RAPPORT DU MAIRE OPENING OF MEETING The Mayor called the meeting to order. Unless otherwise indicated to the contrary in these minutes, the Mayor always avails himself of his privilege provided for in article 328 of the Cities and Towns Act (chapter C- 19) by abstaining from voting. MAYOR S REPORT RAPPORTS DES CONSEILLERS COUNCILLORS REPORTS Councillor Lulham reported that no decision was being made on the location of the dog run. Many letters for and against were received and would like to have a poll to better understand and see all options. Looking at an outside agency to conduct a poll in September.

2 2013-07-02 Mayor Trent expressed that the feedback received was appreciated. In the meantime, any suggestions are welcomed and would be incorporated into the poll. On behalf of Council, the Director General congratulated Eugene Bouchard, Professional tennis player. He also thanked the lifeguards for their excellent work in organizing the St-Jean Baptiste where close to 70 to 80 children participated. As well for the upcoming outing to St-Saveur, a second bus required. Councillor Ikeman reported that Commander Plourde was unfortunately leaving Westmount Police District for a new promotion and wished him success. He would be replaced by Commander Daniel Gerbarde. Mayor Trent expressed that Commander Plourde was an exceptional chief. He was devoted to the community and understood their needs. Councillor Martin reported on the WRC. He outlined the following: - the construction strike was now over and too early to know the impact; - currently 30 days late and construction holidays coming up; - part of the taxes were received and the amount did not include the holdback which would be kept until the completion of the project. Councillor Drury welcomed the newly appointment Assistant City Clerk, Nicole Dobbie, to the meeting.

CARRIED UNANIMOUSLY NOMINATION DIRECTEUR GÉNÉRAL SUBSTITUT ATTENDU QUE le comité plénier et le directeur général recommandent au conseil qu un directeur de service soit nommé pour remplacer le directeur général en son absence. APPOINTMENT SUBSTITUTE DIRECTOR GENERAL WHEREAS General Committee of Council and the Director General recommended to Council that a senior manager be appointed to replace the Director General in his absence.

QUE monsieur Michael Deegan, directeur du Service des sports, loisirs et événements communautaires, soit désigné à titre de directeur général substitut intérimaire, en cas d absence du directeur général substitut, et qu en cette capacité, il soit autorisé à exercer l autorité du directeur général et à agir comme signataire autorisé dans le cadre de ses fonctions. ADOPTÉ À L UNANIMITÉ THAT, in the event of the absence of the Director General, Joanne Poirier, Director of Urban Planning, be designated Substitute Director General, and in this capacity, be authorized to execute the authority and signing privileges of those regularly performed by the Director General. THAT, in the event of the absence of the Director of Urban Planning, Michael Deegan, Director of Sports, Recreation and Community Events, be designated as the Acting Substitute Director General, and in this capacity, be authorized to execute the authority and signing privileges of those regularly performed by the Director General. CARRIED UNANIMOUSLY TARIFS PERSONNEL ÉLECTORAL ATTENDU QU une élection générale municipale aura lieu le 3 novembre 2013; ATTENDU QUE, conformément à l article 88 de la Loi concernant les élections et les référendums dans les municipalités (chapitre E-2.2), tout membre du personnel électoral a le droit de recevoir de la municipalité une rémunération ou une allocation de dépenses pour les fonctions qu il exerce. Le conseil de la municipalité peut établir un tarif de rémunération ou d allocation; ATTENDU QUE la greffière, à titre de présidente d élection, devra embaucher environ 180 personnes comme membres du personnel électoral. TARIFFS ELECTION OFFICERS WHEREAS a municipal general election will be held on November 3, 2013; WHEREAS according to section 88 of An Act respecting elections and referendums in municipalities (chapter E-2.2), every election officer is entitled to receive remuneration or an expense allowance from the municipality for the duties he performs. The council of the municipality may establish a tariff of such remuneration or allowances; WHEREAS the City Clerk, as the Returning Officer, will have to hire approximately 180 people as election officers.

Despite Councillor Lulham s absence at this meeting, the Mayor asked that Council s position be established clearly in order to avoid further debate at the public meeting where residents are expected to raise the point. He also noted that Council intends to move forward with the adoption of the Dog By-law amendment that will restrict the number of dogs allowed under one person s care in all dog runs. Mayor Trent explained that the decision to relocate the Lansdowne Dog Run has to do with the fact that the Westmount Recreation Centre will be surrounded by additional green space to accommodate both the swimmers and those who like to spend leisure time in Westmount Park. By converting the paved area into a new dog run, Council was trying to counterbalance this loss with the extra acre of green space provided at the WRC and considering that the Lansdowne dog run has been considerably reduced by the WRC construction site. Taking into account that all WRC users are gaining from the new facility, it seems fair that dog run users would also get some kind of improvement as well. Mayor Trent expressed concern that the elimination of the dog run in Westmount Park could upset dog owners. Councillor Martin suggested that the relocation of the dog run be deferred in order to take the time to examine what the population expressed through their representation. The Director General mentioned that Councillor Lulham, Marc Fauteux and the Public Works department will be working on the design and plans will be submitted to the Planning Advisory Committee for review. PRINCE ALBERT SQUARE The Director General recommended that the Prince Albert Square project be deferred until next year given the workload in 2013. In the meantime, a virtual design of the proposed square will be put in place and Public Works will measure its impact on parking, deliveries and pedestrians access.

The Director General replied that funds have been appropriated in the 2014 Capital budget for the tennis courts and that the landscaping expenses will be provided in next year s budget. He explained that the landscaping around the Westmount Park Church needs to be finalized. Councillor Martin mentioned that, usually, the contractor is responsible for any damages to the City s property following a construction project. It is preferable to wait until the completion of the WRC before assessing the required reconstruction. The Director General mentioned that negotiations are still required with the RMR with respect to the use of its land for the WRC parking area. INFRASTRUCTURE ASSESSMENT MANAGEMENT The Director General mentioned that he will provide Council s report from the study group shortly. He has asked Marianne Zalzal, the Director of Public Works, and Alain Cazavant, the Assistant Director of Public Works, to report back to him. Councillor Martin requested a timetable for this. APPROVAL OF PURCHASES Councillor Martin questioned the fact that only one quotation was received for the purchase of the used 2012 Nissan vehicle. The Director General explained that Public Works was very specific about the type of vehicle required for proper storage of equipment and tools. Research was done to find the best vehicle within the available budget.

REPORTS TO COUNCIL AT THE PUBLIC MEETING Mayor Trent mentioned his intention to provide information concerning the reduction of the interest rate from 5% to 3% that will impact positively the WRC loan by-law reimbursement. A reduction of approximately $150,000 to $200,000 annually over a 5 year period that should offset some of the extra costs associated to the soil decontamination. He announced that an article will be published in next week s Westmount Independent. ITEMS FOR DISCUSSION/DECISION TRAFFIC MASTER PLAN Copies were circulated of a memorandum from Duncan E. Campbell, Director General to the General Committee of Council, dated May 31, 2013. Mayor Trent announced that the Traffic Master Plan scheduled to be adopted at the public meeting will be deferred to allow Council to review the comments received by May 31, 2013.

The item was deferred to the next General Committee meeting. WATER EMERGENCY REPORT Copies were circulated of a memorandum from Duncan E. Campbell, Director General to the General Committee of Council, dated May 31, 2013 for information. Mayor Trent informed General Committee of Council that the Mayors of the reconstituted cities intend to send a letter to the Montreal Urban Agglomeration concerning the way the water crisis was handled. They questioned the fact that the Agglomeration representatives congratulated themselves in front of the media, even before the Mayors of the cities involved were informed on the status of the event. They also intend to ask serious questions about the practice of allowing sediment to collect over decades in a reservoir, stirring-up such sediment resulted in a water boiling advisory for almost 3 days. STANDING ITEMS - UPDATES MTQ/AMT Councillor Samiotis reported on the unacceptable schedule of the AMT repairs and construction to be carried out on the Westmount Section of the CP tracks between 10 pm and 7 am. She has insisted on a public meeting organized by the AMT where residents can ask questions and be provided with additional information on the kind of operations that will be done during the night. The lack of communication from CP and the AMT has brought concerns from residents living along the tracks. Councillor Samiotis reported on her requests to obtain an update on the locomotive upgrades and the engineering study that was supposed to be tabled last year. She has also asked about the latest discussion on the Train de l Ouest. The Director General reported that the MTQ held on information session on the decontaminated soil along the falaise leading to the Home Depot. He mentioned that the Westmount section was not part of this plan. The Westmount side of the

The Director General plans to enquire about their plans for the STM site before the reconstruction of the Ville-Marie Expressway is started. VARIA ELECTIONS Copies were circulated of the 2013 municipal elections calendar. The Director General confirmed that the last regular Council meeting will be held on Tuesday, October 1 st, 2013 given that the law provides that Council shall not sit 30 days prior to polling day (November 3 rd ). The meeting was adjourned at 7:53 p.m. and resumed at 10:25 p.m. NEW BUSINESS: CONCORDIA WORKSHOP Mayor Trent informed Council of his participation, as instructor for Concordia s Workshop on Social Science and Research ( WSSR ) on the topic of Municipal policy, on 16 and 17 May 2013. Concordia University provides honoraria to its instructors which Mayor Trent received as well. PARKING TICKETS ON GREENE AVENUE Councillor Samiotis reported on ticketing issues on Greene Avenue. In her opinion, the Public Security Officers are carrying out their duties without mercy, leading to shoppers being driven away from the area. Given that merchants had to suffer last summer s reconstruction of the avenue and the fact that parking agents are waiting for meters to expire, she feels add to the aggravation. She suggested that the contractors workers be accommodated on the construction site until completion of the building. She asked that the agents be more lenient for customers. The Director General will relay these comments to the Director of Public Security. A discussion ensued. Councillor Ikeman reported about the loss of parking on Greene Avenue and the constant complaints. In his opinion, it is imperative that Parking Inspector not work on the same street at the same time which gives a poor

VANGUARD DEMOLITION The Director General confirmed the Demolition Committee hearing that will be held on June 19, 2013 and presented plans of the preliminary replacement programme for the building located at 175 Metcalfe Avenue. The proposed plans call for a 6- storey condo building with 2 underground parking levels for this residential zone. Councillor Martin announced that he plans to question the capacity of the sewer system in that area. He has asked the Director of Urban Planning and the Director of Public Works to be prepared to answer these questions. C) BUSINESS ARISING FROM THE MINUTES OF JUNE 3, 2013 INFRASTRUCTURE ASSESSMENT MANAGEMENT Councillor Martin requested a specific date for the tabling of this report. The Director General replied that the report will be submitted at the next meeting of General Committee of Council, on July 2, 2013. PARKING TICKETS ON GREENE AVENUE Councillor Samiotis had requested that clear instructions be provided to the Parking Inspectors to ensure that they were not too overzealous in their duties. The Director General replied that he had shared Council s comments with the Director of Public Security, David Sedgwick who informed him that each inspector has his/her own territory but that they might walk together from the office to go to their individual destinations or during training. The Parking Inspectors have been asked to show some leniency on Greene Avenue given the construction and road works that have been going on in the last year. They must try to strike a balance as some people have been taking advantage of the situation. It is up to the inspector to use his/her own judgment. Councillor Ikeman mentioned recurring complaints have been lodged over many years on Greene Avenue. He explained that, compared to Montreal, our Public Security manpower seems to be higher per capita, and that should be taken into consideration. The Director General explained that Montreal use vehicles and an electronic parking meter system compared with Westmount s visual inspection. He concluded that the parking meter system needs to be replaced as soon as possible. APPROVAL OF PURCHASES: NISSAN TRUCK The Director General provided some explanations on this item that was submitted for Council s approval at the June 3 regular meeting. Public Works and Purchasing had identified the type of truck required and invited 3 dealerships to submit bids. Even though the vehicle was in stock at each dealer, only one quotation was received. The Director General informed

SOUND BARRIER A June 27 meeting has been scheduled to discuss the Sound Barrier. ITEMS FOR DISCUSSION/DECISION AREQ Copies were circulated of the following documentation: Memorandum from Duncan E. Campbell, Director General to the General Committee of Council, dated May 31, 2013; AREQ : Rapport sur l état du dossier tarifaire de l AREQ, avril 2013. Benoit Hurtubise, Director of Hydro Westmount, joined the meeting at 6:20 p.m. The Director General had circulated a letter received from the City of Sherbrooke that expressed concerns about Hydro Québec s proposal to change the electricity rate scale for municipalities. He invited the Director of Hydro Westmount to explain the impact it might have on the operations. Mr. Hurtubise provided a brief presentation explaining that Hydro Québec is looking at increasing its revenues. He mentioned the proposal to introduce a new tariff to municipalities. L AREQ members, being public utility companies, have been charged the multinational enterprise rate (L). In order to increase its profit, HQ would like to create a new rate for municipalities (LG) that would have a great impact on Westmount s profit margin. He explained that cities with multiple inter connections will be the most affected should this proposal be adopted. Mr. Hurtubise pointed out that Sherbrooke would like member municipalities to use their political influence to object to this proposal. He mentioned that any changes to the rate structure need the Régie de l énergie s approval. TRAFFIC MASTER PLAN Copies were circulated of a memorandum from Duncan E. Campbell, Director General, to General Committee of Council, dated June 12, 2013.

GENERAL COMMITTEE OF COUNCIL JUNE 17, 2013 PAGE 4 Mayor Trent reported that, as part of the 4 objectives that Council intended to achieve within this mandate, the Traffic Master Plan is the one which is the closest to completion. He proposed that Council meet one more time during the summer to discuss the last comments before its adoption at the regular meeting in September. The time has come to transfer the report into a plan, without making recommendations on specific issues. Councillors were invited to check their vacation schedule in order to plan the meeting. It was recommended to invite Mr. Peter Starr, the president of the Westmount Municipal Association. Depending on everyone s availability, the Director General could organize the workshop over the next few weeks in order to be ready to discuss the areas of priority. The results of the discussion will allow to plan for any impacts the Traffic Master Plan may have on the 2014 budget and provide guidance prior to road reconstruction. 2013 ELECTIONS - ORGANIZATION AND SALARIES Copies were circulated of the following documentation: Memorandum from Viviana Iturriaga Espinoza, City Clerk, to General Committee of Council, dated June 13, 2013; Context and comparisons on the remuneration and allowances for election officers. The City Clerk recommended to adopt the same remuneration and allowances for election officers as the one adopted for the 2009 Municipal Elections. She informed General Committee of Council that Mrs. Morgannis Graham, Archivist in the City Clerk s Office, has been approached to act as the Election Clerk. All agreed with the recommendations of the City Clerk. Action: A resolution will be submitted for Council s approval at the July regular meeting.

GENERAL COMMITTEE OF COUNCIL JUNE 17, 2013 PAGE 5 CodeRED EMERGENCY NOTIFICATION SYSTEM Copies were circulated of the following documentation: Memorandum from David Sedgwick, Director of Public Security, to General Committee of Council dated June 12, 2013; CodeRed: Solution Overview from Emergency Communications Network to the City of Westmount. General Committee of Council was requested to review a proposal concerning the CodeRED emergency notification system that can send out thousands of messages per minute by telephone, email and text. A demonstration was recently made to the Operations Committee where attendees had a chance to appreciate the versatility of the system. Besides City-wide emergency, it can be used to issue alerts during electrical outages, water service disruptions and snow removal advisories. The estimated costs of $10,000 annually for implementation and use of the CodeRED system is still valid. All agreed with the recommendations of the Director of Public Security to proceed with this service. NEW BUSINESS CLAY COURTS POLICY Councillor Duncan reported on the recent complaints about children using the tennis courts for long periods of time. Following a discussion with the administration, it is recommended to allow children to use the King George Park and Stayner Park tennis clay courts for a maximum period of 45 minutes (30 minutes for singles). All agreed with the recommendations. LANSDOWNE DOG RUN RELOCATION Councillor Lulham reported on the number of letters, calls and emails received by Council members following the decision to relocate the Lansdowne dog run into Westmount Park. Recent visits to the proposed site indicated that the paving area is being used in the morning for Tai Chi exercises. In the meantime, 10 to 12 dogs are let loose on the playing fields between 8:30 p.m. and 10:30 p.m. in the absence of a dog run. In her opinion, there are more people in favour of a new dog run in Westmount Park, as opposed to no dog run at all. Currently, given the WRC construction site, there is no room in the Lansdowne peninsula and there is no other

GENERAL COMMITTEE OF COUNCIL JUNE 17, 2013 PAGE 6 alternative to accommodate the dog owners who would like to come to a pleasant and safe area. Councillor Martin suggested to avoid taking immediate action or proceeding too quickly. Councillor Duncan agreed. Councillor Lulham made a brief presentation of the most updated layout that will be covered with a suitable material, surrounded by shrubs and a metal fence and a water system. It was agreed to support Councillor Lulham s recommendations. AMENDMENT TO DOG BY-LAW Copies were circulated of a memorandum from Duncan E. Campbell, Director General, to General Committee of Council, dated June 13, 2013. Councillor Lulham mentioned that, following the comments from the dog walkers at the June 3 regular Council meeting, it was agreed to modify the draft by-law to prohibit more than 3 dogs at a time only in Summit Woods. Before agreeing to this amendment, Councillor Martin suggested that Council not proceed too quickly and not take immediate action. Action: An amended version of By-law to amend Dog By-law 535 to be submitted for Council s approval at the July 2, 2013 regular meeting. STANDING ITEMS UPDATE AMT/CP Councillor Samiotis reported on the resident information meeting that took place with representatives of l Agence métropolitaine de transport (AMT) and the Canadian Pacific (CP) to advise our residents that work would be undertaken on the CP Westmount subdivision. She received complaints from the Prospect residents that were not invited to the meeting, even though they will be affected by the proposed works not only from a construction point of view but the fact that a new signaling station will be built in front of their homes. She insisted that a second meeting be held to accommodate the residents who were not invited to the first meeting. Councillor Lulham proposed the option of lodging a noise and vibration complaint to the Canadian Transportation Agency (CTA) even though it may not have any impact on CP s decision to install signaling bridges near homes. She explained the

GENERAL COMMITTEE OF COUNCIL JUNE 17, 2013 PAGE 7 mediation process provided by the CTA. She reported on the reasonable request made last year to avoid excessive noise during the night. The City had asked to stop the train service during weekends to no avail. Councillor Samiotis added that a formal request was made for the construction hours and the placement of the signaling bridge. She also told Council that the City had prevented the CP from entering through the Prospect street entrance, an action that disappointed the CP and AMT. SOUND BARRIER The Director General reported on the request from Prospect residents for the installation of a sound barrier along the train tracks. A feasibility study has been requested even though there is no guarantee that this will resolve the issue to diminish the noise. Mayor Trent explained that, a few years ago, Council was given the impression that the MTQ would pay 75% of the costs for a new sound barrier and the City the remaining 25%. Apparently, this option was never available with the result that Westmount and the MTQ will have to share the expenses 50%-50% a far less attractive proposition, and one more difficult to sell to the Westmount taxpayer. In his opinion, assuming that Council agrees to adopt a loan by-law subject to the approval of the entire population, it is far from guaranteed that citizens will agree to spend millions of dollars for a sound barrier. The health problems, citizens might say, would be better alleviated through the use of triple-glazed windows. It will be an especially hard sell since a barrier will not diminish the noise to the second floor of houses and a clear barrier, presents maintenance problems. Moreover, the option of a berm is less attractive and practical, now that CP has ruled out the City using their land. Councillor Lulham explained that the health issue arguments led to the construction of a prototype. This prototype is usually covered with graffiti at high maintenance costs. She would support a feasibility study to provide valued information to the administration. She recommended that the administration researches a subsidy programme that would offer financial assistance to qualified residents for high performance windows. Councillor Samiotis stated that we owed to the residents of Prospect to follow through and have the feasibility study completed The Director General reiterated the administration s intention to go ahead with the June 27 meeting with the MTQ.

GENERAL COMMITTEE OF COUNCIL JUNE 17, 2013 PAGE 8 NEW BUSINESS WATER METERS Councillor Samiotis reported on her recent experience as a resident who received the notice for a water main upgrade. She realized that the City was missing out on an opportunity to encourage residents to fit their homes for water meters while replacing the lead entrance pipes. She suggested that in future when we have streets that are slated for water main upgrades that we ask residents to do that we are better prepared for the installation of water meters at potentially less cost to both the city and the resident. The Director General replied that only commercial buildings will be retrofitted with water meters at this time. ABSENCES Council members were requested to submit their absence sheet to the Assistant City Clerk. COUNCIL MEETING AUGUST 5, 2013 ITEM No. 7 COLLABORATION AGREEMENT WITH THE MINISTERE DES TRANSPORTS DU QUÉBEC FEASIBILITY STUDY FOR A SOUND BARRIER Councillor Samiotis WHEREAS the City of Westmount has been presented the final plans for the reconstruction of the Turcot Interchange by representatives of the Ministère des Transports du Québec (MTQ) on May 22, 2012; WHEREAS studies conducted separately by the City of Westmount and the MTQ clearly indicate that current highway noise levels, especially in the area east of Hallowell Street exceed the permissible level of 65 db, a level that is understood to be the maximum noise level beyond which long term effects on health become a concern; WHEREAS on 4 June 2012, the City of Westmount adopted resolution No. 2012-06-157 requesting the Ministère des Transports du Québec to conduct a feasibility study for a sound barrier; WHEREAS, in accordance with the requirements of the Politique sur le bruit du ministère des Transport du Québec, the proposed implementation of a noise barrier in the identified area meets the criteria of the Ministry; WHEREAS, in accordance with the said Politique, the Ministère des Transports du Québec may contribute up to 50% of the costs for conducting a feasibility study for the construction of a sound barrier in the area located east of Hallowell street, to the extent that the City of Westmount agrees to pay 50% of costs; WHEREAS in order to realize this commitment, the City of Westmount must beforehand sign a collaboration agreement with the Québec Government, represented by the Ministre des Transports du Québec duly authorized by An Act respecting the Ministère des Transports (chapter M-28) and An Act respecting Roads (chapter V-9). COUNCIL MEETING AUGUST 5, 2013 ITEM No. 8 AGREEMENT - NATIONAL BANK OF CANADA Councillor Price WHEREAS an agreement entered into with National Bank of Canada to provide banking and related financial services from January 1, 2009 to December 31, 2010, was extended for a 3-year period as per resolution No. 2010-11-253 adopted by Council at its regular meeting held on November 1, 2010; WHEREAS the National Bank of Canada wishes to renew the agreement for a 3- year period as of January 2014. COUNCIL MEETING AUGUST 5, 2013 ITEM No. 9 PURCHASING CARD PROGRAMME NATIONAL BANK OF CANADA Councillor Price WHEREAS a convention reached in 2009 with the National Bank of Canada following an agreement with the Fédération Québécoise des Municipalités (FQM) led to the issuance of five purchasing cards with a total credit limit of $22,500 for the Public Library, the Sports and Recreation Department and the Information Technologies Department; WHEREAS the Purchasing Division must deal on a regular basis with suppliers that require online electronic payment method and has requested the use of a purchasing card for such purpose. COUNCIL MEETING AUGUST 5, 2013 ITEM No. 10 APPROVAL OF PURCHASES/PUBLIC SECURITY TENDERS WITH VILLE DE MONTRÉAL Councillor Ikeman WHEREAS the City entered into an intermunicipal agreement with the City of Montreal pertaining to the supply of an automated parking ticketing system (système d'émission des constats informatisés en matière de stationnement) (SECI 2) and the supply of related services by the City of Montreal, as per resolution No. 2012-11-257 adopted by Council at its meeting held on November 5, 2012; WHEREAS the power to call for tenders was delegated to the City of Montreal for the purchase of 12 hand held automatic ticketing units (PDAs) and printers, three terminals (to download data), chargers, and accessories and related services, including the installation for the Public Security Department. COUNCIL MEETING AUGUST 5, 2013 ITEM No. 15 ISSUE OF BONDS AND AMENDMENT TO LOAN BY-LAW 1397 Councillor Price WHEREAS, in accordance with section 564 of the Cities and Towns Act (chapter C-19), the council may amend a loan by-law by a resolution requiring no approval if the amendment does not change the object of the loan and (1) does not increase the burden on the ratepayers or (2) increases the burden on the ratepayers by reason only of an increase in the rate of interest or the shortening of the term of repayment; WHEREAS a modification to By-law 1397 entitled "By-law to provide a loan in the amount of $37,000,000 for the arena-pool reconstruction project" is required in order to reduce amortization period. MOVER Councillor Price THAT loan by-law 1397 entitled "By-law to provide a loan in the amount of $37,000,000 for the arena-pool reconstruction project" be amended by replacing Section 3 by the following: "In order to provide for the expenses incurred by this bylaw, Council is authorized to contract a loan in the amount of $25,001,479 over a period of 40 years and in the amount of $11,998,521 over a period of 20 years". COUNCIL MEETING AUGUST 5, 2013 ITEM No. 17 RESOLUTION OF CONCORDANCE Councillor Price WHEREAS, in accordance with Loan By-law 1397, the City wishes to issue a series of bonds, namely a term bond, for a total amount of $17,000 000; WHEREAS, for the purposes of said issue, it is necessary to amend the by-law pursuant to which the bonds are issued. MOVER Councillor Price THAT the above-mentioned loan by-law be amended, if necessary, to conform with what is stipulated below, regarding the amount of bonds previously specified in said by-laws included in the $17,000,000 bond issue; THAT the bonds, namely a term bond, be dated August 21, 2013; THAT these bonds be registered in the name of CDS Clearing and Depository Services Inc. (CDS) and be deposited with CDS; THAT CDS act as the book entry agent, the bond-holding and the disbursing agent and be responsible for the transactions to be carried out for between participants and the municipalities, as described in the memorandum of understanding signed by Québec's Minister of Municipal Affairs, Regions and Land Occupancy and CDS; THAT CDS proceed with the transfer of funds in accordance with the legal requirements of the bond, to that effect, Council authorizes the Treasurer to sign the document required by the Canadian banking system entitled "Authorization for Business Pre-Authorized Debit Plan"; THAT in order to make payments to the participants via electronic funds transfers, CDS be authorized to directly withdraw funds for the payment of capital and interest, from the account in the following financial institution: National Bank of Canada; THAT interest be payable semi-annually on February 21 and August 21 of each year; THAT the bonds issued be not redeemable before maturity; however, they may be redeemed with holder consent in accordance with An Act respecting Municipal debts and loans (chapter D-7); THAT the bonds be signed by the Mayor and the Treasurer. CHAPITRE I - DISPOSITIONS GÉNÉRALES 1. Le chapitre III du Code de construction (L.R.Q., c. B-1.1, r. 0.01.01) intitulé «PLOMBERIE», ci-après désigné le «Code» constitue une partie du présent règlement. Les modifications apportées au Code après l'entrée en vigueur du présent règlement font également partie de celui-ci, sans que le conseil ne doive adopter un règlement pour décréter l'application de chaque modification ainsi apportée. Une telle modification entre en vigueur sur le territoire de la ville à la date que le conseil détermine par résolution. Le greffier donne alors un avis public de l'adoption de cette résolution conformément à la loi. 2. À moins que le contexte ne l'exige autrement ou à moins qu'elles ne soient définies autrement dans le présent règlement, les expressions utilisées dans les présentes ont et incluent les significations attribuées par le Code. 3. Lorsque le présent règlement ou une de ses dispositions est en conflit avec un autre règlement de la Ville ou une disposition du présent règlement, la plus restrictive des dispositions s'applique. 4. Si un bâtiment est endommagé par le feu, un tremblement de terre ou toute autre cause, le présent règlement et tous les règlements pertinents de la Ville s appliquent à l ensemble des travaux nécessaires à sa reconstruction. CHAPTER I - GENERAL PROVISIONS 1. Chapter III of the Construction Code (R.S.Q., c. B-1.1, r. 0.01.01) entitled PLUMBING, hereinafter referred to as the Code constitutes a part of this By-law. Amendments to the Code made after the coming into force of the present by-law is also part of it without the obligation of the Council to pass a by-law to prescribe the applicability of every amendment made. Such an amendment comes into force in the territory of the city on the date fixed by a resolution. The City Clerk shall give public notice of the passing of such a resolution in conformity with the law. 2. Unless the context otherwise requires, or unless otherwise defined in this By-law, the terms utilised herein shall have and include the meaning ascribed thereto in the Code. 3. Where this By-law or any provision thereof is a variance or in conflict with any other City By-laws or any provision of this By-Law, the more restrictive or prohibitive provision shall govern. 4. If a building is damaged by fire, earthquake or any other cause, this By-law and all applicable City Bylaws shall apply to all the work necessary to reconstruct the building. Page 2

5. CHAPITRE II MATÉRIAUX, EXIGENCES ET SPÉCIFICATIONS Section 1 - TUYAUTERIE 6. Malgré les dispositions du Code, les installations de distribution d eau et les installations souterraines réglementées par la section 2.3 de la Division B du Code national de la plomberie Canada 2005 doivent être en cuivre mou recuit et conformes à la norme K (ASTM B 88). 7. Malgré les dispositions du Code, aucune partie d un système de drainage souterrain ne doit avoir un diamètre inférieur à 2 po (51 mm). 8. Malgré les dispositions du Code, les tuyaux et raccords réglementés par la section 2.2 de la Division B et les soussections A-2.2.5, A-2.2.6 et A-2.2.7 de l annexe A du Code national de la plomberie Canada 2005 doivent être exempts de plastique dans toutes les installations de plomberie, à l exception des cas suivants : a) réseaux d évacuation enterrés (drains français); b) réseaux d évacuation non enterrés situés à l extérieur d un bâtiment ou d une structure, à l exception des tuyaux de descente pluviale et gouttières de plastique qui ne sont pas autorisés; c) tuyaux et raccords DWV de laboratoire; CHAPTER II MATERIALS, REQUIREMENTS AND SPECIFICATIONS Division 1 - PIPING 6. Notwithstanding any provision of the Code, the water services and underground water services regulated by section 2.3, Division B of the National Plumbing Code of Canada 2005 shall be of copper, type K (ASTM B 88), soft annealed. 7. Notwithstanding any provision of the Code, no part of an underground drainage system shall be smaller than 2 inches (51 mm) in diameter. 8. Notwithstanding any provision of the Code, pipes and fittings regulated by section 2.2, Division B and subsections A-2.2.5, A-2.2.6, and A- 2.2.7 of Appendix A of the National Plumbing Code of Canada 2005 shall not be made of plastic in any plumbing system, except for the following: a) subsoil drainage systems (French drains); b) above-ground drainage systems located outside any building or structure with the exception of plastic rain leaders and gutters which shall not be permitted; c) laboratory DWV pipe and fittings; Page 3

d) systèmes d arrosage automatique; e) systèmes d alimentation et d évacuation de piscine; f) tuyaux SDR (rapport de dimension normalisée) ou SDR en PVC qui sont autorisés pour l installation à partir du milieu de la rue jusqu à la base du principal regard de nettoyage à l entrée du bâtiment. 9. Malgré les dispositions du Code, aucun tuyau ou raccord en amiante-ciment n est autorisé dans les installations de plomberie. 10. Les tuyaux et raccords de tôle ondulée sont interdits dans toute installation de plomberie. 11. Si un bâtiment est desservi par plus d un tuyau de distribution d eau, chacun étant raccordé à une conduite d eau distincte ou à une même conduite, les tuyaux étant alors séparés par un robinet-vanne, chacun des tuyaux de distribution doit être muni d un dispositif anti-refoulement à son point d entrée dans le bâtiment entre les deux robinets-vanne. Section 2 RÉSEAU DE VENTILATION 12. Malgré les dispositions du Code, le diamètre des tuyaux de ventilation réglementés par la section 2.5 de la Division B du Code national de la plomberie Canada 2005 ne doit pas être inférieur à 4 po (102 mm) à l extérieur d un bâtiment. Section 3 SYSTÈME D ÉGOUT 13. Regards de nettoyage Malgré les dispositions du Code, un regard de nettoyage réglementé par la sous-section 2.4.7 de la Division B du d) lawn sprinkler systems; e) swimming pool supply and drainage systems; f) SDR (Standard dimension ratio) or PVC SDR pipes which are allowed for installation from the center of the street up to the downstream of the main cleanout at the entrance of the building. 9. Notwithstanding any provision of the Code, no asbestos-cement pipe and fittings will be permitted in any plumbing system. 10. No corrugated steel pipe and fittings will be permitted in any plumbing system. 11. When a building is supplied by more than one water service pipe connected to different water mains or to be the same main but separated by a gate valve, every water service pipes shall be provided where it enters the building with a backflow preventer between the two gate valves. Division 2 - VENTING SYSTEMS 12. Notwithstanding any provision of the Code, the diameter of every vent pipe regulated by section 2.5, Division B of the National Plumbing Code of Canada 2005 shall be not less than 4 inches (102 mm) outside a building. Division 3 - DRAINAGE SYSTEMS 13. Cleanouts Notwithstanding any provision of the Code, a cleanout, regulated by subsection 2.4.7, Division B of the Page 4

Malgré les dispositions du Code, les eaux usées provenant d installations situées à plus de 9 pi (2,74 m) sous le niveau de la rue doivent être évacuées dans un puisard et pompées vers le drain du bâtiment. 19. Traps Notwithstanding any provision of the Code, the trap of the floor drain of less than 3 inches (76 mm) in diameter shall be vented. 15. Notwithstanding any provision of the Code, a kitchen drain that is not vented shall have a seal trap of a minimum size of 2 inches (51 mm) of depth. 16. Building sewer A combined building drain shall not be installed Notwithstanding any provision of the Code, the diameter of a building sewer shall be of a minimum of 6 inches (152 mm). 17. Backwater valve Notwithstanding any provision of the Code, backwater valve regulated in section 2.4, Division B of the National Plumbing Code of Canada 2005 shall be installed on basement fixtures only. Backwater valves on the building drain are not allowed. 18. Notwithstanding any provision of the Code, sewage from fixtures located at more than 9 feet (2.74 m) below the street level shall be discharged into a sump and pumped to the building drain. 19. Notwithstanding any provision of the Code, in buildings subject to flooding and backflows, the plumbing inspector may require that such buildings be Page 5

Water meter provision All new buildings must be built to permit the installation of water meters at the entrance of the water main. A straight horizontal run of 2 feet (0.61 m) in length without any fittings or changes in direction shall be provided after the stop and waste main shut off valve for the water domestic connection. Division 7 - CROSS-CONNECTION 26. No connection shall be permitted between a potable water supply system and a non-potable water line or the lines used to distribute the water drawn from one of the sources mentioned in article 25. 27. Any unauthorized connection between the piping systems of two separate water supply sources shall be disconnected immediately upon the request of the City. Page 7

28. Si le propriétaire d un bâtiment vacant ou inhabité néglige ou omet d obstruer les ouvertures de l installation de plomberie, la Ville pourra, aux frais du propriétaire, faire effectuer les travaux par ses employés ou accorder un contrat à ces fins à un entrepreneur indépendant. 33. La Ville peut prendre toutes les mesures qu elle estime appropriées afin d éliminer la nuisance et protéger le public. 28. In cases where the owner of a building fails to comply with a notice from the City and does not take the corrective steps required under this By-law within the period of time determined in the notice, the City may have the work carried out by its employees or by an independent contractor, at the expense of the owner and without prejudice to any other recourse of the City. Division 8 - NUISANCES 29. Any part of a plumbing system that becomes defective or unsanitary shall be repaired, replaced or removed within thirty days after receipt of a written notice from the City. 30. The quality and design of materials and the workmanship employed in work shall in all respects comply with the requirements of the Code. 31. The owner of a vacant or uninhabited building shall plug any opening in the plumbing system. 32. Should the owner of a vacant or uninhabited building neglect or refuse to plug the openings in the plumbing system, the City may, at the owner s expenses, have the work done by its employees or grant a contract for this purpose to an independent contractor. 33. The City shall take any measure it deems necessary to eliminate a nuisance and protect the public. Page 8

Le règlement nº 783 intitulé «Règlement concernant la plomberie» est abrogé 37. Le présent règlement a effet à compter du 1 er juillet 2008. CHAPTER III - FINAL PROVISIONS 34. The director of the Urban Planning department is responsible for the application of this by-law. 35. Any person who violates any provision of this By-law is deemed to have committed an infraction and is liable: a) in the case of a first infraction committed by a natural person, to a fine of at least $ 500 and not exceed $ 1,000 and in the case of a second or subsequent infraction by the same person, at least $ 1,000 and not exceed $ 2,000; b) in the event of a first infraction committed by a legal person, the fine of at least $ 1,000 and not exceed $ 2,000. In the case of a second or subsequent infraction by the same legal person, a fine of at least $ 2,000 and not exceed $ 4,000. 36. By-law 783 entitled By-law concerning plumbing is repealed. 37.
