2 Page: 2 Decision No. 95/04 REASONS (i) FRENCH Introduction [1] The worker was a truck driver. On July 9, 1993, the worker suffered an injury to the right leg as he jumped from his cab to a float. Entitlement was accepted for the right calf and right knee. [2] The worker later complained of pain in the lower back and claimed that the condition resulted from the accident on July 9, The Board denied entitlement for the lower back and the worker is now appealing this issue to the Tribunal. [3] On May 26, 2004, the worker suffered another injury, this time to the lower back. Benefits were allowed. (ii) The worker s evidence [4] The worker gave evidence that the nature of his injury on July 9, 1993, was misunderstood. He stated that, as he prepared to load the truck, he jumped onto the float. The worker stated that he got a sudden snap and a painful sensation throughout his body, from the calf to the neck. The worker stated that he finished his day s work, but that the pain became aggravated during the weekend and he obtained emergency treatment in hospital. [5] The worker stated that he required treatment for a vein thrombosis in the right calf and this masked his back problem. The worker became fully aware of his low back condition while attending physiotherapy. He complained to physiotherapist A. Goyette who reported occasional back pain on September 17, At the same time, the worker was receiving medical attention, physiotherapy and chiropractic treatment for the calf and right knee. [6] On November 30, 1993, Dr. Lafleche noted that the worker had sacro-iliac joint arthralgias Arthroscopic surgery was performed on the right knee on December 1, [7] The worker stated that, after his return to work and resumption of regular duties loading and hauling heavy machinery, he had to favour his right extremity, but he continued to be bothered by low back pain. There were no signs of fractures or subluxations. (iii) The medical evidence [8] First medical treatment at Notre Dame Hospital in Hearst on July 14, 1993, was by Dr. J. Langlois who noted tenderness and swelling of the posterior aspect of the right calf and diagnosed a tear of the leg muscle. The worker was seen the same day by surgeon Dr. G. Lamontagne. A vinogram was conducted of the worker s calf. [9] Physiotherapy was started on July 29, The first indication of a low back complaint appeared in the physiotherapist s clinical note dated September 17, indicating that a new problem had arisen due to right sacroiliac pain. The note indicates occasional back pain and

3 Page: 3 Decision No. 95/04 that palpation of the right sacroiliac joint increased the pain. There was no limitation of the lumbar movement. Ultrasound treatment of the sacroiliac joint was given and stretching exercises were recommended. [10] Reports by family physician Dr. R. Lafleche and consultation reports with orthopaedic specialist Dr. J.P. Lafleche from August to November 1993, fail to mention low back pain. X-ray examination was conducted of the right keg and chest on December 1, 1993, but not of the low back. [11] A consultation report by Dr. J.P. Lafleche, dated November 30, 1993, stated that sacroiliac joint arthralgia of the right sacroiliac joint was suspected. Dr. Lafleche added that there was a questionable relationship to the injury, referring to the leg injury of July 9, [12] X-ray examination of the lower spine was conducted on December 3, It showed mild degenerative changes at L4-L5 with small osteophytes. Disc spaces were well preserved. On the same day, Dr. Lafleche reported that the worker was complaining of pain in the lower back stating as follows: The patient complains of pain in the low back over the S.I. joint radiating to the buttock. There is no pain in the posterior thigh and he states that since the injury he has had pain in the posterior calf area but denies radiation from the back to the posterior thigh down to the popliteal area. There was no radiation to the foot. This ache in the S.I. joint has been present since the injury, but not severe. [13] Dr. Lafleche further reported that examination revealed full motion of the lumbar back and slight pain upon palpation. The physician also noted that x-ray examination has shown very minimal degenerative change of the lumbar spine. [14] In his report to the Board dated February 9, 1994, family physician Dr. R. Lafleche noted back pain as well as buttock and right knee pain. [15] In April 1994, physiotherapy treatment was stared at the WorkFit Centre. The physiotherapist s findings were that the worker had suffered a knee problem resulting from medial menisectomy and a lumbar spine dysfunction with some sacro-iliac involvement. He also received chiropractic treatment from Dr. K. Oldaker. After the end of treatment on July 11, 1994, Dr. Oldaker stated that the right sacro-iliac and lumbar problems were either directly caused by the accident or indirectly caused by the accident since with his right knee injury, his gait was altered due to the pain and weakness of the right keg. [16] On October 17, 1994, Dr. J.P. Lafleche reported that the worker had stated that he had likely irritated his back doing exercise in physiotherapy. [17] The worker returned to work driving a truck. There is an absence of medical records, for the knee as well as the lower back from January 1995, to December 2002, when the worker returned for treatment of the right knee. There is no mention of the lower back as the worker was sent for diagnostic imaging on December 9, 2002, and when he was examined by orthopaedic surgeon Dr. J.L. Remus, on December 11, 2003.

4 Page: 4 Decision No. 95/04 [18] On May 26, 2004, the worker sustained a low back injury in a workplace accident. He became entitled to workplace insurance benefits as a result of that injury. (iv) The reasoning [19] The worker s representative argued that the worker is entitled to compensation benefits for a low back injury which he claims to have suffered at work on July 9, Ms. Lamoureux-Chaylt argued that the worker had sustained a more serious injury to the calf and right knee and that the attending physicians attention at the time became focused on the calf and the knee, the latter requiring arthroscopy on December 1, However, the worker s representative referred to the worker s evidence that he had suffered a jolt to the whole body, from the ankles to the neck, at the time of the injury and that he experienced back pain since then. Ms. Lamoureux-Chaylt noted that, on September 17, 1993, a physiotherapist noted the worker s complaint of pain which he had experienced since the accident. The worker had never experienced back problem before that time, but later radiological studies and examination showed that he had sacroiliac arthralgia and degenerative changes at the L4-L5 level of the lumbar spine. [20] First, I find that the issue of whether or not there is a causal relationship between the worker s back complaints after September 17, 1993, and the injury at work on July 9, 1993, is a moot point. I do not find that the worker was disabled by his back problem and therefore, there is no entitlement to compensation. [21] My review of the medical evidence shows that when the worker reported pain in the lower back, on September 17, 1993, the pain was only occasional and was experienced upon palpation of the sacroiliac area. There was no restriction of movement. The same diagnosis was made by Dr. J.P. Lafleche who examined the worker on November 30, Moreover, Dr. Lafleche confirmed that x-ray examination had shown very minimal arthralgia of the sacroiliac area and small osteophytes at L4-L5. Disc spaces were well preserved and there was no derangement of the bones. [22] There is absolutely no evidence of any deterioration of the low back area in the file. Nor is there any medical treatment afterwards nor any diagnosis of back pain. At no time is it indicated that the worker had any restrictions due to the lumbar back or that he was disabled in any way. In fact, Dr. Remus, who examined the worker in 2003 when the worker returned to the Board for compensation for the right knee, did not mention the lower back. [23] There is no compensation for pain unless it is disabling pain. In this case, the only symptoms present are that of occasional pain which is not mentioned after Mild arthralgia and minimal degenerative changes and small osteophytes are not shown to be disabling. In fact, Dr. Lafleche who noted these deficiencies also noted that there was only pain upon palpation of the sacroiliac and no restrictions of movement. [24] With no evidence of a disability until the worker suffered a further accident on May 26, 2004, this time causing a low back disability, it would serve no purpose to determine whether or not the worker s non-disabling pain symptoms noted from three to six months after the worker s accident, resulted from that accident of July 9, 1993.

8 Decision No. 95/04 MOTIFS (i) Introduction [1] Le travailleur était camionneur. Le 9 juillet 1993, il a subi une lésion à la jambe droite en sautant de la cabine à la remorque de son camion. La Commission lui a reconnu le droit à une indemnité pour le mollet droit et le genou droit. [2] Le travailleur s est ensuite plaint d une lombalgie qu il a attribuée à son accident du 9 juillet La Commission a refusé de lui reconnaître le droit à une indemnité pour le bas du dos, et il en appelle maintenant de cette question au Tribunal. [3] Le 26 mai 2004, le travailleur a subi une autre lésion, cette fois au bas du dos, et la Commission lui a reconnu le droit à des prestations. (ii) Témoignage du travailleur [4] Le travailleur a déclaré que la nature de sa lésion du 9 juillet 1993 a été mal comprise. Il a déclaré qu il se préparait à charger son camion quand il a sauté sur la remorque. Il a indiqué qu il a ressenti un «claquement» soudain et une douleur dans tout le corps, du mollet au cou. Il a déclaré qu il a fini sa journée de travail mais que la douleur s est intensifiée pendant la fin de semaine et qu il s est présenté au service des urgences. [5] Le travailleur a déclaré qu il a dû se faire traiter pour une thrombose dans le mollet droit et que cela a masqué son problème de dos. Il s est vraiment rendu compte de son problème au bas du dos pendant qu il faisait de la physiothérapie. Il s est plaint à son physiothérapeute, A. Goyette, et ce dernier a fait rapport de maux de dos occasionnels le 17 septembre En même temps, le travailleur recevait des traitements de physiothérapie et de chiropractie pour le mollet et le genou droit. [6] Le 30 novembre 1993, le D r Laflèche a noté que le travailleur souffrait d arthralgie à l articulation sacro-iliaque. Le travailleur a subi une chirurgie arthroscopique au genou droit le 1 er décembre [7] Selon le témoignage du travailleur, après son retour au travail et la reprise de ses fonctions régulières consistant à charger et à transporter du matériel lourd, il a dû ménager sa jambe droite mais il a continué à avoir des malaises au bas du dos. Il n y avait aucun signe de fracture ou de subluxation. (iii) Preuve médicale [8] Le premier traitement à l Hôpital Notre-Dame de Hearst le 14 juillet 1993 a été administré par le D r J. Langlois. Ce dernier a noté une sensibilité au toucher et de l enflure à l arrière du mollet droit. Il a posé un diagnostic de déchirure musculaire à la jambe. Le D r G. Lamontagne, chirurgien, a vu le travailleur le même jour. Une veinoscopie du mollet a été pratiquée. [9] Le travailleur a commencé à faire de la physiothérapie le 29 juillet La première indication de plainte au sujet du bas du dos se trouve dans une note clinique datée du

9 Page: 2 Decision No. 95/04 17 septembre du physiothérapeute indiquant que le «nouveau problème» était dû à une douleur sacro-iliaque droite. La note mentionne une «douleur dorsale occasionnelle» et indique que la palpation augmentait la douleur à l articulation sacro-iliaque. Il n y avait pas de réduction de l amplitude des mouvements de la colonne lombaire. Le travailleur a reçu des traitements par ultrasons à l articulation sacro-iliaque, et on lui a recommandé des exercices d étirement. [10] Les rapports du D r R. Laflèche, médecin de famille, et les rapports de consultation du D r J.P. Laflèche, orthopédiste, pour la période d août à novembre 1993 ne mentionnent aucune douleur lombaire. Le travailleur a subi un examen radiologique de la jambe droite et du thorax le 1 er décembre 1993 mais non de la région lombaire. [11] Un rapport de consultation du D r J.P. Laflèche datée du 30 novembre 1993 indique qu il suspectait une arthralgie de l articulation sacro-iliaque droite. Le D r Laflèche a ajouté qu il y avait un lien douteux avec la lésion, en faisant référence à la lésion à la jambe du 9 juillet [12] Un examen radiologique de la colonne lombaire a été effectué le 3 décembre Cet examen a révélé de légers changements dégénératifs en L4 et L5 avec petits ostéophytes. Les espaces intervertébraux étaient bien préservés. Le même jour, le D r Laflèche a fait rapport que le travailleur se plaignait de douleur à la région lombaire : Le patient se plaint de douleur lombaire en S1 irradiant dans la fesse. Il n y a pas de douleur à l arrière de la cuisse, et il déclare qu il a mal à l arrière du mollet depuis la lésion mais il nie une irradiation de la douleur du dos à l arrière de la cuisse à la région poplitée. Il n y a pas d irradiation dans le pied. Cette douleur à l articulation S1 est présente depuis la lésion mais elle n est pas vive. [traduction] [13] Le D r Laflèche a aussi fait rapport que l amplitude des mouvements de la région lombaire était complète à l examen et que la palpation provoquait une légère douleur. Il a aussi noté que l examen radiologique indiquait de très légers changements dégénératifs à la colonne lombaire. [14] Dans son rapport du 9 février 1994 à la Commission, le D r Laflèche, médecin de famille, a noté une douleur dorsale de même qu une douleur au fessier et au genou droit. [15] En avril 1994, le travailleur a commencé à faire de la physiothérapie au WorkFit Centre. Le physiothérapeute a constaté que le travailleur souffrait de problèmes au genou résultant d une méniscectomie interne et d un dysfonctionnement lombaire avec une certaine atteinte sacroiliaque. Le travailleur a aussi reçu des traitements de chiropractie du D r K. Oldaker. Après la fin de ces traitements le 11 juillet 1994, le D r Oldaker a déclaré que les problèmes à l articulation sacro-iliaque droite résultaient directement de l accident ou qu ils en résultaient indirectement du fait que la douleur et la faiblesse résultant de la lésion au genou droit avait entraîné une altération de la démarche. [16] Le 17 octobre 1994, le D r J.P. Laflèche a fait rapport que le travailleur avait déclaré qu il avait probablement irrité son dos en faisant des exercices de physiothérapie. [17] Le travailleur a recommencé à conduire un camion. Le dossier ne contient pas de rapports médicaux au sujet du genou et de la région lombaire pour la période de janvier 1995 à décembre 2002, quand le travailleur est retourné se faire traiter pour le genou droit. La région lombaire n a pas été mentionnée quand le travailleur a été envoyé pour une imagerie

10 Page: 3 Decision No. 95/04 diagnostique le 9 décembre 2002 et quand il s est fait examiner par le D r J.L. Remus, chirurgien orthopédiste, le 11 décembre [18] Le 26 mai 2004, le travailleur a subi une lésion professionnelle à la région lombaire et il a obtenu des prestations d assurance contre les accidents du travail. (iv) Examen de l appel [19] La représentante du travailleur soutient que le travailleur a droit à des prestations pour une lésion à la région lombaire qu il dit avoir subie au travail le 9 juillet M me Lamoureux- Chaylt a indiqué que le travailleur avait subi des lésions plus graves au mollet et au genou droit et que les médecins traitants s étaient concentrés sur ces lésions. La lésion au genou droit a par ailleurs nécessité une arthroscopie le 1 er décembre La représentante a toutefois rappelé que le travailleur avait déclaré avoir subi une secousse dans tout le corps, des chevilles jusqu au cou, au moment de la lésion et qu il avait mal au dos depuis. M me Lamoureux-Chaylt a souligné que, le 17 septembre 1993, le physiothérapeute avait noté les plaintes de douleur ressentie depuis l accident. Elle a aussi souligné que le travailleur n avait jamais eu mal au dos avant mais que des radiographies et des examens ultérieurs à l accident ont révélé une arthralgie sacro-iliaque et des changements dégénératifs en L4-L5. [20] Je constate d abord que la question de savoir s il existe un lien entre les plaintes de maux de dos du travailleur après le 17 septembre 1993 et sa lésion professionnelle du 9 juillet 1993 est sans objet. Comme ses problèmes de dos n étaient pas invalidants, le travailleur n a pas droit à une indemnité à ce sujet. [21] Selon mon examen des documents médicaux au dossier, quand le travailleur a fait rapport d une douleur à la région lombaire le 17 septembre 1993, cette douleur était seulement occasionnelle, et il l a ressentait à la palpation de la région sacro-iliaque. Il n y avait pas de restriction des mouvements. Le D r J.P. Laflèche a examiné le travailleur le 30 novembre 1993 et a posé le même diagnostic. De plus, le D r Laflèche a confirmé que l examen radiologique avait révélé une arthralgie très minime à la région sacro-iliaque et de petits ostéophytes en L4-L5. Les espaces intervertébraux étaient bien préservés, et il n y avait pas de dérangement osseux. [22] Le dossier ne contient absolument aucun document prouvant une détérioration de la région lombaire ou indiquant des traitements médicaux ou un diagnostic au sujet de douleur dorsale. Rien n indique que le travailleur était restreint dans ses activités ou qu il présentait des problèmes invalidants à la région lombaire. En fait, le D r Remus, qui a examiné le travailleur en 2003, quand il est retourné à la Commission pour demander une indemnité pour le genou droit, n a pas mentionné la région lombaire. [23] La douleur ouvre droit à une indemnité seulement si elle est invalidante. En l espèce, les seuls symptômes notés consistent en douleurs occasionnelles, qui ne sont plus mentionnées après Il n est pas démontré que la légère arthralgie, les légers changements dégénératifs et les petits ostéophytes étaient invalidants. En fait, le D r Laflèche, qui a noté ces déficiences a aussi noté qu il y avait de la douleur seulement à la palpation de la région sacro-iliaque et qu il n y avait pas de restriction des mouvements.

11 Page: 4 Decision No. 95/04 [24] Sans preuve d invalidité jusqu à ce que le travailleur subisse un autre accident le 26 mai 2004 à l origine de troubles lombaires invalidants, il ne servirait à rien de déterminer si la douleur non invalidante ressentie de trois à six mois après l accident était attribuable à l accident du 9 juillet [25] Je conclus que le travailleur n a pas droit à une indemnité en l espèce.
