2 The member States of the Council of Europe, signatory hereto, Considering that the aim of the Council of Europe is to achieve a greater unity between its members, in particular by the adoption of common rules in the field of law; Noting that in a great number of member States efforts have been, or are being, made to improve the legal status of children born out of wedlock by reducing the differences between their legal status and that of children born in wedlock which are to the legal or social disadvantage of the former; Recognising that wide disparities in the laws of member States in this field still exist; Believing that the situation of children born out of wedlock should be improved and that the formulation of certain common rules concerning their legal status would assist this objective and at the same time would contribute to a harmonisation of the laws of the member States in this field; Considering however that it is necessary to allow progressive stages for those States which consider themselves unable to adopt immediately certain rules of this Convention, Have agreed as follows : Article 1 Each Contracting Party undertakes to ensure the conformity of its law with the provisions of this Convention and to notify the Secretary General of the Council of Europe of the measures taken for that purpose. Article 2 Maternal affiliation of every child born out of wedlock shall be based solely on the fact of the birth of the child. Article 3 Paternal affiliation of every child born out of wedlock may be evidenced or established by voluntary recognition or by judicial decision. Article 4 The voluntary recognition of paternity may not be opposed or contested insofar as the internal law provides for these procedures unless the person seeking to recognise or having recognised the child is not the biological father. 2

3 Les Etats membres du Conseil de l'europe, signataires de la présente Convention, Considérant que le but du Conseil de l'europe est de réaliser une union plus étroite entre ses membres, notamment en favorisant l'adoption de règles communes dans le domaine juridique; Constatant que dans un grand nombre d'etats membres, des efforts ont été accomplis ou sont entrepris pour améliorer le statut juridique des enfants nés hors mariage en réduisant les différences entre le statut juridique de ces enfants et celui des enfants nés dans le mariage, ces différences défavorisant les premiers sur le plan juridique et social; Considérant que dans ce domaine, de larges disparités existent encore dans les droits des Etats membres; Convaincus que la condition des enfants nés hors mariage doit être améliorée et que l'établissement de certaines règles communes concernant leur statut juridique favoriserait la réalisation de cet objectif et contribuerait en même temps à une harmonisation des législations des Etats membres dans ce domaine; Considérant cependant qu'il est nécessaire d'aménager des étapes progressives pour ceux des Etats qui estiment ne pas être en mesure d'adopter immédiatement certaines des règles de la présente Convention, Sont convenus de ce qui suit: Article 1 Chaque Partie contractante s'engage à assurer la conformité de sa législation aux dispositions de la présente Convention et à notifier au Secrétaire Général du Conseil de l'europe les mesures prises à cette fin. Article 2 La filiation maternelle de tout enfant né hors mariage est établie du seul fait de la naissance de l'enfant. Article 3 La filiation paternelle de tout enfant né hors mariage peut être constatée ou établie par reconnaissance volontaire ou par décision juridictionnelle. Article 4 La reconnaissance volontaire de paternité ne peut faire l'objet d'une opposition ou d'une contestation, lorsque ces procédures sont prévues par la législation interne, que dans le cas où la personne qui veut reconnaître ou qui a reconnu l'enfant n'en est pas biologiquement le père. 2

4 Article 5 In actions relating to paternal affiliation scientific evidence which may help to establish or disprove paternity shall be admissible. Article 6 1 The father and mother of a child born out of wedlock shall have the same obligation to maintain the child as if it were born in wedlock. 2 Where a legal obligation to maintain a child born in wedlock falls on certain members of the family of the father or mother, this obligation shall also apply for the benefit of a child born out of wedlock. Article 7 1 Where the affiliation of a child born out of wedlock has been established as regards both parents, parental authority may not be attributed automatically to the father alone. 2 There shall be power to transfer parental authority; cases of transfer shall be governed by the internal law. Article 8 Where the father or mother of a child born out of wedlock does not have parental authority over or the custody of the child, that parent may obtain a right of access to the child in appropriate cases. Article 9 A child born out of wedlock shall have the same right of succession in the estate of its father and its mother and of a member of its father's or mother's family, as if it had been born in wedlock. Article 10 The marriage between the father and mother of a child born out of wedlock shall confer on the child the legal status of a child born in wedlock. Article 11 1 This Convention shall be open to signature by the member States of the Council of Europe. It shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe. 2 This Convention shall enter into force three months after the date of the deposit of the third instrument of ratification, acceptance or approval. 3 In respect of a signatory State ratifying, accepting or approving subsequently, the Convention shall come into force three months after the date of the deposit of its instrument of ratification, acceptance or approval. 3

5 Article 5 Dans les actions relatives à la filiation paternelle, les preuves scientifiques susceptibles d'établir ou d'écarter la paternité doivent être admises. Article 6 1 Les père et mère d'un enfant né hors mariage ont la même obligation d'entretien à l'égard de cet enfant que celle qui existe à l'égard de l'enfant né dans le mariage. 2 Lorsque l'obligation d'entretien d'un enfant né dans le mariage incombe à certains membres de la famille du père ou de la mère, l'enfant né hors mariage bénéficie également de cette obligation. Article 7 1 Lorsque la filiation d'un enfant né hors mariage est établie à l'égard des deux parents, l'autorité parentale ne peut être attribuée de plein droit au père seul. 2 L'autorité parentale doit pouvoir être transférée; les cas de transfert relèvent de la législation interne. Article 8 Lorsque le père ou la mère d'un enfant né hors mariage n'a pas l'autorité parentale sur cet enfant ou la garde de celui-ci, ce parent peut obtenir un droit de visite dans les cas appropriés. Article 9 Les droits de l'enfant né hors mariage dans la succession de ses père et mère et des membres de leurs familles sont les mêmes que s'il était né dans le mariage. Article 10 Le mariage entre le père et la mère d'un enfant né hors mariage confère à cet enfant le statut juridique d'un enfant né dans le mariage. Article 11 1 La présente Convention est ouverte à la signature des Etats membres du Conseil de l'europe. Elle sera ratifiée, acceptée ou approuvée. Les instruments de ratification, d'acceptation ou d'approbation seront déposés près le Secrétaire Général du Conseil de l'europe. 2 La Convention entrera en vigueur trois mois après la date du dépôt du troisième instrument de ratification, d'acceptation ou d'approbation. 3 Elle entrera en vigueur à l'égard de tout Etat signataire qui la ratifiera, l'acceptera ou l'approuvera ultérieurement, trois mois après la date du dépôt de son instrument de ratification, d'acceptation ou d'approbation. 3

6 Article 12 1 After the entry into force of this Convention, the Committee of Ministers of the Council of Europe may invite any non-member State to accede to this Convention. 2 Such accession shall be effected by depositing with the Secretary General of the Council of Europe an instrument of accession which shall take effect three months after the date of its deposit. Article 13 1 Any State may, at the time of signature, or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Convention shall apply. 2 Any State may, when depositing its instrument of ratification, acceptance, approval or accession or at any later date, by declaration addressed to the Secretary General of the Council of Europe, extend this Convention to any other territory or territories specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorised to give undertakings. 3 Any declaration made in pursuance of the preceding paragraph may, in respect of any territory mentioned in such declaration, be withdrawn according to the procedure laid down in Article 15 of this Convention. Article 14 1 Any State may, at the time of signature, or when depositing its instrument of ratification, acceptance, approval or accession or when making a declaration in accordance with paragraph 2 of Article 13 of this Convention, make not more than three reservations in respect of the provisions of Articles 2 to 10 of the Convention. Reservations of a general nature shall not be permitted; each reservation may not affect more than one provision. 2 A reservation shall be valid for five years from the entry into force of this Convention for the Contracting Party concerned. It may be renewed for successive periods of five years by means of a declaration addressed to the Secretary General of the Council of Europe before the expiration of each period. 3 Any Contracting Party may wholly or partly withdraw a reservation it has made in accordance with the foregoing paragraphs by means of a declaration addressed to the Secretary General of the Council of Europe, which shall become effective as from the date of its receipt. Article 15 1 Any Contracting Party may, insofar as it is concerned, denounce this Convention by means of a notification addressed to the Secretary General of the Council of Europe. 2 Such denunciation shall take effect six months after the date of receipt by the Secretary General of such notification. 4

7 Article 12 1 Après l'entrée en vigueur de la présente Convention, le Comité des Ministres du Conseil de l'europe pourra inviter tout Etat non membre du Conseil à adhérer à la présente Convention. 2 L'adhésion s'effectuera par le dépôt, près le Secrétaire Général du Conseil de l'europe, d'un instrument d'adhésion qui prendra effet trois mois après la date de son dépôt. Article 13 1 Tout Etat peut, au moment de la signature ou au moment du dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion, désigner le ou les territoires auxquels s'appliquera la présente Convention. 2 Tout Etat peut, au moment du dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion ou à tout autre moment par la suite, étendre l'application de la présente Convention, par déclaration adressée au Secrétaire Général du Conseil de l'europe, à tout autre territoire désigné dans la déclaration et dont il assure les relations internationales ou pour lequel il est habilité à stipuler. 3 Toute déclaration faite en vertu du paragraphe précédent, pourra être retirée, en ce qui concerne tout territoire désigné dans cette déclaration, aux conditions prévues par l'article 15 de la présente Convention. Article 14 1 Tout Etat peut, au moment de la signature ou au moment du dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion ou lorsqu'il fera une déclaration conformément au paragraphe 2 de l'article 13 de la présente Convention, formuler au maximum trois réserves au sujet des dispositions des articles 2 à 10 de celle-ci. Des réserves de caractère général ne sont pas admises; chaque réserve ne peut porter que sur une disposition. 2 Chaque réserve aura effet pendant cinq ans à partir de l'entrée en vigueur de la présente Convention à l'égard de la Partie considérée. Elle pourra être renouvelée pour des périodes successives de cinq ans, au moyen d'une déclaration adressée avant l'expiration de chaque période au Secrétaire Général du Conseil de l'europe. 3 Toute Partie contractante peut retirer, en tout ou en partie, une réserve formulée par elle en vertu des paragraphes précédents au moyen d'une déclaration adressée au Secrétaire Général du Conseil de l'europe et qui prendra effet à la date de sa réception. Article 15 1 Toute Partie contractante pourra, en ce qui la concerne, dénoncer la présente Convention en adressant une notification au Secrétaire Général du Conseil de l'europe. 2 La dénonciation prendra effet six mois après la date de la réception de la notification par le Secrétaire Général. 4

8 Article 16 The Secretary General of the Council of Europe shall notify the member States of the Council and any State which has acceded to this Convention of: a b c any signature; any deposit of an instrument of ratification, acceptance, approval or accession; any date of entry into force of this Convention in accordance with Article 11 thereof; d any notification received in pursuance of the provisions of Article 1; e any declaration received in pursuance of the provisions of paragraphs 2 and 3 of Article 13; f any reservation made in pursuance of the provisions of paragraph 1 of Article 14; g the renewal of any reservation carried out in pursuance of the provisions of paragraph 2 of Article 14; h i the withdrawal of any reservation carried out in pursuance of the provisions of paragraph 3 of Article 14; any notification received in pursuance of the provisions of Article 15 and the date on which denunciation takes effect. In witness whereof, the undersigned, being duly authorised thereto, have signed this Convention. Done at Strasbourg, this 15th day of October 1975, in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each of the signatory and acceding States. 5

9 Article 16 Le Secrétaire Général du Conseil de l'europe notifiera aux Etats membres du Conseil et à tout Etat ayant adhéré à la présente Convention: a b toute signature; le dépôt de tout instrument de ratification, d'acceptation, d'approbation ou d'adhésion; c toute date d'entrée en vigueur de la présente Convention conformément à son article 11; d toute notification reçue en application des dispositions de l'article 1; e toute déclaration reçue en application des paragraphes 2 et 3 de l'article 13; f toute réserve formulée en application des dispositions du paragraphe 1 de l'article 14; g le renouvellement de toute réserve effectué en application du paragraphe 2 de l'article 14; h i le retrait de toute réserve effectuée en application des dispositions du paragraphe 3 de l'article 14; toute notification reçue en application des dispositions de l'article 15 et la date à laquelle la dénonciation prendra effet. En foi de quoi, les soussignés, dûment autorisés à cet effet, ont signé la présente Convention. Fait à Strasbourg, le 15 octobre 1975, en français et en anglais, les deux textes faisant également foi, en un seul exemplaire qui sera déposé dans les archives du Conseil de l'europe. Le Secrétaire Général du Conseil de l'europe en communiquera copie certifiée conforme à chacun des Etats signataires et adhérents. 5
