LIABILITY OF THE PARTICIPANT RESPONSABILITÉ DU PARTICIPANT The FMN, the FMN Delegate the team Manager and the riders (hereinafter The Participant ) are jointly and severally liable in respect of the commitments and undertakings entered into by means of this form. FIM Sporting Code, Art LIABILITY The participant in an official event exonerates the FIM, the FMNR, the CONUs, the FIM promoters, the organisers and the officials, their employees and officers and agents from any and all liability for any loss, damage or injury which he may incur in the course of an official event or the training thereof, except under the provisions in Article 0. thereinafter. Furthermore, the participant undertakes to indemnify and hold harmless the FIM, the FMNR, the CONUs, the FIM promoters, the organisers and officials, the employees, officers and agents, from and against any and all liability to third parties for any loss, damage or injury for which he is jointly and severally liable. 4 DECLARATION D ENGAGEMENT DECLARATION OF UNDERTAKING The Participant, undersigned, hereby confirms that he requests to be entered the 06 FIM Trial des Nations or Women s Trial des Nations. By so doing, he expressly commits himself to taking part in this event held in 06. This contractual commitment is final and irrevocable. The undersigned is aware and accepts that an event may be cancelled, moved to another place or replaced by another event and that there may be one or more events in 06 in addition to those listed. By signing this declaration, the Participant, undersigned, attests to the accuracy of the information provided. He confirms that he is cognisant with and accepts the FIM Sporting Code, the FIM Anti-Doping Code, the FIM Disciplinary and Arbitration Code and the Appendices of the FIM Trial des Nations and Women s Trial des Nations currently in force. The Participant, undersigned, is fully aware that the Court of Arbitration for Sport in Lausanne, Switzerland has exclusive jurisdiction to receive any appeal against final decisions handed down by the FIM s jurisdictional bodies. Furthermore, the undersigned undertakes to comply with the instructions and directives of the FIM, the organisers and the officials. The Participant, undersigned, also attests in particular that he is cognisant with the FIM Antidoping Code currently in force and agrees to submit to it unreservedly. The current list of prohibited substances is available at and in Appendix of the FIM Anti-Doping Code at «Le Participant» soussigné confirme par sa signature, demander son inscription pour le Trial Des Nations FIM ou Trial des Nations Féminin 06. Ce faisant, «Le Participant» s engage expressément à participer à cette manifestation qui aura lieu pendant l année 06. Cet engagement contractuel est définitif et irrévocable. «Le Participant» soussigné est conscient et accepte le fait que cette manifestation puisse être annulée, déplacée ou remplacée. Par sa signature, «Le Participant» atteste l'exactitude des informations fournies. «Le Participant» confirme connaître et accepter les Statuts FIM, le Code Sportif FIM, le Code Antidopage FIM, le code disciplinaire et d arbitrage de la FIM ainsi que les Annexes Trial, Trial des Nations et Trial des Nations Féminin FIM en vigueur. En outre, «Le Participant» s engage à se conformer aux instructions et aux directives de la FIM, des organisateurs et des officiels. «Le Participant» soussigné atteste particulièrement connaître le Code Antidopage FIM en vigueur auquel il accepte de se soumettre sans réserve. 5 PRIZE-GIVING CEREMONY CEREMONIE DE REMISE DES PRIX The riders of a team and/or FMN that has won a World Championship title or a FIM World Cup winner title for which an award is presented at the FIM Prize-Giving Ceremony, in any class or discipline, must be present at the Ceremony in question. A rider and/or FMN who does not attend the Ceremony will be subject to a minimum fine of CHF 0'000.- and of CHF 00'000.- maximum (FIM Sporting Code Art. 60.7) Les coureurs d une équipe et/ou une FMN ayant remporté(s) un titre de Champion du Monde ou vainqueur(s) d une Coupe FIM primé(e) à la Cérémonie des Remise de Prix FIM, dans n'importe quelle classe ou discipline, doit(vent) être présent(s) à cette Cérémonie. Un coureur et/ou une FMN qui n'assiste pas à la Cérémonie est passible d'une amende d'un montant minimum de CHF 0'000.- et de CHF 00'000.- maximum (Code Sportif FIM Art. 60.7). ARBITRATION CLAUSE CLAUSE ARBITRALE Any dispute arising from or related to the present entry form shall be submitted exclusively to the Court of Arbitration for Sport in Lausanne, Switzerland, and resolved definitively in accordance with the Code of sports-related arbitration Tout litige découlant ou en rapport avec le présent bulletin d engagement sera exclusivement soumis au Tribunal Arbitral du Sport à Lausanne, Suisse, et définitivement tranché suivant le Code de l'arbitrage en matière de sport. PENALTY FOR NON-PARTICIPATION PÉNALITÉ EN CAS DE NON PARTICIPATION In case of failure to take part in this event, the Participant incurs a financial penalty (Art..7). In case of duly justified absolute incapacity (i.e. illness, accident or injury) to participate in a round or an event, the Participant must obtain a medical certificate and inform the FIM Secretariat before the event concerned, in accordance with the FIM Trial des Nations and/ or FIM Women s Trial des Nations regulations En cas de non-participation à cette manifestation, «Le Participant» s expose à une sanction financière (Art..7). En cas d empêchement absolu dûment justifié (p.ex. cas de maladie, d accident ou de blessure) de participer à une manifestation ou à une manche, «Le Participant» doit obligatoirement produire un certificat médical et informer le Secrétariat FIM avant ladite manifestation conformément au règlement du Trial Des Nations FIM / Trial Des Nations Féminin FIM. 5/6
