The Brother Protection Plan/Limited On-site Extended Warranty Program covers parts and labour as outlined in your original warranty. Pricing of such On-site extended warranties may vary depending on your Brother product model s designation. These On-site extended warranties are eligible only if purchased within the standard warranty period. No Deductible There are no administration fees or deductibles applicable for these services. The Brother Protection Plan/Limited On-site Extended Warranty Program pays for complete On-site service of items under such warranty as described in the original warranty Terms and Conditions.

6 Terms & Conditions This Protection Plan/Limited On-site Extended Warranty Program sets forth the entire agreement between you ( Customer ) and Brother International Corporation (Canada) Ltd. ( Brother ) with respect to services rendered under this Protection Plan/Limited On-site Extended Warranty Program and supersedes all previous negotiations, proposals, representations, commitments, writings, and understandings of any nature whatsoever. This Protection Plan/Limited On-site Extended Warranty Program can only be amended in writing by duly authorized representative of Brother International Corporation (Canada) Ltd. PLEASE CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS. THEY CONTAIN IMPORTANT INFORMATION ABOUT BROTHER S LIMITATIONS ON LIABILITY AND CUSTOMER S AND BROTHER S RESPECTIVE RIGHTS AND OBLIGATIONS. 1) Service Overview To qualify for the Brother Protection Plan/Limited On-site Extended Warranty Program, the machine must be sold as new and in standard configurations at the time of purchase. The Brother Protection Plan/Limited On-site Extended Warranty Program is applicable to certain Brother models only. The Brother Protection Plan/Limited On-site Extended Warranty Program is valid on machine (s) purchased through an authorized Brother Distributor or Dealer, or directly from Brother in Canada only. The Services to be provided under this Protection Plan/ Limited On-site Extended Warranty Program applies only to Canada. The Brother Protection Plan/Limited On-site Extended Warranty Program excludes coverage on machines that are damaged due to improper use of the machine, cosmetic damages, inadequate installation of the machine, connection to other products not recommended for interconnection by Brother, or intentional damage made by the Customer. Toners, drums, and other consumables are also excluded from coverage from this Brother Protection Plan/Limited On-site Extended Warranty Program (Limitations of Service outlined in Section 3). There may be instances where at the discretion of Brother, instead of dispatching a National Service Provider to service your machine, you may be requested to send the machine to Brother for repair. Examples of when Brother may request that you send the machine in for repair include, and without limitation, (a) Brother determines over the phone that extensive repairs are required beyond the normal capabilities of an on-site visit, (b) Brother s history of the machine reveals a problem that can only be repaired at the depot, (c) Brother believes that additional diagnostics of the machine are required, or (d) shortage of repair technicians. In all such circumstances, Brother will provide a replacement unit to the customer. Brother will not be obligated to refund any amounts you may have prepaid for on-site services.

7 Terms & Conditions (cont.) 2) Scope of Service (a) The Brother Protection Plan/Limited On-site Extended Warranty Program is of limited duration and is effective as of the date indicated on the invoice. Brother may require a copy of this proof of purchase with the date clearly indicated in order to be accepted. The Brother Protection Plan/Limited On-site Extended Warranty Program is also of limited coverage. (b) This Brother Protection Plan/Limited On-site Extended Warranty Program extends only to uses for which the machine was designed and which occur during usual and customary usage, all as reasonably listed in the user manual included with your machine or determined by Brother. (c) Brother will provide phone-based trouble shooting to try and resolve the issue (Customer Phone support is available from 8:00AM to 6:00PM ET from Monday to Friday and 8:30AM to 5:00PM ET Saturday and Sunday, excluding statutory Canadian holidays and civic holidays of Quebec). Where Brother has diagnosed that your machine needs repair, Brother will dispatch a National Service Provider to your location, within 48-72hrs to repair your machine. In the event that that Brother support cannot be accurately diagnosed the issue. Brother will dispatch a National Service Provider to your location, within 24-48hrs to further diagnosis the issue and if possible make the necessary repairs. If parts are needed the Service provider will inform you of this and reschedule a visit when he has the necessary parts. The Service provider will provide service during regular business days; Monday through Friday 8:30AM to 5:00PM ET, excluding regularly observed holidays. d) Brother s Responsibilities (i) Provide assistance to the Customer when the machine experiences malfunction. (ii) Perform initial troubleshooting by phone to resolve the issue or determine if onsite service is required. (iii) If on-site service is required, dispatch on-site repair to the Customer s location and repair the Brother machine(s) under warranty.

8 Terms & Conditions (cont.) 3) Limitations of Service Services will not be provided for, with respect to, or as a result of the following: (a) Any machine located outside of Canada. The Brother Protection Plan/Limited On-site Extended Warranty Program is valid on machine (s) purchased and located in Canada only. If the machine that you purchased within Canada is shipped outside of Canada the accompanying warranty will be void. (b) Any damage to or defect in the machine that is cosmetic only or otherwise does not affect machine functionality. Under this Brother Protection Plan/Limited On-site Extended Warranty Program, Brother is not obligated to repair reasonable wear and tear on the machine and other superficial items, such as scratches and dents that do not materially impair your use of the machine. (c) Any machine that anyone other than Brother or a person we designate has tried to repair. Any repair or attempted repair on the machine covered by this Brother Protection Plan/Limited On-site Extended Warranty Program by any party other than Brother or someone we designate will void and cancel this Brother Protection Plan/Limited On-site Extended Warranty Program. (d) Any machine that is damaged in connection with or as a result of incorrect or inadequate Customer Installation. Customer Installation shall include any of the following performed by the Customer or any third party on behalf of the customer: (1) unpacking or moving the machine (2) installation or mounting of a machine to a wall or other structure (or removal of the same following installation) and (3) affixing of brackets or other weight bearing devices designed for mounting or attachment to a wall or other structure (or removal of the same). Customer Installation does not include third party installation services purchased from Brother. (e) Any machine that is damaged resulting from external causes such as, but not limited to, defective or inadequate wiring, outages as a result of public utility company action or inaction, fire, flood, windstorm, hail, lightning, or earthquake, and theft.

(f) Any machine that Brother deems damaged due to misuse or abuse, improper installation, improper maintenance or use in violation of instructions, connection to other products not recommended for interconnection by Brother, use of consumables or accessories not recommended by Brother, over-extending the maximum output capability of the machine, safety precautions or warnings set out in the User s Guide, Network User s Guide, or Quick Setup Guide accompanying the machine. (g) Service for non-brother parts or components found to be the cause of the machine s failure. (h) To repair or replace appearance or structural items, including, but not limited to, housing or cabinet and parts, thereof, or parts and consumables normally designed to be replaced periodically during the life of the machine. This Brother Protection Plan/Limited On-site Extended Warranty Program applies only to the operation of the specified machine under conditions for which it was designed, and does not cover loss or damage. (i) This Brother Protection Plan/Limited On-site Extended Warranty Program does not include Maintenance/Cleaning, Consumables or Periodical replacements parts including, without limitation, toner cartridges and drum units, OPC belts, fixing units, print heads, paper feed/pickup rollers, separation pads, PF kits, transfer rolls, cleaning rollers, waste toner packs or oil bottles.

10 Terms & Conditions (cont.) 4) Customer s Responsibilities In order to receive Service, you are responsible for complying with all of the following: (a) When a new machine(s) is purchased, the Customer must register the product and warranty from the product registration web page: (b) It is the responsibility of the Customer to provide training to their personnel (even if personnel are located in separate and remote retail locations) or whoever else will use the machine that has been purchased. As stipulated in Section 3 Limitations of Service, if any one of the stipulations has not been met by the Customer or its personnel, this warranty will be void and coverage will not be granted by Brother. (c) In the event that a malfunction to your machine occurs, call the Brother Corporate Support line at for the initial troubleshooting of the issue or determine whether an on-site technician is required to be dispatched to your location. (i) Explain Your Problem to the Technician Describe the issue you are having with your machine to the technician. Let the technician know what error message, if applicable, you are getting and when it occurs; what you were doing when the error occurred; and what steps you may have already taken to solve the problem. (ii) Determining to dispatch on-site service to your location If the issue is not resolved after the initial troubleshooting, the Brother technician will arrange for a National Service Provider to come to your location. National Service Provider will call and schedule an appointment with you, to perform on-site services to the malfunctioning machine. Unless otherwise stated, the hours of service rendered to the Customer are 8:30AM - 5:00PM and do not include statutory Canadian holidays and civic holidays of Quebec. Brother is not liable for any failure or delay in performance due to any cause beyond its control.

11 Terms & Conditions (cont.) 5) Important Additional Information (a) Warranty Exclusion Brother disclaims all representations, warranties and conditions, express or implied, statutory or otherwise with respect to this Brother Protection Plan/On-site Extended Warranty Program. (b) Limited Liability Brother will not be liable for indirect or consequential damage, delay in rendering service, or loss of use during the period that the machine is being serviced under this Brother Protection Plan/Limited On-site Extended Warranty Program. Brother s liability to you will not include the servicing of add-on items, peripherals, unauthorized repairs made, or software. Brother s maximum total liability to you will be to re-perform the service and repair the system or if Brother is unable to do so, Brother s total liability to you will be the payment of your actual direct damages not to exceed the amount you paid for this service. (c) Cancellation This Brother Protection Plan/Limited On-site Extended Warranty Program is noncancellable and non-refundable. (d) Transfer of Brother Protection Plan/ Limited On-site Extended Warranty Program This Brother Protection Plan/Limited On-site Extended Warranty Program extends only to original purchasers of the machine within Canada as determined by Brother and is non-transferable.

Les présentes conditions au programme Plan de protection / Garantie prolongée sur place limitée peuvent être amendées uniquement par écrit par un représentant dûment autorisé de La Corporation Internationale Brother (Canada) Ltée. 17 Modalités (suite) 1) Aperçu du service Pour se qualifier au programme Plan de protection / Garantie prolongée sur place limitée de Brother, l appareil doit être vendu à l état neuf et aux configurations standards lors de l achat. Le programme Plan de protection / Garantie prolongée sur place limitée de Brother s applique à certains modèles de Brother seulement. Le programme Plan de protection / Garantie prolongée sur place limitée n est valide que pour les appareils ayant été acquis par le biais de distributeurs ou de détaillants autorisés ou directement chez Brother Canada. Les services devant être fournis sous le programme Plan de protection / Garantie prolongée sur place limitée sont valides au Canada seulement. Il pourrait y avoir des cas où, à la discrétion de Brother, plutôt que de dépêcher un fournisseur de service pour effectuer le dépannage de votre appareil, l on vous demande d expédier l appareil à Brother pour réparation. Des exemples illustrant les cas où Brother pourrait vous demander d expédier votre appareil pour réparation incluent, sans toutefois y être limité : (a) Brother détermine au téléphone que des réparations majeures sont nécessaires bien au-delà des possibilités lors d une visite sur place, (b) l historique de l appareil révèle qu il existe un problème ne pouvant être réparé qu au centre de service, (c) Brother croit qu un diagnostic supplémentaire de l appareil est nécessaire, ou (d) il n y a pas suffisamment de techniciens-réparateurs. En de telles circonstances, Brother fournira un appareil de remplacement au client. Brother ne sera pas obligé de rembourser toute somme que vous pourriez avoir prépayée pour des services sur place.

18 Modalités (suite) 2) Portée du service (a) Le programme Plan de protection / Garantie prolongée sur place limitée de Brother est d une durée limitée et entre en vigueur à la date indiquée sur la facture. Brother peut exiger une copie de la facture indiquant clairement la date d achat pour être admissible au programme. Le programme Plan de protection / Garantie prolongée sur place limitée de Brother fait également l objet d une couverture limitée. (b) Ce programme Plan de protection / Garantie prolongée sur place limitée de Brother s applique uniquement au fonctionnement de l équipement spécifié aux conditions pour lesquelles il a été désigné lors d un usage normal et habituel, tel que raisonnablement indiqué dans le guide de l utilisateur inclus avec votre appareil ou selon ce qui est déterminé par Brother. (c) Brother fournira un service de dépannage par téléphone afin de tenter de résoudre le problème. (Le service à la clientèle est offert de 8 h à 18 h (heure de l'est) du lundi au vendredi et de 8 h 30 à 17 h le samedi et le dimanche, à l'exception des jours fériés du Canada et de ceux propres au Québec). Lorsque Brother détermine que votre appareil a besoin d'une réparation, Brother enverra un fournisseur de services national à votre emplacement dans un délai de 48 à 72 heures afin de réparer votre appareil. Dans l'éventualité où le service à la clientèle de Brother ne peut pas diagnostiquer le problème avec précision. Brother enverra un fournisseur de services national à votre emplacement dans un délai de 24 à 48 heures pour déterminer la cause du problème et effectuer les réparations nécessaires si possible. Si des pièces sont requises, le fournisseur de services vous en informera et planifiera une nouvelle visite lorsqu'il recevra les pièces requises. Le fournisseur de services fournira un service pendant les jours ouvrables réguliers : du lundi au vendredi de 8 h 30 à 17 h (heure de l'est), à l'exception des jours fériés normalement observés. d) Responsabilités de Brother (i) Fournir de l'assistance au client lorsque l'appareil éprouve des défaillances. (ii) Effectuer le dépannage initial par téléphone, afin de résoudre le problème ou déterminer si un service sur place est requis. (iii) Si un service sur place est requis, envoyer un technicien-réparateur chez le client et effectuer la réparation de l appareil couvert par la garantie.

19 Modalités (suite) 3) Limitations de service L on ne fournira aucun service pour, relativement à, ou par suite de : (a) Tout appareil se trouvant à l extérieur du Canada. Le programme Plan de protection / Garantie prolongée sur place limitée de Brother est valide pour les appareils achetés et se trouvant au Canada seulement. Si l appareil dont vous avez fait l acquisition est envoyé hors du Canada, la garantie qui l accompagne sera annulée. (b) Tout dommage ou défaut cosmétique de l appareil ou qui n affecte pas le fonctionnement de celui-ci. Sous le programme Plan de protection / Garantie prolongée sur place limitée, Brother n est pas obligée de réparer l appareil pour des dommages imputables et directement attribuables à l usure normale ou pour tout autre problème superficiel, par exemple les rayures ou les bosselures qui n altèrent pas de façon matérielle le fonctionnement de l appareil. (c) Tout appareil réparé par un tiers autre que Brother ou une personne désignée par Brother. Toute réparation ou tentative de réparation sur un appareil couvert par le programme Plan de protection / Garantie prolongée sur place limitée effectuée par quelqu un d autre que nous ou d une personne désignée par Brother annulera ce programme de garantie. (d) Tout appareil endommagé en raison d une installation inadéquate effectuée par le client. Une «installation effectuée par le client» comprend l une ou l autre des actions suivantes réalisées par le client ou par un tiers pour le client : (1) déballer ou déplacer l appareil (2) installer ou fixer l appareil à un mur ou à toute autre structure (ou pour enlever l appareil après installation) et (3) fixer des supports ou autres dispositifs de support conçus pour fixer ou accrocher des articles à un mur ou à une autre structure (ou pour enlever l appareil après installation). L installation effectuée par le client n inclut pas les services d installation par un tiers achetés de Brother. (e) Tout appareil dont les dommages sont attribuables à une cause externe, notamment le câblage défectueux ou inadéquat, les pannes de courant attribuables à l action ou à l inaction des services publics, un incendie, une inondation, une tempête de vent, la grêle, la foudre, un tremblement de terre et le vol.

20 Modalités (suite) (f) Tout appareil que Brother juge endommagé en raison de la mauvaise utilisation ou l abus, l installation inadéquate, un entretien inadéquat ou une utilisation contraire aux recommandations, un raccordement à d autres produits non recommandés par Brother ou l utilisation de consommables ou accessoires non recommandés par Brother, le dépassement des limites maximum de rendement de l appareil, le non-respect des consignes de sécurité décrites dans le Guide de l utilisateur, le Guide de l utilisateur Réseau ou le Guide d installation rapide fournis avec l appareil. (g) Service pour des pièces ou composantes non-brother dont on a déterminé comme étant la cause de la défaillance de l appareil. (h) Réparer ou remplacer des éléments décoratifs ou structuraux, dont notamment le coffret ou le boîtier et des pièces de ceux-ci, de même que des consommables devant généralement être remplacés périodiquement durant la vie utile de l appareil. Ce programme Plan de protection / Garantie prolongée sur place limitée s applique uniquement au fonctionnement de l équipement spécifié aux conditions pour lesquelles il a été désigné, et ne couvre pas la perte ni les dommages. (i) Ce programme Plan de protection / Garantie prolongée sur place limitée ne couvre pas l'entretien et le nettoyage, les consommables ou le remplacement périodique des pièces, notamment : cartouches de toner, unités tambour, courroies OPC, blocs de fixation, têtes d'impression, rouleaux d'alimentation/d'entraînement papier, rouleaux de séparation, trousses d'alimentation papier, rouleaux de transfert, rouleaux de nettoyage, contenants de toner usé ou bouteilles d'huile. 4) Responsabilités du client Afin de vous prévaloir du service, il vous incombe de vous conformer à toutes les clauses suivantes : (a) Lors de l achat d un nouvel appareil, le client doit enregistrer son appareil ainsi que son programme de garantie à la page web suivante :

21 Modalités (suite) (b) Il incombe au client de donner une formation à son personnel (même si le personnel se trouve à un différent emplacement ou à des endroits de vente au détail dans des régions éloignées) ou à quiconque utilisera l appareil ayant été acheté. Tel que stipulé à la section 3 relativement aux limitations de service, si l une des clauses n est pas respectée par le client ou son personnel, cette garantie sera annulée et Brother ne fournira aucune couverture. (i) Soyez préparé avant l appel Afin que le technicien puisse vous assister efficacement, veuillez avoir l information et le matériel ci-dessous à portée de la main lorsque vous effectuez votre appel : la facture liée à l appareil et les numéros de série, le nom et le numéro de modèle. (ii) Expliquez votre problème au technicien Décrivez au technicien le problème que vous avez avec votre appareil. Laissez savoir au technicien quel message d erreur s affiche, s il y a lieu, et à quel moment cela se produit, décrivez ce que vous faisiez lorsque le problème est survenu et quelles étapes vous avez possiblement prises pour résoudre le problème. (iii) Décision de dépêcher un fournisseur de services sur place à votre emplacement Si le problème n'est pas résolu après le dépannage initial, le technicien Brother prévoira l'envoi d'un fournisseur de services national à votre emplacement. Le fournisseur de services national téléphonera et fixera un rendez-vous avec vous afin de fournir un service sur place pour l'appareil défectueux. Sauf indication contraire, l'horaire des services rendus au client est de 8 h 30 à 17 h et n'inclut pas les jours fériés du Canada et ceux propres au Québec. Brother n'est pas tenue responsable de toute défaillance ou retard liés au rendement pour des raisons indépendantes de sa volonté.

22 Modalités (suite) 5) Renseignements supplémentaires importants (a) Exclusion de garantie Dans toute la mesure permise par la loi, Brother décline toutes les représentations, garanties et conditions expresses, implicites ou statutaires en ce qui a trait à ce programme Plan de protection / Garantie prolongée sur place limitée. (b) Responsabilité limitée Brother ne sera pas tenue responsable des dommages indirects, de retard lors de la fourniture de service, ou de perte au cours de la période pendant laquelle une réparation est effectuée sur l appareil sous le programme Plan de protection / Garantie prolongée sur place limitée de Brother.
