IMPORTANT INFORMATION CONCERNING EXHIBITION STAND CONSTRUCTION NEW WORKING AND WAGE CONDITIONS FOR EXHIBITION STAND CONSTRUCTORS: New provisions governing exhibition stand constructors have been in force in Switzerland since June, 202 On April 24, 202, the Swiss national government declared that the Collective Agreement for the Carpentry Trade would be generally binding, and brought it into force on June, 202. This "Collective Agreement 202 205 for the Carpentry Trade" negotiated between the two sides of industry, i.e. the Swiss Association of Master Carpenters (Verband Schweizer Schreinermeister) and the Swiss trade unions UNIA and SYNA now includes exhibition stand construction for the first time. Through the Swiss Federal Council declaring this agreement to be generally binding, the conditions and provisions for the carpentry trade that have been negotiated by the two sides of industry are now binding, in the same way as a law, on all exhibition stand constructors who have their head office in Switzerland, and also on all foreign exhibition stand constructors who engage in stand construction activities in Switzerland. According to the "Swiss Federal Act on Employees Sent To Switzer-land" (SR 823.20), the main contractor must contractually oblige the foreign subcontractor to respect this Federal Act and hence also to respect the provisions of the collective agreement that have been declared to be universally valid. If this obligation has not been imposed on the foreign subcontractor, the main contractor is jointly and severally liable for any noncompliance with the provisions on the part of the subcontractor. It is recommended that a written agreement be drawn up by way of evidence and that this be kept on one's person in the event of a check being carried out. (Point 20) Minimum working and wage conditions for foreign stand builders and foreign stand employees Under the terms of the Swiss Federal Law on Employees sent to Switzerland (EntsG; SR 823.20), the Swiss Federal Law on the Residence and Permanent Establishment of Foreigners (ANAG; SR 42.20) and the Ordinance Limiting the Number of Foreigners (BVO; SR 823.2), exhibitors have the following duties: Exhibitors must notify the Office of Employment and Economic Affairs of the Canton of Basel-City eight days prior to commencement of work, as a rule, of all employees of foreign nationality who will be working on the exhibition site for eight days or longer in the framework of BASELWORLD. Exhibitors must observe the minimum wage and working conditions for their employees. In particular, they must pay their full travel costs, board and lodging, and also pocket money of at least CHF 30. per day. The duty of notifying and the minimum working an wage conditions are also applicable to foreign stand builders and other service providers called in by the exhibitors. The exhibitors must inform all called in foreign service providers about these duties. Exhibitors of foreign nationality, who call in foreign stand builders for the designing, the setting-up and the dismantling of the stand are not allowed to make these persons available to other exhibitors. The change of the purpose of residence is not possible. The Office of Employment and Economic Affairs and the Security Department of the Canton of Basel-City shall be entitled to check compliance with the minimum working and wage conditions and also with the provisions issued by the aliens police governing the employees entry into and stay in Switzerland. The corresponding documents and evidence, etc. must be handed over on request. Conditions minimales de travail et de salaire applicables aux constructeurs de stands étrangers et au personnel de stand étranger Vu les dispositions de la Loi fédérale sur les travailleurs détachés en Suisse (Odét; RS 823.20), de la Loi fédérale sur le séjour et l établissement des étrangers (LSEE; RS 42.20) et de l Ordonnance limitant le nombre des étrangers (OLE; RS 823.2), les exposants s engagent à remplir les obligations suivantes: Les exposants sont tenus d annoncer à l Office de l économie et du travail, du canton de Bâle-Ville, en règle générale 8 jours avant le début de la mission, l identité et la nationalité de tous les travailleurs employés pendant 8 jours ou plus sur le site de la Foire dans le cadre de BASELWORLD. Les exposants doivent garantir à leurs employés les conditions minimales de travail et de salaire. Ils sont notamment tenus de leur payer intégralement les frais de transport, d hébergement et de repas et de leur verser à titre d argent de poche un montant minimum de CHF 30. par jour. L obligation d annoncer les conditions de salaire minimum et de travail s applique également aux monteurs de stand étrangers travaillant pour les exposants ainsi qu a tout autre partenaire contractuel étranger sollicité. Les exposants sont tenus de rendre les partenaires contractuels attentifs à ces obligations. Les exposants étrangers qui emploient du personnel étranger pour la conception, le montage et le démontage de leur stand, ne sont pas autorisés à l envoyer et l occuper sur d autres stands. Il est interdit de modifier le motif du séjour. L Office de l économie et du travail ainsi que le Département de la sécurité du canton de Bâle-Ville disposent du pouvoir d exercer un contrôle des conditions minimales de travail et de salaire ainsi que des dispositions de la police des étrangers relatives à l entrée et au séjour en Suisse.
