1 Date de mise à jour : 30/03/11 COMPARAISON DES CRITERES D ACCREDITATION - CAEQ 1 CONTEXTE Pour figurer sur la liste des organismes de contrôle et des autorités de contrôle reconnus aux fins de l équivalence visés à l article 10 du Règlement CE 1235/2008, les organismes de certification devront faire une première demande d inscription auprès de la Commission Européenne. Cette demande comprendra, entre autres documents, une description des normes de production et mesures de contrôles appliquées dans les pays tiers où l organisme opère, y compris une évaluation de ces normes et mesures avec les titres III (règles de production), IV (étiquetage) et V (contrôle) du Règlement (CE) n 834/2007. Le présent document est une comparaison des mesures de contrôles que les organismes de certification inscrits au programme d accréditation mené par le CAEQ doivent respecter avec les mesures de contrôles présentées dans le titre V (contrôle) du Règlement (CE) n 834/2007. 6 Criteria wording (EN) Acceptance of prior certification Where products in the production chain have been certified by other certification bodies, the certification body may accept prior certification according to defined procedures. Acceptance* may be granted when equivalent certification procedures have been applied. * Explanatory note: there could be varying acceptance situations to be covered by appropriate acceptance procedures. For example, Acceptance of certificates issued by another certification body under the same certification program and authority; Acceptance of certificates issued by another certification body working under a different certification program and authority; Certification bodies collaborating based on a defined agreement. CAEQ Criteria (EN) Critères CAEQ (FR) CAEQ When the certification body takes account of or uses, for granting its own certification (acceptance of the certification of ingredients included in a product to be certified, certification transference, etc.), the work performed by another certification body, it shall recognize decisions made by this certification body, insofar as that organization has been approved by the same administrative authority with respect to an equivalent accreditation scope. Further the Certification body shall accept residue analysis reports issued by other certifiers and laboratories in accordance with the provisions of the same standard. When the granting of a certification is not governed by a regulatory framework, the certification body may on a private basis, accept certificates issued by another certification body according either to a program coming under a different authority or a collaborative agreement instituted between the concerned certification bodies. A certifier can approve an input approved by another certifier. In case of conflicting decisions, certifiers are requested to achieve consistent assessment by sharing their proofs of assessment. If this fails in last instance the accreditation authority (technical Director / technical Committee) shall decide after screening the provided technical information on the materials (chemicals) in question. In any circumstances, the certification body shall maintain its responsibility for the certification decision resulting from this recognition or acceptance Lorsque l organisme tient compte de ou utilise, pour garantir sa propre certification, les travaux d un autre organisme de certification (acceptation de la certification, d ingrédients présents dans un produits à certifier, transfert de certification, etc.), il reconnaît les décisions de certification prises par cet autre organisme de certification, dans la mesure où celuici a été agréé par la même autorité administrative, pour une portée d accréditation identique. L'organisme de certification accepte les rapports d'analyse sur les résidus, provenant d'autres certificateurs ou laboratoires conformément aux dispositions de la même norme. Lorsque l octroi d une certification n est pas régi par un cadre réglementaire, l organisme peut, sur une base privée, accepter les certificats délivrés par un autre organisme de certification, dans le cadre d un programme relevant d une autorité différente, ou d un accord de collaboration entre ces organismes. L organisme peut après examen accepter un intrant considéré comme approuvé par un autre certificateur. En cas de désaccord sur le résultat d évaluation, les certificateurs concernés partagent leurs constats d évaluation pour parvenir à une évaluation commune. S ils n y arrivent pas, ils soumettent le cas à l autorité d accréditation (Directeur technique/comité technique) qui prendra en dernier recours une décision après une analyse des renseignements techniques fournis sur les substances (produits chimiques) en question. En toutes circonstances, l organisme conserve sa responsabilité en ce qui concerne la décision de certification qui sera prise à l issue de cette reconnaissance ou acceptation. N.B. 7 2.2.1 a b General Criteria wording (EN) a. The certification body shall employ sufficient personnel competent to perform certification functions and operate its system. b. The certification body shall ensure that personnel have knowledge relevant to the scope of certification issued (farming operations, processing facilities, geographic areas, group certification). Criteria should specify minimum education, training, technical knowledge and work experience relevant to the scope of certification issued. 9 Capacity-building Criteria wording (EN) The certification body shall ensure that personnel involved in certification (i.e. inspectors and other certification personnel, including members of technical committees) have and continue to have upto-date technical knowledge in their respective fields of activity to enable them to conduct evaluation and certification effectively and uniformly. In particular, the certification body shall a. Review the competence of its personnel in light of their performance in order to identify training needs; and b. Ensure that new personnel have sufficient competence.* * Explanatory note: for example, new personnel could be required to complete a training course in conducting organic inspection and evaluation and/or undergo a defined on-site apprenticeship period Organizational capacity-building CAEQ Criteria (EN) Critères CAEQ (FR) CAEQ - The certification body shall ensure that personnel involved in certification (i.e. inspectors and other certification personnel, including Technical Committee members) have and continue to have up-to-date technical knowledge in their respective fields of activity to enable then to conduct evaluation and certification effectively and uniformly. In particular, the certification body shall: a) review the competence of its personnel in light of their performance in order to identify training needs, and Explanatory note: it is industry practice to conduct performance reviews of personnel responsible for evaluation, inspection and certification on an annual basis b) ensure that new personnel have sufficient competence. Declare any prior or present association on their own part, or on the part of their employer, with an operator seeking certification to which they are to be assigned to perform certification procedures Assignment of committees The certification body shall have formal rules and structures for the appointment and operation of any committees that are involved in the certification process, reflecting requirements of and Subcontracting (outsourcing) When a certification body decides to subcontract work (outsourcing) related to certification (e.g. inspection) to an external body or person, an agreement covering the arrangements, including confidentiality and conflict of interest, shall be drawn up. The certification body shall ensure that each operator is notified of any changes in the certification requirements without unnecessary delay b b.
