2 Contexte : Contribution des OPCVM aux fonds propres des entreprises (source : AFG Cahiers de la gestion, avril 2011) Les OPCVM sont d importants apporteurs de fonds propres pour les entreprises : La gestion collective représente 12% de la capitalisation totale des actions françaises cotées et les sociétés d assurance 5,4%. 2
3 Contexte : Contribution des OPCVM aux fonds propres des entreprises (source : AFG Cahiers de la gestion, avril 2011) Les OPCVM sont d importants apporteurs de fonds propres pour les entreprises : Plus de 25% des actions françaises et étrangères détenues par des résidents français sont logées dans les OPCVM. Elles se répartissent à égalité entre titres français et étrangers. 3
Contexte : Contribution des OPCVM aux fonds propres des entreprises (source : AFG Cahiers de la gestion, avril 2011) L analyse des portefeuilles des OPCVM actions fait ressortir quelques points saillants : La détention indirecte progresse avec l élargissement de la zone d investissement : 6% en moyenne pour les fonds actions françaises et 17% pour les fonds actions internationales, les expertises non couvertes en interne étant déléguées à des gérants spécialisés (fonds de fonds). Les «BRICS» sont le mieux représentés dans le portefeuille des fonds actions internationales avec au global un poids de l ordre de 11%. 4 4

Market Risk : Quelques points saillants (1/2) Source : QIS 5 Technical Specifications SCR 5.9 : In order to properly assess the market risk inherent in collective investment funds, it will be necessary to examine their economic substance. Wherever possible, this should be achieved by applying a look-through approach in order to assess the risks applying to the assets underlying the investment vehicle. Each of the underlying assets would then be subjected to the relevant sub-modules. SCR.5.10. The same look-through approach should also be applied for other indirect exposures except for participations. SCR.5.11. Where a number of iterations of the look-through approach is required (e.g. where an investment fund is invested in other investment funds), the number of iterations should be sufficient to ensure that all material market risk is captured. SCR.5.12. The above recommendations should be applied to both passively and actively managed funds.../.. 8 8
Market Risk : Quelques points saillants (2/2) Source : QIS 5 Technical Specifications SCR. 5.13. : Where a collective investment scheme is not sufficiently transparent to allow a reasonable allocation of the investments, reference should be made to the investment mandate of the scheme. It should be assumed that the scheme invests in accordance with its mandate in such a manner as to produce the maximum overall capital requirement. For example, it should be assumed that the scheme invests assets in each rating category, starting at the lowest category permitted by the mandate, to the maximum extent. If a scheme may invest in a range of assets exposed to the risks assessed under this module, then it should be assumed that the proportion of assets in each exposure category is such that the overall capital requirement is maximised. SCR. 5.14. : As a third choice to the look-through and mandate-based methods, undertakings should consider the collective investment scheme as an equity investment and apply the global equity risk stress (if the assets within the collective investment scheme are only listed in the EEA or OECD) or other equity stress (otherwise). 9 9
10 Market Risk : Principes de calcul (1/2) Source : QIS 5 Technical Specifications Undertakings should calculate the capital requirement for market risk separately : (a) for participations as defined in Article 92(2) of Directive 2009/138/EC in financial and credit institutions, (b) for participations in related undertakings : (i) excluded from the scope of the group supervision under Article 214 (a) of Directive 2009/138/EC ; or (ii) deducted from the own funds eligible for the group solvency in accordance with Article 229 of Directive 2009/138/EC ; (c) for other assets and liabilities. The value of participations referred to in (a) are excluded from the own funds. To avoid double counting, the capital requirement for market risk for these participations should be nil. The capital requirement for market risk for investments in related undertakings referred to in paragraph 1 (b) should be equal to the loss in the basic own funds that would result from an instantaneous decrease of 100% in the value of these investments. The capital requirement for market risk should be calculated as the sum of the capital requirement corresponding to points (b) and (c). The separate calculation of market risk for the participations referred to above is introduced for QIS5 purposes to facilitate the collection of data on these participations. 10
Market Risk : Principes de calcul (2/2) Source : QIS 5 Technical Specifications For the determination of this capital requirement, all equities and equity type exposures have to be taken into account, including private equity as well as certain types of alternative investments, excluding equity owned in an undertaking part of the same group in which case the approach for the treatment of participations applies. The treatment of participations is as follows: The equity shock is nil for participations in financial and credit institutions. The equity shock is 22% for strategic participations, whether listed in regulated markets in the countries which are members of the EEA or the OECD (global equity) or not (other equity). other participations are subject to the equity shock (30% or 40%, depending on the category of equity). 11 11

Risque immobilier. Les OPCI avec endettement doivent-ils être considérés comme des actions non cotées? Réponses Q&A CEIOPS : Undertakings should make their own assessment as to whether a participation is strategic based on the circumstances of the individual undertaking and where appropriate the group to which it belongs. The QIS5 will require QIS5 participants to state why a participation is considered to be strategic. Where is not possible for an undertaking to determine whether a participation is strategic or not, a participation should be classified as strategic and information should be provided as to why the determination was not possible. (Equity shock = 22%) QIS 5 Technical Specs : For the determination of the capital requirement for equity risk, the following split is considered, equities is listed in regulated markets in the countries which are members of the EEA or the OECD ("Global equity" category), and other equities ( Other equity category). "Other" comprises equity listed only in emerging markets, non-listed equity, hedge funds and any other investments not included elsewhere in the market risk module. Comment faut-il traiter les titres émis par une entité garantie par l État? (par exemple la CADES)? les titres garantis par une collectivité locale? Peut-on considérer que les obligations d'organismes publics français (ex. : SNCF, CDC, Ville de Paris) sont "demonstrably guaranteed by national government of an EEA state" au sens du Q&A CEIOPS? Comment traiter le cas des contrats futurs cotés, pour lesquels des appels de marge sont faits quotidiennement? Pouvez-vous nous confirmer que les OPCVM monétaires sont hors du périmètre du QIS 5 et n'exigent donc pas de capital? Réponses Q&A CEIOPS : As the shock giving rise to the call for margin is instantaneous, the counterparty risk should be also assessed on the assumption that the loss on the value of the call for margin happens in the same day. FAQ QIS 5 : Il convient en fait d appliquer la transparence à ces OPCVM. Existe-t-il une méthodologie pour le traitement des obligations convertibles en actions, notamment pour les calculs des SCR taux, spread et action de ce type de titre? FAQ QIS 5 : Il n existe pas de méthodologie standard pour le QIS5. Pour rappel, chacun des chocs taux, spread et action doit être appliqué. A défaut, quand un actif ne fait pas l objet d un traitement particulier dans les spécifications techniques, il peut être admis à titre de simplification de l inclure dans la catégorie «other equity». 16 16
