C st dans moins d huit mois, n octobr prochain, qu commncra l procès intnté par la Fédération ds parnts francophons d C.-B., l Consil scolair francophon t ds parnts contr l gouvrnmnt provincial. L procès port sur l équivalnc ntr ls écols francophons t ls écols d la majorité anglophon. C sra la troisièm fois qu la Fédération ds parnts (qui s nommait auparavant l «Association ds parnts francophons d C.-B.») dmand l intrvntion ds tribunaux pour obtnir c qu l articl 23 d la Chart canadinn ds droits t librtés garantit n Colombi- Britanniqu : ds écols où l instruction st donné n français langu prmièr, qui sont gérés par un instanc francophon t qui sont équivalnts aux écols anglophons. Ls dux prmièrs causs juridiqus avaint pour objctifs l obtntion d nos proprs écols francophons t la gstion scolair, c qui a mné à la création du Consil scolair francophon d la C.-B. (CSF) tl qu on l connaît aujourd hui. Un qustion d équivalnc Pour nous, parnts, l équivalnc put s résumr ainsi : quand un parnt doit choisir l écol qu fréquntra son nfant t qu il compar l écol situé dans son quartir (écol anglophon ou écol d immrsion) à l écol francophon d sa communauté, s il y a équivalnc, c parnt n aura pas à fair son choix n fonction d l attrait d un écol par Ls consils d administration t la dirction d la Fédération ds parnts t du Consil scolair, accompagnés d M Michl Bastarach t M Mark Powr, avocats dans l dossir. rapport à un autr (dat d construction, apparnc t capacité du bâtimnt, nombr d élèvs, tc.), d la duré du trajt pour s y rndr, d la présnc d salls spécialisés (gymnas, sall d musiqu, bibliothèqu, tc.), t d autrs considérations «physiqus». S il y a équivalnc, ls écols auront autant d attrait l un qu l autr slon d tlls considérations. La décision d la famill st alors fondé sur l typ d nsignmnt donné dans chaqu écol : n anglais langu prmièr (pour l écol anglophon), n français langu scond (pour l immrsion) ou n français langu prmièr (pour l écol francophon). Et, parmi cs trois options, chaqu famill choisit alors cll qu ll croit la millur pour son nfant. La caus juridiqu provincial actull port justmnt sur ctt qustion d l équivalnc. Nous jugons qu, dans un quinzain d communautés n Colombi-Britanniqu, l écol francophon n st pas équivalnt aux écols d quartir (l un d cs écols st Rosds-vnts voir l ncadré). A Crucial Yar for Our Schools! 2013 will b an important yar in th dvlopmnt of Francophon ducation in British Columbia. In lss than ight months, in Octobr, th lawsuit fild against th provincial govrnmnt by th Fédération ds parnts francophons d C.-B., th Consil scolair francophon, and crtain ligibl parnts will bgin. It will b a trial about th comparability of Francophon schools with schools in th Anglophon systm. This will b th third tim that th Fédération ds parnts (formrly known as Association ds parnts) rqusts th intrvntion of th courts to gt what Articl 23 of th Canadian Chartr of Rights and Frdoms guarants in British Columbia: schools whr instruction is givn in Frnch as a first languag, which ar managd by a Francophon authority, and which ar quivalnt to Anglophon schools. Th first two lgal cass wr ld by parnts whos objctivs wr to st up thir own Francophon schools and school managmnt, which in turn ld to th cration of th Consil scolair francophon d la C.-B. (CSF) as it is known today. A Qustion of Equivalnc For parnts, quivalnc can b summd up as follows: whn a parnt must choos th school that thir child will b attnding, thy look at th Anglophon or Frnch immrsion school in thir nighbourhood and thn compar it with th Francophon school in thir community. If thr is quivalnc, th parnt will not hav to mak a choic basd on th appal of on school ovr anothr (dat of construction, xtrior apparanc, building capacity, tc.), travl tim to gt thr, prsnc of spcializd rooms (gymnasium, music room, library, tc.), and othr physical considrations. If thr is quivalnc, th schools will hav comparabl appal at this lvl. Th family dcision is thn basd on th typ of instruction in ach school: in English as a first languag (for th Anglophon school), in Frnch as a scond languag (for th Frnch immrsion school), or in Frnch as a first languag (for th Francophon school). From among ths thr options, ach family thn chooss th on that thy bliv is th bst for thir child. Th currnt lgal cas is prcisly about this qustion of quivalnc. W considr that, in 15 communitis in British Columbia, th Francophon school is not quivalnt to nighbourhood schools (on of ths is Écol Ros-ds-vnts s th adjacnt txt box). This fact ncourags familis to bas thir choic of school on considrations such as th distanc btwn thir hom and th Francophon school, th fact that th Francophon school is bursting at th sams and that thr is no spac for daycar srvics, or th fact that th Francophon school is much lss attractiv than th school that wlcoms Anglophon childrn in th ara. An unfair choic. And bcaus parnts ar still too oftn facd with such a choic, many familis do not choos th Francophon school. As a rsult, thir childrn, in many cass, assimilat into th Anglophon majority, and los thir Francophon cultur and thir Frnch languag. A Long-trm Procss Th dcision to go in front of th courts, which dats back to Jun 2010, was not takn without first intnsifying th fforts to try to rctify th situation, and thn thoroughly analyzing th issus. Pursuing a lgal cas of this magnitud is not don on a whim! Sinc Jun 2010, th Fédération ds parnts and th CSF, who ar assistd by a lgal tam, parnts, and school staff, hav put considrabl ffort into advancing th cas fil. Ds démarchs d longu halin La décision d allr dvant ls tribunaux n juin 2010 n a pas été pris sans avoir n prmir liu multiplié ls fforts pour tntr d rdrssr la situation t n ayant nsuit bin analysé ls njux. Poursuivr un caus juridiqu d ctt amplur n s fait pas n criant «cisau»! Dpuis trois ans, la Fédération ds parnts t l CSF, aidés d un équip juridiqu, d parnts t d mmbrs du prsonnl ds écols, ont mis ls bouchés doubls pour fair avancr l dossir. Plusiurs motions ont été présntés dvant l jug Willcock, c qui a ralnti nos avancés. L gouvrnmnt provincial a, notammnt, contsté l droit du CSF ainsi qu clui d la Fédération ds parnts d rprésntr ls intérêts ds parnts dans l cadr d la caus. Ls jugmnts ont toutfois tranché n notr favur. Nous avons aussi dmandé la prmission d déposr crtains documnts n français à la Cour, afin, ntr autrs, d minimisr ls coûts d traduction, c qu a contsté l gouvrnmnt provincial. Ctt drnièr qustion st maintnant dvant la Cour suprêm du Canada; l audinc sra ntndu à Ottawa l lundi 15 avril prochain.
