P228 ANNEXE 3 - INTERNATIONAL CODE OF ETHICS FOR DEALERS IN CULTURAL PROPERTY International Code of Ethics for Dealers in Cultural Property Members of the trade in cultural property recognize the key role that trade has traditionally played in the dissemination of culture and in the distribution to museums and private collectors of foreign cultural property for the education and inspiration of all peoples. They acknowledge the world wide concern over the traffic in stolen, illegally alienated, clandestinely excavated and illegally exported cultural property and accept as binding the following principles of professional practice intended to distinguish cultural property being illicitly traded from that in licit trade and they will seek to eliminate the former from their professional activities. ARTICLE 1 Professional traders in cultural property will not import, export or transfer the ownership of this property when they have reasonable cause to believe it has been stolen, illegally alienated, clandestinely excavated or illegally exported. ARTICLE 2 A trader who is acting as agent for the seller is not deemed to guarantee title to the property, provided that he makes known to the buyer the full name and address of the seller. A trader who is himself the seller is deemed to guarantee to the buyer the title to the goods. ARTICLE 3 A trader who has reasonable cause to believe that an object has been the product of a clandestine excavation, or has been acquired illegally or dishonestly from an official excavation site or monument will not assist in any further transaction with that object, except with the agreement of the country where the site or monument exists. A trader who is in possession of the object, where that country seeks its return within a reasonable period of time, will take all legally permissible steps to co-operate in the return of that object to the country of origin. ARTICLE 4 A trader who has reasonable cause to believe that an item of cultural property has been illegally exported will not assist in any further transaction with that item, except with the agreement of the country of export. A trader who is in possession of the item, where the country of export seeks its return within a reasonable period of time, will take all legally permissible steps to co-operate in the return of that object to the country of export. ARTICLE 5 Traders in cultural property will not exhibit, describe, attribute, appraise or retain any item of cultural property with the intention of promoting or failing to prevent its illicit transfer or export. Traders will not refer the seller or other person offering the item to those who may perform such services. ARTICLE 6 Traders in cultural property will not dismember or sell separately parts of one complete item of cultural property. ARTICLE 7 Traders in cultural property undertake to the best of their ability to keep together items of cultural heritage that were originally meant to be kept together.

P229 ANNEXE 3 - INTERNATIONAL CODE OF ETHICS FOR DEALERS IN CULTURAL PROPERTY ARTICLE 8 Violations of this Code of Ethics will be rigorously investigated by (a body to be nominated by participating dealers). A person aggrieved by the failure of a trader to adhere to the principles of this Code of Ethics may lay a complaint before that body, which shall investigate that complaint before that body, which shall investigate that complaint. Results of the complaint and the principles applied will be made public. Adopted by the UNESCO intergovernmental Committee for Promoting the Return of Cultural Property to its Countries of Origin or its Restitution in Case of Illicit Appropriation at its Tenth Session, January 1999 and endorsed by the 30th General Conference of UNESCO, November 1999.

P230 ANNEXE 3 - CODE INTERNATIONAL DE DÉONTOLOGIE POUR LES NÉGOCIANTS EN BIENS CULTURELS Code international de déontologie pour les négociants en biens culturels Les professionnels du commerce des biens culturels reconnaissent le rôle clé que ce commerce joue traditionnellement dans la diffusion de la culture et la distribution aux musées et aux collectionneurs privés de biens culturels étrangers, sources d'éducation et d'inspiration de tous les peuples. Ils prennent en compte les inquiétudes exprimées dans le monde entier à propos du trafic de biens culturels volés, illicitement aliénés, provenant de fouilles clandestines et exportés illicitement et acceptent d'être liés par les principes de pratique professionnelle ci-après, destinés à permettre de distinguer les biens culturels ressortissant au commerce illicite de ceux qui ressortissent au commerce licite ; ils s'efforceront d'éliminer les premiers de leurs activités professionnelles. ARTICLE 1 Les négociants professionnels en biens culturels s'abstiennent d'importer ou d'exporter de tels biens ou d'en transférer la propriété lorsqu'ils ont des motifs raisonnables de penser que le bien concerné a été volé, qu'il a été aliéné illicitement, qu'il provient de fouilles clandestines ou qu'il a été exporté illicitement. ARTICLE 2 Le négociant qui agit en qualité de mandataire du vendeur n'est pas réputé garantir le titre de propriété, pourvu qu'il fasse connaître à l'acquéreur le nom et l'adresse complets du vendeur. Le négociant qui est lui-même le vendeur est réputé garantir à l'acquéreur le titre de propriété. ARTICLE 3 Le négociant qui a des motifs raisonnables de penser qu'un objet provient de fouilles clandestines ou qu'il a été acquis de façon illicite ou malhonnête d'un site de fouilles autorisées ou d'un monument s'abstient de concourir à toute nouvelle transaction portant sur cet objet, sauf accord du pays où se trouve le site ou le monument. Le négociant qui est en possession de l'objet, lorsque ce pays cherche à obtenir sa restitution dans un délai raisonnable, prend toutes les mesures autorisées par la loi pour coopérer à la restitution de cet objet au pays d'origine. ARTICLE 4 Le négociant qui a des motifs raisonnables de penser qu'un bien culturel a été exporté illicitement s'abstient de concourir à toute nouvelle transaction portant sur cet objet, sauf accord du pays de provenance. Le négociant qui est en possession de l'objet, lorsque le pays de provenance cherche à obtenir sa restitution dans un délai raisonnable, prend toutes les mesures autorisées par la loi pour coopérer à la restitution de cet objet au pays de provenance. ARTICLE 5 Les négociants en biens culturels s'abstiennent d'exposer, de décrire, d'attribuer, d'évaluer ou de détenir un objet culturel dans l'intention de favoriser, ou de ne pas empêcher, son transfert ou son exportation illicite. Ils s'abstiennent d'adresser le vendeur ou une autre personne proposant l'objet à ceux qui peuvent fournir ces services. ARTICLE 6 Les négociants en biens culturels s'abstiennent de procéder à des démembrements d'objets et de vendre séparément des éléments d'un bien culturel constituant un ensemble complet.

ARTICLE 8 Les infractions au présent code de déontologie font l'objet d'enquêtes rigoureuses de (corps nommé par les négociants adoptant ce code). Toute personne lésée du fait du non-respect par un négociant des principes du présent code de déontologie peut déposer une plainte auprès de cet organisme qui procède à une enquête. Les résultats de l'enquête et les principes appliqués sont rendus publics. Adopté par le Comité intergouvernemental pour la promotion du retour de biens culturels à leur pays d'origine ou de leur restitution en cas d'appropriation illégale au cours de sa dixième session, janvier 1999 et approuvé par la 30e Conférence générale de l'unesco, novembre 1999.

P242 ANNEXE 6 - REPERTORY / RÉPERTOIRE PRESENTATION This Repertory is a preliminary exercise to the comparative studies of the special programme of Euromed Heritage IV regarding the institutional and legislative strenghtening in the field of cultural heritage. It does not intend in any way to be a comprehensive bibliography. The aim is simply to identify existing documents that could serve as reference during the future works. The selection is made according to the following criteria: 1. a wide definition of cultural heritage: movable and immovable, tangible and intangible, historic gardens and cultural landscapes, rehabilitation of historic towns, management of heritage sites, museums and collections, etc., 2. documents concerning institutions, legislations and management practices, 3. preference given to documents posted on a website (through hypertext link), 4. particular attention to the Mediterranean Area and to the partner countries (Algeria, Egypt, Israel, Jordan, Lebanon, Morocco, Palestinian Authority, Tunisia, Syria), 5. particular attention to documents from the European Union. The Repertory is "open" It will be regularly updated, on the basis of the new data that will be collected during the work. We are grateful to all those colleagues who would be so kind as to inform us about documents of interest that have not been listed. The Repertory is posted on the website of the RMSU: www.euromedheritage.net The international regulations, "conventions" and "charters" that guide the continuous progress in the definition of "heritage" and in the "good practices" have also been identified. Reference has been made to the main texts and to the website where they can be consulted. Institutional and legislative strengthening has been recommended by the authorities of the partner countries as a priority of the Euro-Mediterranean partnership for the period 2007 to 2013. Besides the comparative studies, the programme includes the organisation of 6 specialised workshops. The first of them took place in Paris, in December 2008, at UNESCO Headquarters, on the domain of inventories. La sélection répond aux critères principaux suivants : 1. définition large du patrimoine culturel : meuble et immeuble, matériel et immatériel, jardins historiques et paysages culturels, sauvegarde des villes historiques, gestion des sites patrimoniaux, des musées et des collections, etc., 2. documents relatifs aux institutions, aux législations et aux pratiques de gestion, 3. préférence donnée aux documents qui peuvent être consultés par internet (par lien hypertexte), 4. attention particulière pour le Bassin méditerranéen et les pays partenaires (Algérie, Autorité palestinienne, Egypte, Israël, Jordanie, Liban, Maroc, Tunisie, Syrie), 5. attention particulière pour les documents relevant de l'union Européenne. Le répertoire se veut "ouvert" : Il sera régulièrement complété par les données nouvelles recueillies au cours des travaux. Nous sommes reconnaissants envers tous ceux qui voudront bien nous communiquer les publications non inventoriées. Le répertoire est offert en consultation sur le site internet www.euromedheritage.net Les normes internationales, "conventions" et "chartes" qui président aux avancées continues dans la définition du "patrimoine" et dans les prescriptions relatives aux "bonnes pratiques" ont été aussi relevées. Il est fait mention des principaux textes, avec indication du site internet où ils peuvent être consultés. Le renforcement institutionnel et législatif a été souhaité par les autorités des pays partenaires et repris comme une priorité du partenariat euro-méditerranéen pour la période 2007 à 2013. Outre des études comparatives, le programme prévoit l'organisation de 6 ateliers spécialisés, dont le premier s'est tenu à Paris, en décembre 2008, au siège de l'unesco, sur les inventaires. Euromed Héritage, un avenir pour le patrimoine culturel euro-méditerranéen Le programme régional Euromed Héritage offre un cadre pour le partage d expériences, un réseau pour la diffusion des meilleures pratiques, ainsi que de nouvelles perspectives pour le développement de l environnement culturel institutionnel aux niveaux national et régional. Lancé suite à la déclaration de Barcelone en 1995, le Programme Euromed Héritage a mobilisé à travers ses différentes phases des experts en matière de conservation, des institutions du patrimoine, ainsi que des acteurs de l administration et de la société civile des pays du bassin méditerranéen. Ensemble, ils ont redécouvert et partagé leur patrimoine culturel. Chaque phase se construit sur la base des expériences et résultats acquis lors de la phase précédente, marquant une nette progression dans la méthodologie et dans l approche. Euromed Héritage I avait pour objectif de dresser des inventaires du patrimoine et de favoriser la mise en réseaux de musées avec d autres institutions culturelles. Euromed Héritage II et III se sont attachés à renforcer les capacités grandissantes des pays méditerranéens en termes de gestion et de développement de leur patrimoine culturel, en mettant l accent sur le patrimoine immatériel. 2. Euromed Héritage IV, les projets Les projets financés dans le cadre du programme Euromed Héritage4 représentent une grande variété de thèmes tels que les Archives, l Audiovisuel, les Manuscrits, l Archéologie, la Conservation, la Réhabilitation, le Tourisme Culturel, les Musées, les Expositions, les Normes, la Législation, les Inventaires - ATHENA / Amélioration et adaptation des théâtres antiques aux réalités nouvelles. - ELAICH /Approche des liens éducatifs avec le patrimoine culturel. - DES FONDATIONS POUR UN AVENIR SOLIDE / La promotion du patrimoine culturel par les jeunes au Liban et en Jordanie. - HAMMAMED / Sensibilisation au patrimoine culturel des hammams dans le bassin méditerranéen et audelà. - MANUMED II / Des manuscrits et des hommes. - MARE NOSTRUM / Sur la piste du patrimoine, le long des routes maritimes phéniciennes et des villes portuaires historiques de la Méditerranée. - MEDLIHER / Sauvegarder le patrimoine Méditerranéen vivant. - MEDMEM / Partager les mémoires audiovisuelles de la Méditerranée. - MONTADA / Forum de promotion de l architecture traditionnelle au Maghreb. - MUTUAL HERITAGE / De l intégration historique vers une participation active et contemporaine. - REMEE / Redécouvrons ensemble les mémoires de l eau. - SIWA-TANGIER / Protéger et promouvoir le patrimoine matériel et immatériel.

Euromed Héritage IV (2008-2012), un processus de réappropriation S inscrivant dans le cadre de l Instrument Européen de Voisinage et de Partenariat (IEVP), Euromed Héritage 4 (2008-2012) œuvre principalement afin d aider les populations locales à s approprier ellesmêmes leur patrimoine culturel. Cet objectif a été défini en réponse à la Stratégie pour le développement du patrimoine culturel euroméditerranéen : priorités des pays méditerranéen (2007-2013), à laquelle les pays partenaires ont apporté leur contribution et leur engagement. 4. Euromed Heritage IV en quelques points - Coopération multidisciplinaire. - Recherche et bonnes pratiques. - Formation et mise en réseau. - Actions pour stimuler et renforcer les impacts socio-économiques. - Agencement d équipes locales pour la mise en valeur et l appropriation de leur patrimoine. - Développement des structures institutionnelles et législatives du patrimoine culturel au sein des autorités méditerranéennes. C'est dans le cadre de ce dernier point que sont organisés 6 ateliers spécialisés, comme l'atelier de Paris sur les Inventaires et l'atelier de Beyrouth sur le trafic illicite de biens culturels. 5. Unité Régionale de Suivi et de Soutien - RMSU Une Unité Régionale de Suivi et de Soutien, en collaboration avec la Commission européenne, fournit un support technique aux projets et aux bénéficiaires des pays partenaires méditerranéens, assurant l accomplissement des objectifs du Programme Euromed Héritage IV. La RMSU est soutenue par un consortium international aux compétences étendues en matière de patrimoine culturel, menée par Hydea S.r.l. (Italie) et comprenant également le Conseil International des Monuments et Sites (ICOMOS-International), Agriconsulting Europe S.A. (Belgique), Culture Lab (Belgique) et la London Metropolitan University (Royaume-Uni). Euromed Heritage, a future for the Mediterranean cultural heritage The regional programme Euromed Heritage offers a framework for exchanges of experience, channels for disseminating best practices, and new perspectives for the development of the cultural institutional environment at national and regional levels. Created in the wake of the Barcelona Declaration in 1995, the Euromed Heritage Programme has rallied through its various phases, conservation experts, heritage institutions, administrations and civil society actors from countries of the Mediterranean region. Together, these have rediscovered and shared their cultural heritage. Each phase builds upon the experiences and results of the former, with a marked progression in the methodology and approach it stipulates. Euromed Heritage I aimed at the creation of heritage inventories and facilitation of networking between museums and other cultural institutions. Euromed Heritage II and III focused on the increasing of Mediterranean countries capacities in managing and developing their cultural heritage with a special attention on intangible heritage. 2. Euromed Heritage IV, the projects Financed projects within the programme reflect a wide variety of themes such as Archives, Audiovisuals, Manuscripts, Archaeology, Conservation, Rehabilitation, Cultural Tourism, Museums, Exhibitions, Norms, Legislation, Inventories, Institutional framework, - ATHENA / Ancient theatres enhancement for new actualities. - ELAICH / Educational linkage approach in cultural heritage. - FOUNDATIONS FOR A STRONG FUTURE / Youth in Lebanon and Jordan promoting cultural heritage. - HAMMAMED / Raising awareness for the hammam as a cultural heritage for the Mediterranean area and beyond. - MANUMED II / Of manuscripts and men. - MARE NOSTRUM /A heritage trail along the Phoenician maritime routes and historic port-cities of the Mediterranean Sea. - MEDLIHER / Safeguarding Mediterranean living heritage. - MEDMEM / Sharing our Mediterranean audio-visual heritage. - MONTADA / Forum for the promotion of traditional architecture in the Maghreb. - MUTUAL HERITAGE / From historical integration to contemporary active participation. - REMEE /Rediscovering together the water heritage in the Mediterranean region. - SIWA-TANGIER / Protect and promote tangible and intangible heritage. 3. Euromed Heritage IV (2008-2012), a process for re-appropriation Euromed Heritage 4 puts appropriation by the local populations of their cultural heritage at the core of its actions.

P248 ANNEXE 7 - THE EUROMED HERITAGE IV PROGRAMME This objective has been defined in response to the Strategy for the development of Euro-Mediterranean Heritage: priorities from Mediterranean countries (2007-2013), to which the Partner countries have contributed and confirmed their commitment. 4. Euromed Heritage IV is about - Multi-disciplinary cooperation. - Research and good practices. - Training and networking. - Actions to stimulate and reinforce social and economic impacts. - Agency of local groups in the valorisation and appropriation of their heritage. - Improvement of the institutional and legislative frameworks surrounding cultural heritage among Mediterranean authorities. In reference to this last point, six specialized workshops are being organized, similar to the Paris workshop on Inventories and the Beirut workshop on Illicit Traffic in Cultural Property 5. Regional Monitoring and Support Unit - RMSU A Regional Monitoring and Support Unit, in collaboration with the European Commission, provides technical support to projects and beneficiaries from Mediterranean Partner countries, assuring the achievement of Euromed Heritage4 Programme s goals.
