1 United Nations Guidelines on Consumer Protection Working Group on Implementation of UNGCP Meeting 24 March a.m. and 3.00 p.m. (Geneva time) SUMMARY OF THE MEETING Participants: - Chair: Permanent mission of the Gabonese Republic before the United Nations Office in Geneva. - National consumer protection authorities: Brazil, France, Hong Kong SAR, Nigeria, South Africa. - International organizations: UNCTAD - NGOs/Business Associations/civil society organization: Consumers International, CI- Mumbai India Summary of the meeting: 1. Opening of the Working Group on Other Issues meeting: Mr. Saturnin Aboghe, Counsellor in the Permanent mission of the Gabonese Republic before the United Nations Office in Geneva chaired the meeting of the Working Group on Implementation. He welcomed participants to this Working Group following the work programme proposed in the Second Ad Hoc Expert Group Meeting on Consumer Protection of July The Chairperson presented the following agenda for the meeting: A. Presentation of the Background, Work programme and Expected Output of the Working Group on E- commerce The UNCTAD Secretariat thanked participants for providing their inputs to this Working Group. The goal of this group is to provide concrete proposals for the Secretariat Report to the VII UN Review Conference on the issue of the United Nations Guidelines on Consumer Protection (hereinafter UNGCP), and the availability of their revision. In order to gather all opinions on the issues to be included in the revision of the UNGCP on the implementation and control mechanisms for the UNGCP (noting that E- commerce, Financial Services and Other Issues also have respective working groups), the UNCTAD Secretariat prepared a detailed questionnaire and its accompanying instructions circulated in advance. (Please see excel document: UNGCP_Questionnaire WG Implementation; and the pdf document: UNGCP_Instructions WG Implementation, both available in English, French and Spanish). Participants are kindly asked to provide their views on implementation mechanisms to be considered by completing the relevant questionnaire and sending it to the Chairs (kassandongo@yahoo.fr) and to the UNCTAD Secretariat (graham.mott@unctad.org, arnau.izaguerri@unctad.org). The deadline for receiving contributions is Friday 18 April. The first draft of this report is expected by June The Secretariat will assist the Chairs in writing a draft report, which will contain concrete recommendations for a new chapter(s) on Implementation of the UNGCP (June 2014). This report will be circulated among consumer experts, whose inputs will be contained in a final Report. This final Secretariat Report will be issued under the authority of the UNCTAD Secretariat, so participants are not engaging the official views of their States by answering the questionnaire, but rather participating at the expert level. Consumer protection experts will be invited to discuss the said report during a Preparatory Meeting (December 2014 or January 2015) for the VII UN Review Conference (November 2015). 3. 3 The UNCTAD Secretariat summarized the expected output of the questionnaires circulated among participants. Its aim is to identify and develop implementation/monitoring and/or control mechanisms that will be proposed for inclusion in the revision of the UNGCP. In order to better take stock of the interests and priorities of participants in this Working Group, a questionnaire in the form of an Excel document has been circulated. In the questionnaire, the different ways of implementation discussed in the Second Ad Hoc Expert Group Meeting on Consumer Protection are displayed in rows (national, cross- border/cooperation networks, international/universal monitoring), while columns contain specific questions to every corresponding issue. Participants are encouraged to portray their national/regional experiences and to signal their needs on capacity building activities and technical cooperation. For more details, please see the document UNGCP_Instructions WG Implementation. 4. Questions & Answers The Chairpersons opened the floor for comments from participants. Most participants took to the floor to express their interest in constituting an international forum for the discussion of consumer protection policy issues worldwide (in relation to section 3 of the Questionnaire). Some participants inquired on the characteristics that such forum would have. The Secretariat noted that only the wide consultations that are being carried out will determine such proposal in the report. However, it is clear that an Intergovernmental Group of Experts on Consumer Protection Law and Policy would be able to address three different concerns: (i) discussion and monitoring of the UNGCP Implementation; (ii) identification of best practices for future emerging issues not covered in the UNGCP and continued process for inclusion; and (iii) discussion on capacity building and technical cooperation activities, especially for developing Member States. Participants showed great interest in providing their input before the deadline so as to facilitate the drafting of the report. 3

5 C. Questions- réponses. 2. Présentation du contexte, le programme de travail et le résultat espéré du Groupe de travail sur la mise en œuvre des PDNUPC. Le Secrétariat de la CNUCED a remercié la participation des experts dans ce groupe de travail. L objectif de ce groupe est de fournir des propositions concrètes dans le Rapport du Secrétariat pour la VII Conférence de Révision de l Ensemble des Nations Unies sur le sujet des Principes directeurs des Nations Unies pour la Protection du consommateur (PDNUPC). Le Secrétariat a préparé et diffusé un questionnaire pour chaque groupe de travail (commerce électronique, services financiers, autres sujets et mise en œuvre) ainsi que des instructions respectives. (Voir document Excel: UNGCP_Questionnaire WG Implementation; et document pdf: UNGCP_Instructions WG Implementation, disponibles en anglais, espagnol et français). Les participants sont priés de refléter ses opinions sur les mécanismes de mise en œuvre des PDNUPC dans ce questionnaire, et de bien vouloir l envoyer à la Présidence du groupe (kassandongo@yahoo.fr) ainsi qu au Secrétariat de la CNUCED (graham.mott@unctad.org, arnau.izaguerri@unctad.org). La date limite pour recevoir ces contributions est le vendredi 18 avril. Le Secrétariat soutiendra les Présidences pour rédiger un premier rapport, contenant des recommandations concrètes pour des nouveaux chapitres sur la mise en œuvre des PDNUPC, prévu pour juin Ce rapport sera ensuite diffusé pour plus d opinions et des commentaires, qui seront intégrés dans le rapport final. Le rapport final sera publié sous l autorité du Secrétariat, les participants n engagent la position officielle de leurs pays en y contribuant, ils y participent en tant qu experts. Les experts seront invites à débattre le rapport final pendant une Réunion préparatoire (en décembre 2014 ou janvier 2015) pour la VII Conférence de Révision (novembre 2015). 3. Présentation du questionnaire et de ses instructions. Le Secrétariat a présenté les résultats espérés des questionnaires. Leur objectif est d identifier et développer les mécanismes de mise en œuvre, contrôle et/ou surveillance qui seront proposes pour leur inclusion dans les PDNUPC. Afin de mieux comprendre les intérêt et priorités des participants dans ce groupe de travail, 5

6 le Secrétariat propose ce questionnaire sous forme de document Excel. Le questionnaire contient les différents moyens de mise en œuvre (nationaux, transfrontaliers, et internationaux) tels que débattus dans la Deuxième réunion spéciale du groupe d experts sur la protection du consommateur (lignes), ainsi que plusieurs questions spécifiques (colonnes). Les participants sont priés d y refléter ses expériences nationales/régionales et de signaler ses besoins de coopération technique. Pour plus d information, voir le document UNGCP_Instructions WG Implementation (disponible en français). 4. Questions- réponses M. Aboghe a ouvert le débat aux participants. La plupart d entre eux ont pris la parole pour exprimer leur intérêt à constituer un forum international pour la discussion de sujets de politique publique sur la protection des consommateurs (contenu de la section 3 du questionnaire). Quelques participants se sont intéressés par les caractéristiques qu un tel forum pourrait avoir. Le Secrétariat a noté qu il faut d abord mener des larges consultations pour concrétiser cette proposition dans le rapport. Néanmoins, il semble clair qu un possible Groupe intergouvernemental d experts en droit et politique de protection aux consommateurs pourrait s occuper de : (i) débattre et surveiller la mise en œuvre des PDNUPC ; (ii) identifier les meilleurs pratiques pour les sujets émergents qui ne sont pas compris dans les PDNUPC ; et (iii) débattre et accorder des activités de coopération technique, notamment pour les membres en voie de développement. Les participants on montré leur intérêt à envoyer leur contributions avant la date limite afin de faciliter la rédaction du rapport. 6
