Fact Sheet ONTARIO-QUÉBEC LABOUR MOBILITY AGREEMENT RECOGNITION OF QUÉBEC CONSTRUCTION WORKERS BY ONTARIO Situations applicable to a Québec construction worker in Ontario: 1. Worker working in a compulsory trade in Ontario (trades 1 to 6 and 26 of Table A) in a unionized sector. 2. Worker working in a compulsory trade in Ontario (trades 1 to 6 and 26 of Table A) in a non-unionized sector. 3. Worker working in a voluntary trade in Ontario (trades 7 to 25 of Table A) in a unionized sector. 4. Worker working in a voluntary trade in Ontario (trades 7 to 25 of Table A) in a nonunionized sector. 5. Apprentice worker working in a compulsory trade in Ontario (trades 1 to 6 and 26 of Table A) in a unionized sector. 6. Apprentice worker working in a compulsory trade in Ontario (trades 1 to 6 and 26 of Table A) in a non-unionized sector. 7. Worker working in one of the forty Québec occupations (Table B) in a unionized sector in Ontario. 8. Worker working in one of the forty Québec occupations (Table B) in a non-unionized sector in Ontario. 1. Worker working in a compulsory trade in Ontario in a unionized sector For the matched trades (1 to 6 and 26 of Table A), a Québec worker, who is the holder of a journeyperson competency certificate issued by the CCQ or an interprovincial certificate of qualification (red seal), must: register with the local of the trade union representing the trade; comply with the provisions of the applicable collective agreement; have in his possession at all times any one of the following certificates: a) journeyperson competency certificate of the CCQ, b) interprovincial certificate of qualification (red seal), c) Ontario certificate of qualification. NOTE A Québec worker who holds a journeyperson competency certificate - crane operator issued by the CCQ may work in Ontario as an operator of elevating devices with a capacity of less than 8 tonnes without further qualification requirements. To operate elevating devices with a capacity of over 8 tonnes, a worker must hold an interprovincial certificate of qualification (red seal).

2. Worker working in a compulsory trade in Ontario in a non-unionized sector For the matched trades (1 to 6 and 26 of Table A), a Québec worker, who is the holder of a journeyperson competency certificate issued by the CCQ or an interprovincial certificate of qualification (red seal), must have in his possession at all times one of the following certificates: a) journeyperson competency certificate of the CCQ, b) interprovincial certificate of qualification (red seal), c) Ontario certificate of qualification. NOTE A Québec worker who holds a journeyperson competency certificate - crane operator issued by the CCQ may work in Ontario as an operator of elevating devices with a capacity of less than 8 tonnes without further qualification requirements. To operate elevating devices with a capacity of over 8 tonnes, a worker must hold an interprovincial certificate of qualification (red seal). 3. Worker working in a voluntary trade in Ontario in a unionized sector For the matched trades (7 to 25 of Table A), a Québec worker must: register with the local of the trade union representing the trade; comply with the provisions of the applicable collective agreement. NOTE While these are voluntary trades, an employer may, for his own reasons, require a competency certificate as a condition of hiring. 4. Worker working in a voluntary trade in Ontario in a non-unionized sector For the matched trades (7 to 25 of Table A) in the non-unionized sector, a Québec worker does not need to hold a certificate of qualification. NOTE While these are voluntary trades, an employer may, for his own reasons, require a competency certificate as a condition of hiring. 5. Apprentice working in Ontario in a unionized sector For the matched trades (1 to 26 of Table A) in a unionized sector, a Québec worker, who holds a competency certificate apprentice issued by the CCQ or an apprenticeship record book issued by the Ministère de l Emploi et de la Solidarité sociale du Québec (MESS), must: have his apprenticeship contract (concluded with his employer if the latter is in Ontario) registered with the Ministry of Training, Colleges and Universities; register with the local of the trade union representing the trade; comply with the provisions of the applicable collective agreement; for working in obligatory trades, have in his possession at all times either one of the following certificates: a) the competency certificate apprentice of the CCQ, b) the apprentice identification card of Ontario. 2

NOTE The apprenticeship hours accumulated by a Québec worker on construction sites in Québec or in Ontario are fully recognized by the Ontario Ministry of Training, Colleges and Universities insofar as they have been validated by the CCQ or by the Ministère de l Emploi et de la Solidarité sociale du Québec when it comes to determining the apprenticeship period applicable to this worker in Ontario. 6. Apprentice worker working in Ontario in a non-unionized sector For the matched trades (1 to 26 of Table A) in a non-unionized sector, a Québec worker, who holds a competency certificate apprentice issued by the CCQ or an apprenticeship record book issued by the Ministère de l Emploi et de la Solidarité sociale du Québec (MESS), must: have his apprenticeship contract (concluded with his employer if the latter is in Ontario) registered with the Ministry of Training, Colleges and Universities; for working in compulsory trades, have in his possession at all times either one of the following certificates: a) the competency certificate apprentice of the CCQ, b) the apprentice identification card of Ontario. NOTE The apprenticeship hours accumulated by a Québec worker on construction sites in Québec or in Ontario are fully recognized by the Ontario Ministry of Training, Colleges and Universities insofar as they have been validated by the CCQ or by the MESS when it comes to determining the apprenticeship period applicable to this worker in Ontario. 7. Worker working in one of the forty Québec occupations in a unionized sector in Ontario For the forty occupations presented in Table B, a Québec worker is not required to have in his possession a competency certificate or an exemption. He must however: register with the local of the trade union representing the workers assigned to the tasks associated with the occupation; comply with the provisions of the applicable collective agreement. NOTE For the following occupations, the worker is required to have his skills evaluated by the Technical Standards & Safety Authority: 2. Boiler driver 6. Distribution welder (gas) 11. Gas fitter 14. Generator operator 25. Pipe welder 26. Pipeline welder For the following occupations, the worker is required to have his skills evaluated by the Ontario Ministry of Training, Colleges and Universities: 9. Equipment operator (lines) 35. The trade of electrician comprises two divisions in Ontario: Division 1 (Electrician construction and maintenance) and Division 2 (Electrician residential and rural sector). A Québec electrician may perform in Ontario the work entrusted to an electrician belonging to Division 1 or 2. In Québec, the installation of security systems is a specialty within the electrician trade. In order to perform the work entrusted to an electrician in Ontario, Québec workers in this specialty must meet other requirements of Québec or Ontario. 5
