TO THE MEMBERS OF FIFA Circular no. 1307 Zurich, 8 June 2012 SG FIFA Club Protection Programme Dear Sir or Madam, FIFA is pleased to announce that recent Congress in Budapest approved FIFA Club Protection Programme (hereinafter: " Programme") on behalf member associations. Under this Programme, clubs will be indemnified, to a certain extent, if ir players are injured while on duty with senior men's representative "A" teams for matches listed in international match calendar for period between 1 September 2012 31 December 2014. In concrete terms, if a player is injured due to an accident while on duty with his representative "A" team, player's club will be compensated for having to continue to pay player's fixed salary although player is temporarily disabled unable to perform footballing activities for his club. The limits conditions such compensation are specified in enclosed Technical Bulletin Club Protection Programme. Death, permanent disablement or losses such as medical expenses are not covered. In particular, we would like to draw your attention to following points: Matches covered: The Programme covers entire release period for matches between two representative 11 A" teams played on dates listed in FIFA international match calendar or on dates covered by corresponding release periods as defined in Annexe 1 FIFA Regulations on Status Transfer Players. For teams participating in 2014 FIFA World CUpTM, FIFA Confederations Cup 2013, in confederation f inal tournaments or Olympic Men's Football Tournament 2012, it covers entire preparation period all friendly matches within this period. Any or matches matches that fall outside dates mentioned above are not covered. Existing injuries: Players with injuries that already exist when a player joins his national team for a match or for 2014 FIFA World CUpTM, FIFA Confederations Cup 2013, confederation final tournaments or Olympic Men's Football Tournament 2012, Le. injuries for which a player is receiving specific medical treatment when joining representative "A" team for duty, are not covered for part body concerned. The enclosed Technical Bulletin defines what is meant by such existing injuries. Football Tournament 2012, an extraordinary procedure has been put in place enabling players who recover from an existing injury when already on representative team duty thus no longer need medical treatment for that specific injury to be covered by Programme. The respedive procedure is explained in section 2.d) enclosed Technical Bulletin. We advise all parties involved to treat such cases cautiously responsibly, bearing in mind that a player will not be fully covered by Programme until he has fully recovered from his existing injury full cover has been confirmed in accordance with this extraordinary procedure. The enclosed Technical Bulletin explains content, scope limits Programme, as weil as claims procedure. We advise you to read it carefully to make sure that your relevant staff as weil as all your pressional clubs receive a copy this letter enclosure. 2 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME 1 Introduction Pressional football players are usually employed by a pressional football club based on an employment contract. On this basis, a football player plays matches for his respective football club. In addition, football players play international A matches for representative team ir respective association. According to article 1 Annexe 1 FIFA Regulations on Status Transfer Players, clubs, as employers football players, are obliged to release football players for matches on dates listed in international match calendar, published on www.fifa.com. During release period such international A matches, football players may suffer bodily injuries caused by accidents. As a consequence, a football player can suffer a temporary total disablement (hereinafter: TTD) that prevents him from participating in his football club s matches. However, football club still has an obligation to pay football player s salary based on employment contract. Since football player cannot work for football club during a TTD, FIFA has decided to provide compensation for losses encountered by football club during period that football player is temporarily totally disabled (named: FIFA Club Protection Programme). Below, details coverage claims procedure under programme are defined. Please note that coverage for Olympic Men s Football Tournament 2012 is described in Annexe 2.

3 2 FIFA Club Protection Programme a) Purpose FIFA Club Protection Programme The programme will provide compensation for football clubs in event that A representative team football players participating for ir association suffer a TTD, which lasts for more than 28 consecutive days, as a result bodily injuries caused by an accident. The programme will not provide any cover for permanent total disablement or death or for any costs medical treatment. The programme will compensate football clubs that employ injured football player(s). b) Matches covered An international A match means a match arranged by two associations for which both field ir A representative team as defined in FIFA Regulations Governing International Matches, I. General Provisions, Article 3: Definitions. In general, for avoidance doubt, covered are: All matches between two A representative teams played on dates FIFA international match calendar or on dates covered by respective release period for such matches as defined in Annexe 1 FIFA Regulations on Status Transfer Players, as long as y are also contained in list matches published on www.fifa.com. During period between 15 May 2012 31 August 2012, this applies to European football clubs only. All 31 matches UEFA EURO 2012 final tournament, including players released by non-european football clubs. All friendly international A matches played by A representative teams participating in UEFA EURO 2012 final tournament during preparation period (for opposing A representative teams not participating in UEFA EURO 2012 final tournament, only players registered with European clubs are covered). All friendly international A matches played by A representative teams participating in confederation final tournaments, FIFA World

Coverage includes football players both A representative teams. All matches between two A representative teams not falling under conditions described above are not covered. c) Extent compensation provided by FIFA Club Protection Programme Which football players are covered? The FIFA Club Protection Programme will cover all pressional football players who are under an employment contract with a football club released to an association during release period for international A matches for senior men s A representative team for which an obligation to release football players exists. Compensation payments are made to clubs for period y employ pay a salary to those football players. All pressional football players who are employed by football clubs affiliated to a FIFA member association are protected. A pressional football player is a football player who has a contract in writing signed with a football club is paid more for his footballing activity than expenses he incurs for same activity. All or football players are considered to be amateurs are not covered under this programme. When are football players covered? The football players are covered during release period whilst under control respective member association for ficial international A matches A representative team, including all playing, practising, training, training matches, travelling time spent away. Club protection starts from moment football player starts his journey from his home or football club address to report for duty with his association ends at whichever two following options occurs first: at midnight local time on day he returns to his home or football club from international duty, or 48 hours after leaving A representative team, including direct unbroken travel ( operative time ).

5 For avoidance doubt, each every match /or tournament protected under this programme only has one operative time. The operative time does not cease during short period interruptions, especially not during protected tournaments (e.g. short trips by football players to ir home address). What is covered? All football clubs are protected in cases TTD as a consequence an accident suffered by ir players during operative time, which entirely prevents football player from playing for his club for more than 28 consecutive days. What is considered an accident? An accident is when a football player, at an identifiable time place during operative time, suffers a bodily injury due to a sudden external force acting on his body. An accident can also be a specific, sudden act exertion at an identifiable time place from which football player suffers a bodily injury. What compensation does programme fer? The programme compensates football clubs for up to a maximum EUR 7,500,000 per football player per accident. The maximum EUR 7,500,000 is calculated at a daily pro rata compensation up to EUR 20,548 (1/365), which is payable for a maximum 365 days. The maximum daily compensation is limited to EUR 20,548 per accident. The maximum capacity ( aggregate limit ) FIFA Club Protection Programme is EUR 60,000,000 for period between 15 May 2012 31 August 2012, EUR 60,000,000 for period between 1 September 2012 31 December 2012, reafter EUR 70,000,000 per annum. How is compensation calculated? The compensation payable is based solely on fixed salary that football club pays directly to football player as his employer.

6 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME Fixed salary is defined as set amount money paid in weekly or monthly instalments, including matory social security charges, as stipulated in a written signed contract between football club football player. Compensation will not include variable amounts, one-f payments, payments not made on a regular basis or any bonuses, including but not limited to performance or signing-on bonuses, appearance fees /or expenses. Any amounts due on basis provision services a different kind, irrespective whatever nature wher agreed under a separate contract or not, are also not covered. The relevant football player s salary is salary according to contractual situation at time accident occurs. However, any new or amended football player contracts agreed in writing signed before time occurrence an accident are taken into account. Increased or decreased salary payments, agreed in writing signed before occurrence accident, will result in increased or decreased daily compensation with effect from start date new or amended football player s contract. When does compensation stop? Compensation under FIFA Club Protection Programme stops when eir: football player is no longer suffering from a TTD. Payment stops on date on which injured football player is able to resume full team training activities /or participate in matches, whichever is earlier irrespective wher opportunity to participate exists or not; football player dies; football player s occupation changes, for example, his pressional football contract comes to an end; maximum benefit period 365 days is exhausted; maximum compensation per accident per football player /or maximum capacity ( aggregate limit ) programme is exhausted.

7 Payment daily compensation will exclude day when TTD commences, first consecutive 28 days disablement (excess period) day when TTD stops. Who will payment be made to? Payments within FIFA Club Protection Programme will be made from FIFA to football club(s) to which football player is contracted. Will payments to football clubs be taxed? This will differ from country to country. The football clubs are solely responsible for any taxes, levies or deductions related to compensation paid by FIFA. FIFA recommends that each football club consults its tax advisor to ensure that any local taxation requirements are fulfilled. Existing injuries: will existing injuries be covered what is an existing injury? Existing injuries at start operative time will not fall under compensation scheme, save as for exception for final tournaments (see section What are exclusions from FIFA Club Protection Programme? below). An existing injury is a physical injury caused by an accidental incident, degeneration or degenerative condition for which football player is under medical treatment from a health care practitioner when operative time commences. Medical treatment means treatment or medication given to a football player by a health care practitioner for reason a physical injury caused by an accidental incident or degeneration or degenerative condition at commencement operative time, unless medication or treatment is given to a football player to improve his physical condition general health (NB: use unlawful drugs /or narcotics will exclude compensation). If a football player who is suffering from an existing injury plays for his association, FIFA Club Protection Programme will not compensate any loss

8 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME caused by or consequent upon this existing injury. The exclusion is limited to injured part body. Pre-existing injuries: will pre-existing injuries be covered what is a pre-existing injury? All accidents /or consequent bodily injury caused /or contributed to by pre-existing injuries are covered under FIFA Club Protection Programme. A pre-existing injury is a physical /or psychological impairment, defect, degeneration, degenerative condition or infirmity that existed prior to football player joining up for duty with his association. This is to be distinguished from existing injuries, as defined above as when a football player is under medical treatment at start operative time, hence is not covered by programme. Will recurring injuries be covered? Yes, but only injuries recurring within a period less than 30 consecutive days. If a football player suffers an injury following an accident which occurred while playing for his association n recovers, but n again suffers a TTD from same injury within 29 consecutive days this is medically determined by a health care practitioner, n FIFA Club Protection Programme will continue to compensate football club within limits programme. If football player returns works for football club for 30 or more consecutive days, no compensation will be payable from programme should that same specific injury reoccur. Will a TTD due to sickness be covered? No, re will not be any compensation for sickness, which includes heart attacks. Will death permanent total disablement be covered? No. Will self-inflected injuries or attempted suicides be covered? No.

9 d) Exclusions/conditions What are exclusions from FIFA Club Protection Programme? Key exclusions include: The first 28 consecutive days injury; The committing or attempt to commit a felonious or criminal act by football player or football club; The football player being in a state insanity or suffering from any mental or nervous disease, disorder or impairment; The football player being under influence drugs /or narcotics that are not lawfully available, unless specifically subscribed by a health care practitioner/doctor; Any active involvement football players as combatants in a conflict that ir legally recognised governing authorities have declared to be a war; Wars involving USA, Russian Federation, China PR, United Kingdom France; Ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear by-products; Any act terrorism involving emission, discharge, dispersal, release or escape any solid, liquid or gaseous chemical compound or any pathogenic (disease-producing) micro-organism(s) /or biologically produced toxin(s) (including genetically modified organisms chemically synsised toxins) which, when suitably distributed, are capable causing incapacitating disablement or death amongst people or animals; Any losses caused by or consequent upon sickness; Any losses caused by or consequent upon existing injuries; Any losses caused by or consequent upon death permanent total disablement. Football clubs football players affected by trade /or economic sanctions, prohibitions or restrictions due to regulations United Nations, European Union, United Kingdom, United States or any or applicable national economic or trade sanction law or regulations will not be covered /or not receive compensation payments during time sanctions concerned are in force.

10 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME Exception for existing injuries in connection with tournaments (applies to FIFA World Cup, FIFA Confederations Cup confederation final tournaments): If a football player has fully recovered from an existing injury is no longer receiving any medical treatment during operative time this has been confirmed in writing by way specific attached document ( Fitness for Duty/End Medical Treatment Form, see Annexe 1) by national team doctor, club doctor provided that up-to-date medical information by MRI report image, X-ray report image, CT report image is received. The information necessary documents provided will be reviewed, based on medical discretion, within a maximum two (2) working days following receipt, if recovery football player has been confirmed in writing, existing injury exclusion will no longer apply as from moment such confirmation. The use Fitness for Duty/End Medical Treatment Form attached is matory. The hling this recovery procedure is provided by Broadspire documents shall be submitted to TTD.claims@broadspiretpa.co.uk. Conditions precedent: compensation will be paid only if: 1. The notice loss is submitted according to loss hling adjustment process hereunder within 28 days from date accident, certifying that football player has suffered a TTD following an accident. 2. The association, football club football player fully cooperate with FIFA or entities appointed by FIFA for hling loss. Such cooperation shall expressly include providing sports medical representatives in charge, appointed by claim hler, with regular open access to all relevant rehabilitation medical pressionals documents, including all relevant electronic documents involved in assisting football player s recovery from a TTD. The football player has to release all relevant medical doctors from medical secret.

11 3. The association football club must assist cooperate in obtaining /or providing any or records deemed necessary to evaluate incident or loss. 4. After initial notice accident /or loss, it shall be allowed, as ten as may be reasonably necessary, to conduct an examination football player. 5. Non-compliance with se conditions can result in non-compensation, as can any fraudulent statements or concealment material facts, eir in statement made by or on behalf football club /or football player in respect any accident /or loss. 3 FIFA arrangements procedures FIFA has insured its obligation under this programme with recognised international insurers will pay compensation after it has received indemnification from insurers. FIFA will provide compensation only to extent that it receives indemnification from insurers. The international thirdparty administrator Broadspire, based in UK (a subsidiary Crawford Company), will perform claims hling directly with football clubs. At its own discretion, FIFA may assign rights its insurance policy related to a specific loss to football clubs directly. The football clubs are obliged to accept such assignment consequently waive all furr rights against FIFA. No compensation from programme will be paid if a football club does not agree to se arrangements procedures. Loss hling adjustment process i) Loss instructions The following procedures must be followed by football club(s) so that claims can be processed properly.

12 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME Following an accident, notification should be sent immediately to Broadspire. For this purpose, Broadspire has established a web-based application for notification accidents, which will go live as 15 May 2012: http://ttdportal.broadspiretpa.co.uk Requested details accident causing injury to football player must be sent to Broadspire by football club within 28 days accident at latest. Any claims or losses following accidents reported later than this time period will be rejected. ii) Step 1: registration Before a loss can be processed, football club has to provide basic information about football club injured football player, such as: Name E-mail address Security question (to prevent automated hacking). The football club will immediately receive an e-mail with a link to Broadspire portal, toger with a unique user name password. The football club will be able to change password once inside Broadspire portal. iii) Step 2: claim notification After logging on to Broadspire portal, football club will be asked to: Select preferred language (English, French, German or Spanish); Read data privacy notice; Provide details who is submitting claim, football player involved, details accident. The football club will be able to upload up to five (5) documents up to 2MB each, any one (1) larger file (if needed) up to 20MB.

13 As a minimum, se documents should include following details: An initial medical certificate written by association doctor Any hospital reports, emergency ward reports, MRI scans, X-rays, rehabilitation programmes or medical documentation that is available The name contact details association doctor club doctor Upon submission loss, football club will receive a unique reference number (URN) to allow m to track progress. The football club is required to quote this number on all submissions communication regarding loss. iv) Step 3: claim assessment The Broadspire portal will collate all football club s information into a secure document for review processing by specialist claims hling team. Broadspire will respond to football club, represented by a designated senior football club ficial, may require additional information, including but not limited to: An examination assessment injured football player by a medicallegal specialist appointed by Broadspire. Follow-up assessments may be required Broadspire will notify football club should this be case; Production all medical documentation such as reports, certificates, examinations, test results scans relating to injury. Broadspire will advise football club as to what documentation is required at what stage in loss assessment process; The injured football player s historical medical records. Broadspire will advise football club as to what documentation is required at what stage in loss assessment process; Details all treatment (medical rehabilitative) received by injured football player. Broadspire will advise football club as to what documentation is required at what stage in loss assessment process; Pro salary social security charges paid.

14 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME Broadspire may disclose, as far as necessary, all information provided to its appointed medical-legal specialist or third parties involved in assessment claim. The football club will be contacted by Broadspire once loss has been processed informed result procedures. In accordance with conditions governing FIFA Club Protection Programme, injured football player, representatives his football club representatives associations are expected required to cooperate fully with FIFA, Broadspire, medical advisors any or party involved in investigation processing claims (see Conditions precedent ). Broadspire will base loss assessment upon accident circumstances as reported by club. Broadspire may conduct enquiries into accident circumstances request furr information documentation from association or football club. Lack cooperation will result in a loss being rejected. Confirmation loss compensation will be provided: if 28 consecutive day excess period has elapsed; if accident occurred within operative time loss is not subject to any exclusions (see Extent compensation section); if amount loss is proven; subject to all terms conditions FIFA Club Protection Programme. In event that loss is rejected, football club will be notified in writing with an explanation reasons for this decision. If furr explanation is required, Broadspire is available to discuss this with football club. If football club wishes to dispute decision, it shall inform FIFA immediately. v) Step 4: payment to football club Compensation is due on a monthly basis within 30 days agreement loss or within 30 days from date recovery, whichever is shorter.

15 Prior to payment being processed by Broadspire, football club will be required to sign a Form Discharge. This will record details payment(s) to be made. The football club will be required to provide details bank account to which payment is to be made by electronic bank transfer. Evidence will be required bank account in form a letter from football club providing bank account details signed by a duly authorised ficer football club /or a letter from banking institution where account is held, confirming account details. Payment will only be made to an account in name football club. No payments will be made to individuals. Compensation will be paid by FIFA to football clubs after FIFA has received indemnification from insurers. It is very important that football clubs notify Broadspire immediately when injured football player is able to resume (date recovery) its usual training regime /or participate in matches, irrespective wher fixed terms matches training exist or not. The football club shall also notify Broadspire if football club ceases or changes salary payments to football player. Helpline It is very important that loss process is as straightforward as possible. The dedicated helpline may be contacted by football club at any time: TTD.helpassist@broadspiretpa.co.uk Due to sensitive nature potential losses, Broadspire has established a callback facility to enable its staff to validate callers ensure prompt attention by its dedicated staff. Persons contacting hotline are required to provide ir name, club name injured football player toger with a contact telephone number nature query. Broadspire will endeavour to respond within one working day.

16 TECHNICAL BULLETIN FIFA CLUB PROTECTION PROGRAMME 4 Law jurisdiction According to relevant provisions FIFA Statutes (Articles 62ff.), any disputes between football clubs FIFA or or football governing bodies arising in relation to programme are to be submitted to Court Arbitration for Sport (CAS). Disputes between football clubs one or more insurers in cases assignments rights by FIFA to football clubs are subject to Swiss law to be resolved by means ad-hoc arbitration. The respective details are set forth in insurance policy disclosed to football clubs concerned upon assignment rights. 5 Privacy/data protection a) General FIFA, insurers, Broadspire all parties involved in FIFA Club Protection Programme respect value privacy personally identifiable information. Accordingly, a privacy policy has been adopted. Only minimum personal data necessary to deliver loss-hling services will be processed. Sensitive, personally identifiable information will be collected, processed disclosed only if required to comply with legal or contractual obligations, or with consent persons/entities concerned. In context ir involvement in FIFA Club Protection Programme, insurers will, for purposes data protection legislation, be acting as data controller, Broadspire those or parties with whom data may be shared will be acting as data processors.

17 Personal data, including sensitive personal data such as medical reports to appointed medical-legal specialists, may be disclosed where required for provision services. Personal data will not be transferred outside European Economic Area unless it is to a country or territory which ensures an adequate level protection or where we have your consent to do so. b) Consent Personal data sensitive personal data football player(s) may be provided by FIFA ors, including FIFA member associations football club(s), to insurers, Broadspire or parties involved. It is responsibility football club(s) or or organisations providing personal information football player to ensure all necessary steps to ensure such consent, including where required by privacy laws country concerned any competent authority. Prior to entering personal information in Broadspire online reporting system, clubs will be asked to confirm that such consent has been obtained. c) Security FIFA, insurers Broadspire take security personal data very seriously, due to confidential sensitive nature information that will be processed, have implemented appropriate technical organisational measures to protect against unauthorised or unlawful processing personal data against accidental loss or destruction or damage to personal data. d) Access If persons concerned wish to access personally identifiable information that y have submitted to Broadspire /or to request correction any inaccurate information submitted to Broadspire, /or to request deletion, to object to processing data, or to request furr information, y can contact Broadspire at: TTD.Privacy@broadspiretpa.co.uk.
