM:ES/2004/Inf.4 GFCM Short and Medium Term Programme and of document GFCM:ES/2004/3 Forecast of the GFCM total budget for 2005 and budget line allocation. 26. The strategic guidelines developed by the Commission in recent years and the important tools developed to contribute monitoring fishing effort for priority shared fisheries and promoting the development of aquaculture, were stressed in the document concerning the Programme of Work. The importance of preparing management plans for major shared fisheries was also highlighted as well as the need to strengthen mechanisms for ensuring the effective implementation of GFCM management decisions and to take into proper consideration the role of aquaculture. 27. The document concerning the budget for 2005 provided the indicative estimates for the autonomous budget for 2005 mainly extrapolated from expenditures occurred in The Secretariat noted that the suggestion made, at its meeting held in August 2003, by the group of experts tasked with the evaluation of SAC and the budget proposed by the Fourth Session of the Committee on Aquaculture (CAQ), were taken into consideration at the preparation of this forecast. 28. Several delegations commended the Secretariat for the quality of these papers. Following discussion on the document on the budget, it was acknowledged that the budget components were well structured although some elements needed to be better defined. The Commission agreed that priority should be given to securing core activities and strengthening the Secretariat. The presented tentative budget was perceived as a template that would be used as reference for future budgetary exercises of the Commission. 29. The Commission decided to review the 2005 indicative budget chapter by chapter. There was consensus on the issue of reducing the staffing. The Commission decided to freeze the proposed post of Aquaculture expert and to rely upon consultancies at present. As far as the proposed post of Statistician was concerned, the Commission confirmed that the functions would be covered for the time being under the MedFisis Project. 30. The question of funding the post of the Executive Secretary was discussed at length. Most delegations expressed a preference towards having this post funded by the autonomous budget. They generally stressed that this would express the political commitment of the Member countries to strengthen GFCM and to give it a new momentum. Some highlighted

13 5 that such arrangement would be also in line with other similar Regional Fishery Commissions. Some delegations were in favor of a continued financing of this post by the FAO regular programme, not only to maintain a strong link with the Organization but also to avoid increasing the contribution of the Members and eventually allocate more resources to field activities. 31. As a complement to the proposal to fund the post of the Executive Secretary under the autonomous budget, a delegation proposed that all posts in the Secretariat be paid by that budget. Others were of the preference that FAO Regular Budget should at least cover the post of the Deputy Secretary since it would not have to pay anymore for the post of Executive Secretary. 32. The Commission agreed and decided that the post of Secretary would be covered by the autonomous budget. Desirous of ensuring the continued support from FAO, it also requested FAO to consider either to cover one of the posts of the Secretariat other than that of the Secretary or to make available to the Commission the services of another staff member. 33. The Commission welcomed the offer made by FAO to continue providing scientific and technical support and acknowledged the role and importance of such input toward the implementation of the activities promoted by the Commission. 34. The Commission expressed the preference that the statutory meetings will be covered by the autonomous budget. 35. The Commission took note that the 1997 amendments to the Agreement did not alter the legal status of the Commission as a FAO body under Article XIV of the FAO Constitution and that the proposed staff of the Secretariat would be FAO staff. 36. The Commission endorsed the suggested proportional allocation in support of the activities of the Scientific Advisory Committee for the year Concerning the activities of the Committee on Aquaculture, the Commission agreed that funds should be dedicated in priority to the strengthening of the Information System for the Promotion of Aquaculture in the Mediterranean (SIPAM) and the re-establishment of the Network on Environment and Aquaculture in the Mediterranean (EAM). 37. The Commission approved and adopted by consensus the budget for 2005, which is attached in Appendix G. 38. Several delegations reiterated the important role of the FAO regional projects in support of activities of the GFCM at subregional level. The delegate of Monaco enquired on the current activities of the Commission concerning the Black Sea. The delegate from Turkey informed the Commission on the status of the ongoing negotiations for the establishment of a regional fisheries commission or arrangement under the aegis of the Black Sea Economic Commission. PROCEDURE FOR THE SELECTION AND APPOINTMENT OF THE SECRETARY OF THE GFCM 39. The Commission considered document GFCM:ES/2004/5 Procedure for the selection and appointment of the Secretary of the General Fisheries Commission for the

14 6 Mediterranean on the basis of an introductory presentation by the Legal Office of FAO. The Legal Office recalled two legal considerations involved in the process of appointment of the Secretary. The first was that the Secretary is to be fully responsible for the implementation of the policies and activities of the Commission and is required to report thereon to the Commission. The second was that both the Commission, which is required to act through the Organization, and its Secretary as an official of the Organization, are linked to FAO. The Legal Office recalled that, in order for the Director-General to be able to appoint the GFCM Secretary, the Organization must be involved, in a suitable manner, in the selection process of the recommended candidate. 40. The Member States of the European Union, Members of the GFCM (Cyprus, France, Greece, Italy, Malta, Slovenia and Spain) introduced a draft proposal for the Rules of Procedure on the selection of the new Executive Secretary based on procedures used in other fisheries management commissions. 41. Algeria, Libyan Arab Jamahiriya, Morocco and Tunisia made also a proposal for the Rules of Procedure on the selection of the new Secretary in an attempt to facilitate reaching consensus on the matter. 42. As a result of further discussions on the matter, the Commission agreed and adopted by consensus a text to be added, through an amendment to the Rules of Procedure of the Commission. The agreed procedure for the selection and appointment of the first Executive Secretary of the Commission, including the required qualifications and terms of reference for the incumbent, are set out in Appendix H to this report. 43. In connection with this item, the Legal Office noted that the Members of the Commission had proposed a compromise text which appeared to reconcile the concerns which it had expressed on the matter. After having recalled that the issue of the procedure for the selection and appointment of secretaries of bodies established under Article XIV of the FAO Constitution had been referred to the next meeting of the Committee on Constitutional and Legal Matters, and through it to the Council of FAO, the Legal Office further noted that the above was without prejudice to the position of these bodies on the issue. HEADQUARTERS OF THE COMMISSION 44. The Secretariat presented document GFCM:ES/2004/6 entitled Headquarters of the Commission, which contained criteria for the selection of the headquarters of the Commission as well as other related considerations. As an additional reference, the Secretariat also called the attention of the delegations to the document which had been distributed at the request of the delegation of Italy entitled Categories of information that might be requested from countries interested in hosting the permanent secretariat (UNEP/FAO/PIC/INC.7/13 Annex). The Commission considered that these documents contained useful criteria and considerations and should be regarded as complementary and asked the Secretariat to elaborate a draft combining the elements of the two documents. This draft was endorsed by the Commission and is attached to this report as Appendix I. 45. The delegations of Algeria, Italy, Malta and Spain announced or reiterated their respective candidature to host the headquarters of the Commission. The Commission took note of their presentations and decided that all applications in this respect should be submitted to FAO before 30 September These applications should contain the information

15 7 specified in Appendix G as referred to above. FAO shall circulate the applications at the earliest after 30 September 2004 and they will be considered by the Commission at its next ordinary session, which should place within the first half of December ISSUES CONNECTED WITH THE FUNCTIONING OF THE COMMISSION 46. The Secretariat introduced the Agenda item on the basis of document GFCM:ES/2004/7, GFCM:ES/2004/Inf. 7 as well as GFCM:ES/2004/Inf. 11. The Secretariat pointed out a number of practical, institutional and legal issues regarding the functioning of the Commission. 47. The Commission after a very preliminary exchange of views agreed the convenience of considering them more thoroughly during the next ordinary Session of the Commission, particularly taking into account the need for the Members to analyze these issues and make the necessary internal consultations so as to come prepared to the meeting to reach consensus on the decisions and recommendations to be taken. ANY OTHER MATTERS 48. The Commission was informed of the establishment in Tunis, Tunisia in May 2004 of the Association of professional fishers of the Mediterranean coastal countries named MEDISAMAK, and with headquarters in Tarragona, Spain. The Association consists at present of the following countries: Albania, Algeria, Egypt, France, Greece, Italy, Libyan Arab Jamahiriya, Malta, Morocco, Spain and Tunisia. Steps are being taken to increase the number of countries in the Association. On behalf of the Chairman of the Association, a professional member of the French delegation expressed the wish of the association to be granted observer status at GFCM, in order to contribute actively to the objectives of the Commission. The Commission agreed to the request and invited the Secretariat to take the necessary action in this respect. 49. The issue of the appointment of the Deputy Secretary was raised by the delegate of Morocco who suggested the establishment of a selection panel. The Commission acknowledged the proposal and noted that it would have the opportunity to consider it at its next ordinary Session. ADOPTION OF THE REPORT 50. The report of the Extraordinary Session was adopted on 23 July 2004.

17 9 OUVERTURE DE LA SESSION 1. La Commission générale des pêches pour la Méditerranée (CGPM) a tenu une session extraordinaire à Saint-Julien (Malte), du 19 au 23 juillet Ont participé à la session des délégués de 17 membres de la Commission. La liste des délégués est reproduite à l Annexe B du présent rapport. 3. La session a été ouverte par M. Abdelatif Berraho, Président de la Commission, qui a souhaité la bienvenue aux participants et notamment à M. George Pullicino, Ministre des affaires rurales et de l environnement de Malte, qu il a tout spécialement remercié, au nom de la Commission, pour sa présence lors de l ouverture de la session. 4. Le Ministre des affaires rurales et de l environnement, M. George Pullicino, a souhaité la bienvenue aux participants à cette session extraordinaire. Il a rappelé les caractéristiques et l'importance particulières des pêches pour tous les pays situés en bordure de la Méditerranée et a évoqué les spécificités de la région, qui ont été prises en considération dans la formulation du Plan d'action pour la Méditerranée, lancé par la Communauté européenne. Après avoir souligné le rôle d'organes tels que la CGPM, qui assurent une intense coopération, bien nécessaire, entre les pays de la Méditerranée, il a abordé les différentes questions inscrites à l'ordre du jour de la session extraordinaire. Il a rappelé les dispositions de la Déclaration ministérielle de la Conférence sur le développement durable des pêches en Méditerranée, tenue à Venise en novembre L'une des questions à l'étude était le choix du siège de la Commission et, à cet égard, le Ministre Pullicino a réitéré l'offre de son pays d'accueillir le siège de la Commission, en expliquant les caractéristiques uniques qui faisaient de Malte un endroit idéal pour y installer ce siège. 5. Au nom du Directeur général de la FAO, M. Jacques Diouf, et du Sous-Directeur général chargé du Département des pêches, M. Ichiro Nomura, le Directeur de la Division des politiques et de la planification de la pêche, M. Pulvenis de Séligny, a remercié le Gouvernement et la population de Malte pour avoir accueilli cette session et la Communauté européenne pour avoir fourni un appui. 6. M. Pulvenis de Séligny a souligné l importance de cette session qui mettrait fin à un processus entamé en 1989 et conclurait une période intérimaire de près de sept ans. Avec l'entrée en vigueur des amendements à l'accord de la CGPM, le budget autonome devrait contribuer de manière déterminante à renforcer la Commission sur le plan institutionnel et opérationnel et améliorer son autonomie fonctionnelle. Il a rappelé les efforts consentis par la Commission au cours des dernières années pour relever les enjeux émergents. Il a souligné que les Membres devaient prendre des mesures vigoureuses dans des domaines comme la coopération, la communication et la participation aux travaux de la Commission et devaient s'attacher à mettre en oeuvre ses décisions. Il a invité les Membres à poursuivre sur la lancée afin de répondre aux attentes des nombreuses parties prenantes et a précisé que la FAO s'engageait à continuer de fournir tout son appui à cet effort commun (Annexe D) ADOPTION DE L ORDRE DU JOUR ET ORGANISATION DE LA SESSION 7. Les chefs de délégation se sont présentés et ont introduit leurs conseillers.

Le délégué de Malte a déclaré qu une proposition faite par tous les membres de l'union européenne concernant la sélection du secrétaire serait examinée au titre du point 6 de l ordre du jour. La proposition a été distribuée aux membres. 9. A la demande de la Communauté européenne (CE), la Déclaration ministérielle de la Conférence sur le développement durable des pêches en Méditerranée, tenue à Venise en novembre 2003, a été distribuée aux délégués. 10. La Commission a approuvé la suggestion faite par le Secrétaire d ajouter à la documentation le Rapport de la réunion de coordination des sous-comités du Comité scientifique consultatif (CSC) (17 novembre 2003) sous la cote GFCM:ES/2004/Inf La Commission est convenue d inverser l ordre des points 5 et 4 de l ordre du jour. La Commission est également convenue d'examiner au titre du point 8 de l ordre du jour les questions relatives aux projets régionaux exécutés par la FAO en appui aux activités scientifiques et techniques de la Commission. 12. L ordre du jour reproduit à l Annexe A du présent rapport a été adopté avec les changements susmentionnés. 13. Les documents dont était saisie la Commission sont énumérés à l Annexe C. STATUT DE L ACCORD PORTANT CRÉATION DE LA CGPM, TEL QU AMENDÉ EN Ce point de l ordre du jour a été présenté par le Secrétariat sur la base du document GFCM:ES/2004/2. Ce document passait en revue le processus qui a abouti à l entrée en vigueur du budget autonome le 29 avril Le Secrétariat a fait la synthèse des différents facteurs qui ont été pris en considération pour le calcul du barème des contributions adopté lors de la vingt-cinquième session de la Commission et a présenté un tableau mis à jour sur cette question, reproduit à l Annexe E. 15. Les Membres ont été invités à approuver les chiffres concernant les facteurs de richesse et de production halieutique qui ont été utilisés pour le calcul du barème des contributions avant la prochaine session ordinaire. 16. La Commission a fait le point de la situation en ce qui concerne l'acceptation des amendements relatifs au budget autonome et aux questions connexes. Elle a été informée du fait que l'algérie et le Maroc avaient ratifié l Accord tel qu il avait été amendé et que les instruments d acceptation seront déposés au plus tôt auprès du Directeur général. Le Japon devrait terminer le processus de ratification dans le courant du mois. 17. La Commission a été informée par le Bureau juridique sur la dualité de la situation, où un certain nombre de Membres sont tenus de respecter le nouveau texte de l'accord, tel qu'il est modifié par les amendements introduisant de nouvelles obligations, alors que d'autres Membres restaient liés par les dispositions de l'accord de la CGPM telles qu'elles étaient avant ces amendements. Le Bureau juridique a rappelé que d'un point de vue juridique et selon les principes du droit international énoncés dans la Convention de Vienne sur le droit des traités, rien n empêchait la Commission d accepter que tous les Membres participent aux débats. Toutefois, c était à la Commission de décider si elle voulait ou non adopter cette

19 11 démarche. Plusieurs Membres ont exprimé leur inquiétude devant un régime juridique à deux vitesses au sein de la Commission, notamment en ce qui concerne les questions budgétaires. 18. Après un débat sur la question, la Commission a décidé que tous les Membres pourraient participer aux débats. Toutefois, la Commission a décidé que seuls les Membres ayant déposé leurs instruments d acceptation des amendements introduisant de nouvelles obligations pourraient voter sur les questions couvertes par ces amendements entrés en vigueur le 29 avril 2004, si un vote devait s avérer nécessaire. PROPOSITION DE RÈGLEMENT FINANCIER DE LA CGPM 19. La Commission a examiné le document GFCM:ES/2004/4 «Proposition de Règlement financier de la Commission générale des pêches pour la Méditerranée» à la lumière de plusieurs observations liminaires faites par le Secrétariat. La Commission a noté que le Règlement financier proposé s'appliquerait à l administration financière de la Commission, pour ce qui concerne les activités financées par le budget autonome, à l exception de toute contribution faite par l Organisation dans les limites des crédits de son budget biennal. La Commission a noté que le barème des contributions proposé serait joint en annexe au Règlement financier, conformément aux dispositions de l'alinéa b) du paragraphe 3 de l Article IX de l Accord révisé de la CGPM. La Commission a été informée du fait que le Règlement financier serait porté à la connaissance du Comité financier, conformément aux dispositions du paragraphe 13 de l Article II de l Accord révisé de la CGPM. 20. Au cours du débat qui a suivi, des éclaircissements ont été donnés sur une série de questions spécifiques. La Commission a noté que les dispositions proposées au paragraphe 4 de l'article V du Règlement financier concernant la monnaie de mise en recouvrement et la monnaie de versement des contributions pourraient être réexaminées par la suite, à la lumière de consultations ultérieures avec les services concernés de l'organisation. La CE et les Etats Membres de l Union Européenne (UE) ont réaffirmé leur préférence pour que l Euro soit utilisé comme monnaie officielle du budget autonome de la CGPM. 21. Des débats nourris ont eu lieu sur le montant destiné à couvrir les coûts de l Organisation, comme proposé au paragraphe 5 de l Article III du Règlement financier. La Commission a été informée du fait que le budget autonome proposé prendrait la forme d'un fonds fiduciaire ou d un fonds spécial, conformément à l Article 6.7 du Règlement financier de la FAO et que, par conséquent, toute obligation financière pour les Etats Membres de la FAO découlant de l acceptation de ces fonds devrait être couverte par le système de remboursement des dépenses d appui des projets. Il a également été signalé à la Commission qu un taux de 6 pour cent avait été proposé pour ces dépenses d appui et que ce niveau pourrait être réduit si un poste d assistant administratif était approuvé dans le cadre du budget proposé. Il a en outre été précisé que le niveau actuel de remboursement des dépenses d appui était fixé par les organes directeurs de la FAO, sur recommandation du Comité financier, et que le Secrétariat n avait pas l autorité pour déroger aux décisions prises par les Membres de l Organisation. 22. Quelques délégations ont rappelé qu un poste d assistant administratif n avait pas été créé à la Commission des thons de l océan Indien (CTOI), mais que le niveau de remboursement des dépenses de l Organisation avait été fixé à un taux inférieur à 6 pour cent. La Commission, tout en prenant note des observations faites par le Secrétariat, a fortement recommandé au Comité financier de fixer à 4,5 pour cent le taux de remboursement des frais

20 12 de soutien de l'organisation, comme dans le cas de la CTOI. Sur la question des contributions volontaires, quelques Membres ont précisé qu ils n étaient pas du tout en faveur de l application d un pourcentage sur ces contributions, ou que, si cela s avérait inévitable, il faudrait appliquer le taux le plus bas possible. 23. La Commission a approuvé le Règlement financier proposé, tel qu il figure à l Annexe F. Les questions spécifiques mentionnées aux paragraphes 20 et 22 devraient être réexaminées par la FAO, si possible avant la Vingt-neuvième session de la CGPM. 24. La délégation de la CE, supportée par plusieurs Membres, a fait remarquer que le Secrétaire Exécutif devrait être en mesure de suivre et de gérer le budget à tout moment et à la requête d un des Membres de la CGPM. Le Secrétariat a noté que toutes les mesures devront être prises pour tenir compte de cette préoccupation, et ainsi permettre au Secrétaire exécutif d exercer efficacement ses fonctions. Le représentant du Bureau juridique de la FAO a confirmé que cela ne soulevait aucun inconvénient du point de vue juridique. PRÉVISIONS DE BUDGET TOTAL DE LA CGPM POUR 2005 ET RÉPARTITION DES DÉPENSES 25. Le Secrétariat a présenté ce point de l ordre du jour sur la base du document GFCM:ES/2004/Inf.4 «Programme à court et moyen termes de la CGPM» et du document GFCM:ES/2004/3 «Prévisions de budget total de la CGPM pour 2005 et répartition des dépenses». 26. Le document concernant le programme de travail soulignait les directives stratégiques établies par la Commission au cours des dernières années, ainsi que les outils importants mis au point pour contribuer au suivi de l effort de pêche pour les pêcheries partagées prioritaires et pour promouvoir le développement de l aquaculture. Il soulignait aussi à quel point il importait de préparer des plans de gestion pour les grandes pêcheries partagées ainsi que de renforcer les mécanismes garantissant une application efficace des décisions de gestion de la CGPM. Il importait également de prendre sérieusement en considération le rôle de l aquaculture. 27. Le document concernant le budget pour 2005 fournissait des estimations indicatives du budget autonome pour 2005, calculées principalement par extrapolation à partir des dépenses de Le Secrétariat a noté que ces prévisions avaient été établies en tenant compte de la suggestion faite au cours de la réunion d août 2003 par le groupe d experts chargé d évaluer le CSC, ainsi que du budget proposé par la quatrième session du Comité de l aquaculture. 28. Plusieurs délégations ont félicité le Secrétariat pour la qualité de ces documents. À l issue de l examen du document concernant le budget, il a été reconnu que les composantes budgétaires étaient bien structurées, même si certains éléments devaient encore être mieux définis. La Commission est convenue que la priorité devrait aller à la réalisation des activités de base et au renforcement du Secrétariat. Le budget provisoire présenté a été considéré comme un «schéma cadre» qui serait utilisé comme référence pour les prochains exercices budgétaires.

21 La Commission a décidé de passer en revue le budget indicatif de 2005 chapitre par chapitre. Un consensus s'est dégagé sur la nécessité de réduire les effectifs. La Commission a décidé de geler le poste proposé d expert en aquaculture et de faire appel, pour l'instant, à des consultants. S'agissant du poste proposé de statisticien, la Commission a confirmé que les fonctions en question seraient assurées pour le moment par le Projet MedFisis. 30. La question du financement du poste de secrétaire exécutif a été examinée en détail. La plupart des délégations préféraient que ce poste soit financé par le budget autonome. Ils ont signalé en général que cela témoignerait de l'engagement politique des pays Membres à renforcer la CGPM et à lui donner un nouvel élan. Certains délégués ont souligné qu'un tel arrangement serait également conforme à celui mis en place pour d'autres commissions régionales des pêches. Quelques délégations préféraient, en revanche, que ce poste continue à être financé par le programme ordinaire de la FAO, non seulement pour maintenir un lien étroit avec l'organisation, mais aussi pour éviter d'accroître la contribution des Membres et ainsi allouer une part plus importante des ressources aux activités de terrain. 31. Outre la proposition visant à financer le poste de secrétaire exécutif à l aide du budget autonome, une délégation a proposé que tous les postes du Secrétariat soient financés par ce budget. D autres ont préféré que le budget ordinaire de la FAO couvre au moins le poste de secrétaire adjoint, étant donné qu il ne devrait plus financer le poste de secrétaire exécutif. 32. La Commission est convenue et a décidé que le poste de secrétaire serait couvert par le budget autonome. Soucieuse d obtenir la poursuite du soutien de la FAO, elle a demandé à l Organisation de considérer soit de prendre à sa charge l un des autres postes du Secrétariat, soit de mettre à sa disposition les services d un autre fonctionnaire. 33. La Commission a pris note avec satisfaction de l offre faite par la FAO de continuer à fournir un appui scientifique et technique et a reconnu le rôle et l'importance de ces apports dans la réalisation des activités menées par la Commission. 34. La Commission a exprimé le souhait que les réunions statutaires soient couvertes par le budget autonome. 35. La Commission a noté que les amendements de 1997 à l Accord de la CGPM ne modifiaient pas le statut juridique de la Commission qui restait un organe de la FAO, régi par les dispositions de l Article XIV de l Acte constitutif de l Organisation, et que le personnel proposé pour le Secrétariat aurait le statut de fonctionnaire de la FAO. 36. La Commission a approuvé la répartition proposée des ressources destinées à appuyer les activités du Comité scientifique consultatif en S agissant des activités du Comité de l aquaculture, la Commission a estimé que les fonds devraient être alloués en priorité au renforcement du Système d'information pour la promotion de l'aquaculture en Méditerranée (SIPAM) et au rétablissement du Réseau sur l'environnement et l aquaculture en Méditerranée (EAM). 37. La Commission a approuvé et adopté par consensus le budget de 2005, qui est reproduit à l Annexe E. 38. Plusieurs délégations ont réaffirmé le rôle important des projets régionaux réalisés par la FAO à l appui des activités de la CGPM au niveau sous-régional. Le délégué de Monaco a

22 14 demandé des informations sur les activités actuelles de la Commission concernant la mer Noire. Le délégué de la Turquie a informé la Commission des négociations en cours pour la création d'une commission régionale des pêches ou d'un arrangement analogue, qui relèverait de la Commission économique pour la mer Noire. PROCÉDURE DE SÉLECTION ET NOMINATION DU SECRÉTAIRE DE LA CGPM 39. La Commission a examiné le document GFCM:ES/2004/5 «Procédure de sélection et nomination du Secrétaire de la Commission générale des pêches pour la Méditerranée» à la lumière d une introduction présentée par le Bureau juridique de la FAO. Le Bureau juridique a rappelé deux considérations juridiques liées à la nomination du secrétaire: tout d abord, le secrétaire devait être pleinement responsable de l exécution des politiques et activités de la Commission et devait faire rapport à ce sujet à la Commission; et deuxièmement, la Commission, qui doit agir par l intermédiaire de l Organisation, et son secrétaire, qui est fonctionnaire de l Organisation, sont liés à la FAO. Le Bureau juridique a rappelé que pour que le Directeur général puisse nommer le secrétaire de la CGPM, l'organisation devait participer de manière appropriée au processus de sélection du candidat recommandé. 40. Les Etats Membres de l Union européenne, Membres de la CGPM (Chypre, Espagne, France, Grèce, Italie, Malte, Slovénie) ont présenté une proposition de Règles de procédure pour la sélection du nouveau secrétaire exécutif, sur la base des procédures appliquées dans d autres commissions de gestion des pêches. 41. L Algérie, la Libye, le Maroc et la Tunisie ont également proposé des amendements au Règlement intérieur pour la sélection du nouveau secrétaire, afin de faciliter l obtention d un consensus sur cette question. 42. A l issue des débats sur cette question, la Commission a convenu et adopté par consensus un texte qui serait ajouté, sous la forme d un amendement au Règlement intérieur de la Commission. La procédure approuvée pour la sélection et la nomination du premier secrétaire exécutif de la Commission, y compris les qualifications requises et les fonctions du poste, sont reproduites à l Annexe F du présent rapport. 43. Le Bureau juridique a noté, sur cette question, que les Membres de la Commission avaient proposé un texte de compromis qui semblait tenir compte des préoccupations qu il avait exprimées à ce sujet. Après avoir rappelé que la question de la procédure de sélection et de nomination des secrétaires des organes créés en vertu de l Article XIV de l Acte constitutif de la FAO avait été transmise pour la prochaine session du Comité des questions constitutionnelles et juridiques et, par son intermédiaire, au Conseil de la FAO; le Bureau juridique a en outre noté que ceci ne préjugeait en rien des décisions qui seraient prises à ce propos par ces organes. SIÈGE DE LA COMMISSION 44. Le Secrétariat a présenté le document GFCM:ES/2004/6 intitulé «Siège de la Commission», qui présentait les critères applicables à la sélection du siège de la Commission, ainsi que d autres considérations connexes. Il a également appelé l attention des délégations sur un autre document de référence, qui avait été distribué à la demande de la délégation italienne, et s intitulait «Catégories de renseignements pouvant être demandés aux pays qui souhaitent accueillir le Secrétariat permanent» (UNEP/FAO/PIC/INC.7/13, Annexe). La
