The Division may verify the information submitted by you in line with article 133 (b) of the Social Security Act to ensure its accuracy in relation to the claim. Personal data may be disclosed to departments / third parties, who may also have access to your data as authorised by law. Personal information may also be exchanged with benefits institutions of other countries to combat and deter fraud, as provided for in international treaties or bilateral agreements to which Malta is a party. You will be informed in due course of the result of your claim after it has been assessed. The Social Security Division treats your personal information in accordance with the Data Protection Act, (Cap 440) to protect your privacy. You may request in writing to access information held about you, and eventually to rectify, and where applicable to erase incorrect information, having regard to the claim for which you applied. OVERVIEW Persons attaining their retirement age (see table below for information on applicable retirement ages in Malta) may be entitled to a Retirement Pension. 2. ELIGIBILITY A person may be eligible to Contributory Retirement Pension, if the following three criteria are fulfilled: a. Attainment of retirement age (as applicable) Year of Birth Retirement Age Male Female 1951 or earlier or later b. Claimant must, at some point in time, have been registered under the Maltese Social Security scheme and paid a minimum of 52 weeks of contributions, one (1) of which after the age of 19 years. c. Claimant must satisfy the relevant contribution conditions stipulated under the Maltese legislation i.e. the Social Security Act (Cap.318). For more information please read below. 3. PROCEDURE A person residing in Canada and wishing to apply for the Retirement Pension may do so by filling in the prescribed application form. This can be obtained from any Service Canada office or the Consulate General of Malta in Toronto. An application form may also be downloaded from the Ministry s website - Nonetheless, all forms must be sent through the Srvice Canada offices and not directly by the claimant to Malta. 4. DOCUMENTATION REQUIREMENTS a. The applicant has to complete the application form for Retirement Pension as accurately as possible. b. Marriage certificate (if applicable) c. If the claimant is in receipt of a Service Pension (e.g. a private company pension or superannuation fund or retirement savings account) from any former employer, a document indicating the original amount (amount as on first payment) of this pension must be attached to the application form. 5. PAYMENT METHOD The Social Security Division informs the applicant in writing about the outcome of the claim. Once awarded, the pension is deposited into a bank account as specified by the applicant on the application form. FREQUENTLY ASKED QUESTIONS 1. Once a person reaches retirement age, does s/he automatically become eligible to receive a retirement pension? Provided that the person satisfies the contribution conditions described in (2 - Eligibility), he/she is entitled to receive a retirement pension.

8 2. Does one need to apply for it? Yes. An application has to be lodged not later than six months after the attainment of retirement age. If more than six months elapse, the payment of the pension will be effective from the first Saturday following the date when the application is officially received at the Service Canada offices. 3. If I attain Maltese retirement age but am still working, am I entitled to receive my pension? Yes. Persons who reach Maltese retirement age (as applicable in 2a - Eligibility) and are still in employment, are entitled to receive their pension (provided all the other criteria are satisfied) irrespective of the income from employment. 4. What are the relevant contribution conditions for retirement pension under the Reciprocal Agreement between Malta and Canada? Entitlement to contributory benefits, apart from any other statutory conditions, depends upon a contribution test. The first test defines the minimum amount of contributions that need to be paid in order for a person to be entitled for a pension: a) Two-Thirds Pension: Under the Social Security Agreement between Malta and Canada, the claimant must have paid a minimum 156 weeks of contributions under the legislation of Malta after the 21st January b) Retirement Pension: Under the Social Security Agreement between Malta and Canada, the claimant must have paid a minimum 156 weeks of contributions under the legislation of Malta prior to the 21st January The second test is an arithmetical calculation of the yearly average of contributions paid by or credited to the insured during a certain period (as specified by the Social Security Act Cap. 318). Normally this period can vary from 30 to 40 years in the case of a Two-Thirds Pension and 47 years in the case of a Retirement Pension. Contributions paid under the Canadian Pension Plan would be considered in lieu of contributions paid in Malta provided that a minimum of 52 contributions are paid in Malta over the age of 19 years. For further details on the method of calculation see 6, 7 and 8 below. 5. What is the difference between a Two-Thirds Pension and Retirement Pension? The Two-Thirds Pension is an earnings related pension applicable to all persons who have been insured in Malta after the 16th January The basic statutory conditions are that the person has been in insurable employment for at least 10 years prior to retirement and who satisfies the contribution conditions laid down in the Social Security Act (see 4 and 7 for more details). The rate of a Two-Thirds pension depends mainly on the average of contributions paid or credited (see 7 below for more details) and the person s pensionable income (see 8 below). There is a maximum and minimum rate of Two-Thirds Pension, which is dependent upon the person s yearly contribution average. The maximum Two-Thirds pension payable in 2009 is per week. NOTE: The rates quoted above are applicable only to persons who contributed for a full 30 years in Malta and earned over 16,813 per annum. In the case of the other retirement pensions paid, Retirement Pension, Increased Retirement Pension, National Minimum Pension, Increased National Minimum Pension, and Decreased National Minimum Pension, these are paid to persons who were registered under the previous National Insurance Act prior to The rate paid depends mainly on the average of contributions paid (see 7 below), on the Pensionable Income (see 8 below), and also on whether a person is in receipt of a service pension. A married male (whose wife is not in receipt of a Social Security Pension) is paid a married rate, while all other persons are paid a single rate. If a person is eligible for more than one of the above mentioned pensions, only the most advantageous is paid.

9 6. How is a retirement pension calculated? The rate of Retirement Pension depends on a. the average of contributions paid b. the pensionable income earned from the last gainful occupation in Malta c. the ratio resulting from the total number of contributions paid in Malta divided by the total number of contributions paid in Malta and Canada 7. How is a contribution average calculated? In the case of a Two-Thirds Pension, the Contribution Average is the average of the sum of two separate averages (Minimum 15, Maximum 50 contributions per year). The first average is derived from the contributions paid in the last ten full calendar years prior to retirement (total contributions divided by 10). The second average is derived from the contributions paid in any twenty (20) years, preceding the last 10 years, starting from the year a person reaches 19 years of age (or 18 years of age for persons born on or after 3rd April 1958) to the year immediately preceding the starting year of the last 10 mentioned above (total contributions divided by 20). In the case of all other Retirement Pensions mentioned above, the Contribution Average is the average of contributions paid (Minimum 20, Maximum 50 contributions per year) from the year during which a person reaches age 19 or 18 as indicated above, to the calendar year immediately preceding the year of retirement. 8. What is the Pensionable Income? In the case of a Two-Thirds Pension, the Pensionable Income is the average result of the income earned by a prospective pensioner in the last ten (10) years prior to retirement. The assessment of such pensionable income is subject to whether the claimant is employed, self-employed or self-occupied. In the case of an employed person, the Pensionable Income is the result of the average highest income earned in three (3) consecutive calendar years updated with the cost of living increases in the last 10 full calendar years prior to retirement. In the case of self-occupied and/or self-employed persons, the pensionable income is the result of the average income earned during the last ten full calendar years prior to retirement. In the event the person did not work in Malta during the last 10 years, the previous ten (10) years are taken into consideration to arrive at a Maltese income and the same calculation is applied. In the case of a Retirement Pension, where the person did not work in Malta after 21st January 1979, the last income in Malta is considered. This income is then updated with the cost of living increases awarded by the Maltese government up to the date of retirement. 9. Can a person receive a retirement pension if he/she worked abroad? Malta currently has two Social Security Bilateral agreements with Canada and Australia and an agreement with the other 26 EU Member States, 3 EEA countries (Norway, Iceland and Liechtenstein) and Switzerland. This means that if a person worked in Malta and in any of these countries, he/she may be entitled to a Retirement Pension from Malta (under the conditions as explained above) and/or also from any of these countries (under their respective conditions). If a person does not satisfy the contribution conditions explained above, in order to qualify for a pension either from Malta or from any of these countries, he/she may qualify under the provisions of the above mentioned agreements. In this regard, contributions (or periods of employment/residence) in a country are deemed as paid (or worked) in the other country, albeit on a pro-rata basis (see 4.3). QUALITY SERVICE CHARTER The Social Security Division is committed to effect payment of this pension by not later than four weeks following the applicant s retirement. However, this is only possible if the application is lodged before retirement and if the necessary information and documentation are provided as requested in the same application form. Also in the case of overseas pensions, logistical issues may preclude the Division from meeting this objective. The claimant is informed in writing with the entitlement or disallowance of the pension. If the applicant is not entitled, an appeal may be lodged before the Umpire, within 30 days from date of notification.
